EXECUTIVE SUMMARY
The applicant is requesting approval of two Registered Land Surveys adjusting
the lot lines. The parcels are as follows:
Registered Land Survey 122, Tracts A & B (1050 & 1030 Pleasant View
Road) in connection with the sale of a portion of Tract B; and
Registered Land Survey 123, Tract D & Government Lot 1 (950 & 910
Pleasant View Road). Currently, a tennis court and a driveway he within 950
Pleasant View Road which should be included as part of the parcel of 910
Pleasant View Road.
The approvals will simplify legal descriptions for the properties.
ACTION REQUIRED
City Council approval requires a majority vote of City Council present.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on June 5, 2007 to review the
proposed Registered Land Surveys. The Planning Commission voted 5-0 to
approve the requests. The summary and verbatim minutes are item la of the City
Council packet.
RECOMMENDATION
Staff and the Planning Commission recommend the City Council adopt the
following motion:

In the case of both of these requests, the applicant is adjusting a property line (a

Two Registered Land Surveys (RLS) accompany this request. RLS is defined as: A survey of
"registered" (Torrens-title) land, usually done to shorten lengthy legal descriptions, or divide
larger parcels of "Torrens-title" land into smaller tracts.
Minnesota State Statute §508.47, subd. 4 requires that the RLS be approved "in the manner
muired for the approval of subdivision plat " Thus, although the City's ordinance does not
require anything more than an administrative subdivision for approval, Minnesota Statutes
require the City to approve the RLS as they would a subdivision plat. To satisfy this
requirement, the City must hold a public hearing prior to approval of the RLS.
City and County staff reviewed the legal descriptions of both RLS's, which were prepared by a
Registered Land Surveyor, and found them to be accurate.
Once the City has approved the RLS's, the Mayor and City Manager will execute the RLS
mylars and provide the dates of approval. These will then be forwarded to the City Attorney's
office for recording.
RECOMMENDATION
Staff recommends the Planning Commission recommend approval of the attached Registered
Land Surveys referred to as RIS 122 and RLS 123.

Al-Jaff: Yes you have. They shifted the property line about a year ago and they cleaned up a
few things. They came back and they said we forgot to do, what they forgot to do, or what they
neglected to look at is, rather than, currently there is a cross access easement. They wanted to do
away with the cross access easement for this driveway. Clean up this piece. Make sure that the
tennis court remains under single ownership with the single family home and keep this as a
buildable lot. And then the addition to the garage on this one came up about 6 months ago.
Papke: That's it.
McDonald: I don't have any questions either.
Al-Jaff: Then you just need to open the public hearing.
McDonald: Well is there an applicant here to hear from or?
Al-Jaff: I don't see one.
McDonald: Okay. Then in that case I will open up this to a public comment. Anyone wishing
to make comment, would ask that you come forward to the lectern. State your name and address

Jack Fess: Good evening. My name is Jack Fess. I'm a neighbor on 6280 Ridge Road. I know
the Beddor family quite well. I represent my neighbors that are on our private road down there,
so that's why I came up tonight. I really don't understand what he's doing here. Everybody
seems to ask me when I'm walking around the lake every day. I'm retired and I guess I called
you I think the first day when them signs went up and I told everybody I'd come up tonight.
What I don't understand is, he just finished a brand new garage over there. That garage is brand
new.
Al-Jaff: Correct.
Jack Fess: Why would he put and extend that garage without having this done before the
Planning Commission? That's only been completed about a month ago.
Al-Jaff: Correct.
Jack Fess: There's a lot of money in that garage. Now does he just assumed he can move this
over or what?
Al-Jaff: No. No. Two things are happening.
Jack Fess: Okay.
Al-Jaff: When shifting the property line itself is done administratively at staff level, and you
basically take that legal description and you record it with the County and it's valid. The owner
of the property chose to take it a step further and that is obtaining a judicial landmark. The
courts have to approve the location of the judicial landmark so that there is no arguments in the
future as to where certain property lines are.
Jack Fess: Does Mr. Beddor own all of that property under one single listing right now? There's
5 homes involved there.
Al-Jaff: Correct.
Jack Fess: Who owns what? Do you know?
Al-Jaff: Yes.
Jack Fess: Can you make that public so we could at least know. We've got David Beddor lives
in the house next to the garage. We have Steve right now, both houses are being remodeled.
AI-Jaff: Steve owns this piece. Steve Beddor owns this lot. David Beddor owns this lot.
Jack Fess: Okay. The garage is sitting between the two, right?
Al-Jaff: Actually it is located at 1050.

A] -Jaffa 1030 is vacant and owned by Frank Beddor. 950, which currently contains the tennis
court and the driveway is vacant from, when I say vacant it doesn't have a single family home on
it.
Jack Fess: So what are we trying to do? Just leave the tennis courts there or subdivide this in
order to build another house where the tennis courts are someday?
Al -Jaffa May I?
McDonald: Yes, go right ahead.
AI -Jaffa This is where the property line sits in relationship to the tennis court.
McDonald: Exactly.
Al -Jaffa What they are doing is they're moving this property line in this direction, eliminating
this line. So now both the driveway as well as the tennis court belongs to this parcel. Single
parcel.
Jack Fess: Which it should. It's sitting in front of it. But that now opens up a lot between Steve
Beddor's from the tennis court to build another house.
Al -Jaffa Well, it's always there. It's always been there. We are not creating a new lot.
Jack Fess: Right. It meets building restrictions is what you're basically saying.
Al-Jaff: Correct.
Jack Fess: If someone wants to build a house there, he can.
Al -Jaffa Correct. Even today without this, he can do that.
Jack Fess: Yes, I understand. Okay, so right now the way it's set up, are these properties all
under Mr. Beddor or are they broken up, Steve and David? I mean is, how is this broken up right
now?
AI -Jaffa Everything is under Frank Beddor's name with the exception of this home belongs to
Steve. It's under Steve's name. And then this is David's. David Beddor.
Jack Fess: Okay. Okay, that's what we needed to know.
McDonald: That's all you needed?

Papke: Mr. Chair, one clarification question on the basis of one of the other questions. Just to
clarify where on the lot on which the garage was built, there were proper setbacks before this
was made and there will be proper setbacks after this change is made. So from the perspective
that that was being questioned before about hey, this was built before these things were moved.
From the standpoint of setbacks, it's indifferent to that since they were met both before and after.
Al-Jaff: Correct.
Papke: Is that a correct assumption?
Al -Taff: Yes.
McDonald: Okay. Anyone else wish to come forward for a comment? Seeing no one else come
forward, I will close the public meeting. I'll bring it back up for the commissioners for comment.

Thomas: No.
McDonald: Debbie?
Larson: Seems fine.
McDonald: I have no comments either. At that point I guess I'm open to a motion.
Keefe: Sure. Planning Commission recommends approval of the registered land surveys as
described herein.
McDonald: Second?
Larson: I second that.
Keefe moved, Larson seconded that the Planning Commission recommends approval of the
attached Registered Land Surveys referred to as RLS 122 and RLS 123. All voted in favor
and the motion carried unanimously with a vote of 5 to 0.

As we discussed a few months ago, Mr. & Mrs. Beddor are reviewing their estate
planning. As part of this process, they have requested my assistance as a land planner to
revise two of their properties via a Registered Land Survey.
As per our discussions of this matter a few months ago, you had indicated that an RLS
request would be considered a Subdivision. I am herein submitting a Development
Review Application for 2 Subdivisions (RLS 122 & 123). Each Subdivision involves
two lots, one being reduced in size and the other being increased in size. While Mr. &
Mrs. Beddor own three of these lots and Mr. David Beddor owns the forth lot... which
will be increased in size. To support this application, I have attached David Beddor's
signature on the application form (thus two page two applications for RLS 122).
I am also enclosing a copy of you staff report of September 6, 2005 for the previous RLS
of these properties.

Staff has reviewed the proposed land division and determined that it meets the City's
exception to platting, and may be approved as an administrative subdivision. Thus, no
plat is required.
However, under Minn. Stat. § 508.47, subdivisions 2 and 7, the property owner is
required to prepare and record a registered land survey (RLS) for the proposed lot split,
because the transfer does not involve a full government subdivision or a simple fractional
or quantity part of a frill government subdivision or a lot.
Minn. Stat. § 508.47, subd. 4 requires that the RLS be approved "in the manner required
for the approval of subdivision plat." Thus, although the City's ordinance does not
require anything more than an administrative subdivision for approval, Minnesota
Statutes require the City to approve the RLS as they would a subdivision plat. Once the
City has approved the RLS, the Mayor and City Manager should execute the RLS mylars
and provide the date of approval. These will then be forwarded to the City Attorney's
office for recording.
Court Exhibit or Judicial Survey: Analysis of various legal descriptions and survey
maps; field locating of record, existing monuments, and physical features; and mapping
showing this information for the purpose of presenting a visual exhibit to be used in a
courtroom. In some areas of the US, this may also me known as a "Torrens" Survey of
"Registered" or "Torrens" land. A "Judicial' Survey is a Land Survey ordered by the
courts system, at times setting "Judicial Land Marks", also referred to as "JLM's". Some
also may refer to these as 'Ws" which stand for "Judicial Monument", or "Judicial
Marker".
Registered Land Survey "RLS": A survey of "registered" (Torrens-title) land, usually
done to shorten lengthy legal descriptions, or divide larger parcels of "Torrens-title" land
into smaller tracts.

process by which this.
AI-Jaff: Nothing is changing. When I spoke to the city attorney, mainly the objections might
come in if there is an exterior property line that is taking place, but in this case.
Sacchet: They're all interior.
AI-Jaff. They're all interior lot lines. The moving of the property will still take place regardless,
and that can be done through the deed. The only thing this is doing is taking a simple, or a rather
complicated legal description for these properties and turning it into Tract A or.
Papke: So as a result of the re -drawing of the, there's actually some interior borders that do
move, yes?
AI-Jaff: That's correct.
Papke: And is there any impact to setbacks as a result of those? I don't recall the mention in the
staff report.
Al-Jaff: No. If anything it is, I mean one of the issues that they had with this parcel was the
driveway that serves, the driveway that serves Tract B encroaches onto Tract A. So that was the
reason why that property.
Papke: So this is actually a remedial action. It's actually solving a setback problem.
AI-Jaff: Correct.
Sacchet: Any other questions? Just to be clear I mean what is actually changing. Is it the light?
I assume that the light dashed line is the new lot line or is it the old one?
A]-Jaff The old one.
Sacchet: That's the old one. So the new one is the fat one with the little circles.
A]-Jaff: That's correct.
Sacchet: Okay, so we're cutting a corner here and okay.
AI-Jaff And all of these have been approved administratively.
Sacchet: Yeah, and then on the first one where we have the two lots, so Tract B is actually
getting smaller than it was before?

Sacchet: And it's still big enough to have no setback issues since it gets smaller I wondered
about that.
AI-Jaff. I tried to anticipate some of the questions that you might have. Tract A has an area of
1.71 acres. Tract B has 1.5 acres.
Sacchet: So it's still pretty big, okay.
Al -Jaffa And then on these we have 17,600 for Tract A and 7,900 for Tract B. I'm rounding
numbers. And then 43,300 for Tract C. 58,600 for Tract D.
Sacchet: Okay. And access to Tract D and C both go through that flag.
Al -Jaffa That's correct.
Sacchet: Okay, so that would be a private street.
AI-Jaff. It's an existing...
Sacchet: That's existing. There's nothing, okay. Okay, just want to make sure since that's kind
of a sensitive thing. And then Tract B would have it's own flag situation. Long driveway.
AI-Jaf. . Correct. It does have it's own.
Sacchet: It's already all there.
AI -Jaffa Correct.

Debbie Lloyd: The one with four lots, yeah. The one that looked like, you know it was Tract A.
With the flag lot and then.
Sacchet: The one inbetween the driveways.
Keefe: It has frontage on Pleasant View.

RLS, the moving of the property lines was approved administratively.
