City Review Procedure:
• Subdivisions, Planned Unit Developments, Site Plan Reviews, Conditional and Interim Uses, Wetland Alterations,
Rezonings. Comprehensive Plan Amendments and Code Amendments require a public hearing before the
Planning Commission. City ordinances require all property within 500 feet of the subject site to be notified of the
application in writing. Any interested party is invited to attend the meeting.
• Staff prepares a report on the subject application that includes all pertinent information and a recommendation.
These reports are available by request. At the Planning Commission meeting, staff will give a verbal overview of
the report and a recommendation. The item will be opened for the public to speak about the proposal as apart of
the hearing process. The Commission will close the public hearing and discuss the item and make a
recommendation to the City Counal. The City Council may reverse, affirm or modify wholly or party the Planning
Commission's recommendation. Rezonings, land use and code amendments take a simple majonty vote of the
City Council except rezonings and land use amendments from residential to mmmerdalfindustri
• Minnesota State Statute 519.99 requires all applications to be processed within 60 days unless the applicant
waives this standard. Some applications due to their complexity may take several months to complete. Any
person wishing to follow an item through the process should check with the Planning Department regarding its

IN RE:
Application of City of Chanhassen for a Conditional Use Permit and Site Plan approval for a 60-
foot pole with a 10 foot antenna — Planning Case 2013-05.
On February 5, 2013, the Chanhassen Planning Commission met at its regularly scheduled meeting
to consider the application of the City of Chanhassen for a conditional use permit and site plan
approval for the property legally described as:
Part of LOT 2 of SCHMID'S ACRE TRACTS described as follows:
Commencing at the most Southerly corner of lot 2 then northerly along the southeasterly
line of lot 2 a distance of 413.94' to the point of beginning. Then northwesterly deflecting
to the left 71 degrees for a distance of 260.53,' then northeasterly deflecting to the right
111 degrees a distance of 287.73', then southeasterly deflecting to the right 70 degrees for
a distance of 66.75' to the southeasterly line of lot 2 then southwesterly along the
southwesterly line of lot 2 for a distance of 279.04' to the point of beginning.
The site is located west at the southwest intersection of Minnewashta Parkway and Highway 7.
The Planning Commission conducted a public hearing on the proposed conditional use and site
plan that was preceded by published and mailed notice. The Planning Commission heard
testimony from all interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned O-I, Office and Institutional District.
2. The property is guided by the Land Use Plan for Public/Semi-Public.
3. Section 20-232:
a. Will not be detrimental to or enhance the public health, safety, comfort, convenience or
general welfare of the neighborhood or the city.
b. Will be consistent with the objectives of the city's comprehensive plan and this chapter.
c. Will be designed, constructed, operated and maintained so to be compatible in
appearance with the existing or intended character of the general vicinity and will not
change the essential character of that area.
d. Will not be hazardous or disturbing to existing or planned neighboring uses.

e. Will be served adequately by essential public facilities and services, including streets,
police and fire protection, drainage structures, refuse disposal, water and sewer systems
and schools; or will be served adequately by such facilities and services provided by the
persons or agencies responsible for the establishment of the proposed use.
f. Will not create excessive requirements for public facilities and services and will not be
detrimental to the economic welfare of the community.
g. Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare because
of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash.
h. Will have vehicular approaches to the property which do not create traffic congestion or
interfere with traffic or surrounding public thoroughfares.
i. Will not result in the destruction, loss or damage of solar access, natural, scenic or
historic features of major significance.
j. Will be aesthetically compatible with the area.
k. Will not depreciate surrounding property values.
1. Will meet standards prescribed for certain uses as provided in this article.
4. Section 20-110:
(a) Consistency with the elements and objectives of the city's development guides,
including the comprehensive plan, official road mapping, and other plans that
may be adopted;
(b) Consistency with this division;
(c) Preservation of the site in its natural state to the extent practicable by minimizing
tree and soil removal and designing grade changes to be in keeping with the
general appearance of the neighboring developed or developing areas;
(d) Creation of a harmonious relationship of building and open space with natural site
features and with existing and future buildings having a visual relationship to the
development;
(e) Creation of functional and harmonious design for structures and site features, with
special attention to the following:
1. An internal sense of order for the buildings and use on the site and
provision of a desirable environment for occupants, visitors and general
community;
2. The amount and location of open space and landscaping;
3. Materials, textures, colors and details of construction as an expression of
the design concept and the compatibility of the same with adjacent and
neighboring structures and uses; and
4. Vehicular and pedestrian circulation, including walkways, interior drives
and parking in terms of location and number of access points to the public
streets, width of interior drives and access points, general interior
circulation, separation of pedestrian and vehicular traffic and arrangement
and amount of parking.
(f) Protection of adjacent and neighboring properties through reasonable provision
for surface water drainage, sound and sight buffers, preservation of views, light
and air and those aspects of design not adequately covered by other regulations
which may have substantial effects on neighboring land uses.
5. The planning report #2013-05 dated February 5, 2013, prepared by Sharmin Al-Jaffet al, is
incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the
conditional use permit.

LAW ENFORCEMENT/FIRE DEPARTMENT UPDATE.
Mayor Furlong: Good evening Lieutenant.
Lt. Jeff Enevold: Mr. Mayor, council, good evening. Quick update here for you tonight. And the first
slide is on an update on our prescription drug take back program. Oh, was this supposed to work? Okay.
Alright. Our citizens can now anonymously drop off their unwanted medications during business hours.
We announced this on February 4d' and on February 12'h it was full and we had to empty it so. It's
located in the Public Safety Inspections building in the outer lobby. I just checked it before I came down
here and it's full again so on the short time it's been available it's been very successful for us and it
provides a needed service to our community so glad we got that up here. Quick burglary update. You
may have noticed in the monthly report that compared to January 2012 and January 13d' there's a pretty
big increase in burglaries. It went from 2 to 10 and here's the reason why. On February 3rd Eden Prairie
Police arrested 41 year old Brian Williams who is believed to be responsible for over 60 burglaries in the
area. 8 of them in the city of Chanhassen. Hence 2 to 10. There's the 8 that we've seen so. Our crime
techs were able to lift and photograph 3 different shoe prints from the crime scenes that matched shoes
that were taken from his hotel room so because of the great police work that was done by the responding
deputies to identify and preserve the shoe prints, our crime techs were able to come into the scene and
photograph and lift them as evidence and that's really what allowed us to link Mr. Williams to the crime
scenes here in the city of Chanhassen. He is currently charged with burglary, fleeing police and
possessing burglary tools so job well done by the crime techs and our deputies who responded to the
scene. Last one I have is 1 wanted to introduce a new Sergeant who's working up here. Sergeant George
Pufahl. He came to us from the city of Waconia and I'll let him tell you a little bit about his education,
experience and introduce himself. George.
Sgt. George Pufahl: Hi Mr. Mayor, council.
Mayor Furlong: Good evening.
Sgt. George Pufahl: I'm George Pufahl. I'm a Sergeant with the patrol division. I've been a sergeant for
just over a year now so. I've been with the Carver County Sheriff's Office for about 13 years. Started off
as a reserve officer and part time officer. I've been full time for -just over 10 years now. A lot of my
career has been working dog watch patrol on the west end of the county. Have worked as a detective for
the sheriff's office. I've worked undercover narcotics for the Southwest Metro Drug Task Force. Been a
field training officer, range instructor and I'm currently also assigned to the Southwest, or assigned to the
Tri City SWAT Team. I've been a SWAT team member for the last 8 years so, and you know there's a
little bit of arm wrestling that went on and Susan Arntz was having a difficult time letting me go and so
I'm glad to be here in Chanhassen and work with you folks and work with the City and give the same
service that I was giving to the City of Waconia previous so that's me.

Aanenson: This item is actually, the City's the applicant on this application. It's a request for a
Conditional Use and a site plan review to allow for a 60 foot tower with a 10 foot antenna on top of that
for a utility meter reader. This application is a part of a request by the City to put at the fire station this
tower. And the fire station that we're looking at is on Highway 7 and Minnewashta Parkway, so that's
the subject site. A little bit of background on this. We did a radius search, they did some engineering on
this kind of looking at where we needed to, it's called a propagation study where we needed to have the
meters in order to get coverage of the city and if I may 111just go, oops. Talk a little bit more about the
actual why we're doing the water meter and the City Council approved a contract to replace the City's
water meters. Right now how they're being read is they're actually, you have a vehicle that drives around
and picks up all the radio feeds and in looking at the equipment that we had and trying to replace those as
the batteries have expired, they actually chose to go with a different system after a cost benefit so that
now requires these antennas to be placed throughout the city. So I'll go through a little bit more detail but
a majority of them are on water towers throughout the city. There's 6 other sites. The two sites that will
actually be on other features. There's one at Bandimere Park which is on, there's a siren on already so
this is just an appendix to that but this is now the only free standing one again based on that propagation
study where this needs to go so looking at elevations and public properties that it could go on, this
appeared to be the best site for that so again the City does have the ability with the conditional use to
follow through the criteria in the office institutional zoning district which the subject site is zoned to place
it if it finds the conditions necessary in the staff report based on the fact that looked at the land use. The
use by the City. What the purpose is and reasonableness. The City felt that it met that criteria so where
it's being placed is behind the parking lot. You can see the star on the slide there at the end of the parking
lot so there's no vegetation there. There is no screening. There is minimal equipment but that is actually
going inside the fire station itself so then really what it comes down to is the visual impact so with that the
engineering department took some slides from different positions and it's kind of hard to see but I'll try to
do my best here to show you where you can see the actual antennas. So if you're looking at the parking
lot where it's sitting so in Pipewood Curve it's very hard to see back there. You can see one here on
Meadow Lane. Site 3. Site 4, you're coming westbound on Highway 7 and you can kind of see that off.
Oops, actually over on this site in the distance. From the lift station, number 3 looking across. Again
now what's sitting over there is actually a bucket ladder so it's actually physically, it's got the height
correct but actually the bucket itself is quite a bit bigger. So this is actually if you go down then to the
fire station itself where you would see, what you would see going down Minnewashta Parkway. The

monopole quite a bit smaller. It's actually 1 foot in diameter so it's quite a bit narrower. And then when
you get to some of the neighbors across the street on Landings Court, a little bit less visual impact when
you get over there to see that. I did hand out from you, there was some letters from some of the neighbors
that were concerned about the impact of that and wanted to share that with you regarding some health risk
impacts. Included on the City's website are, is some information regarding that electromagnetic field.
Again this is being read right now via the same method as now there's a tower and just to make, not to
make it too complex, how this works is at night it just, there's a frequency that goes out once a day at
night and has a very short duration to get that read and bring it back. It's not a constant read so there's
also additional information on the City's website under the home page under what's new. There's an
engineering site there that talks about, you can go into and learn a little bit more about the questions you
may. Any of our residents may have on electromagnetic field. So with that, a little bit more close up on
the visual impacts. You can see a little bit closer here. There's the one on Highway 7 coming quite a
distance away. Again less visual impact when you're on the landing side and again the one foot in
diameter on the, by the fire station there. So with that we put the findings for the conditional use in there.
We do believe it meets the intent of the city's ordinance. Again because we didn't have another apparatus
that we could have used there that met the height requirements for the propagation study, we had to put
the monopole in so we believe that it meets the intent of the findings of the conditional use so with that
we are recommending approval of the conditional use. It is also approval of the site plan. We left it, we
didn't color paint it. Sometimes those are maintenance issues. Kind of leave it, trying to blend in and
actually there's a lot of different type of vegetation so trying to paint it blue might not have been the best
so leaving that with a site plan. Again the rest of the equipment's inside the fire station itself so a
conditional use and a site plan so again with the attached Findings of Fact we are recommending approval
for this to go to the City Council. So with that I'd be happy to answer any questions that you may have.
Aller. Am I wrong in assuming that the reason the City Council went with this new program is that it
would be not only more cost efficient but EMF efficient. I mean the whole process is more efficient.
Aanenson: That's correct. It's, the battery life is longer and then it's also more efficient as opposed to
having a vehicle going around. Having the stationary sites so it's double efficient, yeah.
Thomas: I guess I have a question. Are we planning on putting in more within the city as we you know,
more of these as we go to be able to net the whole city?
Fauske: As I think Kate had indicated, touch on, that the other areas of the city where this would be
required they're able to put it on existing equipment like a siren or a water tower and it was just in this
particular area of the city they didn't have anything that was high enough to get above that tree canopy.
Thomas: Sure. I guess what I'm saying is we've got these in other locations.
Fauske: Yes.
Thomas: Around the city. This is not the only spot.
Aanenson: Right.
Thomas: And it's also not the only, we've got other ones currently out there is what I'm getting at, right?
Hokkanen: This is the only free standing one.

Fauske: Correct.
Thomas: But we have other ones that are attached to things and are currently submitting so we can get
the entire city.
Fauske: Yes. Thank you, yes.
Thomas: Okay.
Aanenson: And as we move south, as population increases and if we have other infrastructure, we will
take it into consideration when we provide, there'll be additional water towers as we move south of
Lyman Boulevard, Pioneer Trail so we'll look at, if there's a coverage area based on that propagation
study that we need to based on certain elevations, we'll try to accommodate that on an existing facility,
which is always our first choice too.
Alter: How long have we had the other towers operating? The ones that are on the sirens.
Fauske: Just recently. Council approved the radio reads, I believe it was fall last year. I don't know if
that was included.
Aanenson: Yep, September of last year.
Fauske: Okay, thank you. September of last year so they're now just starting to implement it and as they
started looking at the implementation plan they identified this site as need for an independent structure.
Alter: And as of yet we haven't received any public comment, which was adverse or receive adverse
reactions from the operation of those.
Fauske: Not that I'm aware of but I could certainly follow up on that if the commission would like.
Alter: I just want to give due deference to the concern that's been expressed by the people that have
contacted us about the EMF.
Aanenson: Yeah, and again there is information on that on the City's website. About the level and so I
think if we can direct anybody that's interested in that information to the City's website, it gives you a
little bit about the frequency and the amount.
Hokkanen: Is it clear on the website Kate that it only does it once per day? Per night.
Aanenson: Yes.
Hokkanen: It's not a constant, I mean I apologize. I didn't look at it. I didn't have time but.
Aanenson: That's alright. I'll just quickly look at it. There's a couple of questions regarding that, will
interfere with anything that you may have as a personal, any other device you may have. Cell phone and
it says that the transmitting device operates in a licensed band in compliance with the FCC regulations as
such. Thank you. As such the devices are for local territory so no other radio technology devices operate
in the same frequency so it shouldn't interfere. And then the other one about the associated risks, so with
RF, again this is very low, even less than similar bands so like a television. This discussion came up too

when we did the National Weather Service regarding use of the gamma rays and how the frequency and
duration of that sort of thing so again we're reading right now by radio frequency so it's not a new
technology how we read. We'rejust putting them stationary as opposed to a vehicle driving around and
so again the City's home page has a lot of those things on there too and if anybody has more questions on
that I'm sure our City Engineer would be happy to talk to somebody about that too.
Alter: But otherwise it would have to comply with and does comply with the normal tower requirements?
Aanenson: Yes, and then the radio frequency stuff too also has to be in FCC compliance too so.

Bill Cook: Yep. My name is Bill Cook. I live on Landings Drive. 3748 so in the neighborhood where
this is going and I just found out about it today so I haven't done a lot of research. One of my neighbors
sent me an email. I think he sent an email.
Aanenson: Yep, I passed it out
Bill Cook: Okay. I think our concern is that, not against the technology because I'm not a luddite. I
embrace technology but just in terms of this one is different than the other ones as I understand it. It's not
on a water tower. It's essentially at ground level in our neighborhood and we're concerned about you
know the health, possible health impacts of that and I know as you mentioned there's stuff on the City's
website but as you saw with my neighbor, there are a lot of other, there's another view on that in terms of
these transmissions so this isn't up in the air. It's essentially in our neighborhood.
Alter: I think my understanding is that the reason for the tower, what we're doing is we're, with the
request here would be to put in a tower to put it up.
Bill Cook: Yeah I understand but that's 60 feet. That's 5 stories. That's not a water tower
Alter: What's the difference? I think they're equivalent.
Bill Cook: Well there's elevation of the houses in our neighborhood as well so.
Alter: Oh okay, I got you. Alright. Have we looked at the impact of that or?
Fauske: I'm sorry, could you clarify the question? I don't know that question.
Bill Cook: I understand all, if I understand correctly, the rest of these are on water towers.
Aanenson: No, there's one other one that's on a monopole that's in a park. Bandimere Park in a
residential area.
Bill Cook: So this is the only one in the neighborhood that's essentially not on a water tower closer to
ground level?
Fauske: It's a stand alone, the Bandimere Park one is on an emergency siren so it'd be of a similar height,
yes.

Fauske: Yes, and there are water towers in neighborhoods too. Downtown Chanhassen has a water
tower.
Bill Cook: Okay it's, from my house it will probably be essentially at eye level, okay.
Fauske: Out of an upper story, okay. I understand. Well I guess it would depend, I apologize. I don't
know the elevation that your house sits at with respect.
Bill Cook: Well you know and I'm not going to, I'm not arguing the elevation. It's just in terms of the
possible health risks. That's the question that we're raising, some of us as neighbors and you know he
sent a number of references expressing that concern so I mean I'm not sure what that the solution is. I
just went here to sort of speak for myself, my family and for some of the other neighbors that we have a
concern about it.
Aanenson: And Chairman I can follow up on that. Before this item appears before the City Council
additional information, again I'll relate back to when we did the National Weather Service. Same kind of
you know when we were doing that. This has once a day is when they're doing the, and my
understanding it's going to be around midnight that they'll do a very short blast to get the read, once a day
but I can provide some additional information for when this item goes to the council or try to contact the
residents with the information to the question we have.
Aller: I think that would be a good thing for the City Council to have before they make their final
decision on it. And we certainly appreciate the concern.

Julia Prohaska: And I think my husband had sent an email.
Aanenson: Yes.
Julia Prohaska: He is in, out west at a business meeting and I'm just rolling in from a client appointment
so unfortunately I left my notes in my car but I think Bill and I live in the same neighborhood. We are
directly across the street. Our back yard looks out to the fire station and I spent a lot of time doing a lot of
research on it and I definitely have significant concerns about it. If you look at other states in the country,
California, Wisconsin, Florida, Michigan have all had major debates over this and they're trying to have

laws changed that not only about towers, which are even much more, have a much more possibility of
health dangers, but actually people talking about the actual meters being on their homes and a lot of states
now they're trying to have where you can opt out of it so, and I looked at, there was a study that was, or a
letter that was written in 2012. I don't remember what time of the year it was last year, by 50 different
well, very well respected doctors. I think the main one was from, one of the main ones that wrote the
letter was from the University of New York in Albany but they were doctors and scientists from all
around the world and really talking about, and it was on my husband's email that he sent. Really they
don't agree that these, the frequency is not causing health problems and there's a lot of people that were
talking about if they lived, for instance one I just remember reading is, a husband and wife that lived in a
house that had a meter on it and then they had a second home and she had a lot of health problems when
they were in the house that had a meter and then when they would be at their house the other half of the
year that didn't have, so I think the thing that bothered me was all of the evidence of health problems was,
they would only say to date we're to seeing significant things you know and that doesn't make me feel
very comfortable because we all know that as they find out more on things that you know they find out
dangerous but it takes sometimes years of studies to do. Another thing was you know, I know the World
Health Organization had a, was one of the backers of saying oh no, it's you know, these aren't a problem
but when I looked at their research, the research was from, the most recent was from 2002. It was 1998.
1996. I'm going that's over 10 years ago and so I am very concerned and our house is, our house and our
neighbors next door are by far the very closest to it so my husband and I really, with it being a conditional
use I guess I thought I understood that that has to be the condition met is that there are absolutely no
conditions where it does threaten people's health so.
Aanenson: Can I just make a clarification? I think they're being read by radio frequencies today. That's
how they're operating. So thereis a beam going out. It's going to a vehicle that's driving around so there
is.
Julia Prohaska: Right.
Aanenson: There is, so it's a radio frequency. I think we, I want to make sure that that's clear.
Julia Prohaska: I'm sorry, can you state that again?
Aanenson: Right now your meter is being read by radio frequency. Yeah.
Julia Prohaska: I understand.
Aanenson: Yeah, yeah. So what's moving from a vehicle, what we're doing is replacing what, there's a
short 10 year battery that's not replaceable so they're changing it to a different type. Instead of using a
vehicle to do the cost effective and doing a stationary site that it can be read by.
Julia Prohaska: And that bothers me even more because like in some states where they are not trying to
pass laws, and I'm not sure that they haven't already passed that you have the ability to opt out of having
one of the readers on your house so you have a choice if, most of them they charge a fee if you're going
to opt out of it. With a tower, I don't have a choice. I live there. I built my house there. I can't say well
I'm going to opt out of that tower so you know now I've got a tower which they talk about in the articles
has a lot more potential for danger than just one meter on your house. So now I've got a meter on my
house and a big tower so that's what really bothers me and when they say they're going to be reading
them at midnight, well of course that's when we're all also home you know so I just think there must be
other locations in the area. Whether it would be at the park across the lake. The Arboretum. The, we
have a little park you know several parks down the street from us. Roundhouse Park. Freeman Park.
Another one on Highway 7. Why not put it where people are not living so close to it?

Thomas: It would still, yeah it'd be range but it would still come and come to the house to check, you
know what I mean? To check the meters even if we moved it. You know what I mean? It would still be
at the same level, right? I mean we're putting these at about, so I'm assuming being that I, we do
transmitters at my place of business so I understand about networks and what not. I assume we're putting
these about the same height around the city to be able to capitalize on the range we're trying to create,
because we're basically creating a net which is allow it to feed out and read the signals and bring it back,
right?
Aanenson: Correct.
Thomas: Okay. So if we moved it.
Aller:... signal should be the same.
Thomas: Should be the same, yeah. So if we moved it, it would still be the same.
Aanenson: That's my point. I'm saying it'd still be a radio frequency. I guess that was what I was trying
to explain. Whether it's be a car driving around or if it's a stationary pole, it's still coming to your house
to read the meter so I think that's the part we need to understand and communicate.
Thomas: So I mean I understand what you're saying and I understand the concern and I did a lot of
research about it as well back and forth just to understand about, I mean I kind of basically understood the
things because no one seems to have a good consensus as to whether it's a health risk or not. They've
been studying this since 1990 and no one has a consensus and we're using it for many other things you
know.
Julia Prohaska: Right, and that's the thing too.
Thomas: Cell phones. Your microwaves, you know. All these other things that people are using daily
you know what I mean?
Julia Prohaska: Right, and so now we're just adding another layer and that bothers me and I'm sorry but I
don't agree because in one of the articles by these scientists and doctors, you know world renown people
they were, some of them worked at different cancer institutes. They were public health, all sorts of
different things in the first, I think it's the first link that my husband had on there, they do talk about how
people that actually because in some states or in some areas, I don't know maybe even in Minnesota, they
actually have them inside their house and they said that is, you're getting, you have more of a problem
there than if they're on the outside wall so our's are on an outside wall but they compared having them
inside your house to having again a tower close to you so if, already now I've got one on the outside wall
of my house and then I have a tower across the street from me so you know, that up's it for me. So I
guess like I said, we really spent a lot of time reading it and there's, it's kind of like listening to a weather
report. Tomorrow it may be this. Tomorrow we hope to this. It's that and when you read the
information from the doctors and scientists, they can never say 100% we know this is not going to be you
know, they know that there's levels and actually I had a sister that had a, so maybe I'm a little more
sensitive to it. She had a tumor, a acousticneroma and the doctors said these are the kind that they feel
like they're going to be seeing from cell phone use and she's lost a lot of hearing from it and if you look
at some of what people are saying the health hazards to these, it is. It's brain cancer. It's you know
ringing in your ears all the time and so to me if there's some out there, why do I want to subject even the

tiniest possibility of adding another layer of all the technology you know to my house so I guess that's
you know I just feel like can't they find a different place to put it where people are not, where it's not that
close because there's something about being the closeness because they didn't send it to people that live
1,000 feet away. They only sent it, I think the notices to people that are within.
Aller: The notices in the statute only go to 500 feet.
Fauske: Yeah, it has nothing to do with range.
Aller: No matter what we're doing, it only goes to 500 feet.
Julia Prohaska: Okay. But I do know that when you read the article the closeness of being by the towers
is something that they talk about so.

Aller: I think what we're looking at is the contract's been approved. We're running this system and the
only question is, how do we, do we allow for a tower to go up, similar to.

Aller: It's a matter of we're doing it because they want to put this on it but the question before us, is
whether or not the tower is appropriate and under these circumstances we're doing it, they've looked at
the locations. They've decided that this is the best location so with the understanding that the City
Council will receive more additional information about the EMF's so that they're well versed in that, I
don't see any reason why we shouldn't approve it and move it forward.
Thomas: I agree with you. It's being used within the city. It is currently everywhere. We're looking at
building, putting a tower and that's what it is.

Tennyson: The issue is confined to zoning for us and that's our role so, there are other concerns and the
City Council can, they should hear them.

Water Meter Radio Replacement
Overview
In 2001, the City installed radio devices on all water meters to
obtain water usage remotely from a vehicle on the roadway without
having to go on to private property and physically read the water
meters. This system has served the pity well; however, due to their
age, the units' batteries are failing at a very high rate and the
manufacturer no longer services this equipment.
After reviewing several options, the City Council has decided to
completely replace the water meter radios with newer radio
technology. This system will save money over the long term
and includes enhanced customer service features the old system did
not offer. The new radios have a life expectancy of 20 years.
An experienced meter installation contractor Ferguson Waterworks,
has been hired to install the new radios. City staff will assist Ferguson with replacement of
industrial and commercial meters. Water meters are located inside homes and buildings and, in
most cases, are located in the basement and/or utility room.
The $1.19 million dollar project is expected to be complete by September of 2013. This project is
being funded through water and sewer utility usage fees and therefore there are no upfront costs
to property owners at the time of installation.
This program only affects those properties that are connected to the municipal water supply.
Scheduling A Water Meter Radio Replacement
Beginning the week of February 4, 2013, the first group of notices will be mailed to property
owners asking them to schedule an appointment for when installation is scheduled to begin in their
area. These notices will be sent in three separate groups over the next several months. Owners
will be asked to schedule an appointment spanning a two-hour block of time. Evening and
weekend appointments are available upon request. Please do not try to schedule an appointment
until you have received written notice. Appointments must be scheduled within two weeks of
receiving a written notice.
To install the radio, the installer will need to gain entry to your home or business. The water meter
area must be clear and accessible. The installers need at least three feet around the unit to work.
An adult must be present at the time of installation. Installation should take about 20 minutes to
complete.
All Ferguson Waterworks employees wear uniform shirts and travel in marked
vehicles. Background checks on the Ferguson employees working In Chanhassen have been
completed by the Carver County Sherriffs office. Employees will be issued City ID badges.
For the system to operate effectively, all current equipment must be replaced.

EXECUTIVE SUMMARY
The applicant is requesting a Conditional Use Permit and Site Plan Review to allow a
60-foot tower and 10-foot antenna for a Utility Meter Reader. The site is located at
6400 Minnewashta Parkway (southwest of the intersection of Minnewashta Parkway
and Highway 7).
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on February 5, 2013. The Planning
Commission voted five for and none against a motion recommending approval of the
project. The February 5, 2013 Planning Commission minutes are item la of the City
Council packet.
Radio Frequency
Questions were raised at the Planning Commission meeting about the radio frequency
and if there are any health hazards associated with this technology. The radio
frequency (RF) of the new system is 450 MHz. The old radio read system also used
this radio technology to transmit information. The Food and Drug Administration
(FDA) has classified radiation emitted by devices operating at these RF frequencies
as "non -ionizing". Other types of non -ionizing radiation devices include televisions,
radios, remote controls, and other devices that use visible light and infrared light.
Also, the World Health Organization (WHO) has reviewed this technology has not
found any significant health effects because of this technology, especially at low
voltage. While most radio technologies have used analog signals, modern wireless
telecommunications are using digital transmissions. Detailed reviews conducted so
far have not revealed any hazard specific to different RF modulations. The risk of

adverse health effects for the equipment and data transmission frequency specified for the project
is sufficiently low, considerably less exposure than television, Wi-Fi, and cell phones. Further,
radio and television broadcast stations have been in operation for the past 50 or more years
without any adverse health consequence being established. Frequencies used in FM radio
(around 100 MHz) and in TV broadcasting (around 300 to 400 MHz) are lower than those
employed in mobile telephony (900 MHz and 1800 MHz).
All the new radios use between 1 and 2 watts and are powered by C-cell Lithium batteries that
have a voltage of 1.2 volts DC. The typical transmission of the radio data will be once a day for
a very short time period, less than a second. Once the receiver receives the information the data
is transmitted to City hall via fiber optic or through telephone connections. Over 9.0 million 450
MHz radio devices have been deployed on residential metering applications throughout North
America.
RECOMMENDATION
Staff recommends approval of the request.

PROPOSAUSUMMARY
The applicant is requesting a conditional use permit and site plan approval for the construction of
a 60-foot pole with a 10-foot antenna for a utility meter reader. The pole is proposed to be
situated south of Highway 7 and north of Minnewashta Parkway.
A single 10-foot antenna will be mounted above the 60-foot pole. The pole will have a base of
11.25 inches wide and tapers as it reaches the highest point. The control equipment will be
housed inside the fire station building located on the subject site.
No landscaping is proposed since the site has existing mature tree cover. No trees are proposed
to be removed. The pole will be fully screened by the existing mature trees.
Access to the pole is provided via the parking lot that serves the fire station which is accessed off
of Minnewashta Parkway. Staff is recommending approval with conditions.
BACKGROUND
On September 24, 2012, the City Council approved a contract to replace the City's water meter
radios. These radios are connected to every residential and business water meter in the city and
allow the City to read the meters with a City vehicle equipped with a meter reader. This system
is considered a drive -by system. Most of the City's water meter radio batteries are over 10 years
old and are failing. A cost -benefit analysis was completed for the water meter radio project to
determine a cost-effective and long-term solution for the radios. It was determined the drive -by
meter radios should be replaced with a fixed -based collection system. This system is more
efficient and offers a lot more customer service features then the old system. This system also
has the longest life expectancy. In order for the fixed -based system to collect the water meter

information, collectors need to be installed throughout the City. A propagation study has been
completed by the system manufacturer which identified the need for six collectors. Most of the
collectors can be located on existing water towers or antenna poles owned by the City. However,
no existing city -owned infrastructure in the northwest corner of the City is tall enough to service
this area.
GENERAL. CONDITIONAL USE PERMIT AND SITE PLAN
The applicant is requesting a conditional use permit and a site plan review to construct a 60-foot
monopole with a 10-foot antenna for a utility meter reader. The City's Zoning Ordinance allows
towers and antennas in Office and Institutional Districts subject to the approval of a conditional
use permit by the City Council. In reviewing conditional use permit requests, the Planning
Commission must consider possible adverse affects of the use. The standards are:
The City of Chanhassen finds it necessary for the promotion and preservation of the public
health, safety, welfare, and aesthetics of the community that the construction, location, size, and
maintenance of wireless telecommunication facilities be controlled. Further, the City finds:
(1) Towers and antennas have a direct impact on, and a relationship to, the image of the
community;
(2) The manner of installation, location, and maintenance of towers and antennas affects the
public health, safety, welfare, and aesthetics of the community;
(3) A reasonable opportunity for the establishment of wireless telecommunication must be
provided to serve residential and business needs, and;
(4) Uncontrolled and unlimited towers and antennas adversely impact the image and aesthetics
of the community and, thereby, undermine economic value and growth.
The following constitutes our findings:

There are no existing poles or water towers within the mile radius that can accommodate this
tower. The applicant is requesting approval to erect a monopole because there are no existing
structures of adequate height in this portion of the City.
Staff instructed the applicant to provide images showing the pole in the proposed location. The
following are images taken from several locations around the site:

The north and west side of the parking lot are surrounded by mature trees. These trees are
approximately 40 feet tall. The fire station is on the east side of the parking lot. The properties
on the south side of Minnewashta Parkway, south of the fire station have a finished floor
elevation lower than Minnewashta Parkway. These lots also have mature trees that are along
Minnewashta Parkway which provides screening. Due to the existence of mature trees in the
area and the significant distance to other properties in the area from the proposed pole site, no
additional landscaping is planned. Staff took images showing the pole in the proposed location
using the fire department ladder truck. The top of the fire truck railing is approximately the
height of the proposed pole.
City Code does require new antenna support structures to be designed to accommodate
additional users. Providing opportunities for co -location is important if the total number of
towers in the City is to be kept at a minimum. However, this tower is anticipated to be too short
to accommodate cellular providers. In the future, an intemet communication system may be
installed on the pole to service the fire station. The pole is proposed to be installed at the north
side of the fire station parking lot as shown in this exhibit.
COLLECTOR EOUIPMENT
A small collector equipment box (16" x 20") will be installed inside the fire station so the
equipment is in a controlled environment. No other equipment is needed to be installed outside.
PARKING
Parking is available at the fire station to service the equipment. Staff expects only minimal
vehicle traffic to visit the site for maintenance purposes. Maintenance of the equipment is
anticipated to be completed by the City utility department.
LANDSCAPING
The fire station property is surrounded by mature trees. No trees or vegetation will be removed
to install the pole. Staff is not proposing to plant any additional landscaping screening materials
since the property is heavily wooded.
LIGHTING
The parking lot does not have any lighting. The pole is not planned to add any parking lot
lighting. The pole will not be illuminated by artificial means and does not meet the criteria for
needing strobe lights.
SIGNAGE
No advertising signage or identification of any kind will be placed on the pole.

GRADING/DRAINAGE
Access to the pole will be through the fire station parking lot. No site grading will be needed to
install the pole. The drainage pattern of the fire station property will not change.

The radio meter contractor shall submit to the City a footing pole design and drawing signed by a
registered engineer.
Staff finds that the applicant has met the general standards for all conditional uses and the design
standards for poles.

FINDINGS
Site Plan Findines
In evaluating a site plan and building plan, the City shall consider the development's compliance
with the following:
(1) Consistency with the elements and objectives of the city's development guides,
including the comprehensive plan, official road mapping, and other plans that
may be adopted;
(2) Consistency with this division;
(3) Preservation of the site in its natural state to the extent practicable by minimizing
tree and soil removal and designing grade changes to be in keeping with the
general appearance of the neighboring developed or developing areas;
(4) Creation of a harmonious relationship of building and open space with natural site
features and with existing and future buildings having a visual relationship to the
development;
(5) Creation of functional and harmonious design for structures and site features, with
special attention to the following:
a. An internal sense of order for the buildings and use on the site and
provision of a desirable environment for occupants, visitors and general
community;
b. The amount and location of open space and landscaping;
C. Materials, textures, colors and details of construction as an expression of
the design concept and the compatibility of the same with adjacent and
neighboring structures and uses; and
d. Vehicular and pedestrian circulation, including walkways, interior drives
and parking in terms of location and number of access points to the public
streets, width of interior drives and access points, general interior
circulation, separation of pedestrian and vehicular traffic and arrangement
and amount of parking.
(6) Protection of adjacent and neighboring properties through reasonable provision
for surface water drainage, sound and sight buffers, preservation of views, light
and air and those aspects of design not adequately covered by other regulations
which may have substantial effects on neighboring land uses.

Finding: The proposed development is consistent with the design requirements, the
comprehensive plan, the zoning ordinance, and the site plan review requirements. The
site design is compatible with its surroundings. It is functional.
Conditional Use Permit Findings
When approving a conditional use permit, the City must determine the capability of a proposed
development with existing and proposed uses. The general issuance standards of the conditional
use Section 20-232, include the following 12 items:
1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or
general welfare of the neighborhood or the city.
Fm�dm : The proposed pole will provide a basic utility to the area.
2. Will be consistent with the objectives of the city's comprehensive plan and this chapter.
Finding: The proposed use is consistent with the city's comprehensive plan and generally
complies with city ordinance requirements.
3. Will be designed, constructed, operated and maintained so to be compatible in appearance
with the existing or intended character of the general vicinity and will not change the
essential character of that area
Finding: The proposed pole complies with city ordinance requirements. The pole will be
screened by existing vegetation.
4. Will not be hazardous or disturbing to existing or planned neighboring uses.
Fes: The proposed tower will not be hazardous to existing or planned neighboring
uses.
5. Will be served adequately by essential public facilities and services, including streets, police
and fire protection, drainage structures, refuse disposal, water and sewer systems and
schools; or will be served adequately by such facilities and services provided by the persons
or agencies responsible for the establishment of the proposed use.

testimony from all interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned O-I, Office and Institutional District.
2. The property is guided by the Land Use Plan for Public/Semi-Public.
3. Section 20-232:
a. Will not be detrimental to or enhance the public health, safety, comfort, convenience or
general welfare of the neighborhood or the city.
b. Will be consistent with the objectives of the city's comprehensive plan and this chapter.
c. Will be designed, constructed, operated and maintained so to be compatible in
appearance with the existing or intended character of the general vicinity and will not
change the essential character of that area.
d. Will not be hazardous or disturbing to existing or planned neighboring uses.
e. Will be served adequately by essential public facilities and services, including streets,
police and fire protection, drainage structures, refuse disposal, water and sewer systems
and schools; or will be served adequately by such facilities and services provided by the
persons or agencies responsible for the establishment of the proposed use.
f. Will not create excessive requirements for public facilities and services and will not be
detrimental to the economic welfare of the community.
g. Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare because
of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash.
h. Will have vehicular approaches to the property which do not create traffic congestion or
interfere with traffic or surrounding public thoroughfares.
i. Will not result in the destruction, loss or damage of solar access, natural, scenic or
historic features of major significance.
j. Will be aesthetically compatible with the area.
k. Will not depreciate surrounding property values.

4. Section 20-110:
(a) Consistency with the elements and objectives of the city's development guides,
including the comprehensive plan, official road mapping, and other plans that
may be adopted;
(b) Consistency with this division;
(c) Preservation of the site in its natural state to the extent practicable by minimizing
tree and soil removal and designing grade changes to be in keeping with the
general appearance of the neighboring developed or developing areas;
(d) Creation of a harmonious relationship of building and open space with natural site
features and with existing and future buildings having a visual relationship to the
development;
(e) Creation of functional and harmonious design for structures and site features, with
special attention to the following:
An internal sense of order for the buildings and use on the site and
provision of a desirable environment for occupants, visitors and general
community;

3. Materials, textures, colors and details of construction as an expression of
the design concept and the compatibility of the same with adjacent and
neighboring structures and uses; and
4. Vehicular and pedestrian circulation, including walkways, interior drives

circulation, separation of pedestrian and vehicular traffic and arrangement
and amount of parking.
(f) Protection of adjacent and neighboring properties through reasonable provision
for surface water drainage, sound and sight buffers, preservation of views, light
and air and those aspects of design not adequately covered by other regulations
which may have substantial effects on neighboring land uses.

RECOMMENDATION
The Planning Commission recommends that the City Council approve the

INFORMATION
On September 24, 2012, the City Council approved a contract to replace the City's water meter
radios. These radios are connected to every residential and business water meter in the city and
allow the City to read the meters with a City vehicle equipped with a meter reader. This system
is considered a drive -by system. Most of the City's water meter radio batteries are over 10 years
old and are failing. A cost benefit analysis was completed for the water meter radio project to
determine a cost-effective and long-term solution for the radios. It was determined the drive -by
meter radios should be replaced with a fixed -based collection system. This system is more
efficient and offers a lot more customer service features then the old system. This system also
has the longest life expectancy. In order for the fixed -based system to collect the water meter
information, collectors need to be installed throughout the City. A propagation study has been
completed by the system manufacture which identified the need for six collectors. Most of the
collectors can be located on existing water towers or antenna poles owned by the City. However,
no existing City -owned infrastructure in the northwest comer of the City is tall enough to service
this area.
The proposed project is to install a 60'
tall steel pole on the Fire Station #2
property (6400 Minnewashta Parkway)
at the comer of Minnewashta Parkway
and TH 7. The City did look at
attaching the collector unit to the fire
station structure but it was found to be
more expensive then a free standing
pole. The pole would have a 10' tall
galvanized collector rod attached to the
pole. No other equipment is planned to
be attached to the pole at this time. City
Code does require new antenna support
structures to be designed to
accommodate additional users.
Providing opportunities for co -location
is important if the total number of towers
in the City is to be kept at a minimum. However, this tower is anticipated to be too short to
accommodate cellular provides. In the future an internet communication system may be installed
on the pole to service the fire station. The pole is proposed to be installed at the north side of the
fire station parking lot as shown in this exhibit.

The north and west side of the parking lot are surrounded by
mature trees. These trees are approximately 40' tall. The fire
station is on the east side of the parking lot. The properties on \
the south side of Minnewashta Parkway, south of the fire
station have a finished floor elevation lower then Minnewashta ILI
Parkway. These lots also have mature trees that are along_ _
Minnewashta Parkway which provides very good screening. .......
Because of the mature trees in the area and the significant
distance to other properties in the area from the proposed pole
site, no additional landscaping is planned. Staff took images
showing the pole in the proposed location using the fire

COLLECTOR EQUIPMENT
A small collector equipment box (16" x 20") will be installed inside the fire station so the
equipment is in a controlled environment. No other equipment is needed to be installed outside.
PARKING
Parking is available at the fire station to service the equipment. Staff expects only minimal
vehicle traffic to visit the site for maintenance purposes. Maintenance of the equipment is
anticipated to be completed by the City utility department.
LANDSCAPING
The fire station property is surrounded by mature trees. No trees or vegetation will be removed
to install the pole. Staff is not proposing to plant any additional landscaping screening materials
since the property is heavily wooded.
LIGHTING
The parking lot does not have any lighting. The pole is not planned to add any parking lot
lighting. The pole will not be illuminated by artificial means and does not meet the criteria for
needing strobe lights.
SIGNAGE
No advertising signage or identification of any kind will be placed on the pole.
GRADING/DRAINAGE
Access to the pole will be through the fire station parking lot. No site grading will be needed to
install the pole. The drainage patter of the fire station property will not change.
MISCELLANEOUS
The radio meter contractor shall submit to the City a footing pole design and drawing signed by a
registered engineer.

ORDER TERMS
ORDER ACCEPTANCE: Orders will be accepted only after the product price and delivery on the purchase order are in agreement with the quotation
and there are no extenuating contractual conditions. If drawings are required for approval, the order is not accepted and manufacturing will not begin
unfit these drawings have been signed off as approved by all interested parties and returned to Millerbemd Manufacturing Company ("MMC").
ORDER SPECIFCATIONS: Orders for merchandise built to purchaser's specifications or design will be accepted only when accompanied by a
signed approval or signed drawings from the purchaser. Such orders are non -cancelable. The purchaser (including any contractor, distributor,
wholesaler, representing agency or end user) is responsible for inspection of the preliminary product design and inspection of the manufactured
product for its compliance to the specifications. R the product does not conform to the specifications, MMC must be notified of non-conformance
within (1) week of arrival on site. Verbal Orders: No verbal orders will be accepted.
ORDER CANCELLATION: The written consent of MMC must be obtained prior to cancellation of any order. In the event an order a canceled before
completion, the customer is responsible for all material purchased for the order and any work in progress on the order. Depending on quantity level
reached the customer may also be back charged for units already shipped if minimum quantities have not been reached.
LATE CHARGES: MMC will not be responsible to the customer for any!ate charges, penalties, assessments or liquidated damages whatsoever
arising from its manufacture or delivery of the purchased product.
RESTOCKING: Returned goods must be returned to us with a letter of permission, transportation prepaid, and the product must be in good
condition. Orders that are built to customer requirements or are not MMC's standard products are not returnable. Restocking charges are equal to
25% of the invoiced amount on MMC's standard products.
PAYMENTS: Invoicing is done the day of shipment with payment due within 30 days, 45 days is considered past due and a service charge of
1-1I2% per month will be assessed, unless other payment terms are noted in the order acknowledgement.
SHIPPING: Standard MMC practices for protecting merchandise during transit will be followed on all domestic shipments. Seller's responsibility for
full delivery of material ends upon receipt of signed bill of lading. Customer is responsible for inspecting the shipment before signing the bill.
SHORTAGE OR DAMAGE CLAIM! In the case of shortage or damage, purchaser should notify the carrier at once and file a complaint. Claims for
shortage of parts by MMC must be made within 10 days of receipt of shipment at destination. When Merchandise is lost or delayed in shipment,
MMC will not be responsible for expenses incurred in securing replacement merchandise from another source.
TERMS AND CONDITIONS FOR ALL SALES
Products sold by Millefoernd Manufacturing Company ('Company") and delivered to and accepted by the customer (referred to herein as the
"Buyer's upon the express condition that the Buyer acknowledges and agrees to all of the terms and conditions set forth below ("Terms").
Pricing and Delivery Terms: Quotations provided by Company shall not be binding offers, and are open for thirty days, unless earlier cancelled by
the Company, and Company may, in its sole and absolute discretion, accept or decline Purchase Orders submitted by Buyer. Quotations are
subject to acquisition and availability of materials and subject to change without notice to Buyer. In all cases, Compan)(s acceptance of a Purchase
Order must be in writing, on Company's approved Acknowledgement forth, and signed by an authorized representative of Company. Terms

and specifications from Buyer, and Buyer is responsible for the inspection and approval of the preliminary product design and inspection of the
delivered product for compliance to the specifications. Price quotes do not include factory finish paint, signals, electrical apparatuses, signs and
sign brackets, luminaries, unloading and delivery, assembly or installation. The Buyer shall make payments to Company in the amounts and on the
terms stated on Invoices submitted to Buyer from Company. For any invoices not paid when due, Company may charge interest on the outstanding
balance at the rate of 2% per month or the maximum rate allowed by law calculated from the first day for which such invoice was due until payment
in full is received. Pricing is "F.O.B. Millerberrd Manufacturing Company, Winsted. Minnesota" unless otherwise noted- Delivery "are based on
manufacturing lead time at the time Company excepts the purchase order." The Buyer assumes title and control of goods the moment the carrier
signs the bill Of lading, assumes the risks of transportation, and is responsible for filing claims for loss or damage with the carder Company will not
be responsible for delays in shipping caused by state or local agencies with regards to permits, routing, weather, detours, or other matters.
Modifications: These Terms herein and the terms of any Purchase Order accepted by Company may not be otherwise amended or modified, a
writing signed by both Company and Buyer, shall specify any new terms, amendments or modifications, and shall reference these Terms. Buyer
shall immediately remit additional costs upon the acceptance by Company.
Acceptance; Cure: ACCEPTANCE OF GOODS. All products delivered to the Buyer shall be deemed accepted unless Buyer notifies Company
within seven (7) business days of the Buyers receipt of the products that the products do not meet the specifications of a Purchase Order. Notice
delivered under this section shall be in writing and shall be deemed given upon receipt if delivered by hand delivery, U.S. registered or certified mail,
or reputable overnight courier. CURE FOR NON -CONFORMING PRODUCTS. Subject to the terms of Company's Standard Warranty, for all
norr-corrforming products, Company shall, at its option, (i) deliver conforming products within a reasonable time at Company's expense, or (it) refund
all fees paid for the non-conforning products, upon the return of such product to Company in the same condition it left Company's facility. Products
manufactured by Company according to Buyer's specifications shall not be considered non -conforming. A product shall not be considered
non -conforming unless the product is not the product listed on the applicable imoice.
Indemnification, Warranties, and Limitations of Liability. INDEMNIFICATION. Buyer agrees to indemnify and hold Company harmless against any
and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any negligence, wrongful acts, or omissions in
Buyers performance or failure to perform as specified in these Terms.
DISCLAIMER OF WARRANTIES. COMPANY HEREBY EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY AND FITNESS
FOR A PARTICULAR PURPOSE AS DEFINED IN THE UNIFORM COMMERCIAL CODE AND COMPANY MAKES NO REPRESENTATION,

EQUIPMENT, OR ANY OTHER COSTS, PENALTIES, OR LIQUIDATED DAMAGES, REGARDLESS OF WHETHER THEY ARISE FROM
BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY
OF SUCH LOSS OR DAMAGE OR IF SUCH LOSS COULD HAVE BEEN REASONABLY FORESEEN. IN NO EVENT SHALL COMPANY BE
LIABLE TO BUYER FOR MORE THAN THE TOTAL AMOUNT OF FEES IT HAS RECEIVED FROM BUYER.
General Provisions: FORCE MAJEURE: No liability shall result to Company from delay in performance or nonperformance mused by
circumstances beyond the reasonable control of Company, including, but not limited to, acts of God, fire, flood, war, labor disturbances,
governmental regulation, direction or request of Buyer CHOICE OF LAW. This Terms and the parties relationship are governed by and construed
in accordance with the laws of the state of Minnesota without reference to Minnosota s choice of law rules. ARBITRATION. Any controversy or
claim arising out of or relating to these Terms, or the breach thereof, shall be resolved through binding arbitration under the Commercial Arbitration
Rules of the American Arbitration Association, and shall be venued and take place in the state of Minnesota. Judgment on the award rendered by
the arbitrator(s) may be entered in any court having jurisdiction. LIMITATION ON ACTIONS. No action arising out of these Terms, any Purchase
Order, performance or alleged breach thereof, may be brought by Buyer against Company unless commenced within six months after such cause of
action has accrued. ASSIGNMENTS. The Buyer may not assign, delegate, or otherwise transfer these Terms or any right of obligation under these
Terms without the prior written consent of Company. Any assignment, delegation or transfer in violation of this provision shall be void.
TERMINATION. Company may, in its sole and absolute discretion, terminate a Purchase Order, upon fifteen days written notice provided to Buyer.
Buyer may cancel a Purchase Order upon ninety days written notice to Company, provided that the product is not in transit to Buyer, and Company
provides written consent to Buyer to cancel such Purchase Order. In all events, Buyer shall fully reimburse Company for all material purchases for
any works in progress relative to the Purchase Order.

ORDERTERMS
ORDER ACCEPTANCE: Orders will be accepted only after the product price and delivery on the purchase order are in agreement with the quotation
and there are no extenuating contractual conditions. If drawings are required for approval, the order is not accepted and manufacturing will not begin
until these drawings have been signed off as approved by all interested parties and returned to Millerbemd Manufacturing Company ("MMC').
ORDER SPECIFCATIONS: Orders for merchandise built to purchaser's specifications or design will be accepted only when accompanied by a
signed approval or signed drawings from the purchaser. Such orders are non -cancelable. The purchaser (including any contractor, distributor,
wholesaler, representing agency or end user) is responsible for inspection of the preliminary product design and inspection of the manufactured
product for its compliance to the specifications. If the product does not conform to the specifications, MMC must be notified of non-conformance
within (1) week of arrival on site. Verbal Orders: No verbal orders will be accepted.
ORDER CANCELLATION: The written consent of MMC must be obtained prior to cancellation of any order. In the event an order is canceled before
completion, the customer is responsible for all material purchased for the order and any work in progress on the order. Depending on quantity level
reached the customer may also be back charged for units already shipped if minimum quantities have not been reached.
LATE CHARGES: MA9C will .not be responsible to the customer for any late charges, penalties, assessments or liquidated damages whatsoever
arising from its manufacture or delivery of the purchased product.
RESTOCKING: Returned goads must be returned to us with a letter of permission, transportation prepaid, and the product must be in good
condition. Orders that are built to customer requirements or are not MMC's standard products are not returnable. Restocking charges are equal to
25% of the invoiced amount on MMC's standard products.
PAYMENTS: Invoicing is done the day of shipment with payment due within 30 days, 45 days is considered past due and a service charge of

SHIPPING: Standard MMC practices for protecting merchandise during transit will be followed on all domestic shipments. Seller's responsibility for

SHORTAGE OR DAMAGE CLAIM: In the case of shortage or damage, purchaser should notify the carder at once and file a complaint- Claims for
shortage of parts by MMC must be made within 10 days of receipt of shipment at destination. When Merchandise is lost or delayed in shipment,
MMC will not be responsible for expenses incurred in securing replacement merchandise from another source.

"Buyer') upon the express condition that the Buyer acknowledges and agrees to all of the terms and conditions set forth below ('Terms").
Pricing and Delivery Terms: Quotations provided by Company shall not be binding offers, and are open for thirty days, unless earlier cancelled by
the Company, and Company may, in its sole and absolute discretion, accept or decline Purchase Orders submitted by Buyer. Quotations are
subject to acquisition and availability of materials and subject to change without notice to Buyer. In all cases, Company's acceptance of a Purchase
Order must be in writing, on Company's approved Acknowledgement form, and signed by an authorized representative of Company. Terms
contained in Purchase Orders that are in addition to terms contained in Company's Quotation shall not be binding on Company unless Company
specifically references such terms in the applicable AcknovAedgment. Any documents referenced by the purchaser in a Purchase Order shall not be

built to Buyer's specifications and/or design may be accepted by Company, if such Purchase Orders are accompanied by certified design drawings
and specifications from Buyer, and Buyer is responsible for the inspection and approval of the preliminary product design and inspection of the
delivered product for compliance to the specifications. Price quotes do not include factory finish paint, signals, electrical apparatuses, signs and
sign brackets, luminaries, unloading and delivery, assembly or installation. The Buyer shall make payments to Company in the amounts and on the
terms stated on Invoices submitted to Buyer from Company. For any invoices not paid when due, Company may charge interest on the outstanding
balance at the rate of 2% per month or the maximum rate allowed by law calculated from the first day for which such invoice was due until payment
in full is received. Pricing is "F.O.B. Millerbernd Manufacturing Company, Winsted, Minnesota" unless otherwise noted. Delivery "are based on
manufacturing lead time at the time Company excepts the purchase order." The Buyer assumes title and control of goods the moment the carrier
signs the bill of lading, assumes the asks of transportation, and is responsible for fling claims for loss or damage with the carrier. Company will not
be responsible for delays in shipping caused by state or local agencies with regards to permits, routing, weather, detours, or other matters.
Modifications: These Terms herein and the terms of any Purchase Order accepted by Company may not be otherwise amended or modified, a
writing signed by both Company and Buyer, shall specify any new terms, amendments or modifications, and shall reference these Terms. Buyer
shall immediately remit additional costs upon the acceptance by Company.
Acceptance; Cure: ACCEPTANCE OF GOODS. All products delivered to the Buyer shall be deemed accepted unless Buyer notifies Company
within seven (7) business days of the Buyer's receipt of the products that the products do not meet the specifications of a Purchase Order. Notice
delivered under this section shall be in writing and shall be deemed given upon receipt if delivered by hand delivery, U.S. registered or certified mail.

Buyer's performance or failure to perform as specified in these Terms.
DISCLAIMER OF WARRANTIES. COMPANY HEREBY EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY AND FITNESS
FOR A PARTICULAR PURPOSE AS DEFINED IN THE UNIFORM COMMERCIAL CODE AND COMPANY MAKES NO REPRESENTATION,
AGREEMENT, GUARANTEE OR WARRANTY, EXPRESS OR IMPLIED OR INFERABLE FROM THE COURSE OF DEALING OR USAGE OF

in accordance with the laws of the state of Minnesota without reference to Minnesota's choice of law rules. ARBITRATION. Any controversy or
claim arising out of or relating to these Terms, or the breach thereof, shall be resolved through binding arbitration under the Commercial Arbitration
Rules of the American Arbitration Association, and shall be venued and take place in the stale of Minnesota. Judgment on the award rendered by
the arbitrator(s) may be entered in any court having jurisdiction. LIMITATION ON ACTIONS. No action arising out of these Terms, any Purchase
Order, performance or alleged breach thereof, may be brought by Buyer against Company unless commenced within six months after such cause of
action has accrued. ASSIGNMENTS. The Buyer may not assign, delegate, or otherwise transfer these Terms or any right or obligation under these
Terms without the prior written consent of Company. Any assignment, delegation or transfer in violation of this provision shall be void.
TERMINATION. Company may, in its sole and absolute discretion, terminate a Purchase Order, upon fifteen days written notice provided to Buyer.
Buyer may cancel a Purchase Order upon ninety days written notice to Company, provided that the product is not in transit to Buyer, and Company
provides written consent to Buyer to cancel such Purchase Order. In all events, Buyer shall fully reimburse Company for all material purchases for
any works in progress relative to the Purchase Order

1. A building permit is required to construct (erect) the tower (pole).
2. The tower must be designed for an 90 MPH wind load including the effect of
one-half inch of radial ice.
3. City Ordinance requires the tower support structure must be designed to
"accommodate additional users".
4. The tower plans must be signed by a professional engineer licensed in the State
of Minnesota.
5. The contractor shall meet with the Inspections Division as early as possible to

INFORMATION
On September 24, 2012, the City Council approved a contract to replace the City's water meter
radios. These radios are connected to every residential and business water meter in the city and
allow the City to read the meters with a City vehicle equipped with a meter reader. This system
is considered a drive -by system. Most of the City's water meter radio batteries are over 10 years
old and are failing. A cost benefit analysis was completed for the water meter radio project to
determine a cost-effective and long-term solution for the radios. It was determined the drive -by
meter radios should be replaced with a fixed -based collection system. This system is more
efficient and offers a lot more customer service features then the old system. This system also
has the longest life expectancy. In order for the fixed -based system to collect the water meter
information, collectors need to be installed throughout the City. A propagation study has been
completed by the system manufacture which identified the need for six collectors. Most of the
collectors can be located on existing water towers or antenna poles owned by the City. However,
no existing City -owned infrastructure in the northwest corner of the City is tall enough to service
this area.
The proposed project is to install a 60'
tall steel pole on the Fire Station #2
property (6400 Minnewashta Parkway)
at the comer of Minnewashta Parkway
and TH 7. The City did look at
attaching the collector unit to the fire
station structure but it was found to be
more expensive then a free standing
pole. The pole would have a 10' tall
galvanized collector rod attached to the
pole. No other equipment is planned to
be attached to the pole at this time. City
Code does require new antenna support
structures to be designed to
accommodate additional users.
Providing opportunities for co -location
is important if the total number of towers
in the City is to be kept at a minimum. However, this tower is anticipated to be too short to
accommodate cellular provides. In the future an internet communication system may be installed
on the pole to service the fire station. The pole is proposed to be installed at the north side of the
fire station parking lot as shown in this exhibit.

The north and west side of the parking lot are surrounded by
mature trees. These trees are approximately 40' tall. The fire
station is on the east side of the parking lot. The properties on
the south side of Minnewashta Parkway, south of the fire
station have a finished floor elevation lower then Minnewashta
Parkway. These lots also have mature trees that are along
Minnewashta Parkway which provides very good screening.
Because of the mature trees in the area and the significant
distance to other properties in the area from the proposed pole
site, no additional landscaping is planned. Staff took images
showing the pole in the proposed location using the fire
department ladder truck. The top of the fire truck railing is
approximately the height of the proposed pole.

COLLECTOR EQUIPMENT
A small collector equipment box (16" x 20") will be installed inside the fire station so the
equipment is in a controlled environment. No other equipment is needed to be installed outside.
PARKING
Parking is available at the fire station to service the equipment. Staff expects only minimal
vehicle traffic to visit the site for maintenance purposes. Maintenance of the equipment is
anticipated to be completed by the City utility department.
LANDSCAPING
The fire station property is surrounded by mature trees. No trees or vegetation will be removed
to install the pole. Staff is not proposing to plant any additional landscaping screening materials
since the property is heavily wooded.
LIGHTING
The parking lot does not have any lighting. The pole is not planned to add any parking lot
lighting. The pole will not be illuminated by artificial means and does not meet the criteria for
needing strobe lights.
SIGNAGE
No advertising signage or identification of any kind will be placed on the pole
GRADING/DRAINAGE
Access to the pole will be through the fire station parking lot. No site grading will be needed to
install the pole. The drainage patter of the fire station property will not change.
MISCELLANEOUS
The radio meter contractor shall submit to the City a footing pole design and drawing signed by a
registered engineer.
