GRANT OF PE NT EASEMENT
FOR PUBLIC TRAIL PURPOSES
BLACK CHERRY DEVELOPMENT, LLC, a Minnesota limited liability company
("Grantor"), inconsideration of One Dollar ($1.00) and other good and valuable consideration, the
receipt and sufficiency of which is -hereby acknowledged, does hereby grant unto the CITY -OF
CHANHASSEN, a Minnesota munici Mipal corporation, the Grantee, hereinafter referred to as the
"City", its successors and assigns, -forever, a permanent easement -for public -trail purposes over,
on, across, under and through the land legally described on the attached Exhibit "A" and depicted
on the attached Exhibit "B (the "Easement Premises").
IN
CLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon- Easement -Premises Premises at all reasonable -times -to construct, reconstruct, inspect, repair, and
maintain said public trail systems over, across, on, under, and through the Easement Premises,
together with the right to grade, level, -fill, drain, pave, and excavate the -Easement -Premises, and
the further right to remove trees, bushes, undergrowth, and other obstructions interfering with the
location, construction, and maintenance of said public -trail systems.
The above -named Grantor, for itself, its successors, and assigns, does covenant with the
City, its successors and assigns; that it is well seized in fee title of the Easement- Premises; that it
has the sole right to grant and convey the easement to the City; that there are no unrecorded
interests in the Easement Premises; and it will indemnify and -hold -the City harmless for any breach
of the foregoing covenants.

EXHIBIT "A"
to
GRANT OF PERMANENT EASEMENT
A 10.00 foot wide easement for trail purposes over, on, across, under and through Lots 14, 16, 17,
and 19, Block 1, ERHART FARM, according to the recorded plat thereof, Carver County,
Minnesota. The centerline of said easement is described as follows.
Commencing at the most easterly corner of said Lot 14; thence on an assumed bearing of North
73 degrees 50 minutes 29 seconds West, along the northerly line of said Lot 14, a distance of 36.83
Feet to the point of beginning; thence South 19 degrees 31 minutes 55 seconds West 36.74 feet;
thence southerly 6.01 feet along a tangential curve concave to the east, having a radius of 12.00
feet, and a central angle of 28 degrees 40 minutes 37 seconds to the point of reverse curvature;
thence southerly, and southwesterly 157.20 feet along a tangential curve concave to the west,
having a radius of 154.39 feet, a central angle of 58 degrees 20 minutes 11 seconds, and a chord
bearing of North 20 degrees 01 minute 23 seconds East; thence South 25 degrees 44 minutes 45
seconds West 28.83 feet; thence southwesterly 5.92 feet along a tangential curve concave to the
northwest, having a radius of 8.00 feet, and a central angle of 42 degrees 24 minutes 04 seconds;
thence South 68 degrees 08 minutes 49 seconds West 71.53 feet; thence southwesterly 1.81 feet
along a tangential curve concave to the southeast, having a radius of 10.00 feet, and a central angle
A 10 degrees 22 minutes 53 seconds; thence South 57 degrees 45 minutes 56 seconds West 89.24
feet; thence southwesterly 0.72 feet along a tangential curve concave to the southeast, having a
radius of 10.00 feet, and a central angle of 04 degrees 06 minutes 12 seconds; thence South 53
degrees 39 minutes 44 seconds West 149.42 feet to the southwesterly line of said Lot 17, and said
centerline there terminating.
The sidelines of said easement are to be prolonged or shortened to terminate at said southwesterly
line of Lot 17, Block 1, and said northerly line of Lot 14, Block 1.
