PLANNING CASE FILE NO. 0443
WHEREAS, the City of Chanhassen is requesting to vacate the drainage and utility
easement of Lots 9 and 10, Block 1, Mghcrest Meadows; and
WHEREAS, the existing easement was granted in 2005;
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves vacating the drainage and utility easements on Lots 6, 8, 12 and 13, Block 1, Highcrest
Meadows as defined on the attached vacation description.
Passed and adopted by the Chanhassen City Council this 22nd day of June, 2009.

Dear Jean:
You told me to contact Alyson if I had any questions in connection with the above, but
when I tried callin& her this afternoon I got her voicemail indicating that she would be
gone until July 30 . So, to speed things along, I am addressing this communication to
you with a copy to Alyson.
The enclosed Grant of Permanent Easement over a portion of Lot 5, Block 5,
Highcrest Meadows was forwarded to me for review and recording along with
Resolution No. 2009-53 vacating drainage and utility easements on Lots 6, 8, 12 and
13, Block 1, Highcrest Meadows, and three other permanent drainage and utility
documents from either Yoberry Farms, Inc. or Pulte Homes of Minnesota LLC over
portions of Lots 6, 8, 9, 10, 12 and 13, Block 1, Highcrest Meadows.
The resolution and the easements over portions of Lots 6, 8, 9, 10, 12 and 13, Block 1,
Highcrest Meadows have been sent to the County for recording. I am unable to record
the enclosed easement because split deeds between Yoberry Farms, Inc. and Pulte
Homes of Minnesota LLC were recorded on May 22 and May 28, 2009, which was
prior to the date of your transmittal letter sending me the documents for review and
recording (June 15, 2009). Pulte Homes of Minnesota LLC now owns a portion of
Lot 5, Block 5 which is included in the easement description attached to the enclosed
Grant of Permanent Easement, so we will need a fee owner consent from Pulte Homes
in order to record the easement. I have enclosed the necessary consent. Please forward

FOR DRAINAGE AND UTILITY PURPOSES
Yoberry Farms, LLC, a Minnesota limited liability company, hereinafter referred to as
"Grantor", in consideration of good and valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, does hereby grant unto the City of Chanhassen, a Minnesota municipal
corporation, the Grantee, hereinafter referred to as the "City", its successors and assigns, forever, a
permanent easement for public drainage, and utility purposes over, under, and across that part of Lot 5,
Block 5, HIGHCREST MEADOWS, according to the recorded plat thereof, Carver County, Minnesota,
legally described on Exhibit A and depicted on Exhibit B, both of which are attached hereto and made a
part of by this reference.
Including the rights of the City, its contractors, agents, servants, and assigns, to enter upon said
public easement premises at all reasonable times to construct, reconstruct, inspect, repair, and maintain
said public drainage, and utility systems over, across, on, under, and through the easement premises,
together with the right to grade, level, fill, drain, and excavate the easement premises, and the further
right to remove trees, bushes, undergrowth, and other obstructions interfering with the location,
construction, and maintenance of said public drainage, and utility systems.

PUBLIC HEARING: VACATION OF DRAINAGE AND UTILITY EASEMENTS,
HIGHCREST MEADOWS.
Paul Oehme: Thank you Mayor, City Council members. This item is requested by the
developer, Pulte Homes of the Highcrest Meadows. Highcrest Meadows development is located
here on the map, which is just north of Longacres and east of Trunk Highway 41. The easement
vacations are shown here on the plat. Two locations that have been requested for vacation at this
time. Just a little background. On May 13`s of this year an administrative subdivision request
was approved which changed the orientation of the lot lines between Lot 6 and 8 shown here,
and Lots 12 and 13. The lot line adjustments were necessary so that the new style of homes that
Pulte's proposing will comply with the impervious surface coverage requirements. As a result of
the lot line adjustments, Pulte Homes was or has requested a portion of these plotted drainage
utility easements to be vacated and new easements being dedicated along the adjacent property
lines. This drawing shows the area in yellow here that the area that, where the old property line
was and the drainage and utility easement is requested to be vacated and the darker lines showing
the new property line and then drainage and utility easement on each side of the property line.
That's for Lot 6. Lot 6 and 8 and then on Lot 12 and 13 likewise. The old property line shown
here which has been moved to the, moved to the west and new property line and new drainage
and utility easements shown. Gopher State One has been called and no private or public utilities
are in these drainage utility easements to be vacated so at this time I would recommend that the
utility easements be vacated and I stand for questions. I would request that a public hearing be
opened at this time.
Mayor Furlong: Thank you. Any questions for staff before we open the public hearing?
Councilman Litsey: Maybe just to reaffirm that it doesn't have any material affect on any of the
city interest then?
Paul Oehme: Correct. Yeah, there are no, no city utilities at these locations and drainage
patterns are consistent with what the original platted development had anticipated so there's
really no change from a city standpoint or impacts to the city.
Councilman Litsey: Great, thanks.
Mayor Furlong: Mr. Oehme based upon the proposed change, and I'm not at this point I think it
makes sense to go forward but based upon those proposed change, the size of the home that
they're planning to build and the structure, what amount of impervious surface coverage are they
looking at with this change and with what they're proposing to do?

Kate Aanenson: I can answer that. The home sizes, some of these are ramblers which wasn't
anticipated with the underlying development going to larger two stories so the impervious
surface requirement is still consistent with the residential single family.
Mayor Furlong: Which is 25 percent?
Kate Aanenson: Yep, so that's still staying the same. What this allows it, some creativity into
the style homes which the new builder has in place. So in order to accommodate that. Moving
the lot line is administrative. Moving the easement takes council action.
Mayor Furlong: Right.
Kate Aanenson: It just allows for the rambler as opposed to the kind of two story. Gives them
more flexibility but it does not increase the impervious surface.
Mayor Furlong: And I guess my question is with the housing style, the rambler that, once that is
completely, once that's constructed and with the driveway and everything, are they going to be
right at the 25%? Are we looking at potential problems with the homeowner coming back in? I
know we have the 10 by 10 for patio but somebody coming in and immediately needing a
variance to impervious surface?
Kate Aanenson: I think to Pulte's credit they spent some time meeting with the planning staff
and the engineering staff. Originally they were looking at horseshoe driveways and elongated,
not horseshoe driveway, excuse me. Side loaded garages which would have made a longer
driveway which didn't work so through meeting with them and to their credit, worked through
all those issues to get what would match because the lots were already established but there was
some flexibility moving the lot lines so we worked through all those issues and they are in
compliance. We always want to have some flexibility for a homeowner to do additional work on
the site, and they understand that because...
Mayor Furlong: Right, and will that be?
Kate Aanenson: ...we're the customer.
Mayor Furlong: Right. Will that be the case here then?
Kate Aanenson: Yes, there is flexibility on those lots.
Mayor Furlong: Okay.
Kate Aanenson: Because these lots are not at the minimum. 15,000.
Mayor Furlong: Right, but even with the rambler on there, which obviously is the larger
footprint, they're still going to have space for the homeowner to.
Kate Aanenson: Put in an additional patio. A yard barn, something like that, yes.

As a result of the lot line adjustments, Pulte Homes has requested that portions of the platted

This letter is to confirm that on March 9, 2008, the Chanhassen City Council
approved a resolution vacating the easement at Lots 9 and 10, Block 1, Highcrest
Meadows.
In order to finalize the vacation, the Council resolution must be recorded at Carver
County. In addition, the City generated a list of lot owners within 500 feet of the
subject area, which was required for the public hearing notice. The City charges a
fee of $3.00 per lot for this service. There were 23 property owners notified
which gives a total of $69.00 (23 x $3.00). Therefore, a total of $69.00 is due
payable to the City of Chanhassen at your earliest convenience. If you have any

Mario Cortolezzis: It's kind of hard when you're dealing with a special needs community. The
special needs community is very, very, it's a very closed circle but awareness like I'm doing
tonight. This is the biggest thing for us. Awareness. Letting them know there is a program out
there. Letting the school boards and I do meet with the school boards and let them know, yes we
are available. And it's just, if they have a new person move into the county or to the school
district, they'll be able to say here's a pamphlet. If it could benefit you, give them a call so our
main goal with meeting with cities and meeting with people is, you represent the people that live
in the city so when someone comes to you and says have you heard of this program, we want you
guys to have as much knowledge as possible so awareness is a big thing for us.

PUBLIC HEARING: HIGHCREST MEADOWS: VACATION OF DRAINAGE AND
UTILITY EASEMENTS.
Paul Oehme: Thank you Mayor, City Council members. This easement is located, for
consideration for easement vacation on Arrowhead Lane, which is again in the Highcrest
Meadows development, shown here in the exhibit. It's located just north of Longacres Drive and
east of Trunk Highway 41. On January 23rd of 2009 an administrative subdivision was approved
which changed the orientation of the common lot line between Lots 9 and 10 in Highcrest
Meadows which is shown here. Parcel A represents the newly described Lot 9, which is here.

And Parcel B is Lot #10. The lot line adjustment was necessary so that the type of home that the
developer is proposing to build on Parcel A will comply with the current ordinance. As a result
of a lot line adjustment the developer has requested that the platted drainage and utility easement
between Lots 9 and 10 be vacated and replaced with a 10 foot wide drainage and utility easement
centered over the newly common lot line. And here's an exhibit of the vacation exhibit. Gopher
State One locates was called and no events of public or private utilities within this vacated
easement were identified. The City Council therefore is recommended to vacate the drainage
and utility easement between Lots 9 and 10 of Block 1, Highcrest Meadows as shown on this
survey here produced by Westwood Professional Services dated January 13, '09. At this time I'd
stand for any questions that the council may have and I would request that a public hearing be
open.
Mayor Furlong: Okay, thank you. Any questions for staff at this time? On what's before us this
evening. Councilman McDonald.
Councilman McDonald: Could I just ask one question. I think I understand what's going on but
this is basically just to readjust the lot so they can build a particular home there and it meets the
qualifications.
Paul Oehme: Yes. The Lot #9, the building that's proposed to be built there has changed from
it's original configuration and therefore to meet our ordinance for setbacks and what have you,
that's why the property request for changing it was made.
Councilman McDonald: Okay, that's all I had. Thank you.
Mayor Furlong: Just to clarify, the issue before us tonight is not the change in lot line. That was
done administratively.
Kate Aanenson: That's correct.
Paul Oehme: That's already been done.
Mayor Furlong: That's been done and the new lot, or Lot 10 still meets all the requirements.
Kate Aanenson: That's correct and.
Mayor Furlong: It's just the fact that because that lot line moved, we have to physically consider
relocating the utility easement.
Paul Oehme: We have to readjust those easements accordingly.
Kate Aanenson: And really there is no setback from an easement. You can go right up to the
easement, but we try to make them all uniform so the easement centers over the property line as
the city engineer.
Mayor Furlong: Rather than keeping the entire easement on one property and none on the other.

Kate Aanenson: Correct. Correct. Because you can go setback right up to it but I think it's, to
be consistent is why we recommended that. There are no utilities in there right now.

Kate Aanenson: I don't think so.
Mayor Furlong: Okay. Are there any other questions for staff? If not we'll go ahead and open

Resolution #2009-20: Councilwoman Tjornhom moved, Councilwoman Ernst seconded

PROPOSED MOTION
"The City Council is recommended to vacate the drainage and utility easements
on Lots 9 and 10, Block 1, Highcrest Meadows as shown on the survey
prepared by Westwood Professional Services dated January 13, 2009.
City Council approval requires a simple majority vote of the City Council
present."
On January 23, 2009 an administrative subdivision was approved which changed
the orientation of the common lot line between Lots 9 and 10, Block 1, Highcrest
Meadows.
The City of Chanhassen • A growing community with clean lakes, quality schools, a charming downtown, thriving businesses, winding trails, and beautiful parks. A gest place to live, work, and play.
"Parcel A" represents the newly described Lot 9 and "Parcel B" as Lot 10. The lot line
adjustment was necessary so that the type of home that Pulte Homes is building on Parcel A will
comply with the maximum impervious surface requirement.

utility easement between Lots 9 and 10 be vacated and replaced with a 10 -foot wide drainage and
utility easement centered over the new common lot line.

underlying parcels of the Highcrest Meadows, Highcrest Meadows Second Addition And Highcrest

WHEREAS, the existing public drainage and utility easements were granted to the City as
part of the Wirtz plat on September 8, 1986; and

City Council approve the resolution combining improvement projects associated with the
construction of TH 212, Project numbers 04-05, 03-09-3, and 04-06. All voted in favor and
the motion carried unanimously with a vote of 4 to 0.
L. AWARD OF BID. FINANCIAL SOFTWARE.
Councilman Lundquist: Thank you Mr. Mayor. Just wanted to have a brief discussion on this,
more around the size of the project. Sizable investment of, somewhere in the neighborhood of
over $200,000 on this and so rather than putting it in the consent agenda to bring that up and talk
about what it is. I think it's a good investment. It invests in technology to help us be more
productive and be more efficient in one of our key areas, service to the residents and revenue
collection and that stuff so again something that we've been working on for a long time. A lot of
time and energy has gone into it so glad to see it come to fruition and we'll look forward to
seeing it's successful implementation and gaining the benefits that we get from having it.

Paul Oehme: Thank you Mayor, City Council members. As you may recall on April 25`a of this
year the City Council approved the final plat for the Yoberry Farms development, now Highcrest
Meadows development, Additions 1, 2 and 3. One of the conditions of that final plat approval
was to vacate existing utility and drainage easements within the project limits. Staff has
reviewed the developer's request to vacate these drainage and utility easements within the
Highcrest Meadow area. These easements are originally, were originally dedicated as part of a
previous development and are no longer necessary for this development. Currently no utilities
exist in this area. The easements that we were discussing are before you tonight are shown in
this drawing here. The second addition to the Highcrest Meadow development and they're 10
foot drainage utility easements around the perimeter of the development. This is consistent with
other developments that the city has and vacating easements before final plat is approved. The
easements are pretty straight forward for vacation. New easements will be dedicated in
conjunction with the new development. Staff recommends that a public hearing be open at this
time and I do stand for questions.
Mayor Furlong: Thank you, any questions for staff. Hearing none, we'll proceed to open the
public hearing at this time with regard to item 2(a), which is vacation of existing utility and
drainage easements. Any interested parties can come forward to the podium. Please state your
name and address to comment on this item. If there is nobody, then without objection we'll
close the public hearing and proceed.
Paul Oehme: Thank you Mayor. The next two items on the agenda for tonight are typically
handled under consent agenda items. They are approving of the development contract and
approval of plans and specifications. The plans and specification items that were included in
your background are consistent with other developments and staff recommends approval of those
plans and specs at this time. The development contract, one modification that the developer has
requested we change in one of the contracts of 3rd Addition. The property owner is Karen
Weathers. The developer and the property owner currently are requesting that the developer and
the current property owner be included on the final agreement form so I'm sorry.
Kate Aanenson: It's an and/or.
Paul Oehme: Or it's an and/or, okay.
Roger Knutson: At this point they haven't closed. They'd like the flexibility to have either
name on the development contract and the mylars. We've reviewed that and we see no issue
there. We'll get the letter of credit of everything will be done right, but rather than bring it back
after it closes, which we have unfortunately had to do in the past, they'd like it approved so that
either name could be on the development contract and the mylars.
Councilman Lundquist: Specifically where is that referenced?
Paul Oehme: Just be wherever, I think there's 3 or 4 locations in the development contract.
Mayor Furlong: Is that item 2(c)?

Item A was the only item that we were required to have a public hearing on. Since they're
published as B and C, I would certainly open the podium at this time if anybody wants to
comment in the form of a public hearing or public comments on item B or C to the council. You
can bring them forward at this time as well. Just to be sure everybody has a chance to be heard.
Okay, if not then we'll proceed with the council. If there's a motion we can either combine or
separate. Is there any objection to combining? If not, is there a motion?

amended for the 3 Addition to reflect current owner Karen Weathers and, I'm sorry, or Yoberry

Justin Miller: Good evening Mayor and council. In 1996 the City of Chanhassen purchased the
single family home at 8405 Great Plains Boulevard. It is the highlighted parcel here on the map.
Sorry it's not a better map but this would be Highway 101 and this is the house right there. The
City did purchase that for $107,000 from Willis and Anita Klein and the purpose of that purchase
was the future alignment of the highway 101 GAP project. As you know that project is now
right around the corner and so MnDot is in the process of acquiring the necessary property.
We've put together a list of our expenses that the city has had since we purchased this property
and it comes out to an estimated $130,944.00. Approximately. We have exchanged this number

VACATION OF EASEMENT
CITY OF CHANHASSEN
NOTICE IS HEREBY GIVEN that the Chanhassen City Council will hold a public
hearing on Monday, June 13, 2005, at 7:00 p.m. in the Council Chambers at Chanhassen City
Hall, 7700 Market Boulevard. The purpose of this hearing is to consider the request of Yoberry
Farms, LLC, David Hurrel, and Karen Weathers for the vacation of all drainage and utility
easements on the underlying parcels of property within the plat of Highcrest Meadows, Highcrest
Meadows 2nd Addition, Highcrest Meadows 3 Addition.
A legal description and drawing of the proposed vacation area are available for public
review at City Hall during regular business hours.
All interested persons are invited to attend this public hearing and express their opinions
with respect to this proposal.

Dear Sharmeen:
Enclosed is Pulte Home's application for the vacation and reestablishment of the drainage and
utility easement along the common lot line between Lots 9 & 10, Block 1 Highcrest Meadows.
The easement needs to be relocated to match the modifications to the lot line that have been
previously approved by the City. I have also enclosed a check in the amount of $300.00 to cover
the application fee, a legal description of the drainage and utility easement to be vacated, a legal
description of the new drainage and utility easement, an exhibit showing the relocation of the lot
line, and an exhibit showing the new drainage and utility easement.
