Authorize Preparation of Feasibility Study for Stone Creek Drive
Project No. 98-15
The feasibility report for Coulter Boulevard Phase II, Project No. 93-26B, was
approved in February of 1996. This feasibility report included the construction of
Stone Creek Drive north of Coulter Boulevard. However, the work to construct
Stone Creek Drive north of Coulter Boulevard was eliminated from the project
since the developers had not finalized their plans for the area. It now appears that
there is an interest on the part of the developer, Bluff Creek Corporate Partners,
and an adjacent property owner, Family of Christ Lutheran Church, to have a
segment of Stone Creek Drive north of Coulter Boulevard constructed to an urban
roadway section with municipal utilities.
The City has received petitions from both Bluff Creek Corporate Partners and
Family of Christ Lutheran Church for a public improvement project to take place
in the 1999 construction season. The project scope anticipated at this time would
consist of the construction of Stone Creek Drive from Coulter Boulevard north
approximately 600 feet to an urban collector roadway section with concrete curb
and gutter, storm sewer, and watermain.
In order to meet the requirements of State Statute 429, a new feasibility report
must be prepared for the project. Since Bonestroo, Rosene, Anderlik &
Associates had prepared the initial feasibility report for Project No. 93-26B, I have
requested that they provide a quote to conduct the feasibility study for the new
Stone Creek Drive project They have submitted a quote for preparation of the
feasibility report in the not-to-exceed amount of $695. The estimated cost
assumes a preliminary plat and preliminary grading/utility plan is available from the
developer.
In accordance with City policy on similar petitioned projects in the past, it is
recommended that the petitioning properties be required to secure the cost of
preparing the feasibility study. If the project is ordered, the security amount will
be applied towards the special assessments against the property. The cost sharing
for the feasibility security has been split as follows as requested by the petitioners:

At this time it is staff's recommendation that the City Council authorize the
consulting engineering fIrm of Bonestroo, Rosene, Anderlik & Associates to
prepare the feasibility report for the extension of Stone Creek Drive north of
Coulter Boulevard, Project No. 98-15 with a not-to-exceed amount of $695
conditioned upon the petitioning property owners, Bluff Creek Corporate Partners
and Family of Christ Lutheran Church, securing the cost of the feasibility study as
outlined above.

Manager's Comment
Coulter Boulevard was built as a public improvement project recognizing the
various owners involved. Stone Creek Drive is similar in that there are two
different benefIting owners. The likelihood of both agreeing to how the road could
be built privately is unlikely. At this point, it is compounded by the fact that one of
the two parcels may have a different owner January 1, 1999. The City is in the
best position to coordinate the project and to fairly assign costs to the two
benefIting owners. Approval of proceeding with the feasibility study is
recommended.

Dear Anita:
We have reviewed the preliminary plat and your letter regarding Stone Creek Drive north of Coulter.
As you are aware, we assisted the City with Coulter Boulevard adjacent to this site under project 93-
26B. Provisions were made for the Stone Creek Drive construction as part of the 93-26B work.
We would be able to prepare a letter type Feasibility Report for the new Stone Creek Drive project
using available current information and previous information from 93-26B. The report could be
prepared within 4 weeks of authorization. The cost of the report would be no more than $695. The
estimated cost assumes a preliminary plat and preliminary grading/utility plan is available from the
developer. The estimated cost also assumes that the public hearing will be completed at one
meeting.

AGREEMENT
AGREEMENT made this _ day of ,1998, by, between, and among the
CITY OF CHANHASSEN, a Minnesota municipal corporation ("City"), and BLUFF CREEK
PARTNERS ("BCP"), a Minnesota partnership of Land Group, Inc., its general partner; and
FAMILY OF CHRIST LUTHERAN CHURCH (FCLC).
RECITALS
A. The City has under consideration Improvement Project No. 98-15 ("the Project").
B. Property under the control of BCP and FCLC would benefit by the project.
C. The City is only willing to continue its consideration of the Project on conditions
that BCP and FCLC fund preparation of the feasibility report.
NOW, THEREFORE, in consideration of the mutual covenants the parties agreement as
follows:
1. The City will instruct its consulting engineering firm to prepare a feasibility report
for the Project.
2. Upon execution of this Agreement, BCP shall pay to the City $347.50 and FCLC
shall pay to the City $347.50 to fund preparation of the feasibility report for the Project.
3. If the City awards bids for the project, the payments described above shall be
applied toward payment of the special assessments for the Project on the land owned by the party
making the payment.
