DATE: CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION NO: June 27. 2005 2005-61 MOTION BY: SECONDED BY: Tiornhom Lundquist A RESOLUTION V ACA TING PORTIONS OF PUBLIC RIGHT -OF-WAY AND DRAINAGE & UTILITY EASEMENTS AT 2150 CRESTVIEW DRIVE PLANNING CASE (V ACA TION) FILE NO. 05-02 WHEREAS, the City received a request from Lecy Bros. Homes, the property owner of the Shively Addition, to vacate a portion of an existing public right-of-way and all drainage and utility easement within the existing plat of Shively Addition; and WHEREAS, the existing public right-of-way and drainage and utility easement was dedicated to the City as a part of the Shively Addition plat in 1990; and WHEREAS, a condition in the development contract required the vacation of a portion of the existing right-of-way for Crestview Lane (Drive); and WHEREAS, the dedicated right-of-way and drainage and utility easement on the plat are being superceded by the realigned right-of-way and drainage and utility easements within the Crestview Addition Plat approved on May 9,2005; and WHEREAS, the applicant is requesting the City vacate the right-of-way and easement area which would run through the middle of the proposed new lots. NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby approves vacating a portion of the public right-of-way for Crestview Lane (Drive) and a portion of the drainage and utility easement at 2150 Crestview Drive as defined in the attached vacation description.
