Accept Streets and Utility Improvements in Orchard Green
Project No. 06-04
Staff has received a letter from Matt Pavek, Project Engineer with Terra
Engineering, Inc., requesting the City consider acceptance of the streets and utility
improvements in the above-referenced project. According to Mr. Pavek, the public
streets and utility improvements have been completed in conformance with the
approved plans and specifications. City staff performed a walk-through inspection
of the project and found the improvements to be in satisfactory condition.
It is therefore recommended that the City Council accept the public streets and
utility improvements in Orchard Green, Project No. 06-04, for perpetual
maintenance and ownership conditioned upon the receipt of the required two-year
street maintenance bond and the required two-year utility maintenance bond.

This is our official request for an assignment of the Developers Contract for Orchard Green.
Mortgage on property:

The mortgage holder consent was a part of the original developers contract, with the same underlying fee owner,
(Tom Raymond) who is now going to be the new developer.
The party requesting the assignment is the fee owner (Tom Raymond), and he has already signed fee owner
consent forms as a part of the original developers agreement. I would assume he doesn't need to consent to
assigning himself the developers agreement.

On another note: We submitted a letter requesting final City acceptance of the Streets & Utilities for Orchard
Green in July. We stated that all the Utilities were built to City standards etc...we did not mention that the lot irons
were in place...they are now in place, so please schedule this project for final City Acceptance.
We also need a letter from the City stating that items 1,2 & 3 of the letter from Gordy Stauff dated 7/10/2006 have
been complete and are acceptable to the City. The City is still holding the escrow dollars for these items as
welL.Can we be reimbursed for these items prior to transfer of the developers contract?
