TERNIINATION OF INGRESS AND EGRESS EASEMENT
's T rnunation of Ingress and Egress Easement entered into this� day of
b6q1 , 2022, by and between TIMOTHY A. ERHART and DAWNE M.
ERHART, husband and wife ("Erhart") and BLACK CHERRY DEVELOPMENT LLC, a
Minnesota limited liability company ("BCD").
WI�REAS, by Quit Claim Deed, dated April 10, 1987, recorded in the Office of
the County Recorder of Carver County, Minnesota, on April 18, 1987, as Document No.
86077, Delta Bandimere and Gladys Bandimere, husband and wife, and Arthur Bandimere
and Shirley Bandimere, husband and wife (collectively, the "Grantors'), granted to Erhart
an easement for ingress and egress over and across the West 50 feet of the West 183 feet of
the South 290.40 feet of the Northwest quarter of the Northwest Quarter of Section 25,
Township 116, Range 23, Carver County, Minnesota (the "Ingress and Egress
Easement");
WI�REAS, BCD is the successor -in -interest to the Grantors of the burdened
property under the Ingress and Egress Easement;
WHEREAS, Erhart is the owner of the Ingress and Egress Easement and has not
assigned or conveyed the Ingress and Egress Easement;
WHEREAS, the Ingress and Egress Easement has not been used and both Erhart and
BCD desire to terminate the Ingress and Egress Easement.
NOW, THEREFORE, in consideration of the mutual covenants contained herein and
other good and valuable consideration, the parties hereto hereby terminate and rescind the
Ingress and Egress Easement in its entirety and such easement shall be null and void and of
no effect.
