Highover Trail Project: Award of Bid
The Highover neighborhood was platted in April of 1997. The development
includes 54 residential single-family lots in addition to a city outlot to be utilized
as a trail corridor. The trail was not installed at the time of plat due to the lack
of a southerly exit point. With the recent platting of Highcrest Meadows, plans
were made to connect the Highover trail outlot with Highcrest Meadows. The
2006 Park and Trail Acquisition and Development CIP includes $80,000 to
complete trail improvements within this corridor.
The city retained the firm of Brauer and Associates to provide professional
services associated with the planning, preparation of construction documents,
bidding and construction observation for this project. Upon completing a
proposed construction plan and following an internal review of the plans, a
project notification letter was mailed to residents in the Highover area. In
response to the letter, I received a half-dozen calls and emails.primarily in
support of the project. However, one section of the proposed trail was deemed
unsafe by Ken and Lisa Peitz who reside at 6811 Highover Drive.
On the morning of September 8, I met with the Peitz's to hear there concerns.
We met on-site at 7:30 a.m., a time that coincided with bus stop pick-ups,
allowing additional neighbors to join in our conversation. The primary concern
of this group was that the steep grade, curvy alignment, and fact that the bottom
of the trail connects directly with Highover Drive would present significant
hazards to trail users, particularly children.
It was the unanimous consensus among this group that deleting the portion of
the trail project from Highover Trail to Highover Drive would result in a better
overall project. A big part of the reasoning for this consensus is that a second
northerly trail connection that parallels and serves the same purpose as the
"hilly/curvy" trail has recently been installed. This trail, which was constructed
in the northwest quadrant of the Pinehurst at Lake Harrison development, was
not "on the books" when the Highover trail was first conceived.

Following this initial meeting, we received a copy of a petition that had been
circulated around the neighborhood calling for the deletion of the north section
of trail. Staff scheduled a neighborhood meeting to allow for additional
neighborhood input into the proposal to delete this particular section of trail.
Postcards were mailed to all residents within the Highover development in
addition to residents immediately north of the development. On Tuesday
evening, September 19, I met with approximately one dozen residents at the
project site near the intersection of Lake Lucy Road and Highover Trail.
A number of issues were brought up by the participants in the meeting.
Primary among the topics was the continued feeling that the steep section of trail
at the north end of the project would create safety hazards and should be deleted.
Two families who reside adjacent to the trail voiced their desire to see the entire
project dropped. Some attendees thought the dollars set aside for this trail
should be saved and set aside for a future underpass project to connect
pedestrians to the Regional Park on Lake Minnewashta. The project includes
chain link safety fencing, a fact that was of concern to a number of the group.
The fence specified in the project documents is a six-foot high, galvanized chain
link fence. I agreed to recommend that the specification be amended to a four-
foot high, green vinyl-coated chain link fence as a means of mitigating concerns
over the "look" of the fence.
Responding to the input received during the neighborhood meeting, a project
addendum deleting the section of trail from Highover Trail to Highover Drive
and modifying the fence specification was published on September 22 and
delivered to all plan holders of record. Sealed bids were opened for this project,
as amended, on Friday, September 29 at 2:00 p.m. Eight bids were received
ranging from a high of $106,847.25 to a low of $65,866.30. The low bid was
submitted by KA. Witt Construction Inc. of New Prague, Minnesota. A copy of
the low bid and a bid tabulation is attached.
RECOMMENDA TION
It is recommended that the City Council approve the Highover Trail project as
amended and award the project to the low bidder, KA. Witt Construction Inc. of
New Prague, Minnesota in the amount of $65,866.30.

The City's 2006 Park and Trail Acquisition and Development Capital
Improvement Program (CIP) includes the construction of the "Highover" Trail.
The trail is approximately 2,000 feet in length and will travel from Highover
Drive south to Highcrest Meadows within the power line outlot owned by the
City. The diagram on the reverse side of this letter depicts the trail design and
location. The project has a planned bid opening date of September 29 and a
project completion date of November 15, 2006.

This trail will offer area residents new and interesting opportunities for outdoor
recreation. Trails that connect to other trails/sidewalks, neighborhoods, within
"natural" corridors, and that loop walking and running routes are highly valued
in our community. The Highover trail offers all of these things in addition to
some very nice views and overlooks.

Our current maintenance plans for the trail do not include snow removal. The
steep grades encountered at the north end of the trail and the future stairway
connection to the Highcrest Meadows neighborhood would make for some
exciting snowplowing and even more exciting foot travel once cleared. The trail
will remain open in the winter with snow depths and weather dictating the
condition of the trail surface at any given time.

The budget for this trail project is $80,000. Park and trail dedication fees
collected in your area make up a portion of the funding for this exciting
improvement. Recreation and transportation trails stand out across the country
as the No. 1 requested park and recreation amenity. The city's trail system
currently stands at 54 miles, with more being added every year. We are pleased

September 7th, 2006
This is a petition we want to present to the City of Chanhassen in regards to the "Highover" Trail, which
we feel is unsafe for ALL of our children, and all of us in our neighborhood and surrounding area.
As you mayor may not know, the City of Chanhassen is planning to put the "Highover" Trail from the
corner of High over Drive to Highcrest Meadows within the power line outlot.
We received the attached letter regarding this trail. Even though some of you may have called the city
manager regarding this issue expressing your concerns, we noticed yesterday, September 6th that there
was a surveyor walking by our home. We talked to him and he told us that they were going through with
the trail as planned.
Our main concern is that the trail begins on Highover Drive and Lake Lucy Rd which is a very steep hill.
Our concerns are:
1. Whoever uses it will be at risk having an accident.
2. Whoever uses it will not be able to see a car coming from the south on Highover Drive.
3. The cars would NOT be able to see a pedestrian coming down that trail, until it's too late!
4. When it is raining, the trail will be slippery.
5. During the morning hours the trail will have dew, thus making it slippery.
6. This trail will be facing northwest, thus never getting the sun until late afternoon, thus being icy in
winter months..
7. It would be very difficult for pedestrians to walk up the trail as well without slipping.
8. In the winter, you can imagine how children would love to use this trail as a sledding hill.
9. Anyone using a skate board, roller blades, bikes, strollers - whatever could result in them
not being able to stop, thus run onto the busy street, which could possibly lead to injury.
10. We can also visualize children using the rock walls for a ramp, or other dangerous stunts like
jumping or climbing on the rocks and falling.
This project costs the city $80,000, which we are all paying with our taxes. The city would be liable for
any and all accidents that would happen on this trail, thus many law suits (which we tax payers would end
up paying for).
As we're talking to the neighbors, we have a deep concern for the safety of our neighborhood and city
(whoever would be using this trail). There is another trail close by that is recently completed.
We feel that it is necessary for the city of Chanhassen to confer with the City Safety and Police
department in regards to the possible safety issues listed above.
We, the undersigned feel that the city of Chanhassen could avoid many accidents by choosing this
alternative:
1
START the Highover Trail at the Pinehurst trail (which is already there) and connect to new trail
by the Highover Trail intersection.
This would avoid going down the steep and rocky hill ending altogether, thus avoiding many
accidents.
What sense does it make to have our families to cross two busy streets, when this could aU be
avoided by connecting the trail to the Pinehurst trail, thus leading pedestrians foUowing that trail
safely all the way to Chanhassen.

All work shown on original documents north of the residential street, Highover
Trail, are removed from this project. Refer to GRAPHIC A TT ACHMENT
"A" for detailed limits of the area that has been removed from the project.
Item #2 - Replace bid
form
Replace the original bid form with the attached updated bid form. The updated
bid form is labeled as ADDENDUM #1 - ATTACHMENT "B". This updated
bid form must be used by bidders for bid submittal and bidders shall
acknowledge receipt of Addendum on the Bid Form.

The undersigned, being familiar with the local conditions affecting the cost of the work and with the Contract
Documents and in accordance with the provisions thereof, hereby propose to furnish all labor, materials,
and equipment necessary to complete construction under this Bid Proposal.
The quantities indicated for "UNIT PRICE" bid items are for bidding purposes only and for comparison to
contractors quantities. Estimated quantities are not guaranteed. "UNIT PRICE" ~~ds shall include all labor,
materials, storing, equipment, overhead, profit, insurance, tags, etc. necessary to cover the work described
in the contract documents. Final payment to the contractor for "UNIT PRICE" bid items shall be based on
the contractors bid quantity.
Each Bidder must verify or establish quantities and the extent of work to their own satisfaction for "LUMP
SUM" bid items, and submit a total bid sufficient to cover all the work outlined in the contract documents.
"LUMP SUM" bids shall include all labor, materials, storing, equipment, overhead, profit, insurance, tags,
etc. necessary to cover the work described in the contract documents. Final payment to the contractor for
"LUMP SUM" bid items shall be based on the contractor's bid price for completion of the work outlined in
the contract documents.
The bidder is responsible for reviewing the site conditions (both surface and subsoil) and contract
documents to establish a clear understanding of the work within the scope of this project. The bidder shall
not rely on verbal information obtained from employees of the owner or consultant.
