CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: October 9. 2006 RESOLUTION NO: 2006-73A MOTION BY: LundQuist SECONDED BY: Tiornhom A RESOLUTION AMENDING THE BY-LAWS OF THE CHANHASSEN FIREFIGHTERS RELIEF ASSOCIATION WHEREAS, the Chanhassen Firefighter's Relief Association has requested the City to approve an amendment to Article XII, Sections 12.1 A and 12.1 B of the Association's By-laws; and WHEREAS, approval of the amendment to the By-laws is in the best interests of the City and the Relief Association. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Chanhassen, Minnesota, that the amendment to Article XII, Sections 12.1 A and 12.1 B modifying death benefits be approved as included in Attachment A. A TT ACHMENT A ARTICLE XII - ANCILLARY BENEFITS Section 12.1. Death Benefits. A. Vested or Deferred Vested Member. Effective January 1,2001. Upon the death of any member on the deferred vested pension roll or any active member who is vested, prior to commencement of the benefit, a lump sum pension shall be paid to the member's surviving spouse and surviving children as designated by the member, or if none, to the member's designated beneficiaries for the balance of the member's account in the plan, or the $25,000.00 in Section 12.1 B, whichever is greater. Such benefit shall commence on the first of the month following death and shall be payable as a one time payment. B. Active Member Who is Not a Vested or a Deferred Vested Member. Effective January 1, 2001. A death benefit of $25,000.00 shall be paid to the designated beneficiary of an active member of this Association who is .also an active member of the Chanhassen Volunteer Fire Department who is not a Vested or Deferred Vested Member under Section 1 A of this Article. This benefit shall be paid out of the Special fund.
