FINDINGS OF FACT

IN RE:
Application of Tiger Investors LLC for a Conditional Use Permit (CUP)
On September 17.2024. the Clhanhassen Planning Commission met at its regularly scheduled
meeling to consider the application ofTiger lnveslors Ll,C for a contracling yard conditional use
permit. The Planning Commission conducled a public hearing on the proposed conditional use
permit. preceded by published and mailed notice.

3. Conditions. The permit is issued subject to the following conditions:
a) Equipment and supply storage must be screened or enclosed at all times hy fencing or
vegetative screening. Screening shall comply with cit-v code.
b) Vehicles/equipment shall be slored u'ithin an enclosed or screened area.
c) No unlicensed or inoperable vehicle/equipment shall be slored on-premises.
d) All chemicals shall be slored in proper storage facilities. specified by OSHA regulations.
e) The contractor shall be licensed. bonded, and insured.
1) All pavement surfaces must be repaired and maintain a quality level of condition, fiee
from potholes and crumbling.
g) The scope of the Conlractors Yard may lre increased if the amounl ofpaved and screened
area is increased. up to the allowed amounl according to the zoning district. Industrial
Office Park (lOP). Increase in impervious surface may require modifications and
alteration to the stormwater miligations on site.
1. Pcrmit. On August 8, 202.1, the city received a completed land use application for the
property legally described as Lot l0 & I I . Block 5, Chanhassen Lakes Business Park
("Proper11"'). requesting a conditional use permit fbr a contracling yard on the Property.
2. Property. The Property is currently zoned Industrial Of'fice Park (lOP). l'he Properly ts
guided b1'the 2040 Land tJse Plan lirr Olllce Induslrial Use. Ciontracting yards are
considered a Conditional Llse within the Industrial Office Park (lOP) zoning dislrict.
h) 'lwo spruce trees, a minimunr of 4 feet tall at planting measured from finished grade,
shall be planted along the drivervay within the property, along the NW corner of the space
dellned as contractor yard on the site plan Exhibit C.
i) It is the developer's responsibility to ensure that permits are received from all other
agencies with jurisdiction over the projecl (i.e. Can'er County. RPBCWD, Board of
\\hter and Soil Resources. MnDOI etc.) prior to the commencement of construction
activities.
j) The applicant shall complete a wetland delineation onsite to confirm if the depressional
area is a jurisdictional u'elland. If any area onsite is delermined to be a jurisdictional
wetland then the applicant shall revise plans to meel all applicable city code regulations.
The \l'etland delineation shall be completed within 3 monlhs afler the approval of the
C'onditional Use Perrnit.
k) The applicanl and their Engineer shall work with city staff in amending the construotion
plans. daled May 31,2024, and Augusl9,2024 prepared by Moore Engineering Inc. lo
fully satisly conslruction plan comments and concerns u'ithin 6 months after the approval
ol'1he ( ondilional LIse l)crmil.
l) I'he applicant shall provide updated plans and models to demonstrate that the contraclor's
yard site is meeting u'ater quality standards. A permanent BMP to manage the runoff
generaled by the contractor's yard is anlicipated. These models shall be submitted as part
o1' all future submiltals.
m) The applicant shall creale a stormwater managemenl plan approved by staff to describe
how the site is meeting citl' requirements including u'ater qualitl'and erosion control.
'l he slorm$'ater management plan including site improvements shall be executed within
l2 months after the approval of the Conditional Use Pennit.
n) The developer shall enter into encroachmenl agreements for all existing and proposed
improvements Iocated in public easements. 'l'he encroachment agreements shall be
recorded within l2 months after the approval of'the Conditional [Jse Permit.
4. Termination of Permit. The city mav revoke the permit following a public hearing lbr
violation ofthe lerms ol'this pcrmit. The citl, rnay institute an)'propcr action or proeeeding a1
law or at equily to prevent violations of the rvithin property, to restrain or abate violalions of
the rvithin pcrmit. or 10 prevent use or occupanc)' of the Subject Propertl'.
5. Lapse. I f u'ithin one ) ear ol the issuance of this permit the authorized construction has not
been substanlialll' completed or the use commenced. this permit shall lapse, unless an
exlension is granted in aocordance with the (lhanhassen Zoning Ordinance.
6. Criminal Penal$, Violation of the terms of this conditional use permil is a criminal
misdemeanor.
DI.]CISION
The City Council approves the proposed conditional use pennit based on the findings of
fact included herein, and suhject to the conditions of the staff report.
