VARTANCE 2023:11
Permit. Subject to the tenns and conditions set fofth herefur, the City of Chanhassen hereby grants
the following variance;
The Chanhassen Board of Appeals and Adjustrnents approves the requested 6-foot side yard
setback, 2-foot driveway setback, and 5 percent lot cover variances for the construction of a
detaclred Ea:"age, subject to the conditions of approval,

ancl legally descr.ibed as Lot 2, Block 2, City Lots of Chanhassen, CarverCounty, Minnesota.
Conditions. The variance apploval is subject to the following conditions:
A building perrnit must be obtained prior to demolishing any structures on tlre site and before
beginning any construction on the site .
Building plans must provide sufficient infonnation to verifu that proposed building meets all
requirement.s of the Minnesota State Building Code, additional comments or requirements may be
required after plan review.
Retailing walls (if present) more than four feet high, tneasured from the bottom of the footing to
the top oI the wall, inust be designed by a professional engineer and a building permit must be
obtai;ed prior to coustruction. Retaining walls (if present) under four feet in height require a
zouing pelrnit,
The applicant shall have the proposed right-of-way (alley) vacated and recordcd with the Carver
County Land Records Depaftment prior to issuance of a building permit.
The applicant shall update their construction plans to include a turuaround in accordance with Sec
2O-1122(d)(8) of City ordinance prior to issuancc of a building permit.
The plalter box depicted in the public right-of-way (alley) owned by the applicant must be
relocated within thi applicant's propeffy and maintain a minitnum separation of 10 feet from the
sanitary sewcr main located within the right-of-way'
A reviscd design rrust be developed by the applicant to address the increase in stormwater
volprnes created over the lot cover lirnit. The design shall include stormwater Best Managelnent
practices (RMPs) to treat stolmwater calculated as 0.55 inches rnultiplied by the inct'ease in lot
cover ovet 25%. Design plans must be approved by the Water Resources Engineer'
An Operatious aud Maintenance agreement describing the precise location and extent of the
onsite BMP(s), as well as rnaintenauce activities and an inspection checklist shall be signed by
thc pr.opefty owner and the city and shall be recorded against the property at the county recorder's
office. The property owller shall be responsible fol all costs and fees associated with the
operations and maintenance agreelllent creation and recolding,

9. The installation of any improvements on the Site shall meet allapplicable jurisdictional
requirements, including but not limited to the Minnesota Depaftment of Natural Resources and
the Riley Purgatory Bluff Creek Watershed Distlict, and all applicable pennits shall be obtained
prior to any site improvements.
10. Eaves may extend no more than 1.5 feet beyond the approved setback and the edge ofthe eaves
must be at least 2.5 feet fi'om the side lot line.
I 1. Gutter downspouts may not be oriented to the west.
4. Lapse. lf within one (l ) year of the issuance of this variance, the allowed consruction has not been
substantially completed, this variance shall lapse.
