REQUESTED ACTION
Approve change order for turn lane on Powers Boulevard.
BACKGROUND
On February 28, 2005, Council approved a cooperative agreement with MnDOT
for improvements in junction with the TH 212 project.
On April 19, 2005, Council approved a loan agreement with the State of
Minnesota for funding the TH 212 project.
On November 14, 2005, Council approved assessments for TH 212.
DISCUSSION
This change order is for the addition of a curb cut and turn lane on Powers
Boulevard for future access to a property on the east side of the county road.
These improvements were not in the cooperative agreement, but were requested
by the property owner to plan for future development. The turn lane was assessed
100% to the benefitmg property owner on November 14, 2005. The City just
recently received the change order for this work. The change order number is the
TH 212 project change order number.
Approval of the change order is recommended.

This Contract is between the State of Minnesota, acting through its Commissioner of Transportation, and Contractor as follows:
I. SCOPE OF WORK
WHEREAS. This Project encompasses new design and construction for the realignment of TH 212, creating a controlled access
highway from existing TH 312 termination to approximately 0 75 miles west of the intersection of Carver County
Road 147 and TH 212, and
WHEREAS The project consists of the design and construction of four-lane controlled access highway, and
WHEREAS' The Project generally consists of grading, surfacing, noise berms, noise walls, ponds, signals, lighting, and signing
and bridge construction, and
WHEREAS. Additional major responsibilities include but are not limited to environmental coordination, public relations, utility
coordination, and warranties, and
WHEREAS' The new TH 212 will be part of the National Highway System, and
WHEREAS The original project contract documents and plans do not indicate a right turn lane or a left turn lane on Powers
Blvd at Station 88+00, and
WHEREAS The City of Chanhassen has requested that a left turn lane on southbound Powers Boulevard and a right turn lane
on northbound Powers Boulevard and a curb cut out at approximate Station 88+00, and
WHEREAS The Engineer has determined that constructing these turn lanes under this Contract is in the best interest of the
traveling public and constitutes Extra Work as Per Directive Letter 12.
NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AND UNDERSTOOD THAT:
1) The Contractor is directed to design and construct a left turn lane on southbound Powers Boulevard and design and
construct a right turn lane on northbound Powers Boulevard at approximate Station 88+00.
2) All design and construction for this change will be made as per the Contract documents for this project.
3) Payment will be as per the negotiated lump sum for all labor, equipment and materials associated with the design and
construction of the right turn lane and the left turn lane as listed below in the 'Estimate of Cost' A payment for
Contractor's Allowance In the amount of 10% for the first $50,000 of subcontractor work and 2% of the the remaining
subcontractor cost, and a Contractor's risk payment as provided in Book 1, 13 6 3 will also be made
4) The Contractor shall not make claim of any kind or character whatsoever for any other costs or expenses which they
may have incurred or which they may hereafter incur, in performing the work and furnishing the materials required by
this Agreement.
