2004-71 e CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DA TE: September 27. 2004 RESOLUTION NO: 2004-71 MOTION BY: Peterson SECONDED BY: Lundquist A RESOLUTION V ACA TING VARIOUS PUBLIC EASEMENTS IN BURL WOOD ADDITION - VACATION FILE NO. 2004-06 WHEREAS, the City received a request from Mike Falk, developer of the Burlwood subdivision, to vacate various public easements within the subdivision; and WHEREAS, the existing 20-foot wide public easement was granted to the City as a part of City Project No. 75-2 in 1976; and WHEREAS, the Burlwood subdivision was plated in December, 2003; and e WHEREAS, this vacation involves two different easement areas. The first area involves a 20-foot wide sewer and water easement that covers an approximately 30-year old existing sanitary sewer and water line within the development. As a part of the Burlwood plat, the developer has dedicated public right-of-way over the existing sewer and water lines. As such, the easement is no longer necessary and can be vacated; and WHEREAS, the second easement area involves the standard lot line easements within Lots 1-4, Block 1 of the development. Due to conflicts with the proposed house sizes on the minimum-sized lots, the developer has elected to delete one of the lots to leave a total of three lots versus four. The deletion of Lot 4 will require revisions to the existing lot lines. The developer is requesting to vacate the side lot line easements in the area where the existing lot lines will be moved. The developer intends to dedicate new easements over the new lot line locations; and NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby approves vacating various public easements in Burlwood Addition as defined in the attached vacation description subject to the following: 1. Minimum 5-foot wide public drainage and utility easements must be dedicated along each side of the new lot lines. An easement being a 20 foot perpetual easement for sewer and watermain purposes over, under and across the above described property, the centerline is described as follows: Beginning at the intersection of the west line of Carver- Beach, according to the recorded plat thereof, and the westerly extension of the center line of Laurel Road (now known as West 67th Street) as dedicated in said plat; thence westerly, along the westerly extension of said center line, to the east line of the west 200.00 feet of the Northwest Quarter of the Southeast Quarter of Section 2, Township 116 North, Range 23 West; thence southerly, parallel with the west line of said Northwest Quarter of the Southeast Quarter, to the north line of the South 674.00 feet of said Northwest Quarter of the Southeast Quarter and said center line there tenninating. e e 9/13/04
