RELEASE OF ORIGINAL DECLARATION
THIS RELEASE OF ORIGINAL DECLARATION is made this 1 Oth day of
October, 2022, by the Riley Purgatory Bluff Creek Watershed District, a
governmental subdivision of the State of Minnesota with purposes and powers
pursuant to Minnesota Statutes chapters 103B and 103D ("RPBCWD").
RECITALS
WHEREAS, Foxwood, LLC, a Minnesota limited liability company
("Foxwood") and Timothy A. Erhart and Dawne M. Erhart, husband and wife
(collectively, "Erhart and, together with Foxwood, "Declarant") granted certain
rights to RPBCWD pursuant to a Declaration, executed by Declarant, dated
September 1 1, 2017, recorded September 29, 2017, as Document No. A652513
(the "Original Declaration") regarding certain real property within the City of
Chanhassen, Carver County, Minnesota,
WHEREAS, Declarant's successor in interest to such property has since
granted to RPBCWD certain other rights pursuant to a subsequent declaration,
which rights under said subsequent declaration supersede and replace the
rights granted to RPBCWD under the Original Declaration and, therefore, the
Original Declaration no longer serves any purpose or function.

NOW, THEREFORE, RPBCWD hereby releases and discharges the Original
Declaration in its entirety and such Original Declaration shall be null and void
and of no further purpose or effect.
IN WITNESS WHEREOF, the undersigned has executed this instrument the day
and year first set forth.
