TIMOTHY A. ERHART and DAWNE M. ERHART, husband and wife, hereinafter
referred to as "Grantors", in consideration of One Dollar ($1.00) and other good and valuable
consideration, the receipt and suci
ffiency of which is hereby acknowledged, does hereby grant unto
the CITY OF SEN, a Minnesota municipal corporation, the Grantee, hereinafter referred
to as the "City", its successors and assigns, a temporary easement for public drainage and utility
purposes over, across, on, under and through the property legally described on Exhibit "A" and
depicted on Exhibit "B" attached hereto (the "Easement Premises").
TO HAVE AND TO HOLD the same, unto the City, its successors and assigns, commencing
upon execution of this easement and expiring upon the earlier of: (i) the subdivision of Outlot E or
Outlot F of Erhart Farm; or (ii) a permanent public drainage and utility easement is established over
the Easement Premises. This grant of easement includes the right of ingress to and egress from the
asement Premises, for the purpose of constructing, reconstructing, inspecting, repairi Eng, and
maintaining the property of the City, at the will of the City, its successors and assigns; it being the
intention of the parties hereto that the Grantors hereby grant the uses herein specified without
divesting themselves of the right to use and enjoy the above described temporary Easement Premises,
subject only to the right of the City to use the same for the purposes herein expressed.
it is understood by the -Grantors that the City shall not be responsible for any restoration or
replacement costs or damages resulting from the construction and maintenance of the Easement
Premises. It is further understood that vegetation will be removed and that excavation will occur on
the Easement Premises.

The above named Grantors, their heirs, successors and assigns, do covenant with the City,
its successors and assigns, that they are well seized in fee We of the above described Easement
Premises; that they have the sole right to grant and convey the easement to the City; that there are
no unrecorded interests in the Easement Premises; and that they will indemnify and hold the City
harmless for any breach of the foregoing covenants.

RANT OF I'1'EASEMENIA
A 40.00 foot wide temporary easement for public drainage and utility purposes lying over, across,
on, under and through Outlot F, ERHART FARM, according to the recorded plat thereof, Carver
County, Minnesota. The centerline of said easement is described as follows:
Commencing at the northeast corner of said Outlot F; thence southerly along the westerly right-
of-way line of Eagle Ridge Road, as dedicated on said plat, 46.89 feet along a non -tangential curve
concave to the east, having a radius of 530.00 feet, a central angle of 05 degrees 04 minutes 08
northerly line of said Outlot F has a bearing of South 75 degrees 56 minutes 36 seconds East),
seconds, and a chord bearing of South 11 degrees 31 minutes 20 seconds West (assuming the
thence southwesterly 236.63 feet along a reverse curve concave to the northwest, having a radius
of 520.00 feet, and a central angle of 26 degrees 04 minutes 22 seconds to the point of beginning;
thence North 55 degrees 28 minutes 02 seconds West 155.74 feet, to the southerly line of Lot 1,
Block 1, BUTTERNUT RIDGE ADDITION, according to the recorded plat thereof, Carver
County, Minnesota, and said centerline there terminating.
The sidelines of said easement are to be prolonged or shortened to terminate at said southerly line
of Lot 1, Block 1, BUTTERNUT RIDGE ADDITION, and the northwesterly right-of-way line of
said Eagle Ridge Road.
Said temporary easement will expire upon the earlier of (i) the subdivision of Outlot E or Outlot F
