FINDINGS OF FACT
AND RECOMMENDATION
lN RE: Apptication oflnland Developer Partnels and Level 7 Developrnent LLC. for a
preliminary plat and site plan review.
On June 3,2025. the Chanhassen Planning Commission met at its regularly scheduled meeting to
considcr the application for site plan rcview and subdivision ofa 35.34-acrc property to plat an I l-
acre lot for the construction ofa 412-unit multi-family apartn.rent building.
The Planning Commission conducted a public hearrng on the proposed development which was
prcceded by publishcd and mailed notice. Thc Planning Commission hcard testimony liom all
iuterested persons wishing to speak and made the following Findings of Fact on the remaining
application.
FINDINGS OF FACT
4. The Subdivision Ordinance directs the Planning Commission to consider seven possible
advcrse effccts of thc proposcd subdivision. Thc scvcn cffects and our findings regarding
them are:
a. The proposed subdivision is consistent with the zorung ordinance;
Finding: The subdivision meets all the requirentents of the Planned Unil Developntent
and the zoning ordhance if the conditions ofapprolal are nret.
b. The proposed subdivision is consistent wlth all applicable city, county and regional plans
including but not limited to the city's comprehensive plan;
Finding; The proposed subdivision is consistent :l.'ith the Comprehensive Plan and
subdivision ordinance if the conditions qfapprot'al are met.
The physical characteristics of the site. including but not limited to topography, soils,
vegetation, susceptibility to erosion and siltation, susceptibility to tlooding, and stormwater
drainage are suitable for the proposed development;

l. On April 18, 2025 thc City receivcd a land usc applrcation for thc propcrty lcgally descnbed
in attachment Exhibit A for the following:
A. A preliminary plat subdivision for an I l-acrc lot for multi-family construction.
B. A site plan review for lhe construction of a 412-unit apartment building,
2. Thc property is currcntly zoncd Planncd Unit Dcvelopmcnt PUD.
3. The property is guided by the Land Use Plan fbr Commercial.
PRELIMINARY PLAT FINDINGS
Finding: The proposed site is suitablefor development subject to the conditions sltecilied
in this report.
d. The proposed subdivision makes adequate provision for water supply, storm drainage,
sewage disposal, sffeets, erosion control and all other improvements required by this
chapter;
Finding; The proposed .sLrbdivision will provide adequate urhan idrastructure subject to
tlrc conditions specified in this report.
e. The proposcd subdivision will not cause environmcntal damagc;
Finding: The proposed subdivision will not cause environmental damage.
f. Thc proposed subdivision will not conflict with cascmcnts ofrecord; and
Finding: The proltosed subdivision will not conllict with existing easements
g. The proposed subdivision is not prcmature. A subdivision is prcmaturc if any of the
following exists:
I ) Lack of adequate stomlwater drainage.
2) Lack ofadequatc roads.
3) Lack of adequate sanitary sewer systems.
4) Lack ofadequatc off-site public improvemcnts or supporl systems
Finding: The proposed subdivision will hat,e access to public utilities a,d streets if the
speci/ied conditions ofapproval are mel.
a) Is consistent with the elements and objectives of the city's development guides,
including the comprehensive plan, oflicial road mapping, and other plans that nlay be
adopted.
Finding: The site plan is consistent *'ith the elemenls and ob-iectives ol lhe citv-'s

Finding: The site plan is cottsistent v'ith the -site plan reviex' requirentenls
SITE PLAN REVTEW FINDINGS
5. The Applicant has requested approval of the site plan dated 04.18.2025 prepared byCivil Site
Group.
6. The zoning ordinance directs the City to consider nine possible adverse effects ofthe
proposed site plan. The nine (9) eff'ects and our findings regarding them are:

c) Preserves the site in its natural state to the extent practicable by minimizing tree and
soil removal and dcsigning grade changcs to bc in keeping with thc gcncral
appearance of the neighboring developcd or developing or developing areas.

d) Creation ofa harmonious relationship ofbuildings and open spaces with natural site

development.
Finding; The proposed design creates a harmonious relationship between dwellittg
4,pes proposed in the planned unit det,elopntenl, natural site.features, and proposed
landscaping.
e) Creates a functional and harmonious design for structures and site features, with
special attention to lhe following:

parking in tem:s of location and number of access points to the public streets,
width of inlerior drives and access points, general interior circulation, separation
of pedestrian and vehicular trat'fic and arrangement and amount of parking.
0 Protects adjacent and neighboring properties through reasonable provision for surface
watcr drainage, sound and sight buffcrs, prcscrvation of vicws, light and air and those
aspccts of design not adequately covcrcd by other regulations rvhich may havc
substantial effects on neighboring land uses.
g) Within the Highway Corridor (HC) districts. cousistency with the purpose, intent and
standards of the HC districts.
Finding: The pntposed site plan does ('teote an intemal sense of order .for the
huildings and uses on the site through the balance of ktnd.scaping, mctterial
applications, and circulation.for pedestrians and vehicles.
Finding: The site plan as proposed does protect adja(ent and neighboring properlies
.for swface w,ater drainage, sound and sight buffers, prcservation ofviev's, light and
air that could have substantial e/fecls on neighborittg land uses.
Finding: The px;posed site plan is not within the Highwat Corridor Dist'ict
h) Within the Bluff Creek Overlay (BCO) dislrict. consisteucy witli the purpose, intent
and standards of thc B( O district.
Finding: The proposed site ltlon is not within the Bl{f Creek Overlal' District
i) Maintarn an acceptable road system level of service.
Finding: The proposed plan does not a.ffect the rcad s)'slem level ofsenice and

connecIion, parking, and pedeslrian circulation.
7. The planning report Planning Case 2025-08, dated May 28,2025, prcpared by Rachel
Arsenault, et al, is incorporated herein.
The Plannrng Commission recommends approval of the requested Site Plan Review and
Preliminary Plat to the City Council.
