MEMBERS ABSENT: None. APPROVAL OF MINUTES: APPROVE PARK & RECREATION MINUTES DATED NOVEMBER 22, 2022 Commissioner Peck moved, Commissioner Fischer seconded to approve the Minutes of the Park and Recreation Commission Meeting dated November 22, 2022 as presented. All voted in favor and the motion carried unanimously with a vote of 8 to 0. GENERAL BUSINESS: 1. 2022 YEAR IN REVIEW PRESENTATION Recreation Manager Tandon gave a slideshow presentation highlighting the Park Department programs and events from throughout 2022. New opportunities in 2022 included Youth Ice Fishing Camps and Team Ski and Snowboard Camps, Bunny Yoga, the Senior Center 30th 4 Park and Recreation Commission Minutes – December 13, 2022 2 Anniversary, Summer Concert Series Kick Off Day, Community Day at the Rec Center, and the 55+ Senior Expo. 2. 2023 PARK AND RECREATION COMMISSION VACANCIES Park and Recreation Director Ruegemer shared that Commissioners Fischer, Peck, and Chair Tsuchiya’s terms will be up on March 1, 2023 and applications will be ready on January 12, 2023. REPORTS: 1. TREE LIGHTING CEREMONY REVIEW Recreation Manager Tandon stated the 2022 Tree Lighting Ceremony was held on Saturday, December 3 from 5-6pm. Councilmember Haley Schubert and family flipped the ceremonial switch illuminating City Center Park. Despite low temperatures there was a strong turnout with around 500 people in attendance. The event had refreshments, s’mores, bonfires, carolers, live reindeer, and a visit from Santa. Ms. Tandon thanked Buy Chanhassen, SouthWest Metro Chamber of Commerce, The Mustard Seed Landscape and Garden Center, Living Christ Lutheran Church, and SouthWest Transit. She thanked the Park Department for putting up all the lights which looked great. She noted that 19 homes were registered for the Tour of Lights program throughout Chanhassen. 2. RECREATION CENTER QUARTERLY UPDATE Mr. Ruegemer updated the Commission that the City entered into a new contract for wall replacement with W.L. Wall. He shared about Rec Center events including the Artisan Fair, Holiday Boutique, Dance for Fun, Go Gymnastics, Paint your Pet (personalized cat and dog paintings), and sports including Small Fry Sports and Lil’ Star Sports, as well as Pickleball. Mr. Ruegemer noted upcoming events include Fit for Life Free Trial Class on January 17, and the Royal Ball on January 27. 3. SENIOR CENTER QUARTERLY REPORT Mary Blazanin, Senior Center Coordinator, gave an update noting they are wrapping up many fun holiday gatherings and parties right now. Quarterly events included Life Long Learning speakers and classes with 150 participants, Health and Wellness Services with 162 monthly attendees, as well as Weekly Groups and Clubs with 157 weekly attendees. She shared about the Senior Expo, Octoberfest Luncheon, Veterans Day Pancake Breakfast, Holiday lunch and celebration, and Noon Years Potluck Lunch. Day trips included Paramount Theater in St. Cloud, Ames Center in Burnsville, and A Christmas Carol at the Guthrie. She shared about donations and fees to help offset cost of the events and programs. 5 Park and Recreation Commission Minutes – December 13, 2022 3 4. PARK MAINTENANCE QUARTERLY UPDATE Adam Beers, Park Superintendent, gave an update stating the Roundhouse Park playground will be installed in the spring of 2023, the North Lotus hockey rink is ready, and they have been working on facility shutdown and winterizing the buildings. He noted the winter season is when the department work on trees along the trails, and skating rinks are being prepared. Temps should fall the following week and flooding will occur 24 hours a day to stabilize the ice and get the rinks ready for use. COMMISSION MEMBER COMMITTEE REPORTS: None. COMMISSION MEMBER PRESENTATIONS: None. ADMINISTRATIVE PRESENTATIONS: Mr. Ruegemer updated the Commission on the previous night’s City Council meeting, noting they adopted the 2023 budget with a 6.3% levy. The increased levy will cover additional trail maintenance dollars of $138,000. He noted they will get two of the three playgrounds the Commission proposed and depending on any surplus the City may be able to do the third playground at Carver Beach. They will do South Lotus and Sugar Bush in 2023. ADJOURNMENT: Commissioner Markert moved, Commissioner Kutz seconded to adjourn the meeting. Funds for the project are included in the 2023 Capital Improvement Program. SUMMARY This year's park and trail capital improvement program contains $170,000 for a variety of work to be completed as a part of the Park Equipment Replacement Schedule. Funds for the project have been distributed equally between South Lotus Lake Park and Sugarbush Park for the purchase and installation of new playground equipment, engineered wood fiber, and associated restoration costs. Four companies were selected to participate in the RFP process providing playground equipment designs. Vendors were selected based on past performance and equipment quality. Costs include supervised installation from vendor representatives and factory warranty on equipment. An online workshop was available for residents to vote on a preferred playground design for both South Lotus Lake Park and Sugarbush Park. Online voting was available January 4th - January 15th using the Civic Engagements Module on the city's website. There were more than 750 engagements with the poll and 482 residents shared their preference. Attached is a debrief of all engagements across all the different social media platforms, playground designs, quotes, and CIP sheet for the project. Customer agrees to regularly inspect and maintain the Equipment, and to provide, inspect and maintain appropriate safety surfacing under and around the Equipment, in accordance with PPLT’s product literature and the most current Consumer Product Safety Commission Handbook for Public Playground Safety. 2. Default, Remedies & Delinquency Charges. Customer’s failure to pay any invoice when due, or its failure to otherwise comply with the terms of this Quote, shall constitute a default under all unsatisfied invoices ("Event of Default"). Upon an Event of Default, PPLT shall have all remedies available to it at law or equity, including, without limitation, all remedies afforded a secured creditor under the Uniform Commercial Code. Customer agrees to assist and cooperate with PPLT to accomplish its filing and enforcement of mechanic’s or other liens with respect to the Equipment or its location or its repossession of the Equipment, and Customer expressly waives all rights to possess the Equipment after an Event of Default. Until all amounts due hereunder are paid in full, Customer shall not: (i) permit the Equipment to be levied upon or attached under any legal process; (ii) transfer title to the Equipment or any of Customer's rights therein; or (iii) remove or permit the removal of the Equipment to any location not specified in this Quote. 5. Purchase Money Security Interest. Customer hereby grants, pledges and assigns to PPLT, and PPLT hereby reserves a purchase money security interest in, the Equipment in order to secure the payment and performance in full of all of Customer’s obligations hereunder. Customer agrees that PPLT may file one or more financing statements, in order to allow it to perfect, acquire and maintain a superior security interest in the Equipment. 6. Choice of Law and Jurisdiction. All agreements between Customer and PPLT shall be interpreted, and the parties' obligations shall be governed, by the laws of the State of Missouri without reference to its choice of law provisions. Customer hereby consents to the personal jurisdiction of the state and federal courts located in the city and county of St. Louis, Missouri. 7. Title; Risk of Loss; Insurance. PPLT Retains full title to all Equipment until full payment is received by PPLT. Customer assumes all risk of loss or destruction of or damage to the Equipment by reason of theft, fire, water, or any other cause, and the occurrence of any such casualty shall not relieve the Customer from its obligations hereunder and under any invoices. Until all amounts due hereunder are paid in full, Customer shall insure the Equipment against all such losses and casualties. 8. Waiver; Invalidity. PPLT may waive a default hereunder, or under any invoice or other agreement between Customer and PPLT, or cure such a default at Customer's expense, but shall have no obligation to do either. No waiver shall be deemed to have taken place unless it is in writing, signed by PPLT. Any one waiver shall not constitute a waiver of other defaults or the same kind of default at another time, or a forfeiture of any rights provided to PPLT hereunder or under any invoice. Free door prize tickets will also be available at the event (one per person), with prizes exceeding $3,000 in total value. Food and drink concessions will be available for purchase. The popular ice fishing contest runs from 1-3 p.m., and over $6,000 in prizes will be awarded to the 50 largest fish by weight. Tickets are being sold for the contest at $10 each (limit 2) and are available online, at City Hall, and at the event beginning at 10:30 a.m. The February Festival Medallion Hunt, sponsored by Nicolet National Bank (formerly Charter Bank), will precede the event and will begin Monday, January 30th at 9 a.m. Clues will be posted on the city website as well as the front door of Nicolet National Bank in Chanhassen at 9 a.m. each day preceding the event. To promote the event, front-page ads with interactive QR codes were placed in the Chanhassen Villager and the Chaska Herald. Social media posts are being shared via city accounts and a Facebook event has been created and shared. Fishing contest information was physically mailed and e-mailed to all previous fishing contest participants. Posters and flyers will be posted around Chanhassen and in city facilities. February Festival would not be possible without the support of local businesses and service organizations. The Chanhassen Rotary is coordinating hot concessions from Grill Star Catering, and will be selling hot beverages, beer, and snacks. They will also drill over 1,000 holes for the ice fishing contest. The Chanhassen Lions Club will return as event marshals this year to enforce fishing contest 37 rules and DNR regulations. The boys and girls of Scout Troop #330 will be selling bait and s'mores kits again this year. The Riley Purgatory Bluff Creek Watershed District will be providing free snowshoeing to event participants. Free kicksledding demos will be provided by Carver County Parks. Vexilar and Clam Outdoors will be providing volunteers to help kids and families try ice fishing for the first time. Various other local businesses and organizations are providing merchandise donations for the fishing contest and door prize drawing, and the Carver County Sheriff's Department and Chanhassen Fire Department will be present at the event to ensure safety. The contest is scheduled for Saturday, February 4, 2023 from 1:00-3:00 p.m. on Lake Ann in Chanhassen. 2. Contestants may purchase one or two tickets, giving each contestant the opportunity to fish with one or two lines. One ticket per line, and one line per hole. Tickets must be attached to fishing poles or tip-ups by rubber bands, which will be provided on the ice. 3. No fish houses, fish house sleds, enclosures, wind breaks, coolers, large containers, glass bottles, ice augers, or ice chisels are allowed in designated fishing area. Chairs, heaters, five-gallon buckets with gear, bait pails, depth finders, thermos containers, fishing poles/sticks, and other miscellaneous small gear is allowed. 4. No motorized vehicles/ATV’s allowed in the designated fishing areas other than those being used by emergency personnel. 5. Contestants are allowed to set up in the fishing area prior to contest, but no pre-fishing is allowed. In order to claim a fishing hole, a fishing pole or tip-up with an attached fishing ticket must be present. Weighted lines without hooks or bait can be used to check depth prior to 12:45 pm. No lines are allowed in the water from 12:45 pm to the start of the contest. No underwater cameras are allowed in the water after 12:45 pm. Contest marshals will strictly enforce compliance. All fishing must take place within the contest area. 6. To enter a fish, bring it to the judge’s stand immediately upon catching it. Fish must be alive in order to be eligible. All eligible fish will be returned to the water after weigh in. 7. Pursuant to DNR regulations, all largemouth bass and northern pike from 24”-36” must be immediately returned to the water. These fish are ineligible for the contest and DNR regulations will be strictly enforced. 8. All “largest fish” prizes are determined by weight and will be awarded following the contest. You may enter all the fish you catch, but only one “largest fish” prize will be awarded per person. In the event of a tie in weight, the contestant with the first entry wins the higher prize, the second fish places next. a. Please note: In the event that a portion of the “largest fish” prizes are not awarded using this method, a drawing from all fishing ticket stubs will be held to determine winners. Each winner will be asked a trivia question – if they answer the trivia question correctly, they will be awarded the prize. If they answer incorrectly, a new ticket stub will be drawn. 9.
