2004-10 e e e CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: March 8. 2004 RESOLUTION NO: 2004-10 MOTION BY: Peterson SECONDED BY: A votte A RESOLUTION V ACA TING A PORTION OF PUBLIC RIGHT-OF-WAY ON KIRKHAM ROAD WEST OF 3737 HICKORY ROAD - V ACA TION FILE NO. 2004-06 WHEREAS, the City received a request from Dan Revsbech, representing the property owner at 3737 Hickory Road to vacate an existing portion of the public right-of-way of Kirkham Road that is adjacent to the west lot line of the applicant's property; and WHEREAS, the existing 30-foot right-of-way for Kirkham Road was dedicated to the City as a part of the Red Cedar Point Lake Minnewashta plat in 1913; and WHEREAS, the portion of Kirkham Road that is proposed to be vacated exists as a gravel driveway that serves both 3737 Hickory Road and 3800 Red Cedar Point Road, and the remaining southerly portion is not improved and is simply a "paper street". NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby approves vacating a portion of the public right-of-way on Kirkham Road as defined in the attached vacation description subject to the following: 1. A 30-foot wide utility and drainage easement shall be retained over the existing sanitary and water lines within the vacated area. 2. A private driveway easement is required over the vacated right-of-way for the benefit of 3800 Red Cedar Point. Passed and adopted by the Chanhassen City Council this 8th day of March 2004.
