A RESOLUTION V ACA TING A PORTION OF PUBLIC DRAINAGE & UTILITY
EASEMENT AT 501 BIG WOODS BOULEVARD - V ACA TION FILE NO. 2004-05
WHEREAS, the City received a request from David Igel, the property owner of 501 Big
Woods Boulevard, to vacate a portion of an existing public drainage and utility easement within the
rearyard of the applicant's property; and
WHEREAS, the existing public drainage and utility easement was dedicated to the City as
a part of the Big Woods on Lotus Lake plat in 2001; and
WHEREAS, a condition in the development contract required a drainage and utility
easement to be a minimum of 50-feet from the center-line of an existing creek on the parcel; and
WHEREAS, the dedicated easement on the plat at time of recording was at a width of 70-
feet from the creek; and
WHEREAS, the applicant is requesting the City vacate the easement area in excess of 50-
feet from the creek center-line in order to construct a swimming pool in the rearyard of his lot.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves vacating a portion of a public drainage and utility easement at 501 Big Woods Boulevard
as defined in the attached vacation description.
Passed and adopted by the Chanhassen City Council this 9th day of August, 2004.
