Planning Commission PresentationPlanning Case #2024-09 Contractors Yard Request Conditional Use Permit Planning Commission – September 17, 2024 City Council – September 23, 2024 Applicant: Tiger Investors LLC Requesting a conditional use permit for a contracting yard at 1591 Park Road. 1 Location History of the site: Former City of Chanhassen Public Works Facility 2 Proposed Site Plan 3 Zoning Overview Sec 20-232 General Issuance Standards The planning commission shall recommend a conditional use permit and the council shall issue such conditional use permits only if it finds that such use at the proposed location: Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. Will be consistent with the objectives of the city's comprehensive plan and this chapter. Will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. Will not be hazardous or disturbing to existing or planned neighboring uses. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare due to excessive production of traffic, noise, smoke, fumes, glare, odors, rodents or trash. Will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. Will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. Will be aesthetically compatible with the area. Will not depreciate surrounding property values. Will meet standards prescribed for certain uses as provided in this article. (Ord. No. 80, Art. III, § 2(3-2-3), 12-15-86; Ord. No. 377, § 23, 5-24-04) 4 Zoning Overview Sec 20-289 Contracting Yard Equipment and supply storage must be screened or enclosed. Screening shall comply with buffer yard D and F4 fencing as specified in this chapter. Vehicles/equipment shall be stored within an enclosed or screened area. No unlicensed or inoperable vehicle/equipment shall be stored on-premises. All chemicals shall be stored in proper storage facilities, specified by OSHA regulations. The contractor shall be licensed, bonded and insured. (Ord. No. 377, § 27, 5-24-04) 5 CUP Conditions The Applicant shall: Ensure they receive permits from all other jurisdictional entities Plant two additional trees to cover the current hole in screening Maintain the pavement surfaces in good condition Request an administrative increase in the contractor area if they would like to expand the yard, up to the impervious coverage allowed by the IOP zoning district. The Applicant shall work with water resources department to: Update the construction plans Submit water quality models Complete a wetland delineation to determine if any wetlands exist on the property Develop a stormwater management plan Enter into encroachment agreements for improvements in public easements 6 Planning Commission Discussion 7 Public Hearing 8 Planning Commission Discussion 9 Proposed Motion β€œThe Chanhassen Planning Commission recommends the City Council approve the proposed contracting yard conditional use permit at 1591 Park Road.” 10
