Café Zupas – CUP (Conditional Use Permit) Statement of Compliance – Chanhassen, MN
Café Zupas is looking to build a new, free-standing drive-thru restaurant on the pad of the West
Village shopping center. The fast casual restaurant use is complimentary to the shopping center
and compatible with the retail and restaurant uses in the area and the zoning district. The
addition of the Café Zupas restaurant will not create any hazard or nuisance to the neighboring
uses. Given the location in an existing shopping center, the site can supply the necessary
services, including fire, police, trash and required utilities, and will not stress the system. Also,
the new building will not be detrimental to the economic welfare of the community, providing a
new, fresh, house-made food alternative.
The use and design are in accordance with the city’s comprehensive plan and design standards
and will be complimentary to the existing shopping center while also keeping with Café Zupas
brand identity. Again, given the location in the existing West Village Shopping Center the new
restaurant will not create additional traffic congestion in the area, rather it will allow the city to
work with the owners to improve the flow into the existing center.
This new Café Zupas restaurant will operate similarly to all the Café Zupas Drive Thru restau-
rants and will not create conditions that are detrimental to the area is it relates to odors, trash,
traffic, and we expect it will only have a positive impact to the community and the surrounding
property values. The parking study dated Dec. 2022 shows that overall parking in the West
Village Shopping Center is underutilized (see table 9, pg. 42) and the addition of a new build-
ing with drive-thru would keep the parking demand below capacity.
In addition to the Conditional Use approval Café Zupas is requesting consideration for a vari-
ance as it relates to a design element for our building. We have designed a building that has
variations in depth and height to make for a more interesting and attractive design. The east
elevation proposes a small tower element that has a faux living wall and a painted element that
says, “Nourish the Good Life”, a reference to our fresh, healthy, and house made offerings.
This wall would otherwise be a large blank surface and with the design element presents a more
complete presentation. While this painted element is not signage, per the Chanhassen code it
will be considered a sign and therefore be more than what we would be permitted. It is for this
painted element that we are requesting the variance. We do feel that this request will make for
a more attractive design and will be in harmony with the area and the West Village Shopping
Center.
