These comments and questions are based on the information submitted. Further comments and concerns may develop as this proposal advances. Lyman Boulevard (CSAR 18) was just recently reconstructed in 2006. As part of the development of the construction plan, access for this property was reviewed and addressed. The access plan developed as part of the roadway construction plan included access onto Lyman Boulevard (CSAH 18) only at the west side of this property. The proposal to have two accesses from this property onto CSAH 18 does not meet the spacing requirements of the preliminary transportation plan. An access permit from the County Engineer's Office will be required for any access onto CSAH 18 (Lyman Blvd.). Carver County cannot at this time assure that access locations will be permitted as presently proposed and/or what type of additional roadway improvements may be needed on CSAH 18 to accommodate these accesses. City ordinances require all property within 500 feet of the subject site to be notified of the application in writing. Any interested party is invited to attend the meeting. • Staff prepares a report on the subject application that includes all pertinent information and a recommendation. These reports are available by request. At the Planning Commission meeting, staff will give a verbal overview of the report and a recommentlation. We live at 801, 851 and 891 Lyman Blvd. in Chanhassen, directly west of the new Hwy 101 intersection. For quite a while we have been observing the ongoing changes to our neighborhood. We have attended informational meetings about the Kraus Anderson development going in directly across Lyman from us, the new Transit station to the Northeast, the new fire station that will be built just to our West and the proposals for the development on the property just to our East on Lyman. We want you to know that we are all knowledgeable parties and are fully aware that the adjacent property on Lyman to our East will not support residential housing in the future and should be rezoned for "Retail". We are not against such an action like some of the outspoken and sometimes unrealistic Springfield residents have been and continue to be on this subject. We are the most affected by the changes around us and we want you to realize this due to the following items: 1. We have already lost part of our properties due to the widening of Lyman Blvd. 2. We must put up with the increased 50 mph traffic directly in front of our homes, making it dangerous to enter and exit from our driveways. MnDot's lack of foresight in at least giving us a left turn lane to our homes, even atter the City Engineer mentioned it was not safe, has made entering even more dangerous, as many times we have almost been rear ended while waiting to turn left into our driveways. 3. We have the noise of the new freeway coming to us across the valley to our West with no sound barriers. 4. We have a pipeline running through our front yards with a 100 ft. easement which prevents us from planting trees as a barrier from Lyman. 5. Our driveways are steep and slippery in the winter, making it difficult to navigate them due to the increased height of Lyman. 6. We have the Bluff Creek Overlay at our back doors, making half of the property we own unusable or unchangeable. 7. We will have a Kraus Anderson Retail development directly across Lyman from our homes, creating more traffic, noise and lights. 8. We will have a probable Retail development directly adjacent to our properties to the East as the Brighton Corporation builds, creating more traffic, noise and lights. 9. The new Fire station just to our West bringing the joy of many sirens as emergency vehicles leave the station and pass our homes. Unlike the rather closed community of Springfield, we will be directly impacted by all these things. They will not. Until now, they have been the strongest objectors to any development even near their community. We need you to hear us and act on our behalf to build this neighborhood into the retail hot spot that the new Hwy 212 and its major intersection with Hwy 101 has created. We realize in doing so, our properties that we love so much will become more and more undesirable as residential havens, and we will need your foresight to save us from financial loss in the future. None of us want to move from our homes, but when we are ready, we need to be assured that the new Comprehensive Plan that you will set this year will include the plan of future rezoning of our properties to "Retail' so that we will be able to sell and not be negatively impacted several years from now. We feel that we have valid and compelling reasons for our request and hope that you will act upon this to make sure that the Comprehensive Plan allows for "Planned Future Rezoning" of our properties. In closing, all of us are residents of Chanhassen by choice. We chose this city for various, and all good reasons. However, we have watched the development of property around us with a mixture of anger and fear. Fear, because we three home owners seem to have little to say in the changes, and anger because we know that the residential value of our dream homes is decreasing with every new project approved by the city and built around us. We appreciate what our City has done for us in the past and have hope that you will listen and support us in this endeavor as we move into the future. Copies of the meeting invitation, mailing list and sign -in sheets are provided in Sleeve 5. In addition to the mailing to owners within 600 feet of the site, the invitation and mailing list was sent by e-mail to Patty Mullen on November 27, 2007, with the understanding that she would forward it to all residents in Springfield Subdivision. A total of fourteen (14) people attended, including: • A representative of Kraus -Anderson, developer of the Neighborhood Business project across Lyman Blvd., immediately north of the site. • A representative of Southwest Metro Transit which is developing a Park -and -Ride facility and other uses the NE corner of the Lyman / 101 intersection. • Three (3) owners representing two of the three properties west of the site, along Lyman Blvd. • Nine (9) owners representing eight (8) properties in Springfield Subdivision, east of the site across the newly -improved, six -lane SH -101. Neighborhood Comments Brighton has received only three (3) written comments (by e-mail) from neighboring residents. Those comments—per the attached messages and responses [Sleeve 51—focus on buffering the impacts of the proposed development. Residents from two of the three homes west of the site, while not expressing support for the proposal, did acknowledge that the site is unlikely to develop as residential. Brighton Properties LLC Application 5 January 30, 2008 Chanhassen, MN Mitilzation Actions Brighton is committed to address the expressed concerns of area residents by the following: • West ❑ Construct a heavily -landscaped area with retaining walls and berms, to the extent possible, along the west property line to enhance the buffering that the current topographic difference provides. ❑ Control lighting and signage to assure that no "spill" occurs beyond the site. ❑ Work with the residents for safer access to Lyman Blvd. with a "potential" cross -access easement to the full access intersection at the northwest comer of the site; and for the extension of utilities to the west property line to serve those residents. • East ❑ In addition to the buffering provided by the existing Springfield berm and the new six - lane Highway 101, Brighton will berm and heavily landscape the on-site setback (50 - foot minimum) and unimproved right-of-way (ranging from 30 feet to 50 feet) by license agreement with MNDOT. The closest structure in the project—the Walgreen's Pharmacy—will be approximately 440 feet from the nearest Springfield residence, separated by berms and landscape buffers on both sides of the new six -lane highway. ❑ Control lighting and signage to assure that no "spill" occurs beyond the site. • South ❑ The Bluff Creek wetland provides a natural buffer for the property to the south. The site was previously cleared to the wetland boundary. In concert with site development, the shoreline and wetland setback within the "Primary Zone" will be re -vegetated to re- establish the natural habitat. • North ❑ Inasmuch as the "neighbor" across Lyman to the north will be commercial, and the principal view for the on-site commercial uses will be from the intersection of Lyman Blvd. and Highway 101 southbound, the landscaping design along the Lyman frontage will be more "open", providing the required commercial visibility. The "Conclusions" [Page]] of the report, Sleeve 71 of that report areas follows: "The Brighton Development's site -generated traffic is about 4,440 gross trips per day. Net new daily trips added to the roadway network total 2,610, with 1, 040 allocated to/from north of the site, 790 to/from the south, 260 to/from the east and 520 to/from the west. Site - generated traffic is projected to be about 230 new trips in the A.M. peak hour and about 140 new trips in the P.M. peak hour. Capacity analysis was not part of the scope of this traffic study. However, the added volumes to the County roads are relatively low and it is expected that the County roads will easily be able to accommodate the additional traffic. " Site Access Currently, access to the site is provided by a full -access intersection with Lyman Blvd., located at the northwest corner of the site [See Exhibits, Sheet 111, and a residential access from SH -101 approximately 350 feet south of the Lyman / 101 intersection. Table 2 summarizes the trip rates that were utilized for this study. Table 3 summarizes the resulting gross trip generation. A total of 397 trips are projected to be generated in the A.M. peak hour, 316 in the P.M. peak hour and 4,439 "trip ends" on a daily basis. In terms of trip generation statistics, a trip end is one movement either into or out of the site. This would be the expected level of trips counted at the driveways of each of the land uses it they were individual, stand-alone facilities. The actual new trips added by the development to the surrounding roadway system Page 5 will be lower for two reasons. First, in a commercial center such as this one, there is a degree of trip sharing between uses. The ITE Trip Generation Handbook suggests guidelines for such retail -to -retail and retail -to -office reductions. Based on these guidelines, it is assumed that 10% of the trips are shared in the A.M. peak hour, 19% are linked in the P.M. peak hour and 27% are shared on a daily basis. TRAFFIC ASSIGNMENT Based on the trip generation and distribution, site traffic was assigned to the three access points and to the intersection of TH 101 / CSAH 18. (Site traffic is the gross trip generation minus multi-purpose trip reductions.) Figure 4 shows the A.M. peak hour, P.M. peak hour and daily site -generated traffic, including the new trips and pass -by trips but not the multi-purpose trips. We appreciate early coordination with our agency on development activities that involve access onto our highways. Mn/DOT has approved its Highway Access Category System and Spacing Guidelines as the Department's policy for managing access and signal spacing on the State's Trunk Highways. The guidelines are intended to promote the safety and mobility of the traveling public while accommodating the access needs of the surrounding area. We have used these policy guidelines in reviewing the proposed development adjacent to TH 101. For access management purposes, Mn/DOT categorizes this stretch of TH 101 as a 6B - collector in an urban/urbanizing area. It is Mn/DOT's strong desire to have the proposed `right in, right out' access onto TH 101 be located as far south of the intersection of TH 101 and CR 18 as possible to maintain as much corridor mobility and safety as possible. The proposed "pork chop" island at the access to TH 101 is not necessary as traffic only has a `right in, right out' option at this access. Further, it is recommended that the development limit the number of accesses onto CR 18 to no more than one, which should be directly aligned with the CR 18 access to the "Crossroads of Chanhassen" project to the immediate north. There should be a shared thru lane, with a right turn lane, for the entrance at CR 18, so that it further ties into the "Crossroads of Chanhassen" development. Lastly, the drive-thru window traffic for the proposed Walgreen's conflicts with internal traffic circulation and should be modified. Sight distances for the access onto TH 101 maybe affected due to the crest located at this location. An intersection profile will be necessary to determine if sight distances are adequate. Further, the recommended width of the access at TH 101 should be 32' instead of 26'. An equal opportunity employer @CANNED A drainage permit may be required. Storm Water Pondine ■ Three potential storm water pond locations have been conceptually depicted, but not sized. That will come at the next, or Development Stage of the process. They will be outside the primary zone setback in accordance with Sec. 20-1564(a) of the Zoning Ordinance. Comment 2. Site TonoQranhv ■ The revised site plan conceptually addresses topographic concerns by depicting finish - grade contours created by a terraced engineered retaining wall (or series of walls). Projected finish -floor elevations for each building are noted in the Project Phasing Information table on the site plan. Comment 3. Vehicular Access ■ We don't agree with the conclusion that the access points "are not permitted. " There is a process to make that determination and we have taken only the initial steps to ascertain what options that process affords. ■ The south -bound Highway 101 ("going -home') access is essential to any use of the site. The proposal is to up -grade the existing residential access to a RI/RO. MNDOT has provided guidance on how to make that a reality. ❑ Without that access, south -bound traffic will have to pass through the Lyman / 101 intersection twice, adding unnecessarily to the traffic at that intersection. ■ The Lyman access is more challenging. Required Setbacks ■ The revised site plan incorporates the required setbacks as follows: ❑ 50 -foot buffer from the east property line to the first row of parking. ❑ 100 -foot buffer from the west property line to the closest building. However, the newly -constructed principal access at the northwest corner of the site establishes the westerly edge of site drives and parking with buffering of the adjoining single family dwelling provided by berms, retaining walls and landscaping. ❑ 50 -foot wetland setback to the closest structure. ❑ 20 -foot building setback from the pipeline easement. Comment S. Bluff Creek Primary Corridor Boundary. ■ At the Development Stage, the Primary Zone will be precisely established and site plan adjustments made, as necessary. There will be no grading within the first 20 feet of that zone. The storm water pond(s) will be constructed outside of that area. Comment 6. Pedestrian Access ■ The site plan has been modified to show how pedestrian access will be provided to/from the northwesterly intersection and to the Lyman / 101 intersection, thence, to pathways on the north side of Lyman and the east side of 101. Comment 7. Traffic Issues (The requested $2,400 escrow is provided with the revised application. However, we question the need for it except to fund an independent review of the traffic report prepared by Westwood Professional Services, Inc., and submitted with our initial application, as directed by your 12-17-07 e-mail.) ■ Item a. See response under Comment 3, above. ■ Item b. The Lyman RI/RO has been re -aligned to resolve the potential for confusion. ■ Item c. Staff is also concerned that these accesses could negatively affect the function of both Lyman Boulevard and Highway 101. b. The proposed eastern access on Lyman Boulevard is offset from the north -south drive aisle, which would cause driver confusion. c. Staff is concerned that the proposed drive-throughs for Buildings 1 and 2 will create vehicular conflict within the site. Internal vehicular movements appear to have many conflicts. 8. The preliminary plan submittal must show how the site will be served by gravity sanitary sewer. As -built information for the site indicates that the sanitary sewer stub located at the west entrance to Lyman Boulevard is approximately 17 feet deep. The topography of the site drops significantly from north to south approximately 35 feet. 9. The proposed change in land use would increase the sewer flow from the property. Further analysis will be required to determine if the 8 -inch stub and the downstream utilities can handle the peak flows. That is the primary purpose for the meeting next week. • We have not yet reviewed the "old town" design concepts proposed by Kraus -Anderson, but we will take that and the character of Chanhassen into consideration as we move forward. It is evident from the design and architecture of recent development in the area that strict design criteria are in place, thus we have included "up -grades" in our proposed construction budgets. • What you see on our web site fits the character and requirements of the areas in which the projects occur. We acknowledge that expectations vary with other communities—including Chanhassen—and will design accordingly. • There is a great deal of area within the 101 right-of-way for landscape in addition to on-site landscape setbacks that provides an opportunity for significant buffering. However, I wanted to share a few of my personal thoughts and I am not representing any other home owners or the position of the Springfield Board. The developer (Kraus I think) on the other corner showed a very "old town" design with character vs "box" retail. After reviewing your web site I noticed only very plain box type examples. I personally feel your design should be close in design 1/14/2008 Page 2 of 2 style as the other developments on the corner vs "box" look. A consistent, high end look will increase the values of all properties commercial and residential around this corner. A couple of other ideas to consider: - Propose in detail to shield all Springfield houses from any lights and views throughout all seasons. This might be in the form of dirt barriers and evergreen trees lined along the border or 101 towards Springfield. Our association owns the land between the road and the land owners. Another idea would be to propose significant landscaping on our side of the road with higher Berm, Evergreens (All year trees) to 100% shield the proposed development. The addition of a high quality privacy fence that wraps from the beginning of Springfield to around the corner to the first entrance off Lyman to be consistent. Very high "character" design similar to the bus station and Kraus along with a legitimate proposal to shield 100% Springfield yearround are my thoughts. In addition, we have completed and on-going projects in Colorado and Washington and southwestern Idaho. What sort of concepts does your company typically work with and what are you proposing for the Lyman/101 property? Our MN projects are neighborhood convenience oriented, providing services to area residents. Potential uses may include banks, restaurants, coffee shops, drug/convenience (no gas stations) dry cleaning or similar neighborhood services. We will review two site concepts at the meeting to initiate the discussion, but we are still "open" to site layout. Are you in the process of acquiring the land from Mr. Gianetti? Yes. What is the status of that? We have a signed Purchase Option Agreement on the property. I don't know how familiar you are with the history of that parcel but as a neighborhood with over 150 houses and even more young children we are very keen that the propert y is developed responsibly keeping in mind that there is typically a transition or buffer zone between single family residental to any sort of commercial use. We are aware of the recent effort by Mr. Gianetti to obtain approval for a Harley Davidson dealership. Our investigations acknowledge the adjacent single-family areas but also consider how the site is in, reality, isolated by topography, woods, wetlands, berming and distance. That is the basis for our belief that neighborhood business—properly designed and buffered—is an appropriate use. As you know, the land is currently zoned residential and there are residental properties directly adjacent to that land. We are aware of the current zoning and are sensitive to the nearby residential development. We will be looking for appropriate buffering solutions. Also, the land you are interested in buying has a wetland component and we want to ensure that any proposed use takes that into account as well. The Bluff Creek wetland constrains the use of the site; in fact, approximately one-third is wetlands. The remainder is subject to Overlay district setbacks and standards. 1/14/2008 Page 3 of 3 We are also keenly interested in signage since that land isn't directly adjacent to the new 212 freeway. Any proposal needs to minimize visual and audio pollution. How are you trying to address those concerns with your concept while obviously bringing in tenants that can make your concept profitable? We have not yet looked at those details, but you can be assured that signage, wetland protection, compatibility, quality, buffers, lighting and landscaping will all be taken into account as we work through the process with the City and the neighborhood.
