It was wonderful talking with you this morning. We are releasing the erosion and sediment escrow for the Holasek site.
It was being held until some of the stockpiles had stabilized with vegetative cover. I feel comfortable releasing it at this
point. I do ask you throw some additional seed on the stockpiles for the new dirt brought in. They're not quite stabilized,

SUBJ: Holasek Grading IUP
On the afternoon of May 22, 2015, six piezometers were installed on the Holasek site as
shown in Attachment 1. Measurements were taken on May 27-29 and on June 1-2.
Additional measurements will be taken however based upon field observations, I have the
following updates:
Saturation or inundation at or near surface for 5% of the growing season is considered
meeting the hydrology requirement for wetland determination under the 1987 U.S. Army
Corps of Engineers' Wetland Delineation Manual. In Carver County, the growing season
is between 155 and 175 days making 5% equivalent to eight or nine days.
No water was observed within piezometers #2, #3 or #6 during any site visit.
Piezometers #I and #5 had water consistently present from 14 to 18 inches. Near the
surface is considered to be that area where at least 50% of the root growth occurs. In the
absence of normal conditions, it is assumed to be equal to 12 inches below grade.
Piezometer #4 met this criteria for a minimum of six days. It is likely, based upon
secondary observations such as soils and drainage patterns, that this location meets the
criteria to be considered wetland. I am certain that the area north of piezometer #4 meets
the criteria to be considered a jurisdictional wetland.
During every visit, this area was observed to be saturated to the surface. A boring was
hand dug and free water was observed at six inches with water entering the pit through
the exposed face of the bore whole at the surface. The soil has a historic epipedon which
is indicative of a hydric soil —a soil that develops under saturated conditions. In addition,
bulrush and sedges - obligate wetland plants - were observed in abundance throughout
the area.

The area between piezometer #5 and piezometer #6 is at a lower elevation than the piezometers. Given
that piezometer #5 showed consistently elevated water tables, if that ground water elevation remains
consistent moving east of piezometer #5, it is probable that the depth to ground water would be within the
root growth zone. However, the readings of piezometer #6 bring into doubt how far that near -surface
water extends. In any event, further investigation in this area would be needed before any excavation or
fill could occur.
There is one additional area that could be impacted by the proposed excavation and could potentially be
wetland. (Note, there are other areas further south on the property that are either known to be wetland
or present with conspicuous signatures that would warrant further investigation before land disturbing
activities would be allowed.) This area is just south and west of piezometer #I at the toe of the slope. It
has been saturated at the surface during every site visit and was inundated on May 26 and May 27. There
was also secondary indicators of hydrology that were observed including surface soil. While it would be
possible to excavate without directly impacting this area, further investigation would be prudent.
Based upon my observations, no excavation should be allowed south of the pipeline, in the vicinity of
piezometers #4, #5 and #6 until a qualified wetland professional performs a wetland determination and
delineation. Excavation could occur north of the pipeline provided the limits of grading remains east of
piezometer #I or a wetland determination and delineation, if needed, is performed in the area west of
piezometer # 1. This review was only concerned with the areas potentially impacted by the proposed
grading IUP and is in no way intended to be construed as an exhaustive review of the entire subject
property.

investigation and/or cleanup have adequately addressed the petroleum tank release at the site (Site)
listed above. Based on the information provided, the MPCA has closed the petroleum tank release site
file.
The closure of the petroleum tank release site file means the MPCA does not require any additional
investigation and/or cleanup work at this time or in the foreseeable future. Please be aware that file
closure does not necessarily mean that all petroleum contamination has been removed from this Site.
However, the MPCA has concluded that any remaining contamination, if present, does not appear to
pose a threat to public health or the environment under current conditions.
The MPCA reserves the right to reopen this file and to require additional investigation and/or cleanup
work if new information, changing regulatory requirements, or changed land use makes additional work
necessary. If you or other parties discover additional contamination (either petroleum or non -
petroleum) that was not previously reported, Minnesota state law requires that the MPCA be notified
immediately.
You should understand this letter does not release any party from liability for the petroleum

1. Permit. Subject to the terms and conditions set forth herein, the City of Chanhassen
hereby grants an interim use permit for the following use:
To permit the removal of organic soils (peat) from the property and the stockpiling of soil
on the property. The estimated amount of cut from the site is 52,478 cubic yards of material.
The estimated amount of fill material being stockpiled is 91,000 cubic yards. The grading
plan was prepared by Ronald C. Hedlund, dated April 27, 2015, revised May 1, 2015.
2. The permit is for the following property situated in the City of Chanhassen,
Carver County, Minnesota, and legally described as shown on Exhibit A.
3. Conditions. The permit is issued to import fill to the site subject to the following
conditions:
a. Prior to grading within the pipeline easement the applicant must provide the pipeline
company a copy of the grading plan and obtain any necessary permits.
b. Before grading operations commence the applicant must provide the Engineering
Department with the proposed haul route. Any changes to the haul route must be
communicated as needed throughout the grading operation.
c. Before grading operations commence the applicant must provide adequate evidence that
the areas with the potential to meet the criteria for classification as jurisdictional wetland
are either;
1) not wetland due to failure to present with adequate hydrology, or
2) are delineated according to the methodologies set forth in the U.S. Army Corps of
Engineers Wetland Delineation Manual and a report must be submitted to the city
for review and approval in accordance with the Minnesota Wetland Conservation
Act.

d. No excavation may occur within delineated wetlands that would not be considered no -
loss of wetland under MN Rules sections 8420.410, 8420.0415 and 8420.0420 or without
meeting proper sequencing and mitigation in accordance with the Minnesota Wetland
Conservation Act.
e. A security in the amount of $1,000.00 shall be provided for erosion control, vegetation
and site stabilization.
f. The interim use permit shall terminate on November 1, 2016.
g. Before grading operations commence, the proposed grading area south of pipeline must
be delineated according to the methodologies set forth in the U.S. Army Corps of
Engineers Wetland Delineation Manual and a report must be submitted to the city for
review and approval in accordance with the Minnesota Wetland Conservation Act_
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit.
5. Lapse. If within one year of the issuance of this permit the authorized construction has
not been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal
misdemeanor.
7. This permit shall expire with the completion of the site improvements approved by this
permit.

Paul Oehme: Thank you. This item was brought before the Planning Commission on June 2nd.
The applicant is Chadwick Group and Holasek Farms. There was a public hearing at the June 2nd
meeting. The vote was 7 to 0 in favor of the interim use permit. The subject site again is 8610
Galpin Boulevard which is just south of Galpin Boulevard and north of the Twin Cities rail,
Twin Cities Western Rail line that runs through Chanhassen on the western side of town. The
applicant is requesting a grading permit specifically for excavation of approximately 52,478
cubic yards of poor soils. They also would like a, to truck in or and stockpile about 91,000 cubic
yards of material in anticipation of future development. The applicant has applied for and did
receive a building demolition permit for this project or for this site already. The grading plan is
shown here. The applicant has taken soil borings and has installed some piezometers on the site.
The areas that are in question for poor soils for future development are shown here in these two
locations. Those are the sites, areas that potentially would need to be corrected if it's future
development. The areas here shown are the stockpile areas. These are temporary stockpile areas
so as the developer, property owner removes material, he needs to stockpile material in and
eventually fill in some of these areas. As I had mentioned the developer has taken soil borings.
Piezometers. A lot of the site is hydronic soils which means that they're muck soils or unsuitable
for building so there's going to be, have to be a lot of grading work potentially would take place
on the site. In conjunction with that soil analysis staff did review the soils in the soil borings and
piezometer readings and we estimate that there are potentially some wetland characteristics out
on the site so we have identified areas that we would like further study for potential wetland and
specifically wetland delineation on the site consistent with Minnesota Wetland Conservation Act
and federal guidelines as well so the excavated area here on the north side, we feel that doesn't

show any wetland characteristics or potentially wetland areas. That area seems to be okay. The
area to the south, this area is still in question. That's why we're requesting that the developer,
property owner investigate this site for potential wetland areas as well. And again the two
stockpile sites are shown in this area and again they're both temporary stockpile sites. So with
that staff does concur with the application and does recommend approval for the interim use
permit. Like I had mentioned June 2' a public hearing was held for this item so if there's any
questions I'd be more than happy to try and answer them.
Mayor Laufenburger: Alright, thank you Mr. Oehme. Any member of council have a question
for Mr. Oehme? I just have one. Paul you said or in the staff report it says that since the
Planning Commission meeting staff has received additional information about the existing
conditions of the site. Is there any information that you've received that would preclude us from
moving forward at this time?
Paul Oehme: Not at this time. It's consistent with the background.
Mayor Laufenburger: Okay. And the reason this is coming before the council is because of the
volume of dirt that they want to move, is that correct?
Paul Oehme: That's correct. In our code staff can permit for up to 1,000 cubic yards of material.
This is well over that allotted limit so that's why it has to be brought back to council for
consideration and approval.
Mayor Laufenburger: Okay. Alright. Is there any other comment or motion from the council?
Councilwoman Ryan: Mayor, I have a quick question.
Mayor Laufenburger: Certainly, Councilman Ryan. Councilwoman Ryan excuse me.
Councilwoman Ryan: That's okay. In the packet it says for the hours of operation, the word
expected kind of jumped out at me. 7:00 to 7:00. Do we have guidelines set for the hours of
operation and have they agreed to work within those hours?
Paul Oehme: So the City does have standard working hours that they have to abide by and
basically those are the hours so if they want to go above and beyond that they would have to
come back to staff and potentially to the council for modifying those working hours.
Councilwoman Ryan: Okay. But so far they've agreed to work within the constraints.
Paul Oehme: Work within the allotted city working hours that's in our code.

City Council approval requires a majority vote of the entire City Council.
EXECUTIVE SUMMARY
The applicant is requesting an Interim Use Permit to permit the removal of organic
soils from the property and the stockpiling of soil on the property in anticipation of
the eventual development of the site. The estimated amount of cut from the site is
52,478 cubic yards of material. The estimated amount of fill material being
stockpiled is 91,000 cubic yards.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on June 2, 2015 to review the proposed
grading plan. The Planning Commission voted 7 for and none against a motion to
recommend that City Council approve the Interim Use Permit. The Planning
Commission wanted to make sure that the proposed grading plan was consistent with the
Wetland Conservation Act regulations.
Since the Planning Commission meeting, staff has received additional information about
the existing conditions of the site. The northerly grading area will need to be slightly
modified to avoid potential wetland impacts, and grading in the southerly excavation
area may not occur until a wetland delineation is performed, approved and sequencing
requirements are met (see attached Chadwick IUP conditions and allowed activities
schematic).
Planning Commission minutes for June 2, 2015 are included in the consent agenda for
the June 22, 2015 City Council packet.

The area between piezometer #5 and piezometer #6 is at a lower elevation than the piezometers. Given
that piezometer #5 showed consistently elevated water tables, if that ground water elevation remains
consistent moving east of piezometer #5, it is probable that the depth to ground water would be within the
root growth zone. However, the readings of piezometer #6 bring into doubt how far that near -surface
water extends. In any event, further investigation in this area would be needed before any excavation or
fill could occur.
There is one additional area that could be impacted by the proposed excavation and could potentially be
wetland. (Note, there are other areas further south on the property that are either known to be wetland
or present with conspicuous signatures that would warrant further investigation before land disturbing
activities would be allowed.) This area is just south and west of piezometer # 1 at the toe of the slope. It
has been saturated at the surface during every site visit and was inundated on May 26 and May 27. There
was also secondary indicators of hydrology that were observed including surface soil. While it would be
possible to excavate without directly impacting this area, further investigation would be prudent.
Based upon my observations, no excavation should be allowed south of the pipeline, in the vicinity of
piezometers #4, 45 and #6 until a qualified wetland professional performs a wetland determination and
delineation. Excavation could occur north of the pipeline provided the limits of grading remains east of
piezometer # 1 or a wetland determination and delineation, if needed, is performed in the area west of
piezometer # 1. This review was only concerned with the areas potentially impacted by the proposed
grading IUP and is in no way intended to be construed as an exhaustive review of the entire subject
property.

PROPOSAL/SUMMARY
The applicant is requesting an Interim Use Permit to permit the removal of organic soils (peat)
from the property and the stockpiling of soil on the property in anticipation of the eventual
development of the site. The estimated amount of cut from the site is 52,478 cubic yards of
material. The estimated amount of fill material being stockpiled is 91,000 cubic yards.

APPLICABLE REGULATIONS
Chapter 7, Article III, Excavating, Mining, Filling and Grading
Chapter 20, Article IV, Division 5, Interim Use Permits
On September 11, 1995, the City approved Interim Use Permit #95-3 for the placement of 36,000
cubic yards of fill material on the site.
In 1957, the Holaseks, Betty and Earl, founded the nursery and greenhouse on the property which
operated until the end of 2014.
Chadwick Group, Inc. has submitted an application to excavate up to 52,478 cubic yards on the
property located at 8610 Galpin Boulevard. Historically the site has been used as a greenhouse
operation. This operation has since ceased and the site will likely be redeveloped in the near
future. In anticipation of this the applicant has identified areas on the site that contain soils that
are unsuitable for building pads, parking and other site development amenities. These soils are
proposed to be excavated. The applicant prefers to remove the excavated material from the site.
In the event that an off-site location is not found for the material the applicant has identified two
stockpile areas.
Two areas are proposed to be excavated, each to a depth of approximately 10 feet. The northern
excavation consists of approximately 25,300 cubic yards of cut; approximately 27,200 cubic
yards of cut is expected from the southern excavation.
Two stockpile areas are identified in the northwest comer of the property. The stockpiles will
contain material suitable to make the appropriate soils corrections on the site. The larger
stockpile in the northwest comer would be about 30 feet high within a 340 -foot by 340 -foot area.
A second stockpile to the east would be about 20 feet high within a 200 -foot by 350 -foot area.
There are currently buildings within the proposed stockpile areas. A demolition permit has been
issued to remove all of the buildings from the site.
An underground pipeline bisects the property and some of the proposed earthwork is in close
proximity to the pipeline. The applicant confirmed that the pipeline company has an easement
over this utility. Prior to grading within the pipeline easement the applicant must provide the
pipeline company a copy of the grading plan and obtain any necessary permits.
Access to the site for the grading operation will be from the existing driveway at Lyman
Boulevard. Before grading operations commence the applicant must provide the Engineering
Department with the proposed haul route. Any changes to the haul route must be communicated
as needed throughout the grading operation.

This site is tributary to Lake Hazeltine which is included on the Section 303D list for impaired
water bodies. Care should be taken during any activities on the site to improve the quality of
runoff from the site, thereby improving the water quality of Lake Hazeltine.
In reviewing the application, it was
noted that nearly half of the site is
covered with organic "muck" soils.
These are labeled MK and PM in
Figure 1. These soils are known to
develop under saturated or
inundated conditions. The soil
survey for the area indicates that
there are significant portions of the
site with hydric soils. Those areas
in red are likely to have a
seasonally high water table within
15 centimeters of the surface.
A geotechnical report, prepared by
Braun Intertec, had boring data
from February of 2015 around the
buildings and November of 2005 in the agricultural field area. The 2005 borings revealed
several areas with peat layers as deep as 24 feet. In some cases, water was observed within the
borings but no time was allowed to observe the static water elevation. Aerial photographs were
reviewed for the area back to 1937. In several of these photographs the area presents with
signatures indicative of wetland conditions.
Because of this data, it is not possible to conclude that wetland does not exist on site.
Observation of three parameters is required in order for an area to be classified as a wetland:
hydric soils, a dominance of hydrophilic vegetation under "normal conditions" and hydrology.
Based upon the U.S. Army Corps of Engineers Wetland Delineation Manual (Corps Manual),
soils and vegetation appear to be met. However, there is some question as to whether hydrology
would be met. Staff met with the applicant and it was decided that piezometers shall be installed
by the applicant in the questionable areas and observed by city staff for a reasonable time to
determine if hydrology is present as defined in the Corps Manual.
If the area is found to have hydrology, a delineation of the wetland areas will be required and any
activities must be in compliance with the MN Wetland Conservation Act and the Federal Clean
Water Act. If there is an absence of adequate hydrology then the excavation can proceed as
planned. The Wetland Conservation Act does allow for excavation in Type 1, 2 and 6 wetlands
as long as the excavation does not convert the area to deep water habitat or other non -wetland
cover type. However, the applicant would not be able to fill in the excavated areas at a later date
without that being considered a wetland impact.

RECOMMENDATION
Staff recommends that the Planning Commission approve the Interim Use Permit to permit site
grading up to 52,478 cubic yards of excavation and 91,000 cubic yards of stockpile as shown on
the plans prepared by Ronald C. Hedlund, dated April 27, 2015, revised May 1, 2015, subject to
the following conditions and adoption of the attached Findings of Fact and Recommendation:
1. Prior to grading within the pipeline easement the applicant must provide the pipeline
company a copy of the grading plan and obtain any necessary permits.
2. Before grading operations commence the applicant must provide the Engineering Department
with the proposed haul route. Any changes to the haul route must be communicated as
needed throughout the grading operation.
3. Before grading operations commence the applicant must provide adequate evidence that the
areas with the potential to meet the criteria for classification as jurisdictional wetland are
either;
a. not wetland due to failure to present with adequate hydrology, or
b. are delineated according to the methodologies set forth in the U.S. Army Corps of
Engineers Wetland Delineation Manual and a report must be submitted to the city for
review and approval in accordance with the Minnesota Wetland Conservation Act.
4. No excavation may occur within delineated wetlands that would not be considered no -loss of
wetland under MN Rules sections 8420.410, 8420.0415 and 8420.0420 or without meeting
proper sequencing and mitigation in accordance with the Minnesota Wetland Conservation
Act.
5. A security in the amount of $1,000.00 shall be provided for erosion control, vegetation and
site stabilization.
6. The interim use permit shall terminate on November 1, 2016.
7. Before grading operations commence, the proposed grading area south of pipeline must
be delineated according to the methodologies set forth in the U.S. Army Corps of
Engineers Wetland Delineation Manual and a report must be submitted to the city for
review and approval in accordance with the Minnesota Wetland Conservation Act.

12.
Request for an Interim Use Permit for grading of the property to remove peat and stockpile
fill material on the property located at 8610 Galpin Boulevard.
On June 2, 2015, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Chadwick Group, Inc. and Holasek Farms, LP for an
Interim Use Permit for grading operation. The Planning Commission conducted a public hearing
on the proposed development preceded by published and mailed notice. The Planning
Commission heard testimony from all interested persons wishing to speak and now makes the
following:
FINDINGS OF FACT
1. The property is currently zoned A-2, Agricultural Estate District.
2. The property is guided in the Land Use Plan for Office Industrial uses.
3. The legal description of the property is shown on the attached Exhibit A.
4. When approving an interim use permit the City must determine the capability of a proposed
development with existing and proposed uses. The general issuance standards of the
conditional use Section 20-232, include the following 12 items:
a) The proposed grading operation will not be detrimental to or endanger the public health,
safety, comfort, convenience or general welfare of the neighborhood or the city. All
reasonable and appropriate erosion control measures shall be used to protect the public.
b) The proposed grading operation will be consistent with the objectives of the city's
comprehensive plan and the zoning chapter and shall comply with the grading requirements
of Chapter 7 of the City Code.
c) The proposed grading operation will be designed, constructed, operated and maintained so
to be compatible in appearance with the existing or intended character of the general
vicinity and will not change the essential character of that area
d) The proposed grading operation will not be hazardous or disturbing to existing or planned
neighboring uses.

e) The proposed grading operation will be served adequately by essential public facilities and
services, including streets, police and fire protection, drainage structures, refuse disposal,
water and sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use.
f) The proposed grading operation will not create excessive requirements for public facilities
and services and will not be detrimental to the economic welfare of the community.
g) The proposed grading operation will not involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any persons, property or
the general welfare because of excessive production of traffic, noise, smoke, fumes, glare,
odors, rodents, or trash.
h) The proposed grading operation will have vehicular approaches to the property which do
not create traffic congestion or interfere with traffic or surrounding public thoroughfares.
i) The proposed grading operation will not result in the destruction, loss or damage of solar
access, natural, scenic or historic features of major significance.
j) The proposed grading operation will be aesthetically compatible with the area.
k) The proposed grading operation will not depreciate surrounding property values.
1) The proposed grading operation will meet standards prescribed for certain uses as provided
in Chapter 7, Articles III, of the Chanhassen City Code.
5. The planning report #2015-12 dated June 2, 2015, prepared by Robert Generous, et al, is
incorporated herein.
The Planning Commission recommends that the City Council approve the proposed
development including an Interim Use Permit to allow site grading to remove peat and allow
material stockpiling on the site.

Interim Use Permit—Soil Correction
Holasek Greenhouse Parcel
Narrative
The site has significant deposits of high organic peat soil. This soil is unsuitable for building purposes.
The material does have a use in soil blends particularly the high clay content soils found in the area. The
idea is to put to good use, that which Mother Nature created, and make for better gardens in the area.
By undertaking this operation at this time, it allows for an orderly usage of the material. If left until the
development stage, it will have to be moved in a hurry and will likely be in the way. Each of those
factors are a detriment to site development.
Wetlands — there is a marsh at the far south west corner of the site. This is nowhere near the areas that
will be disturbed. There is a hill separating the area of operations and the marsh.
Runoff—The peat deposit is located in low areas on the farm. The natural drainage pattern is in to this
area. Removing soil will further lower the site. It is not expected that there will be detrimental erosion,
(as water runs down hill). Normal rains would drain into the site, not off of or away from the site.
Neighborhood Impact —The site is bounded by a railroad, and industrial districts both in Chanhassen and
Chaska. It is located on Lyman Blvd. CR 18 and the entrance is signalized making for an excellent, safe
entrance and exit for this operation and future uses of the site. The land is graded for office industrial
uses and is currently zoned A-2, Ag Estate.
Hours of Operation — While many of the neighboring uses may have 24 hour operations, it is expected
this would be a 7am to 7pm operation.
Conclusion:
We would like to get started just as soon as possible so we could get the good soil to folks this year. It
will be beneficial to the site, reducing future costs and allowing greater site utilization. In order to
complete, we must begin.

8610 GALPIN BOULEVARD INTERIM USE PERMIT: REOUEST FOR AN INTERIM

APPLICANT: CHADWICK GROUP, INC. OWNER: HOLASEK FARMS, LP,
PLANNING CASE 2015-12.
Fauske: Thank you Chairman Aller and members of the Planning Commission. The first item
on your agenda is an interim use permit application for grading purposes. The applicant is
Chadwick Group Incorporated and Holasek Farms. The site is located south of Lyman
Boulevard and just south of the intersection at Galpin to the north of the railroad that goes
through town here. The site has historically been used since 1957 as a greenhouse operation.
That business has ceased to operate as of this year and currently the applicant, pardon me. The
property owner has the demolition permit to demolish the buildings on the property and looking
at the ultimate development of the site they've looked at doing some soil corrections at this time
in order to remove some material that isn't suitable for building foundations in order to prep the
site for any potential future redevelopment. There's no plans at this time for redevelopment but
they just wanted to take this opportunity during this construction season to go ahead and request
permission to remove material and bring in some material that would be suitable for building.
Again they're requesting an interim use permit to remove the organic soils from the property and
then also to stockpile some additional soil on the property for future development of the site.
According to the development application the amount of cut material proposed is just over
52,000. 52,478 cubic yards and based on the grading plan submitted staff estimates that it's
about 91,000 cubic yards of stockpile on the site at two locations. The grading plan submitted
with the application shows the proposed cut areas, which is right here. Just for frame of
reference right here is the intersection at Galpin and Lyman. That's also the entrance to the site
so the first cut areas in this location and the second cut area to the south. Also for frame of
reference if you've seen the site there's an underground gas line that bisects the property at this

location. The two stockpile sites shown on the plan. There's one here in the northwest comer
and then another one here in the central area. When we met with the applicant prior to submittal
we had indicated that there's some, that there have been based on historical photos that there
would be, there could be some wetland conditions on the site so included in the packet this
evening was mention of some soil borings that were taken on the site which verifies the amount
of peat that's located on the site where they're proposing to excavate. And since then, since the
staff report was published staff has been working with the development team, the project
proposer with regards to trying to determine if there are any wetland conditions out here so this
slide here, the area shown in red is material that is a soils survey that shows soils that can be
indicators of a wetland. So in response and after our conversation with the applicant, the
applicant went ahead and installed 6 piezometers on the site and at a location that we discussed
in the meeting and the purpose of the piezometers is to monitor the ground water elevation and
what that information tells us is if there's, in Minnesota if there's ground water present within
the 12 inches below the surface, that indicates hydrology for a wetland if it's I believe 5 percent
of the growing season which is about 8 or 9 days. So we're taking data readings from the
piezometers. Some supplemental information was handed out to you prior to the meeting. We
apologize for the late distribution of this information but we've been trying to get as much
information as possible for the Planning Commission just to let you folks know that there's still
some information that we're gathering to try to determine if there are wetlands out there. In the
staff report staff does include a condition that if there, that any wetlands would have to be
delineated and any impact to those wetlands would have to go through the Wetland Conservation
Act. The interim use permit does not supersede the Wetland Conservation Act. So as we
continue to get this information, share it with the project proposer, at this point there's some
indications of some elevated ground water at approximately this location. Again as a frame of
reference the underground gas line bisects at this location so in this location then also a potential
for where there's been some observance of surface water at this location. Just to the west of one
of the piezometers so the applicant has been very responsive to staff as far as going and
addressing our concerns and providing us the information requested so we've been very happy
with his response. So based on the information that we have at this time the motion that is, that
staff is recommending that the Chanhassen Planning Commission recommends that the City
Council approve the interim use permit to allow the site grading subject to the conditions of
approval and adopt the Findings of Fact and Recommendation. At this time I would be happy to
answer any questions that the commission might have at this time.
Aller: Just for the record we've received a memorandum dated June 2, 2015 from Terry Jeffery,
the Water Resources Coordinator which was just discussed. It's part of our record and will be
part of the package that's on the City's website for those of you who are present or at home who
would like to take a look at that again following this matter to June 22, 2015 for it's final
conclusion. The soil that's being removed is mostly peat?
Fauske: Correct.
Aller: And my understanding from the report is that it's going to be removed and taken off site.
Fauske: Correct.

Aller: Is that still the plan?
Fauske: Correct.
Aller: And then will any of the activities I guess that, are any activities in the grading covered by
our conditions such that we won't be modifying this from a potential wetland to a non -wetland
without knowing it? Is there, with the piezometers in place and with our conditions, are we
assured that this is not going to be something where we're turning a potential wetland into a non -
wetland.
Fauske: Correct. On page 4 of the staff report under the recommendations section, number 3
states before grading operations commence the applicant must provide adequate evidence that
the areas within, with the potential to meet the criteria for classification as jurisdictional wetland
are either (a) not wetland or (b) delineated. So that condition, staff put that condition in there
knowing that we're still gathering some evidence to understand if there's wetland. Any
approvals, any recommendations for approval to the council at this time would not supersede the
Wetland Conservation Act and allow the applicant to go and make any impact to a wetland.
Aller: And then just for our understanding and those individuals that are interested in this
project, no grading take place unless those conditions are met.
Fauske: That is correct.
Aller: Any additional questions or comments?
Tietz: Yeah Alyson, I just want a clarification on Andrew's question because it appears that the
stockpiled material is going to be the peat material that's extracted and then it's going to be
stockpiled until it can be sold as garden material according to the notes that are attached to the
document.
Fauske: The applicant is here as well to answer some of those questions.
Tietz: Okay.
Fauske: During the review I did pose the question if the stockpile was for the cut material or if it
was import and perhaps he could answer that question.
Tietz: Okay, and the import material, the 91,000, estimated 91,000 cubic yards, where is that
going to come from and how would that be brought to the site and.
Fauske: Certainly.
Tietz: It looked like the slopes that are proposed would not create excessive drainage from the
slopes of the stockpile which I'm sure, and if it's stockpiled for any length of time does that have
to be over seeded?

Fauske: Excellent questions Commissioner Tietz. The location where they'll be bringing the
material in, I'll leave that for the applicant to answer that question. I'm not certain if they've
identified that source. One of the things we have requested and did receive from the applicant is
the proposed haul route and he indicated Highway 41 to Lyman which we just get that
information one, to make sure that the roads are adequately designed to carry that type of traffic.
And number two is quite often if there's a haul route we'll, a resident in the area might say hey
there's all these trucks going. What's going on and then we have an answer to their question
when they've called in.
Tietz: Sure.
Fauske: Regarding the slopes on the stockpile, the grading plan shows them to be a 3 to I slope
which is from what we've witnessed is what you would call a maintainable slope where it can
establish vegetation. They certainly would be required to stabilize the stockpile after a period of
time when it hasn't been worked on so that's all part of their erosion control plan that they'll be
working on with staff.
Tietz: Okay, thank you.
Fauske: You're welcome.
Undestad: I've got one quick one too. Just on your recommendation 3. Would 3(b) then, would
that technically take care of Terry Jeffery's concerns in his letter here? The last paragraph he
had his observations on there.
Fauske: That's correct. Recommendation 3(b) is stating if the wetland is delineated according to
the methodologies that are approved practices, that they would have to be submitted for review
and then when it says an approval in accordance with the Minnesota Wetland Conservation Act,
that would be that if there's, for instance there are certain types of wetlands that can be excavated
a certain amount so that condition would then cover that. I believe in this instance it was a
maximum of, and I don't want to speak out of tum. I think it was 3 feet or something to that
extent. So whatever would be allowed, whatever work would be allowed under the Wetland
Conservation Act, recommendation 3(b) is intended to cover that as far as under the interim use
permit. That they could do any excavation that would be allowed under the Wetland
Conservation Act.
Aanenson: Chairman Aller if I may, just to be clear for everybody on the Planning Commission
and anybody else tracking this, so on the last page of Terry's recommendation is that a qualified
wetland delineation be made so, just so there's no ambiguity there so then they'll decide based
on the delineation some of those factors.
Undestad: Okay.

Chadwick Group. I reside at 4477 Manitou Road, Excelsior, Minnesota, 55331. Good to be in
front of you again on another matter here. It's always good to keep things moving forward and
fun in the city of,Chanhassen. I've had good working relations with your staff here and provided
a lot of guidance on this. A little bit of background. Our family was in the vegetable business
for years and years. My dad and Earl Sr. were kind of vegetable farmers together way back in
the way back days and so it's fun to keep working with that family and things as they move
along after, from '57 the year I was born til now my heavens. Times change. Needs change.
Greenhouse industry's changed greatly here in Minnesota. It's kind of cold up here and they can
bring stuff up in a truck pretty fast and that's that. Plus people get older just like all of us they
kept having birthdays too so now we're in a new phase and that is, here we've got this wonderful
site right here in Chanhassen. Perfect access to great roads. I've never had a chance to grading
where I've got a signalized interchange. Yes, thank you very much. I did live long enough. I'm
good. I'm done after this and black dirt or peat doesn't support buildings. Black dirt or peat
rather is kind of a, not a menace but it's a pain in the behind or if you're trying to build a
building. So you've got to get that stuff out of there. The more you can get out of there the
better your yield is going to be. A new kind of yield. Square food building. Number of square
feet of buildable surface that you can have. That's a different kind of a crop. So it takes a little
while to get that done and you can do it either this way which is let's go at it when we've got a
little bit of time or you can have the emergency which is let's go at it really fast and it costs a lot
of money to get rid of it and it costs a lot of money to bring stuff in. And I'll try to answer as
many questions as we go along but where will the import come from? I don't know exactly but
I've got to be very careful that what you bring in you don't have to haul off again. That it would
be good compactible fill and compatible with the site that's there and that stuff shows up and
sometimes it moves a long way down the road and sometimes you can be 3-4-5 miles from it and
boy that's a handy thing. It's good for the environment if we don't have to haul it all over
creation and back again. Personally black dirt or peat is a terrible thing to waste. You know it
took God and nature 10,000 years to put it there. We shouldn't just put it in a berm and look at
it. We should make it available for gardens and that kind of thing. Enough talking. We've had
a lot of input on this plan. I think we have a good plan. I've been working with staff and they've
been very helpful in what's going on out there and helping us understand the site. It's been
farmed for years and years and years. We've got all kinds of studies done on it. We're just
trying to get ready to go. Don't have any hey, this is what we want to go build right now. Some
people looking at it. Again it's a great site. There's not a lot of sites left in Chanhassen so I'm
happy to represent that site and help them get it started.
Aller: Great.
John Chadwick: Any questions?
Aller: Well first Mr. Chadwick I'd like to commend you for beginning early. Working with the
staff. It sounds like you've got a great relationship going. It sounds like you're on the soils early
which is going to be good for environment as well as for your building. Just to get to some of
the questions and make sure that they're answered so everyone's on the same page. The peat is
going to be moved off site?

Aller: And so that will not be stockpiled?
John Chadwick: I don't see it as being stockpiled very long. There might be gee we've got
some equipment there. We'll move that off and get peat in a stack and then move that off site
and then bring some different equipment in but it wouldn't be for very long. The intent of the
stockpile is there for good compactible soil. Future soil.
Aller: And you're using as an ingress and egress the existing roadway?
John Chadwick: Yes sir. Yes.
Aller: And it's in the plans, in the report.
John Chadwick: Yeah.
Aller: The water erosion plan, you've been working with the City on that? And so you're
comfortable with all the conditions that have been put in the report this far?
John Chadwick: Yes, yes and as a practical matter when you dig a hole you kind of know where
your water's going to end up. I know we all know that and we had some guys worried about
ponding in a gravel pit one time and we said well, you've never been able to make it pond in a
gravel pit. It's sand. It goes down and then we kind of worked through all that stuff so yes sir.
Aller: Okay great. And have you had an opportunity to take a look at Mr. Jeffery's report?
John Chadwick: Yes.
Aller: And you understand that we'll be asking for a designation and delineation of the wetland.
John Chadwick: If, I think there's a word if in that and if it is, absolutely. Is that on the page 3?
Aller: Well there's a condition in the report and then there's his report which is also requesting
that if the water continues to be at the levels in the piezometers that they are, that we'd be
requesting that. So I don't want you to come back and I don't want any surprises.
John Chadwick: Correct, correct. And I'm looking at about 3 or 4 last paragraphs, if the area is
found to have hydrology a delineation of wetland areas will be required. Of course so that's not
a surprise.
Aller: Wonderful, thank you. I have no further questions. Anyone else? Thank you very much

wishing to speak either for or against the item before us can do so at this time. Seeing no one
come forward, we'll go ahead and close the public hearing. Comments. I think the report's
pretty straight forward. It's great that it's again an early project. We're in here preparing
something for the future and there won't be hopefully any surprises as we move along so I can't
foresee any problems and I'm glad that Terry Jeffery's on it and doing his reports now so we'll
know where things stand. I'll entertain a motion at this time.
Undestad: I'll make a motion that the Chanhassen Planning Commission recommends the City
Council approve the Interim Use Permit to allow site grading subject to conditions of approval
and adopts the Findings of Fact and Recommendation.

Undestad moved, Yusuf seconded that the Chanhassen Planning Commission recommends
the City Council approve the Interim Use Permit to permit site grading up to 52,478 cubic
yards of excavation and 91,000 cubic yards of stockpile as shown on the plans prepared by
Ronald C. Hedlund dated April 27, 2015, revised May 1, 2015, subject to the following
conditions and adoption of the attached Findings of Fact and Recommendation:
1. Prior to grading within the pipeline easement the applicant must provide the pipeline
company a copy of the grading plan and obtain any necessary permits.
2. Before grading operations commence the applicant must provide the Engineering Department
with the proposed haul route. Any changes to the haul route must be communicated as
needed throughout the grading operation.
3. Before grading operations commence the applicant must provide adequate evidence that the
areas with the potential to meet the criteria for classification as jurisdictional wetland are
either;
a. not wetland due to failure to present with adequate hydrology, or
b. are delineated according to the methodologies set forth in the U.S. Army Corps of
Engineers Wetland Delineation Manual and a report must be submitted to the city for
review and approval in accordance with the Minnesota Wetland Conservation Act.
4. No excavation may occur within delineated wetlands that would not be considered no -loss of
wetland under MN Rules sections 8420.410, 8420.0415 and 8420.0420 or without meeting
proper sequencing and mitigation in accordance with the Minnesota Wetland Conservation
Act.

5. A security in the amount of $1,000.00 shall be provided for erosion control, vegetation and
site stabilization.
6. The interim use permit shall terminate on November 1, 2016.

SIGNAGE WITH A LOGO TO EXCEED 30 PERCENT OF THE SIGN DISPLAY AREA

Ingvalson: Good evening Chairman Aller and rest of the Planning Commission. For those of
you that don't know me my name is Drew Ingvalson. I don't have a name up there yet so just
want to let everyone know my name is Drew so feel free to ask me any questions as we go along.
So the first thing we're looking at, so what we're looking at here is a sign logo percentage
variance request. This is the applicant is Lund Food Holdings and then the owner is MET
Properties. So the location is 800 West 780' Street. The property is north of West 780' Street and
then west of Kerber Boulevard. Looking at that, the signage is located just to the south here, on
the south side of the building and then also on the east side. The east elevation. Then there also
is a monument sign that's located right here at the entrance and this is the Byerly's store for
those of you that don't know. So the request the applicant is making is they're requesting a
variance to allow the replacement of the existing signage that will have logos that exceed 30
percent of the sign display by up to 12.1 percent. City code allows logos to be up to 30 percent
of the sign. The largest one that they are proposing is 42.1 percent. This request is being made
to keep consistency between the signage that they have at other sites and also with the signage
that they have here in Chanhassen. So a little bit of background. There was a variance actually
given for this site in 1994. The variance was given to allow up to 431 square feet on the south
elevation which you see in that picture and then up to 376 square feet on the east elevation. At
the time the maximum signage allowed was 80 square feet. In 2002 and 2003 they went through
a remodel which has the signs that you see there in the picture, that's current. And that signage
actually reduced the signage on the south elevation to 270.6 square feet and on the east elevation
to 57.7 square feet. This is much lower than the maximum allowed at that time so the variance
wasn't needed at that time. The signage actually was up to 275 square feet for a side of the
building. So here's what the signage is going to look like. The new signage is on the right and
the current signage is on the left so the first thing is there is going to be changes to the logo. It's
going to be changed from that B that you see on the left side to L&B for Lunds and Byerly's.
They are also going to be reducing the letter height so that height is reduced approximately 6
inches on most of the signage and also signage is changed from Byerly's to Lunds and Byerly's.
And another thing off the signage is, keeping consistency with the letter depth. The depth of the
letters is going to be 4.5 inches so that's a dimension that it has off of the wall and then also the
logos have that same letter depth. The City requires a half an inch for that letter depth so it's
much deeper. Has a lot more of an accent than what the City requires. Also the logo has that
same letter depth. The City does not require it to have logos have letter depth. They can be on a

Request for an Interim Use Permit for grading of the property to remove peat and stockpile
fill material on the property located at 8610 Galpin Boulevard.
On June 2, 2015, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Chadwick Group, Inc. and Holasek Farms, LP for an
Interim Use Permit for grading operation. The Planning Commission conducted a public hearing
on the proposed development preceded by published and mailed notice. The Planning
Commission heard testimony from all interested persons wishing to speak and now makes the
following:
FINDINGS OF FACT
1. The property is currently zoned A-2, Agricultural Estate District.
2. The property is guided in the Land Use Plan for Office Industrial uses.
3. The legal description of the property is shown on the attached Exhibit A.
4. When approving an interim use permit the City must determine the capability of a proposed
development with existing and proposed uses. The general issuance standards of the
conditional use Section 20-232, include the following 12 items:
a) The proposed grading operation will not be detrimental to or endanger the public health,
safety, comfort, convenience or general welfare of the neighborhood or the city. All
reasonable and appropriate erosion control measures shall be used to protect the public.
b) The proposed grading operation will be consistent with the objectives of the city's
comprehensive plan and the zoning chapter and shall comply with the grading requirements
of Chapter 7 of the City Code.
c) The proposed grading operation will be designed, constructed, operated and maintained so
to be compatible in appearance with the existing or intended character of the general
vicinity and will not change the essential character of that area.
d) The proposed grading operation will not be hazardous or disturbing to existing or planned
neighboring uses.

e) The proposed grading operation will be served adequately by essential public facilities and
services, including streets, police and fire protection, drainage structures, refuse disposal,
water and sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the

f) The proposed grading operation will not create excessive requirements for public facilities
and services and will not be detrimental to the economic welfare of the community.
g) The proposed grading operation will not involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any persons, property or
the general welfare because of excessive production of traffic, noise, smoke, fumes, glare,
odors, rodents, or trash.
h) The proposed grading operation will have vehicular approaches to the property which do
not create traffic congestion or interfere with traffic or surrounding public thoroughfares.
i) The proposed grading operation will not result in the destruction, loss or damage of solar
access, natural, scenic or historic features of major significance.
J) The proposed grading operation will be aesthetically compatible with the area.
k) The proposed grading operation will not depreciate surrounding property values.
1) The proposed grading operation will meet standards prescribed for certain uses as provided
in Chapter 7, Articles III, of the Chanhassen City Code.
5. The planning report #2015-12 dated June 2, 2015, prepared by Robert Generous, et al, is
incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the proposed
development including an Interim Use Permit to allow site grading to remove peat and allow
material stockpiling on the site.

The area between piezometer #5 and piezometer #6 is at a lower elevation than the piezometers. Given
that piezometer #5 showed consistently elevated water tables, if that ground water elevation remains
consistent moving east of piezometer #5, it is probable that the depth to ground water would be within the
root growth zone. However, the readings of piezometer 46 bring into doubt how far that near -surface
water extends. In any event, further investigation in this area would be needed before any excavation or
fill could occur.
There is one additional area that could be impacted by the proposed excavation and could potentially be
wetland. (Note, there are other areas fwther south on the property that are either known to be wetland
or present with conspicuous signatures that would warrant further investigation before land disturbing
activities would be allowed.) This area is just south and west of piezometer #I at the toe of the slope. It
has been saturated at the surface during every site visit and was inundated on May 26 and May 27. There
was also secondary indicators of hydrology that were observed including surface soil. While it would be
possible to excavate without directly impacting this area, further investigation would be prudent.
Based upon my observations, no excavation should be allowed south of the pipeline, in the vicinity of
piezometers #4, #5 and #6 until a qualified wetland professional performs a wetland determination and
delineation. Excavation could occur north of the pipeline provided the limits of grading remains east of
piezometer #1 or a wetland determination and delineation, if needed, is performed in the area west of
piezometer # 1. This review was only concerned with the areas potentially impacted by the proposed
grading IUP and is in no way intended to be construed as an exhaustive review of the entire subject
property.

The site has significant deposits of high organic peat soil. This soil is unsuitable for building purposes.
The material does have a use in soil blends particularly the high clay content soils found in the area. The
idea is to put to good use, that which Mother Nature created, and make for better gardens in the area.
By undertaking this operation at this time, it allows for an orderly usage of the material. If left until the
development stage, it will have to be moved in a hurry and will likely be in the way. Each of those
factors are a detriment to site development.
Wetlands — there is a marsh at the far south west corner of the site. This is nowhere near the areas that
will be disturbed. There is a hill separating the area of operations and the marsh.
Runoff—The peat deposit is located in low areas on the farm. The natural drainage pattern is in to this
area. Removing soil will further lower the site. It is not expected that there will be detrimental erosion,
(as water runs down hill). Normal rains would drain into the site, not off of or away from the site.
Neighborhood Impact—The site is bounded by a railroad, and industrial districts both in Chanhassen and
Chaska. It is located on Lyman Blvd. CR 18 and the entrance is signalized making for an excellent, safe
entrance and exit for this operation and future uses of the site. The land is graded for office industrial
uses and is currently zoned A-2, Ag Estate.
Hours of Operation — While many of the neighboring uses may have 24 hour operations, it is expected
this would be a 7am to 7pm Monday to Friday operation.
Conclusion:
We would like to get started just as soon as possible so we could get the good soil to folks this year. It
will be beneficial to the site, reducing future costs and allowing greater site utilization. In order to
complete, we must begin.
