This letter is to confirm that on February 8, 2016, the Chanhassen City Council
approved the Interim Use Permit to permit grading in excess of 1,000 cubic yards to
allow a parking lot alteration, widen the main entrancelexit driveway, and stormwater
improvements subject to the following conditions:
1. The applicant's engineer shall adjust the slope of the expanded drive lane to
convey runoff to the northeast gutter line.
2. The plans must be revised to label the catch basins to match the CB/MH Schedule
on Page C5.
3. Slopes shall be labeled on all proposed pipes.
4. The note for the draintile shall be revised so that no sock is used on the draintile.
5. The applicant shall submit an erosion control plan (including additional detail
plates) for this project per City Code §19-154.
6. A $5,000 escrow to guarantee restoration and erosion control measures will be
required with the permit.
7. Staff will require that the applicant provide a proposed haul route for review and
approval.
8. An as -built grading plan is required at the completion of site grading to ensure
compliance with the approved grading plan.
9. MnDCT comments shall be incorporated into the plans.
10. The parking spaces and aisles must be adjusted to meet the Chanhassen City Code
requirements.
11. The parking lot design shall be revised to provide a travel path for north -south
pedestrians.

conditions.
A security in the amount of $5,000 for erosion control must be submitted prior to site grading.

1. Permit. Subject to the terms and conditions set forth herein, the City of Chanhassen
hereby grants an interim use permit for the following use:

2.Pte. The permit is for property situated in the City of Chanhassen, Carver County,
Minnesota, and legally described as shown on the attached Exhibit A.
3. Conditions. The permit is issued to import fill to the site subject to the following
conditions:

6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal
misdemeanor.
7. This permit shall expire with the completion of the site improvements approved by this
permit.

Mayor Laufenburger: Is there a staff report?
Paul Oehme: Yes Mayor, City Council members.
Mayor Laufenburger: Mr. Oehme, nice to see you again.
Paul Oehme: Nice to see you too. So this request is from again the Minnetonka School District.
The parcel is located at 6421 Hazeltine Boulevard. Just off of Highway 41, south of Highway 7.
So the request is for an interim use permit. Typically these projects are pretty straight forward in
nature. The reason why this triggers an interim use permit is because there is excess grading
material on this project. Anything over 1,000 yards of material hauled off, or trucked in and
trucked off the site requires an interim use permit. This project is, I think it's 2,100 cubic yards
of material that will be moved around. The plan that the school district would like to proceed
with is the expansion of basically their entrance drive. Highway 41 is over here on the left hand
side. The school is located over here so this is the entrance drive coming into the facility. There
is one lane of traffic in and out. At this location there is a left turn and right turn lane as you get
closer to 41. The school district would like to expand this location here to increase the capacity
of the traffic exiting the facility during peak hour times. Also there's some minor modifications
to the main parking lot that the school district would like to take on and the some sidewalk or
some trails next to the tennis courts that they would like to make at this time too. Some minor
drainage and utility, drainage and stormwater improvements as well and then I think the parking
lot would be overlaid after the project is done. Here's just kind of the traffic flow of what the
future access to the, in and out of the facility would look like so basically a designated right turn
and left tum lane all the way through the entrance land just sort of for better queuing and better

stacking. More capacity of people waiting to get onto Highway 41 from the parking lot. With
that I'd stand for any questions.
Kate Aanenson: If I may add Mayor, members of the City Council.
Mayor Laufenburger: Ms. Aanenson.
Kate Aanenson: This item did appear before the Planning Commission on January 19'h. There
was a public hearing held. I just wanted to point out that there was nobody in attendance at that
meeting. 'There was a few calls from some of the neighbors but staff had addressed those
comments I think to the satisfaction of the neighboring properties so there wasn't anybody at that
meeting but they did, the Planning Commission did recommend approval of the interim use
permit.
Mayor Laufenburger: Alright, thank you Ms. Aanenson. Any questions of staff regarding this
interim use permit?
Councilwoman Ryan: I just have a couple questions Mayor.
Mayor Laufenburger: Councilwoman Ryan.
Councilwoman Ryan: Do you mind going back to the diagram?
Paul Oehme: Sure.
Councilwoman Ryan: This doesn't totally have to do with the actual permit but it's more of the
design of the interior part of the parking lot. Are they still going to have, are they changing the
parking lot so there is no more cut through in the middle of the parking lot? Right now at the
school it's basically split in half and I don't know if that's like supposed to be the walkway or
what but it's.
Paul Oehme: North/south line?
Councilwoman Ryan: Yes,
Paul Oehme: I think that was one of the improvements that, I think it was this location here.
Maybe that's the, the school district representative is here. Maybe he can answer that question
too but I think that was part of the improvement that was planned for the parking lot.
Mayor Laufenburger: Is somebody from the school district here?
Cliff Buhman: I'm here to represent the school.

Cliff Buhman: My name is Cliff Buhman and I'm with Inspect. I'm the engineer of record on
the project working with the City. And the plan for the school is to paint a crosswalk in the area
where there is an existing crosswalk. So basically if you look at that little island just below the
far right or east tennis courts.
Mayor Laufenburger: Yep.
Cliff Buhman: That little island that projects, that will be striped all the way across and there
currently is an accessible walkway through there with a pedestrian ramp.
Kate Aanenson: I was just going to add, that came up at the Planning Commission too. We have
access from like 3 different directions that kids can walk to the school and so that was a concern.
Mayor Laufenburger: So the concern is to protect the pedestrians that are arriving.
Kate Aanenson: Correct. Right.
Mayor Laufenburger: So that they have a safe walk route.
Kate Aanenson: Correct, so they could come from the north. They come from the west and the
south also.
Mayor Laufenburger: Okay.
Councilwoman Ryan: So the sidewalk does cut through the middle of the parking lot or does
not?
Cliff Buhman: No there is not a sidewalk there now. There's an island that's going to be
removed and has part of a sidewalk on it but the drives obviously are contiguous but that will
link that north/south and the pathways too to an existing pedestrian ramp that there is a sidewalk
then on the south side.
Councilwoman Ryan: On the south side, okay.
Cliff Buhman: Yes,
Mayor Laufenburger: Any other questions Councilwoman Ryan?
Councilwoman Ryan: And then are there going to be sidewalks on the east and west side of the
tennis courts or will it just remain that there's the sidewalk on the, inbetween the courts.

Kate Aanenson: Yeah and then there's an opening on the south side too and actually you can
come over somewhere through on this side too.

Mayor Laufenburger: Mr. Oehme, when we grant, there was something about discussion about a
traffic pattern, is that correct? Who wants to speak? Or a traffic study. MnDOT is completing a
study which will provide us with more information about traffic in this area assisting in decision
making regarding potential improvements. Is that still underway?
Paul Oehme: It is. So MnDOT has done some preliminary investigation on Highway 41 with
traffic and speeds and school district representatives and the City are talking to MnDOT about
taking it to the next level, or looking at pedestrian movements and other ancillary information.
Basically it's a pedestrian movement study that MnDOT would like us to, school district to
complete and the impetus and what we're trying to get towards is a speed school zone along
Highway 41 so.
Mayor Laufenburger: During school movement hours.
Paul Oehme: Exactly to reduce the speeds during those peak hours where traffic and pedestrians
are coming in and out of the school campus so that's what we're shooting for. That's you know
there's some pedestrian counts that have to be taken so I think we're going to have to wait til
spring to actually get some reasonable counts on that but I think we're going to try to draft up a
report here pretty quick and try to get you know MnDOT to buy into that so improvements can
take place this year yet.
Mayor Laufenburger: Mr. Oehme, this isn't related to the movement of this grading stuff but the
City Council participated with I think it was safe routes to schools and we did some crosswalk
and flashing and median. Can you just speak to that? Or more importantly will the MnDOT
study include potential changes to that or are those, is that construction secure?
Paul Oehme: That construction's secure and actually this last fall when MnDOT did the traffic
study they actually did enhance the crosswalk that was out there that the City participated in and
built so there's some stop bars.
Mayor Laufenburger: Yep.

Paul Oehme: Painted stop bars on the pavement and there's some additional signage out there as
well so now to take it to the next level is to the look at the school speed zone. That's the next
thing that we're shooting for.

to make a public plea so to speak that MnDOT does do something. As a Minnetonka.

Councilwoman Ryan: Parent and a lot of friends. Mr. Bourgeois you've been very responsive
so I appreciate your action on behalf of the school district but this is a serious concern to a lot of
Minnetonka/Chanhassen. Minnetonka School District but Chanhassen residents of the safety of
pulling in and out of Minnetonka Middle School West so I encourage the City and school district
to continue to push MnDOT to do something here because I know that the residents would really
appreciate it and I know we all feel the same way about keeping our students safe and it's a, it
has to be a priority.

Todd Gerhardt: Just a quick comment for Paul. Sony about that Packer loss. We're feeling for
you every day. Little bit of a Packer fan above Paul on that one so.
Mayor Laufenburger: Is there?
Todd Gerhardt: Yeah. What I'd like to do is thank Todd Hoffman and his staff for a wonderful
February Festival. What a perfect event. Thank you Mayor for the wonderful weather that we
had and sunshine and it was just perfect but I think we really have to call out the Rotary group.
Had a group of about a dozen gentlemen out there drilling 1,000 holes prior to the event and it's
not easy but they did have donuts to work towards so Todd splurged and donated donuts to the
guys so. Also the Boy Scouts sold bait, s'more kits. Culver's was out there. There's a lot of
work that goes into this. You know just showing up for a few hours and Culver's has always
been there and a big supporter of our special events in the community so a big thanks to them.
Our Park and Rec Commission, they volunteer their time in helping out in the ticket area. They
help out in the food concessions and beverage concessions so a big thanks to them. Chairman
Cole Kelly was our emcee again this year. He does a fantastic job of emceeing the event and
keeping everybody up to date on fish caught. The door prizes and so I appreciate his efforts and
all the volunteers that participated in the event so just a great event and perfect. No injuries.
That's always good and Todd's got a great team out there and do a fantastic job.
Councilman Campion: I'd like to second those thanks. It was a pretty awesome event. I've
been a couple times in years past but I brought my 4 year old out there who had never ice fished

6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal
misdemeanor.
7. This permit shall expire with the completion of the site improvements approved by this
permit.

As a follow up to our last email correspondence regarding the MMW site improvements, I'd like to thank you
for addressing the landscape concerns around the tennis courts. This fall we were very surprised to see
numerous evergreens planted around the tennis courts which should provide a much improved buffer. We
appreciate that follow up and look forward to ensuring that these take good root this next year.
In addition, we have reviewed the new proposal for the widening of the drive lane and the other site grading
changes proposed for MMW (public hearing tonight). In general, we agree with the recommendations made by
City staff should the project move forward. As a neighborhood, we discuss concerns about the increased traffic
on 41 and the speed of the traffic especially around the school and cross walk at Chaska Rd. Has the City or
MnDOT studied the impact of reducing the speed limit on highway 41 as a way to better manage the congestion
and safety?

Mr. Generous,
I am writing regarding the proposed development at Minnetonka Public Schools 6421 Hazeltine Boulevard
(MMW). As a neighbor to this property, I am generally supportive of the proposal and the recommendations of
the city staff. Of particular importance to me and my neighbors is the landscaping plan which was absent in the
proposal. I am glad that the staff highlighted this in the report and made the submittal of a plan
mandatory. Although we could not determine if the staff was recommending a landscaping plan that was under
the minimum code requirements. We would strongly recommend that the landscaping plan at least meet the
code minimum if not exceed it. Exceeding the code minimum would be welcomed considering that the parking
lot is replacing an area that has substantial natural plants, trees and other wildlife.
In addition, we would like to recommend that the City and School review this landscaping and the rest of the
landscaping around the tennis courts for a period of at least 2 years to ensure that the landscaping has
successfully taken root. We have been very disappointed in the landscaping that was done during the
development of the tennis courts a few years ago where —5 evergreen trees were planted too close to the
perimeter fence and the majority of them died within 1 year and were never replaced. The result is now a
series of dead evergreens surrounded by invasive buckthorn and other invasive vines which do not achieve a
good landscape buffer for the large chain link fencing associated with the courts.

On January 27, 2014, the Chanhassen City Council approved Interim Use Permit #2014-01 for site
grading in excess of 1,000 cubic yards to allow a parking lot expansion and stormwater
improvements on the south side of the school building as part of the swimming pool project within
the building.
On January 24, 2011, the Chanhassen City Council approved the interim use permit to permit site
grading for the tennis courts at Minnetonka Middle School West, Planning Case #2011-01.
On February 27, 2006, the Chanhassen City Council approved Interim Use Permit #2006-03 to
permit the grading of approximately 3,400 cubic yards for an infiltration basin and drainage swales
to reduce downstream erosion and sedimentation along Highway 41.
On June 9, 2003, the Chanhassen City Council approved Interim Use Permit #2003-02 to permit
grading in excess of 1,000 cubic yards to install a storm water pond and reconfigure the bus
circulation route and parking area on the north side of the school.
The applicant is requesting an interim use permit for 2,100 cubic yards of grading for site
improvements. The proposed project includes widening the driveway, drainage improvements by
the pond near the tennis courts and at the southwester comer of the building and parking lot
improvements.

GRADING AND DRAINAGE
This IUP permit is for 2,100 cubic yards of grading. The proposed project includes widening the
driveway, drainage improvements by the pond near the tennis courts and at the southwestern
comer of the building and parking lot improvements.
The existing driveway for the school is a crowned drive that directs runoff to the gutter on either
side of the roadway where it is collected at catch basins to enter the stormwater system for this
part of TH 41. The proposed widened driveway design shall add a drainage structure along the
new gutter line of the widened drive which will tie into this same system. MnDOT will require a
drainage permit for this work. The applicant's engineer shall adjust the slope of the expanded
drive lane to convey runoff to the northeast gutter line before entering the catch basins.
The main parking lot existing drainage is served by several catch basins to collect the runoff for
discharge into the stormwater pond near the tennis courts. Grading changes are proposed for this
parking lot but the catch basin elevations will be adjusted with the parking lot mill and overlay.
The southwest comer of the school's recent addition has been experiencing some drainage
issues, with water ponding near the comer of the building. The applicant has proposed
constructing a concrete valley gutter on the South Drive from near the building corner to the
catch basin that was originally intended to collect that run-off. While a valley gutter would
likely alleviate the drainage issue, staff is concerned about the long-term maintenance
implications such as pavement heaving or cracking bituminous when placing a concrete material
in the bituminous drive lane. Staff recommends examining other methods to direct stormwater
away from the building.
The plan set shall be revised to consistently show the proposed and existing contours updated
since the last IUP was issued. An as -built grading plan is required at the completion of site
grading to ensure compliance with the approved grading plan.
Staff will require that the applicant provide a proposed haul route for review and approval.
EROSION CONTROL
The applicant shall submit an erosion control plan for this work per City Code 19-154 that shall
include, but not be limited to, silt fence on downslopes and inlet protection for nearby structures.
A $5,000 escrow to guarantee restoration and erosion control measures will be required with the
permit.
STORMWATER UTILITIES
The project will also include construction of draintile, two new catch basins and a storrnwater
pipe near the pond and tennis courts. This new system will tie into an existing catch basin that
outlets into the stormwater pond. The plans must be revised to label the catch basins to match
the CB/MH Schedule on Page C5. Slopes shall be labeled on all proposed pipes. The note for
the draintile shall be revised so that no sock is used on the draintile. It is city staff's experience
that a sock will clog with sediment and prevent the draintile from functioning per design.

DRIVEWAY
The school's driveway provides the school direct access to TH 41. The city has received
comments from MnDOT on how this project will tie into their Trunk Highway. The applicant
shall review MnDOT's letter, included in the staff report. The design shall be revised to
incorporate MnDOT comments, which are summarized below:
• The mill and overlay project would trigger ADA improvements at TH 41 including
completing the trail to the comer along with a pedestrian curb ramp.
• The plans don't show the crosswalk pavement markings being replaced.
• A drainage permit is required.
• The proposed development will need to maintain or reduce existing drainage rates to
MnDOT right of way.
• The project developer will need to submit the most current construction plans and
existing/proposed hydraulic computations for the 10 and 100 -year rainfall events
verifying that all existing drainage patterns and systems affecting MnDOT right of way
will be perpetuated.
• A work in right of way permit is required.
On the west side of TH 41, opposite the school's driveway, the Beehive Homes 2°d Addition is
under construction. When construction is complete, its access will be aligned with the school's
driveway access. In the future, that access is intended to become a public street when the
adjacent property is developed. Staff recommends the applicant consider pavement markings at
the access at TH 41 to accommodate the through movement.
The parking spaces and aisles must be adjusted to meet the Chanhassen City Code requirements
of 9 -foot by 18 -foot minimum stall dimensions, as well as the 26 -foot wide driving aisles for 90 -
degree parking spaces.

peak times (See Figure 1). The outside
travel loop will accommodate busses,
while the parking area inside the parking
islands will be for automobile traffic.
The parking lot plan includes installation of
vehicle gates at the northeast and southeast
comers of the parking lot to assist with
maintenance access. The applicant has also
indicated that the vehicle gates may be used to
accommodate longer queue lengths during peak
times (not shown on the proposed traffic
layout).

The plan must follow all applicable
State and Federal guidelines,
including ADA standards for the
sidewalk reconstruction.
LANDSCAPING
Minimum requirements for the parking lot landscaping at Minnetonka Middle School West
include installing two landscape islands within the reconfigured parking area to replace the
existing landscape island proposed to be removed. Landscape islands are required in all parking
lots. Each island shall have an interior perimeter width of 10 feet and contain two trees each.
The islands are required by ordinance and correspond to the existing parking lot landscaping on
site.
Staff recommends that the Planning Commission approve the interim use permit to permit
grading in excess of 1,000 cubic yards to allow a parking lot alteration, widen the main
entrance/exit driveway and stormwater improvements subject to the following conditions:
1. The applicant's engineer shall adjust the slope of the expanded drive lane to convey runoff to
the northeast gutter line.
2. The plans must be revised to label the catch basins to match the CB/Ml-1 Schedule on Page
C5.
3. Slopes shall be labeled on all proposed pipes.
4. The note for the draintile shall be revised so that no sock is used on the draintile.
5. The applicant shall submit an erosion control plan (including additional detail plates) for this
project per City Code § 19-154.

AND RECOMMENDATION
IN RE:
Application of Minnetonka Public Schools District 276 for an Interim Use Permit to permit
grading in excess of 1,000 cubic yards (Planning Case #2016-03).
On January 19, 2016 the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Minnetonka Public Schools District 276 for an interim use
permit to allow a parking lot alteration, widen the main entrance/exit driveway, and stormwater
improvements for the property located at 6421 Hazeltine Boulevard. The Planning Commission
conducted a public hearing on the proposed interim use which was preceded by published and
mailed notice. The Planning Commission heard testimony from all interested persons wishing to
speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned OI, Office Institutional District.
2. The property is guided by the Land Use Plan for Public/Semi-Public use.
3. The legal description of the property is:
The Southwest Quarter (SW Y.) of the Northwest Quarter (NW Y,) of Section Three (3),
Township One Hundred Sixteen (116), Range Twenty Three (23) West, according to the U.S.
Goverment Survey thereof, excepting therefrom the 35/100ths acres conveyed by deed
recorded in the office of the Register of Deeds of Carver County, Minnesota, in Book 8 of
Deeds, page 400, and that part thereof conveyed by deed recorded in the office of the Register
of Deeds of Carver County, Minnesota, in Book 41 of Deeds, page 322, and subject to the
right, title and interest of the State of Minnesota in that strip of land conveyed by deed
recorded in the office of the Register of Deeds of Carver County, Minnesota, in Book 33 of
Deeds, page 25.
Also, that part of Lot E, Bardwell Acres, not conveyed by said deed recorded in the office of

4. When approving an interim use permit the city uses the standards for a conditional use permit,
the city must determine the capability of a proposed development with existing and proposed
uses. The general issuance standards of the conditional use Section 20-232, include the
following 12 items:
a. The grading operation will not be detrimental to or endanger the public health, safety,
comfort, convenience or general welfare of the neighborhood or the city. The site work
will result in the creation of a better queuing opportunity at the site exit, alter parking and
improve the storm water management system which will improve water quality.
b. The grading operation will be consistent with the objectives of the city's comprehensive
plan and the zoning code providing additional stone water treatment. The earthwork will
be maintaining the site in a form suitable for institutional use which is compatible with
the Comprehensive Plan and the zoning code.
c. The grading operation will be designed, constructed, operated and maintained so to be
compatible in appearance with the existing or intended character of the general vicinity
and will not change the essential character of that area because the site improvements will
improve the use of the site as well as improve water treatment.
d. The grading operation will not be hazardous or disturbing to existing or planned
neighboring uses because the grading and drainage will be contained within the site
perimeters. Hours of operation are limited and specific conditions of approval will be in
place and enforced by the city.
e. The grading operation will be served adequately by essential public facilities and services,
including streets, police and fire protection, drainage structures, refuse disposal, water
and sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use. The grading is temporary which does not need to be served by public
facilities and services. The proposed grading will improve storm water management in
this area.
f. The grading operation will not create excessive requirements for public facilities and
services and will not be detrimental to the economic welfare of the community since this
site already contains a school.
g. The grading operation will not involve uses, activities, processes, materials, equipment
and conditions of operation that will be detrimental to any persons, property or the
general welfare due to excessive production of traffic, noise, smoke, fumes, glare, odors,
rodents, or trash. The conditions of the approval will provide standards by which the
activities should be minimized.
h. The grading operation will have vehicular approaches to the property which do not create
traffic congestion or interfere with traffic or surrounding public thoroughfares. Through
the use of signage, limits on the hours of operation, and the limited nature of the
operation, traffic impacts will be limited.
i. The grading operation will not result in the destruction, loss or damage of solar access,
natural, scenic or historic features of major significance. The grading operation is
limited.

j. The grading operation will be aesthetically compatible with the area since the grading and
re -vegetation of the site will improve the site storm water management.
k. The grading operation will not depreciate surrounding property values since the plan will
improve the site and its impacts on the surrounding properties.
1. The grading operation will meet standards prescribed for certain uses as provided in
Chapter 7, Article III of the Chanhassen City Code.
5. The planning report #2016-03 dated January 19, 2016, prepared by Stephanie Smith, et al, is
incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the interim use
permit to permit grading in excess of 1,000 cubic yards to allow a parking lot alteration, widen the
main entrance/exit driveway and stormwater improvements.

As a follow up to our submittal of the Interim Use Permit and Earthwork Permit
Applications last week, along with the supporting plans and documents for the
proposed project at Minnetonka Middle School West, I acknowledge the following
for the proposed project:

convenience, or general welfare of the neighborhood or the city.

Would you please send me the plans for widening the entrance/exit to Minnetonka Middle School West? Or at
least a link directly to the plan?
I went to Chanhassen City's project page and was unable to find a plan for the widening of the entrance/exit to
MMW.
Specifically, I'm interested in knowing how many trees will be removed from MMW property. But I'm
interested in the overall plan as well. I m concerned with the timing of this plan.
We've lived at 6405 Melody Lane since 1999. Our house is adjacent to the entrance/exit to MMW. I was living
here during the last changes to the entrance/exit and parking lot. It was a nightmare. We were unable to be
outside almost the entire summer due to noise and dirt.
Allowing more and more cars at Minnetonka Middle School West is not the solution. Widening the driveway is
not the solution. There are too many cats coming to the school after school and there are too many cars on
Highway 41. A signal light at the entrancelexit to the school would be a better solution. Limiting the number of
cars at the school would be a better solution. Eliminating unused buses would be a better solution.
As long as the only entrancelexit to Minnetonka Middle School West is Highway 41, there will be traffic issues
at MMW in the morning and the evening. Highway 41 is very busy, talk to the State Patrol who direct traffic
from Westwood Community Church at certain times during the week.
Please do more work in understanding this issue. It has been ongoing for over 20 years. New people come into
jobs and think they have the answers. Look at the history. This isn't a new issue.
Concern today is the lack of outdoors our children are in. How much more green space is MMW going to give
up?
MMW is a school more concerned about cars and buses than the outdoor appeal and education of children.
At least talk to the State Patrol and see what the officers that direct traffic on Highway 41 suggest.

Water Resources.
A drainage permit is required. The proposed development will need to maintain or reduce existing
drainage rates to MnDOT right of way. The project developer will need to submit the most current
construction plans and existing/proposed hydraulic computations for the 10 and 100 year rainfall events
verifying that all existing drainage patterns and systems affecting MnDOT right of way will be

2. Three (3) sets of full size plans. Although submitting seven sets of full size plans will expedite the

MnDOT Drainage Permits Checklist
Purpose of the MnDOT Drainage Permit
MnDOT Metro District regulates activities that impact its drainage systems and its MS4
regulated area. The purpose of the Drainage Permit is to protect State of Minnesota
investment in infrastructure including but not limited to roadways, storm water treatment
basins, ditches and storm sewer systems. $xeess storm water and/or sediment laden storm
water added to MnDOT's drainage systems leads to degradation of these assets. Negative
impacts include but are not limited to: sediment deposition, loss of flood storage capacity
and also loss of hydraulic conveyance capacity. These impacts may cause premature
flooding of the road surface and/or erosion damage on State right-of-way.
Technical Requirements of the MnDOT Drainage Permit
The permit applicant shall demonstrate that offsite runoff coming to MnDOT drainage
system and/or right-of-way will not increase as a result of the proposed project. This is
quantified as a "no increase in discharge" criteria for the 2 -year, 10 -year and 100 -year
storm events. Compliance is demonstrated by applying hydraulic/hydrologic software
models. HydroCAD and XPSWMM are the approved models to compare the pre and post
project discharge values. Typically, HydroCAD is sufficient to model most proposed
projects. However, XPSWMM may be required if the project contains extensive storm
water pipe systems connected to MnDOT storm sewer or if HydroCAD cannot in
MnDOT's judgment effectively model pressure flow, complex junctions and/or
backwater effects that are present. The 2 -year, 10 -year and 100 -year storm events shall be
based upon Atlas 14 runoff amounts per the NOAA website.
In addition, Drainage Permit Applicants shall meet all applicable water quality treatment
requirements established by the local Watershed District(s) and the MPCA.
Permit applicants should anticipate that specific projects that seek to divert runoff to
another sub -watershed or watershed will be denied. It is MnDOT practice to avoid such
watershed diversions whenever practicable.
Submittal Requirements:
Readablellegible watershed maps that show pre and post nroiect drainaee
conditions. These two separate contour maps shall be large enough in scale so that
approximate flow paths can be determined for verifying the Time of
Concentrations used in the models. The drainage/watershed maps shall include
enough detail so that Curve Numbers used in the hydraulic models may be

• Surface water flow direction and storm water pipe water flow direction shall be
indicated on the pre and post project watershed maps.
Minimum recommended watershed map scale is 1" =100'. Project applications
submitted with smaller scales (e.g., 1"=500') may be rejected and returned to the
applicant. The same would apply for project watershed maps that do not include
topographic contours or basic land use information such as the location of
buildings, pavement and "green space". Watershed maps submitted as pdf files or
CAD files shall be readily printable at scales that allow for good readability.
• Pre and post project watershed maps shall be clearly linked to the drainage
models such that the names of the sub -watersheds, ponds and drainage structures
are the same in the models as shown on the watershed maps. In addition,
watershed and sub -watershed boundaries shall be clearly shown.
• Submission of the actual pre and post project HydroCAD or XPSWMM models is
required: pdf copies of the drainage model simulations are unacceptable. In the
event that the models cannot be transferred readily by electronic mail or electronic
repository site, a hardcopy CD shall be provided.
• Curve numbers shall be determined per NRCS methodology and should be
modified as needed based upon detailed knowledge of soil type and specific
conditions on site. HydroCAD modeling software includes NRCS guidance for
determining curve numbers based upon land use and condition.
• Time of concentration (Tc) computations and assumptions that in MnDOT's
assessment clearly overestimate or underestimate this critical runoff parameter
will be rejected. Two common assumptions that lead to overestimating Tc
include: using the "Lag/CN" method to determine peak runoff from watersheds
that have a relatively long and/or diverse flow path, and assuming that sheet flow
occurs for a distance exceeding100 feet. Conversely, pre -project Tc shall not be
underestimated to offset post project increases in peak discharge.
• Available freeboard for existing and proposed treatment ponds shall be shown on
the watershed maps as well as the normal and 100 -year high water levels. All
proposed pond treatment systems along MnDOT right-of-way shall have a
minimum freeboard of 2.0 feet between the road surface and the proposed
100 -year H WL.
• Infiltration basins, filtration basins and ponds adjacent to MnDOT right-of-way
shall be designed to provide at least 2 feet of elevation difference between the
100 -year HWL and the crest of the basin berm. The berm crest shall be at least 5
feet wide. The emergency overflow shall be lined from crest to toe of slope with
Turf Reinforcement mat or Category 6 or 7 Erosion Control Blanket.

• Best management practices (BMP's) including infiltrationtfiltration sites, storm
water ponds, etc. shall be clearly labeled on the pre and post project watershed
maps.
• Plan sheets submitted as watershed maps shall be evaluated as such. They shall be
readable and legible and meet all the same requirements including clear
delineation of watershed boundaries, readable map scale, and land use shown by
an aerial photo background map, or that is clearly depicted based on details on the
plan sheet or sheets submitted.
• Project plan sheets relevant to the Drainage Permit are required and include:
existing site conditions, the proposed grading plan as well as proposed site
drainage system plans and profiles. The plans shall include applicable wetland
impact/mitigation features and temporary sediment and erosion control measures
for the project. In addition, erosion control blanket will be used to stabilize
disturbed area on MnDOT right-of-way unless other methods such as rip -rap
treatment are called for in the plans and approved by MnDOT.
• Pond and basin special structures including weirs and orifices shall be consistent
with what is used in the HydroCAD or XPSWMM models submitted and include
relevant calculations/details.
• A table summary of existing versus proposed site discharge to MnDOT drainage
system/right-of-way is required for the 2 -year, I0 -year and 100 -year Atlas 14
rainfall events.
• Post project storm water discharge to MnDOT ditches or other open channel shall
be limited to flow velocities of 6 fps or less for a 50 -year Atlas 14 rainfall event.
• Project discharge points that will connect to MnDOT ditch or channel shall be
located such that they do not cause erosion or conflict with the grade of the
existing ditch or channel.
• Proposed access road culverts on MnDOT right-of-way shall be designed for the
10 -year Atlas 14 rainfall event unless they are part of a significant drainage ditch
along the roadway in which case a 100 -year or 50 -year design will apply.
• Direct connections to MnDOT storm system shall be avoided. Connection to open
ditch, or channel is preferred. If direct storm sewer connections cannot be
avoided, it is the applicant's responsibility to provide a good connection typically
via a new structure. Furthermore, MnDOT offers no warranty that there will not
be a hydraulic backwater effects on the new storm line upstream that is connected
to MnDOT's existing storm sewer.

• For all disturbed areas that sheet flow to MnDOT right-of-way and any disturbed
areas within MnDOT right-of-way, either Erosion Control Mat or Bonded Fiber
Matrix shall be used for temporary/permanent erosion control.
• Silt fence shall not be used for erosion control at the proposed project site
perimeter. Rather, continuous Wood Chip or compost Sediment Control Logs
shall be implemented.
Permit applicants are encouraged to contact MnDOT Metro Water Resource Engineering
with questions/concerns. Questions posed early in the permit application process help to
avoid project delays. This is particularly true for large project Drainage Permits with
significant complexity.

INTERIM USE PERMIT #2016-03
1. Permit. Subject to the terms and conditions set forth herein, the City of Chanhassen
hereby grants an interim use permit for the following use:
To permit grading in excess of 1,000 cubic yards to allow a parking lot alteration, widen the
main entrance/exit driveway, and stormwater improvements. The grading plan was
prepared by hispec, Inc., dated Revised October 23, 2015.
2. Pro . The permit is for property situated in the City of Chanhassen, Carver County,
Minnesota, and legally described as shown on the attached Exhibit A.
3. Conditions. The permit is issued to import fill to the site subject to the following
conditions:
a. The applicant's engineer shall adjust the slope of the expanded drive lane to convey
runoff to the northeast gutter line.
b. The plans must be revised to label the catch basins to match the CB/MH Schedule on
Page C5.
c. Slopes shall be labeled on all proposed pipes.
d. The note for the draintile shall be revised so that no sock is used on the draintile.
e. The applicant shall submit an erosion control plan (including additional detail plates)
for this project per City Code §19-154.
f. A $5,000 escrow to guarantee restoration and erosion control measures will be
required with the permit.
g. Staff will require that the applicant provide a proposed haul route for review and
approval.

h. An as -built grading plan is required at the completion of site grading to ensure
compliance with the approved grading plan.
i. MnDOT comments shall be incorporated into the plans.
j. The parking spaces and aisles must be adjusted to meet the Chanhassen City Code
requirements.
k. The parking lot design shall be revised to provide a travel path for north -south
pedestrians.
1. The applicant shall submit documentation to the city for how the queues will lay out
with use of the gates.
m. The plan must follow all applicable State and Federal guidelines.
n. The applicant shall install a total of two islands in the reconfigured parking area and a
minimum of four deciduous trees.
o. The interior width of the landscape islands or peninsulas shall be 10 feet.
p. The applicant shall install perimeter landscaping to correspond to existing parking lot
site conditions.
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit.
5. Lance. If within one year of the issuance of this permit the authorized construction has
not been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal
misdemeanor.
7. This permit shall expire with the completion of the site improvements approved by this
permit.

compliance with Minnesota Statute 505.03, subdivision 2, Plats. Before any further development, please

Water Resources:
A drainage permit is required. The proposed development will need to maintain or reduce existing
drainage rates to MnDOT right of way. The project developer will need to submit the most current
construction plans and existing/proposed hydraulic computations for the 10 and 100 year rainfall events
verifying that all existing drainage patterns and systems affecting MnDOT right of way will be

metrodevreviews.dotngstate.mn.us provided that each separate e-mail is under 20 megabytes.
2. Three (3) sets of full size plans. Although submitting seven sets of full size plans will expedite the

MnDOT Drainage Permits Checklist
Purpose of the MnDOT Drainage Permit
MnDOT Metro District regulates activities that impact its drainage systems and its MS4
regulated area. The purpose of the Drainage Permit is to protect State of Minnesota
investment in infrastructure including but not limited to roadways, storm water treatment
basins, ditches and storm sewer systems. Excess storm water and/or sediment laden storm
water added to MnDOT's drainage systems leads to degradation of these assets. Negative
impacts include but are not limited to: sediment deposition, loss of flood storage capacity
and also loss of hydraulic conveyance capacity. These impacts may cause premature
flooding of the road surface and/or erosion damage on State right-of-way.
Technical Requirements of the MnDOT Drainage Permit
The permit applicant shall demonstrate that offsite runoff coming to MnDOT drainage
system and/or right-of-way will not increase as a result of the proposed project. This is
quantified as a "no increase in discharge" criteria for the 2 -year, 10 -year and I00 -year
storm events. Compliance is demonstrated by applying hydraulic/hydrologic software
models. HydroCAD and XPSWMM are the approved models to compare the pre and post
project discharge values. Typically, HydroCAD is sufficient to model most proposed
projects. However, XPSWMM may be required if the project contains extensive storm
water pipe systems connected to MnDOT storm sewer or if HydroCAD cannot in
MnDOT's judgment effectively model pressure flow, complex junctions and/or
backwater effects that are present. The 2 -year, 10 -year and 100 -year storm events shall be
based upon Atlas 14 runoff amounts per the NOAA website.
In addition, Drainage Permit Applicants shall meet all applicable water quality treatment
requirements established by the local Watershed District(s) and the MPCA.
Permit applicants should anticipate that specific projects that seek to divert runoff to
another sub -watershed or watershed will be denied. It is MnDOT practice to avoid such
watershed diversions whenever practicable.
Submittal Requirements:
Readable/legible watershed maps that show pre and post project drainage
conditions. These two separate contour maps shall be large enough in scale so that
approximate flow paths can be determined for verifying the Time of
Concentrations used in the models. The drainage/watershed maps shall include
enough detail so that Curve Numbers used in the hydraulic models may be
verified by MnDOT.

• Surface water flow direction and storm water pipe water flow direction shall be
indicated on the pre and post project watershed maps.
Minimum recommended watershed map scale is 1" =100'. Project applications
submitted with smaller scales (e.g., 1"=500') may be rejected and returned to the
applicant. The same would apply for project watershed maps that do not include
topographic contours or basic land use information such as the location of
buildings, pavement and "green space". Watershed maps submitted as pdf files or
CAD files shall be readily printable at scales that allow for good readability.
• Pre and post project watershed maps shall be clearly linked to the drainage
models such that the names of the sub -watersheds, ponds and drainage structures
are the same in the models as shown on the watershed maps. In addition,
watershed and sub -watershed boundaries shall be clearly shown.
• Submission of the actual pre and post project HydroCAD or XPSWMM models is
required: pdf copies of the drainage model simulations are unacceptable. In the
event that the models cannot be transferred readily by electronic mail or electronic
repository site, a hardcopy CD shall be provided.
• Curve numbers shall be determined per NRCS methodology and should be
modified as needed based upon detailed knowledge of soil type and specific
conditions on site. HydroCAD modeling software includes NRCS guidance for
determining curve numbers based upon land use and condition.
• Time of concentration (Tc) computations and assumptions that in MnDOT's
assessment clearly overestimate or underestimate this critical runoff parameter
will be rejected. Two common assumptions that lead to overestimating Tc
include: using the "Lag/CN" method to determine peak runoff from watersheds
that have a relatively long and/or diverse flow path, and assuming that sheet flow
occurs for a distance exceeding100 feet. Conversely, pre -project Tc shall not be
underestimated to offset post project increases in peak discharge.
• Available freeboard for existing and proposed treatment ponds shall be shown on
the watershed maps as well as the normal and 100 -year high water levels. All
proposed pond treatment systems along MnDOT right-of-way shall have a
minimum freeboard of 2.0 feet between the road surface and the proposed
100 -year HWL.
• Infiltration basins, filtration basins and ponds adjacent to MnDOT right-of-way
shall be designed to provide at least 2 feet of elevation difference between the
100 -year HWL and the crest of the basin berm. The berm crest shall be at least 5
feet wide. The emergency overflow shall be lined from crest to toe of slope with
Turf Reinforcement mat or Category 6 or 7 Erosion Control Blanket.

• Best management practices (BMP's) including infiltration/filtration sites, storm
water ponds, etc. shall be clearly labeled on the pre and post project watershed
maps.
• Plan sheets submitted as watershed maps shall be evaluated as such. They shall be
readable and legible and meet all the same requirements including clear
delineation of watershed boundaries, readable map scale, and land use shown by
an aerial photo background map, or that is clearly depicted based on details on the
plan sheet or sheets submitted.
Project plan sheets relevant to the Drainage Permit are required and include:
existing site conditions, the proposed grading plan as well as proposed site
drainage system plans and profiles. The plans shall include applicable wetland
impact/mitigation features and temporary sediment and erosion control measures
for the project. In addition, erosion control blanket will be used to stabilize
disturbed area on MnDOT right-of-way unless other methods such as rip -rap
treatment are called for in the plans and approved by MnDOT.
• Pond and basin special structures including weirs and orifices shall be consistent
with what is used in the HydroCAD or XPSWMM models submitted and include
relevant calculations/details.
• A table summary of existing versus proposed site discharge to MnDOT drainage
system/right-of-way is required for the 2 -year, 10 -year and 100 -year Atlas 14
rainfall events.
• Post project storm water discharge to MnDOT ditches or other open channel shall
be limited to flow velocities of 6 fps or less for a 50 -year Atlas 14 rainfall event.
• Project discharge points that will connect to MnDOT ditch or channel shall be
located such that they do not cause erosion or conflict with the grade of the
existing ditch or channel.
• Proposed access road culverts on MnDOT right-of-way shall be designed for the
10 -year Atlas 14 rainfall event unless they are part of a significant drainage ditch
along the roadway in which case a 100 -year or 50 -year design will apply.
• Direct connections to MnDOT storm system shall be avoided. Connection to open
ditch, or channel is preferred. If direct storm sewer connections cannot be
avoided, it is the applicant's responsibility to provide a good connection typically
via a new structure. Furthermore, MnDOT offers no warranty that there will not
be a hydraulic backwater effects on the new storm line upstream that is connected
to MnDOT's existing storm sewer.

• For all disturbed areas that sheet flow to MnDOT right-of-way and any disturbed
areas within MnDOT right-of-way, either Erosion Control Mat or Bonded Fiber
Matrix shall be used for temporary/permanent erosion control.
• Silt fence shall not be used for erosion control at the proposed project site
perimeter. Rather, continuous Wood Chip or compost Sediment Control Logs
shall be implemented.
Permit applicants are encouraged to contact MnDOT Metro Water Resource Engineering
with questions/concerns. Questions posed early in the permit application process help to
avoid project delays. This is particularly true for large project Drainage Permits with
significant complexity.

Application of Minnetonka Public Schools District 276 for an Interim Use Permit to permit
grading in excess of 1,000 cubic yards (Planning Case #2016-03).
On January 19, 2016 the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Minnetonka Public Schools District 276 for an interim use
permit to allow a parking lot alteration, widen the main entrance/exit driveway, and stormwater
improvements for the property located at 6421 Hazeltine Boulevard. The Planning Commission
conducted a public hearing on the proposed interim use which was preceded by published and
mailed notice. The Planning Commission heard testimony from all interested persons wishing to
speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned OI, Office Institutional District.
2. The property is guided by the Land Use Plan for Public/Semi-Public use.
3. The legal description of the property is:

4. When approving an interim use permit the city uses the standards for a conditional use permit,
the city must determine the capability of a proposed development with existing and proposed
uses. The general issuance standards of the conditional use Section 20-232, include the
following 12 items:

a. The grading operation will not be detrimental to or endanger the public health, safety,
comfort, convenience or general welfare of the neighborhood or the city. The site work
will result in the creation of a better queuing opportunity at the site exit, alter parking and
improve the storm water management system which will improve water quality.
b. The grading operation will be consistent with the objectives of the city's comprehensive
plan and the zoning code providing additional storm water treatment. The earthwork will
be maintaining the site in a form suitable for institutional use which is compatible with
the Comprehensive Plan and the zoning code.
c. The grading operation will be designed, constructed, operated and maintained so to be
compatible in appearance with the existing or intended character of the general vicinity
and will not change the essential character of that area because the site improvements will
improve the use of the site as well as improve water treatment.
d. The grading operation will not be hazardous or disturbing to existing or planned
neighboring uses because the grading and drainage will be contained within the site
perimeters. Hours of operation are limited and specific conditions of approval will be in
place and enforced by the city.
e. The grading operation will be served adequately by essential public facilities and services,
including streets, police and fire protection, drainage structures, refuse disposal, water
and sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use. The grading is temporary which does not need to be served by public
facilities and services. The proposed grading will improve storm water management in
this area.
f. The grading operation will not create excessive requirements for public facilities and
services and will not be detrimental to the economic welfare of the community since this
site already contains a school.
g. The grading operation will not involve uses, activities, processes, materials, equipment
and conditions of operation that will be detrimental to any persons, property or the
general welfare due to excessive production of traffic, noise, smoke, fumes, glare, odors,
rodents, or trash. The conditions of the approval will provide standards by which the
activities should be minimized.
h. The grading operation will have vehicular approaches to the property which do not create
traffic congestion or interfere with traffic or surrounding public thoroughfares. Through
the use of signage, limits on the hours of operation, and the limited nature of the
operation, traffic impacts will be limited.
i. The grading operation will not result in the destruction, loss or damage of solar access,
natural, scenic or historic features of major significance. The grading operation is
limited.
J. The grading operation will be aesthetically compatible with the area since the grading and
re -vegetation of the site will improve the site storm water management.
k. The grading operation will not depreciate surrounding property values since the plan will
improve the site and its impacts on the surrounding properties.
1. The grading operation will meet standards prescribed for certain uses as provided in
Chapter 7, Article III of the Chanhassen City Code.
5. The planning report #2016-03 dated January 19, 2016, prepared by Stephanie Smith, et al, is
incorporated herein.
The Planning Commission recommends that the City Council approve the interim use
permit to permit grading in excess of 1,000 cubic yards to allow a parldng lot alteration, widen the
main entrance/exit driveway and stormwater improvements.
