2003-69 ~, CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION DA TE: AUl!USt 11. 2003 RESOLUTION NO: 2003-69 MOTION BY: A votte SECONDED BY: Labatt RESOLUTION CERTIFYING CERTAIN PROPERTY IN THE CITY OF CHANHASSEN AS NO LONGER BEING ELIGIBLE FOR AGRICULTURAL PRESERVE STATUS WHEREAS, the City has been granted the authority pursuant to Minnesota Statutes Chapter 473H (commonly referred to as the "Metropolitan Agricultural Preserves Act"), to certify property as eligible or ineligible for special tax status as Agricultural Preserves, and; WHEREAS, in accordance with the procedures specified in Chapter 473H, by Resolution 82-06, adopted March 1, 1982, the City certified property shown on the map attached hereto as Exhibit 'A', located at 1551 Lyman Boulevard, and legally described as the Northwest Quarter of the Southwest Quarter of Section 23, Township 116, Range 23 West as eligible or qualified for Agricultural Preserve status; and WHEREAS, Chapter 473H provides (in g473H.04, Subd. 2) that "land shall cease to be eligible for designation as an agricultural preserve when the comprehensive plan and zoning for the land have been amended so that the land is no longer planned for long term agricultural use and is no longer zoned for long term agricultural use, evidenced by a maximum residential density permitting more than one unit per 40 acres," and; ".... WHEREAS, the property certified by Resolution 82-06 Subject Property is currently planned or guided in the City of Chanhassen 2020 Comprehensive Plan (adopted June 28, 1999) for Residential - Low Density and Residential - Medium Density uses and is currently zoned as Agricultural Estate District, which permits minimum lot sizes of 2.5 acres; NOW, BE IT RESOLVED that the City Council of the City of Chanhassen, in accordance with the authority, responsibility and procedures specified in Chapter 473H, hereby certifies the property previously certified by Resolution 82-06 and described above, as no longer eligible for Agricultural Preserve status and directs city staff to notify the metropolitan council ofthis action as required by law.
