92-48 Ci%y of Chanhassen Carver and Hennepin Counties, Minnesota DATE: ADril 13. 1992 RESOLUTION NO: 92-48 MOTION BY: Mason SECONDED BY: Workman RESOLUTION VACATING RIGHT-OF-WAY WITHIN OUTLOT B OF TRAPPERS PASS AT NEAR MOUNTAIN 3RD ADDITION WHEREAS, a petition was received from Lundgren Bros. for the vacation of an unnecessary right-of-way within Outlot B of Trappers Pass at Near Mountain 3rd Addition; and WHEREAS, a public hearing was held on said petition on April 13, 1992; and WHEREAS, said public hearing was preceded by two weeks published and posted notice as required by Section 412.851 of Minnesota Statutes; and WHEREAS, the applicant has received final plat for Summit at Near Mountain which created single family lots; and WHEREAS, within Outlot B, the existing right-of-way, which is 15 feet wide and approximately 600 feet long, is no longer necessary since the outlot has been replatted, and includes the provision of new right-of-way meeting city standards as described as follows: LEGAL DESCRIPTION OF RIGHT OF WAY TO BE VACATED FOR THE SUMMIT AT NEAR MOUNTAIN That portion of Oak Grove Avenue as dedicated in the recorded plat of "Pleasant View", Carver County, Minnesota, lying northwesterly of the following described line: Beginning at the most southerly corner of Outlot B, TRAPPERS PASS AT NEAR MOUNTAIN 3RD ADDITION; thence North 37 degrees 29 minutes 53 seconds East, assumed bearing, along a southeasterly line of said Outlot B, and its northeasterly extension, to the northeasterly line of said Oak Grove Avenue, and said line there terminating; said Oak Grove Avenue also being known as "Iroquois", "Iroquois Road" and "Indian Hill Road". NOW, THEREFORE, BE IT RESOLVED that any and all of the above described easements and right-of-way are hereby vacated. Passed and adopted by the Chanhassen City Council this 13th day of April, 1992.
