I think that it is very unlikely that staff would support a variance request for a message center over 32 sq. ft.
The code stipulates that variances cannot be grated that “adversely affect the spirit or intent of this article.” It is my belief that the code establishes the three tiers of sign size
and specifies a decreasing percentage of message center signage for each subsequent tier with the intent of limiting the maximum size of a single message center. The maximum threshold
established is 32 sq. ft. If the code was not concerned with establishing a set limit for message center size the initial tier’s 50% ratio would have been applied to all sign sizes.
I would also be concerned about the precedent of allowing for a larger sized message center without a clearly defined hardship. Many businesses could make a case for combined signage
or not taking advantage of their theoretical maximum signage in exchange for a larger message center. Allowing a business to make a case that they should be allowed a sign of proportions
and size permitted by the ordinance despite not technically meeting the square footage requirement for that category of sign is in this case justifiable, but allowing businesses to
exceed the maximum size limits specified for their zoning district is a very different type of variance… and one I would not support.

I am just interested in your opinion so that I can advise the Youngstedt team.

Matt,
I was able to sit down with the Community Development Director and the Senior Planner who worked on the original site plan for this area in the early 90s, and here is what we’ve been
able to figure out:
1) The site has an existing variance allowing for a 12’ monument sign.
2) A condition of the existing variance was that the businesses would consolidate their signage into a single monument sign.
3) Within the existing ordinance and variance you would be allowed to have 64 sq. ft. of total signage, 28.8 sq. ft. of which could be an electronic message center.
4) If you requested a new variance for a 12’ monument sign with 80 sq. ft. of total signage you could have a 32 sq. ft. electronic message center.
5) The variance process would entail $450.00+ in fees, and take around 60 days (public hearing and council action required).
6) If goal is an electronic message center, staff is not sure that 3.2 sq. ft. of extra message center is worth the time and expense on your end; however, that is your and your
client’s decision.
7) If you decide to pursue a variance, staff would likely recommend approval with the condition that all three parcels consolidate their monument/pylon signage to the single sign
(Once you have a formal proposal ready we can meet to go over it and I will be able to give a firm answer on our recommendation, but in principle we support a variance allowing for
a larger sign in exchange for consolidating signage).
Please keep in mind that the Planning Commission and City Council have the sole authority to grant a variance. They may or may not go with staff’s recommendation. If you have any other
