2003-0102 't--_~ e CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTY, MINNESOTA RESOLUTION Date: November 10,2003 Resolution No. 2003-102 Motion By A votte Seconded By Labatt A RESOLUTION APPROVING THE V ACA TION OF EASEMENTS FOR PUBLIC RIGHTS OF WAY, STREETS AND UTILITIES, MAINS, PIPES AND APPURTENANCES LOCATED IN LOT 2, BLOCK 1, CHANHASSEN MALL, OUTLOT B, FRONTIER CINEMA ADDITION AND OUTLOT A EASY RIDER ADDITION e WHEREAS, the Market Street Station, LLC has petitioned for the vacation of easements for public rights of way, streets and utilities, mains, pipes and appurtenances, granted by those certain Easements dated August 26, 1976 and recorded on August 30, 1976 as Document Nos. 30098 and 30099 in the office of the Carver County Recorder, located in the property described as follows: The South 60.00 feet of the North 560.00 feet of the West 180.00 feet of the Northeast Quarter of the Northwest Quarter of Section 13, Township 116 North, Range 23 West of the 5th Principal Meridian that lies within Lot 2, Block 1, Chanhassen Mall, Outlot B, Frontier Cinema Addition and Outlot A, Easy Rider Addition, together with the West 60.00 feet of the East 280.00 feet of the following described property and over, under and across the South 60.00 feet of the North 560.00 feet of the East 220.00 feet of the following described property: That part of the Northwest Quarter of the Northwest Quarter of Section 13, Township 116 North, Range 23 West of the 5th Principal Meridian, lying northerly of the northerly right-of-way line of the Chicago, Milwaukee, St. Paul and Pacific Railroad. EXCEPT the westerly 10 acres of that part of the above described property lying south of the south right- of-way line of County State Aid Highway No. 16 (old State Highway No. 5) that lies within Lot 2, Block 1, Chanhassen Mall, Outlot B, Frontier Cinema Addition and Outlot A, Easy Rider Addition. e 108842 ') . . e Together with that part of the Northwest Quarter of the Northwest Quarter of Section 13, Township 116 North, Range 23, West of the 5th Principal Meridian lying 30 feet either side of the following described line: Beginning at the southwest comer of the East 250.00 feet of the North 530.00 feet of the Northwest Quarter of the Northwest Quarter of said Section 13; thence North 86 degrees 02 minutes 38 seconds West (assuming the north line of the Northwest Quarter of said Section 13 has a bearing of North 88 degrees 48 minutes 14 seconds West) a distance of 650.00 feet and said center line there terminating, that lies within Lot 2, Block 1, Chanhassen Mall, Outlot B, Frontier Cinema Addition and Outlot A, Easy Rider Addition. WHEREAS, a public hearing was held on said petition on November 10, 2003; and WHEREAS, said public hearing was preceded by two weeks published and posted notice as required by Section 412.851 of Minnesota Statutes; and WHEREAS, there is no public interest to be served by the continued public ownership of the easements for public rights of way, streets and utilities, mains, pipes and appurtenances set forth above. NOW, THEREFORE, BE IT HEREBY RESOLVED, that any and all of the described easements for public rights of way, street and utility purposes over under and across the property described herein are hereby vacated.
