Drive. Since the'Ju1~.1.;ZQ06Council meeting, the tum lane has beeninstfafe(L
Staff just recently received the change order paper work. Staff has reviewed the
costs and finds them acceptable. Staff is still waiting for a change order from
MnDOT for the, sewer extension to the site. These improvements have also been
installed. The turnlane change order amount is for $23,787.43. The total cost for
the fire station improvements will be well below the original estimate of $83,000.
The second change order request is for substituting Cobra head light fixtures
which are standard MnDOT fixtures at signalized intersections, with shoebox
fixtures which are the City's standard fixtures for the intersection lighting at
signalized intersection. Also, the shoebox, fixtures will better match the street
light fixtures along the corridors. All seven signals that will be constructed in
Chanhassen in conjunction with the TH 212 project are proposed to have the
shoebox light fixtures. All of the signals are proposed to be painted brown to

The following is a summary of the changes made to the TH 212 contract to date if
the.proposed change orders are approved:

The changes being proposed would be under the contract amount with MnDOT.
Funding for the TH 212 improvements is being financed with the State of
Minnesota Loan Agreement.
Staff recommends approval of the change orders at this time.

This Contract is between the State of Minnesota, acting through its Commissioner of Transportation, and Contractor as follows:
I. SCOPE OF WORK
WHEREAS: This Project encompasses new design and construction for the realignment of TH 212, creating a controlled access
highway from existing TH 312 termination to approximately 0.75 miles west of the intersection of Carver County
Road 147 and TH 212, and
WHEREAS: The project consists of the design and construction of four-lane controlled access highway, and
WHEREAS: The Project generally consists of grading, surfacing, noise berms, noise walls, ponds, signals, lighting, and signing
and bridge construction, and
WHEREAS: Additional major responsibilities include but are not limited to environmental coordination, public relations, utility
coordination, and warranties, and
WHEREAS: The new TH 212 will be part of the National Highway System, and
WHEREAS: The original project contract documents and plans do not indicate a right turn lane on eastbound Lyman Boulevard
for a fire station site to be developed by the City of Chanhassen, and
WHEREAS: The City of Chanhassen has requested that a right-turn lane be provided for eastbound Lyman Boulevard to the
new fire station site to the South of Lake Susan Drive, and
WHEREAS: The Contractor will need to design and construct a right turn lane for eastbound Lyman Boulevard to future fire
station as per Request for Cost Proposal Letter No. 13,
NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AND UNDERSTOOD THAT:
1) The Contractor is directed to design and construct a right turn lane on eastbound Lyman Boulevard to future fire station
at approximate stationing of 21 +00 to 25+00, which is to include, but not limited to excavation, common fill, granular fill,
aggregate base, bituminous surfacing, curb and gutter, striping and signing all in accordance with the contract
documents.
2) The Contractor shall not make claim of any kind or character whatsoever for any other costs or expenses which they
may have incurred or which they may hereafter incur, in performing the work and furnishing the materials required by
this Agreement.

The amount shown in the Estimate of Cost is a negotiated final and represents a cost to be paid
100% by the City of Chanhassen.

WHEREAS: With this request the original number of fixtures has increased from 12 total fixtures to 27 total fixtures, and
WHEREAS: The project manager has determined that this is an increase and scope and the Contractor will be compensated
for said increase in fixtures.
\JOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AND UNDERSTOOD THAT:
1) The Contractor is directed to design and construct Shoebox fixtures inplace of Cobra head fixtures at each of the
intersections within the limits of the City of Chanhassen and within the limits of the Project.
