CAS-02_2017-02 VARIANCE OWNER: YOUNGSTEDT'S11-62- CITY 1-6Z CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 622 AN ORDINANCE AMENDING CHAPTER 20 OF THE CHANHASSEN CITY CODE, THE CITY'S ZONING ORDINANCE, BY AMENDING A PLANNED UNIT DEVELOPMENT THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS: Section 1. Chapter 20 of the Chanhassen City Code, the City's zoning ordinance, is hereby amended by amending the Mission Hills Planned Unit Development Design Standards in its entirety as follows: Mission Hills Zoning Standards a. Intent The purpose of this zone is to create a PUD neighborhood commercial/mixed density housing zone. The use of the PUD zone is to allow for more flexible design standards while creating a higher quality and more sensitive proposal. All utilities are required to be placed underground. Each structure proposed for development shall proceed through site plan review based on the development standards outlined below. Except as modified by the Mission Hills standards below, the mixed density housing development shall comply with the requirements of the R-8, Mixed Medium Density District. Except as modified by the Mission Hills standards below, the commercial development shall comply with the Neighborhood Business District, BN. Lot 1, Block 1, Mission Hills 3'd Addition shall comply with the R-12, High Density District. b. Permitted Uses The permitted uses within the development shall include the following: • Single Family Residential • Medium Density Residential • High Density Residential with a Child Daycare Center C. Setbacks In the PUD standards, the building setback for commercial is 50 feet from any public right-of- way. The High Density parking setback shall be 35 feet from any public right-of-way and/ or interior property line. There shall be a buffer separating the residential portion from the High Density portion of the site. This buffer shall be in the form of a bene and landscaping. All units shall have access onto an interior street and not 86th Street. 6. The apartment building located on Lot 1, Block 1, Mission Hills 3'd Addition shall: a. Have pronounced entrance. b. Insure that all foundation walls are screened by landscaping or retaining walls. c. Have materials which include masonry, painted siding, and exterior finish and insulation system (E.I.F.S.) and the structures will have sloped shingle roofs. All elevations that can be viewed by the public have received equal attention. e. Site Landscaping and Screening The planting plans prepared for the site are intended to create a strong sense of street tree plantings using overstory deciduous trees such as Summit Ash, Linden, and Sugar Maple. Highways 101 and 212 will be buffered with a combination of overstory evergreen trees and ornamental deciduous trees. The outdoor private living areas will be buffered with the use of evergreen trees. The wetland will be highlighted with the introduction of native wetland species. In addition, to adhere to the higher quality of development as spelled out in the PUD zone, all loading areas shall be screened. Each lot for development shall submit a separate landscaping plan as a part of the site plan review process. Berms of 2 to 3 feet high shall be added along the Highway 101 and 212 right-of-way. These berms shall be seeded and/or sodded and bushes and trees shall be planted on them. All disturbed areas within the single family lots shall be seeded and/or sodded. Two trees with a minimum of a 2'h inch caliper shall be planted within the front yard setback. These two trees shall consist of one overstory evergreen tree and one ornamental deciduous tree. 1. All open spaces and non -parking lot surfaces (outlot) shall be landscaped, or covered with plantings and/or lawn material. 2. Outdoor storage is prohibited. 3. Loading areas shall be screened from public right-of-ways. Wing wall may be required where deemed appropriate. 4. The Outlot shall be seeded and maintained in a weed free condition in all areas proposed for future development. f. Signage One monument sign along Great Plains Boulevard shall be permitted for Lot 1, Block 1, Mission Hills 3'd Addition. 1. Monument signage shall be subject to the monument standards in the sign ordinance. 2. Wall signs are permitted on no more than two street frontages. The total of each wall mounted sign display areas shall not exceed 24 square feet. 3. All signs require a separate permit. 4. The signage will have consistency throughout the development and shall tie the building materials to be consistent with the signs. Signs shall be an architectural feature, they shall not be solely mounted on a pole of a foundation. 5. Consistency in signage shall relate to color, size, materials, and heights. 6. No illuminated signs within Lot 1, Block 1, Mission Hills 31 Addition may be viewed from the residential section of the PUD. 7. Only back -lit individual letter signs are permitted. 8. Individual letters may not exceed three feet in height. 9. Only the name and logo of the business occupying the unit will be permitted on the sign. RESIDENTIAL One monument identification sign shall be permitted for the residential development. The sign may not exceed 24 square feet in area and 5 feet in height. g. Lighting 1. All light fixtures shall be shielded high-pressure sodium or LED fixtures. Light level for site lighting shall be no more than one-half foot candle at the property line. This does not apply to street lighting. The maximum height of a residential street light shall not exceed 15 feet. Light fixtures within Lot 1, Block 1, Mission Hills 3' Addition shall not exceed 25 feet. 2. Glare, whether direct or reflected, as differentiated from general illumination shall not be visible beyond the limits of the site from which it originates. 3. Lights shall be on a photoelectric cell to tum them on and off automatically as activated by yearly conditions. Mayor Laufenburger: Ahight, thank you very much. sI 35 Chanhassen City Council — January 23, 2017 X Kate Aanenson: Thank you. This item appeared before the Planning Commission on January P. The Planning Commission voted 4-0 to approve the variance for a sign at 50 Lake Drive East. The applicant, Matthew Duffy, owner Steve Youngstedt. I have quite a few slides here but in the interest of time I'm going to kind of breeze to the main issue. MacKenzie Walters on our staff did a great job explaining the nuances of this. There was a variance granted before. That being that there's 3 properties involved in the existing sign that's off premise. 30, 40 and 50 Lake Drive East so they currently have an off premise sign. A highway sign. Each of those, two of those parcels that have frontage on are allowed those so they were given a variance in order to accommodate them all on one post. And I'm not going to go through all the zoning. So there has been other variances in the area. Okay, goodness sakes. Okay so these are the 3 properties that are included at 30, 40 and 50 Lake Drive East and there was some other variances which I'm not going to spend a lot of time going through those but they were granted a variance and that sign sits out on Highway 5 right now and it's got all 3 users of Youngstedt's. Different businesses on that sign and that sign, I'll go to this one. Looks like this. This is the existing sign so the main issue there is that the sign, the proposed sign would have a 4 foot height variance which was granted before and a 16 foot area so by putting in the message center, which is allowed as part of this package, in filling this in it adds about an additional 20 square feet. The staff felt comfortable with that recommendation of giving the variance. We had already given a variance to the existing sign. We think it's appropriate to keep all the signs at one location as opposed to the two separate which could be taller so, and in looking at this and the fact of giving them the message center they had some visuals that were included in the packet that show looking at it from a distance. Very hard to read that small script so and this way you're getting the opportunity, the message center for all 3 businesses so the staff did support that as did the Planning Commission. So again we are supporting the variance. The applicant, a representative is here so we are recommending that you allow the 12 foot high ground low profile sign with the 80 foot square foot display area with the conditions in the staff report which would require getting a permit. So existing posts would stay in place. We're just changing the internal formation on that so with that I'd be happy to answer any questions that you have. Mayor Laufenburger: Thank you Ms. Aanenson. APPROVE AMENDMENTS TO CHAPTER 10 OF THE CHANHASSEN CITY CODE REGARDING ON -SALE INTOXICATING LIQUOR LICENSE FOOD TO LIQUOR SALES RATIO REQUIREMENT. Mayor Laufenburger: Who's got this one? Todd Gerhardt: Staff is asking that the council remove the requirement that on -sale wine and beer and on -sale intoxicating liquor licenses serve a 50 percent food to liquor ratios. Right now our restaurants have to have a 50150 ratio of at least 50 percent food to liquor and staff has done numerous surveys and have found that this trend is going away with the micro breweries and things like that popping up. That more establishments, restaurants are serving more liquor than food because of the price of the liquor and so staff is recommending that change and eliminating the 50 percent attributed to the sale of food. We have a slow no wake zone, a Chapter 19 and 20 storm water issue, a wetland protection ordinance issue and then an application by Youngstedt's for a sign variance. Being that the City is the applicant on the first 3 items I would request that we go ahead and move item 4 up to the top of the agenda so that the non -community individuals can come forward and make a presentation since they're here. For the record we have a quorum and hearing no objection we'll go ahead with Youngstedt's sign variance which is a request to install an 80 square foot monument sign located at 50 Lake Drive East for Youngstedt's Car Wash, Collision Center and Tire & Auto Service. YOUNGSTEDT'S SIGN VARIANCE — REQUEST TO INSTALL AN 80 SQUARE FOOT MONUMENT SIGN LOCATED AT 50 LAKE DRIVE EAST FOR YOUNGSTEDT'S CAR WASH, COLLISION CENTER AND TIRE & AUTO SERVICE. Walters: Thank you. So this is Planning Case 2017-02. The variance for 50 Lake Drive East. The variance is as you mentioned for a 12 foot high ground low profile sign with 80 square feet of sign display area. The location of this, this variance actually involves 3 separate parcels although the sign is permitted under the 50 Lake Drive East address. The parcels 40 and 50 Lake Drive East are adjacent to Highway 5 and 30 Lake Drive East has frontage on Lake Drive. They're all accessed from the communal drive on Lake Drive East here. The zoning surrounding these parcels is predominantly, immediately surrounding is in green. It's Highway and Business Services District. To the east is an industrial office park and south of Lake Drive East is single family residential housing. Free standing signs like the one being requested are permitted in the Business Highway Services District and also in the Industrial Park District. The zoning for this district would allow structures with more than 50,000 square feet to have pylon signs of up to 20 feet high or, I apologize. My slide appears to have gotten a little mussed up there. Or less than 50 square feet, 16 feet high pylon signs. The display area for the over 50,000 square feet is capped at the 80 square feet of display area. Less than 50,000 square feet is 64 square feet of display area. For the ground low profile signs like we're discussing tonight the maximum height for the district is 10 feet for the buildings over 50,000 square feet and those less than 50,000 are restricted to 8 feet in height. Again with the respective 80 square feet for the larger structures J Chanhassen Planning Commission — January 3, 2017 and 64 square feet of display area for the smaller structures. I should note that the original site plan for these buildings included a variance for a 12 foot high ground low profile sign. Electronic message centers are also allowed within the Business and Highway Services District and in the case of those anyone that's 64 square feet or over is restricted to no more than 40 percent of the sign display area can be electronic message center. So for an 80 square foot sign the maximum size would be 32 square feet. So a little bit of history on the site. As I mentioned when this was first brought before the Planning Commission in 1992 there was a recommendation to have the 12 foot high ground low profile sign in exchange for the applicant consolidating the signage from 30, 40 and 50 Lake Drive East into a single sign. The idea was to reduce the amount of clutter along Highway 5 and also to not have additional free standing signs facing the single family district to the south across Lake Drive. In June of 1994 the sign plan was approved with that 12 foot variance. In 1994 the permits for the existing sign for 40 and 50 Lake Drive East were issued and in '96 the panel for 30 Lake Drive East joined the sign as well. In 2000 some of the panels were replaced and that has been all of the activity on the sign to date. So what the applicant is proposing is to keep the existing 12 foot high ground low profile sign. They would be using the existing sign supports seen here. They would be adding an 80 square foot sign display area with a 32 square foot electronic message center so this would require a 16 square foot variance from the ordinance's normal 64 square feet of signage allowed for these parcels. They are proposing to continue to consolidate detached signage for 30, 40 and 50 Lake Drive East into the single 50 Lake Drive East sign. The location would be the same as present. The narrow parcels and narrow building profiles prevent pretty limited wall signage facing Highway 5. That combined with the 50 foot setback from the highway and then the minimum 10 foot setback from the yard has created some limited visibility for the existing sign which is why they are requesting relief in the form of an 80 square foot sign instead of the normal 64 foot. Right here you see the sign location. Again they're proposing to maintain the current location. The sign has been there since '94. We've never received any complaints about in terms of safety, sight lines, anything like that so comparing the existing sign to what's proposed, as I mentioned a 12 foot height would be retained. The current sign has three 20 square foot panels. Those would be replaced with a single 80 square foot panel but it would stay within the current boundaries established by the sign and they would be installing an electronic messaging center. For comparison without the variance and consolidation each parcel in theory could have both 40 and 50 Lake Drive East would be entitled to up to a 16 foot high pylon sign with an individual 64 square feet of display area and 28.8 square feet of message center so again the proposed consolidated signage equals a lot smaller visual impact on the Highway 5 corridor. This is just recapping again the theoretical different combinations of signage allowed under the ordinance. I should mention that 30 Lake Drive East would also be entitled to an 8 foot high ground low profile sign with the 64 feet of display area and the 28.8 square foot message center. So the staff's assessment is we agree that the existing sign does have limited visibility because it's broken into the three 20 square foot cabinets and it is located a significant distance back from Highway 5 with cars moving at 55 miles per hour there are definitely some legibility issues. The height and location would remain unchanged. The net change to this variance would be adding 16 square feet of display area. The applicant would continue to waive the right to any other detached signage except I believe a small directional sign which they're allowed without permit 2 Chanhassen Planning Commission — January 3, 2017 under our ordinance and it is our belief that one 80 square foot sign is preferable to multiple 64 square foot signs along that corridor. For that reason staff does recommend approving the proposed sign variance with conditions. If you have any questions I'd be happy to take them at this time. Aller: I don't have any questions. Anyone else have a question? Tietz: I just have one question. Aller: Commissioner Tietz. Tietz: It's more for information because I certainly don't object to this at all. It seems very appropriate and consistent with the past and obviously a consolidation but is there, with electronic signs the repetitively of change, is there a distraction factor for traffic on highways if it, now this one probably is I don't know pretty static but if it changes rapidly and goes to a lot of different messages, is there any issue with that from the highway department or from public safety at all? Walters: Yeah. Tietz: Not just this sign, I'm just saying, I'm trying to learn a little bit. Walters: Yep that's a, it's always a concern with message centers. This electronic message center would be required to meet the conditions of our ordinance so we prohibit flashing, scrolling, otherwise distracting message centers so when they came around for the sign permit where the variance would be issued, you know we would speak with the applicant. Make sure their image change time conformed to our ordinances guidelines and we have had some preliminary talks on that and yeah. Aanenson: I would just say the other thing we do control is the level of nits which is the illumination so if it does, if we do get reports of you know sparkling or something that would be distracting then we would just follow up and address with the applicant. Tietz: Yeah. Pretty unique technology today to make changes rapidly and keep ... thanks. Aller: Any additional questions at this time? Weick: We're not requiring that they maintain the existing pylons right? They could rebuild those if they wanted? Walters: The conditions that staff is proposing would require that any replacement pylons match the material and construction of the building aesthetics but were the applicant to choose to redo the pylons, there's nothing in this variance that would stop them. Aanenson: If I may, one of the conditions we do on pylon signs is that they be architecturally compatible with the building so it is brick, we want these to be brick. The hall here but after so many years we just thought we'd better update the sign. When Abra moved up hugging the highway, I get 3-4 calls a week, where are you? I'm dumbfounded after 22-23 years of being there so I give them directions. Now they just zip, and it's from the back on Lake Drive. There's a big Abra sign, Victory sign, they go right by us. They don't stop so we should have done this a long time ago and it's time to get `er done but Youngstedt's, I mean I have never worked for a better company that donates over a half a million dollars to the Chanhassen, the Eden Prairie, the Victoria high schools. It's just a great company to work for and I suspect I'll be there another 5-10 years. I don't know but it's just, I want people to find us and it's frustrating when I've been there so long they can't find us. Even right now I just what the heck. When Abra went up close to the road there that was a big blockage so I think this proposal just might help us and that little sign in the back. Before I get going I'd like to clarify that really Chapter 18 and 20 are the chapters that come before this body for the public hearing. Chapter 6 and 19 are included here for informative purposes so that this body knows where we are going and Chapter 19 has prompted some ancillary changes to Chapter 18 and 20 that I will discuss as we go through this. Go through this presentation tonight. Aller: Great. If I could just take a second to ask and inquire of the commissioners, any objections to having all 3 items presented at once? Weick: No objections. Aller: Seeing none, thank you Jeffery proceed. Jeffery: Well as you're all aware we're going through local water management plan update. This is a response to changes at the federal, regional, state and local level. So as part of that our local controls also need to update. Not all 3 of the local controls that are being discussed tonight are part of the local water management plan but Chapter 19 and Chapter 20 are. But I will start with Chapter 6 which is the slow no wake zone. So a brief history. So really I'll be moving in reverse order of how they are placed on your agenda for tonight. The slow no wake, the first time we looked at, City of Chanhassen looked at implementing a slow no wake was in 2001. They looked at Lotus Lake specifically and at that time they could not, it did not pass because they could not reach consensus about what the triggering elevation of the lake would be. So time passed and then in October, September and October of 2005 if anybody remembers we had a particularly rainy season. We saw a lot of infrastructure damage and we saw a lot of lake levels coming up so at that time they introduced a slow no wake ordinance for all recreational management classed lakes within Chanhassen. Through a variety of discussions and other reasons what ended up happening is Lake Susan and Lotus Lake both had a slow no wake ordinance, special slow no wake ordinance placed on it but none of the rest of them did. Then that brings us to June, 2014 where the Minnesota Department of Natural Resources after about 12 inches of rain in a 3 week period issued an emergency slow no wake for all area lakes. The parcels currently have a variance allowing for a 12 -foot high ground low -profile sign with the condition that the three parcels consolidate their freestanding signage. Were the signage not consolidated, each business would be entitled to a separate freestanding sign with up to 64 square feet of display area. Staff believes that a single consolidated sign reduces cluttering and is aesthetically preferable. The proposed sign would utilize the existing sign's supports, be located in the same position, and would need to comply with the city's sign code. Staff is recommending approval of this variance request. PLANNING COMMISSION SUMMARY The Planning Commission held a public hearing on January 3, 2017 to review the proposed variance. No members of the public spoke for or against the variance request. Planning Commission Youngstedt's Variance - Planning Case 2017-02 January 3, 2017 Page 6 of 8 ANALYSIS The staff report for the property's original sign plan review dated May 5, 1994 outlines the Planning Commission and City Council's rational for approving the existing ground low profile sign's 4 -foot height variance. The report indicates that staff proposed the applicant consolidate the three parcel's signage in exchange for allowing 30 Lake Drive E to have signage facing Highway 5. Staff and the applicant settled on the current 12 -foot high sign with 60 square feet of display area. The staff report justified the 4 -foot variance by noting that the existing sign code would have permitted both 40 Lake Drive E and 50 Lake drive E to have 20 -foot high pylons signs with 80 square feet of display area. The Planning Commission and City Council agreed with stats s assessment that a single coordinated sign was preferable and granted the variance. On January 9, 1995 Ordinance 231 amended the City Code to limit 20 -foot high pylon signs and 10 - foot high ground low profile signs with 80 square feet of display to parcels with principal structures in excess of 50,000 square feet. The rational was that buildings of this size would have sufficient frontage to adequately space out these signs along the corridor, mitigating the visual impact, and that the potential for a larger number of tenants justified a larger maximum display area. All three of the principal structures located on 30, 40, and 50 Lake Drive E are under the 50,000 square feet required by the existing ordinance for the larger signs, and their combined square footage of approximately 22,823 square feet also falls well short of the stipulated threshold. While the buildings would no longer be allowed 20 -foot high signs with 80 square feet of display area, the zoning code does allow for signs of that scale within the Highway and Business Services District. The proposed sign would equal the district's maximum permitted display area and would exceed the maximum permitted height for a ground low profile sign by 2 feet, but would be 8 feet under the maximum permitted height for pylon signs. The City Code would allow for both 40 and 50 Lake Drive E to construct their own 16 -foot high pylon signs with 64 square feet of display area along Highway 5. While 30 Lake Drive E would not be able to construct a sign facing Highway 5, it would be able to erect an 8 -foot high ground low profile sign with 64 square feet of display area facing Lake Drive E. Staff believes that one consolidated sign is preferable to multiple signs in close proximity to one another along the Highway 5 corridor. The proposed sign's height and placement is the same as the existing sign. To date the existing sign's height and placement have not generated any safety concerns or complaints. The increase from 60 to 80 square feet of display area will be the result of filling in the space between the three existing cabinets. Filling in these gaps will increase the sign's apparent mass; however, the proposed sign will not exceed the boundaries created by the existing pillars. The proposed EMC will be subject to the sign code's general provisions regulating brightness, motion, and scale. These provisions are designed to ensure that the EMCs do not create safety risks Planning Commission Youngstedt's Variance - Planning Case 2017-02 January 3, 2017 Page 7 of 8 by distracting drivers. The proposed EMC would have a display area of 32 square feet, the largest the code allows in this district. While this is a large EMC, its visual impact would be less than that of two distinct 28 square foot EMCS which the Sign Code would otherwise allow these properties. SUMMARY The proposed sign would require a 4 -foot height variance and a 16 square foot display area variance. While the proposed sign is larger than what the ordinance allows for these properties, it does not exceed the dimensions allowed for the Highway and Business Services District. Staff believes that it is preferable to have a single consolidated sign with 80 square feet of display area facing Highway 5 rather than potentially having two signs with a combined display area of 128 square feet of display area along the same frontage. The view to the properties from MN Hwy 5 is blocked by trees and the car wash sits behind the other two buildings. The current sign does not effectively advertise and promote our businesses to traffic on MN Hwy 5. We know from much anecdotal evidence that many people that could benefit from our services in the western suburbs near Chanhassen do not know about the location of our businesses in Chanhassen. We believe replacing our current monument sign (three individual and smaller static signs) with a digital message center sign would enable us to advertise more effectively to the cars that drive by every day on MN Hwy S. We would like to combine the signage allowance for our three properties and install one new sign to support all three businesses. Proposed Sign Design: • 10x8 Overall Sign = 80 sf • ID Component at the top for Youngstedts overall brand • 48 Electronic message center to support all three businesses • Three (3) individual panels highlighting each of the three different business locations Preferred Design Because our three Chanhassen locations are set off MN Hwy 5, our buildings and the building signage are not effective advertising mediums. Most people that drive by Hwy 5 do not see or notice our businesses. The only tool we have to advertise our Chanhassen locations to Hwy 5 traffic is our combined monument sign. Because of setback requirements on MN Hwy 5, the current allowance for our sign setback is a considerable distance from the road. As a result it is more difficult for drivers to easily view and read the contents of our signage. We believe the most effective advertising tool we can deploy is a panel that identifies our overall Younstedts brand logo, spaces identifying each of the three businesses and a larger electronic message center to display advertising messages that would support all three businesses. We believe the ability to change the static advertising message through a software controlled message center will not adversely affect the community or the traffic on Hwy S. By being able to communicate our various services more frequently to the people that live and travel through Chanhassen, we are making it easier for them to find and support a local business. On March 22, 1993, the City Counca3 approved: 1) Site Plan Review for Abra Auto Service Center, 6,494 Square Feet; 2) Conditional Use Permit to Allow an Auto Service Facility in the BH District. Both applications were approved with the following conditions relating to signage: 1. A 4 foot varve to achieve a 12 foot high monument sign. This sign which will face Highway 5 shall contWo only the names of ilse occupants of Lots 1, 2 and 3. The applicant must obtain a sign permit prior to erecting any signage on site. Provide a detailed sign plan for staff review prior to the City Council meeting. The monument sign may not exceed 12 feet in height Sign covenants are to be submitted outlining the use and limit of one common sign and allowances for its use by the remaining undeveloped lot. Planning Commission May 5, 1994 Page 2 2. No signage will be allowed until sign plan approval is obtained from the Planning Commission and City Council. The applicant has submitted a sign plan for review and approval. ANALYSIS: The zoning ordinance allows one ground low profile business sign per street frontage, with a maximum of two such signs per IOL The area of the sign may not exceed 80 square feet in display area nor be greater than 8 feet in height The sign must be located 10 feet from any property line. The ordinance also permits one pylon business sign, not to exceed 64 square feet in display area. Such sign shall be located at least 10 feet from any property line, and shall not exceed 20 feet in height When the applicant submitted the original application, one monument identification sign was proposed at the north edge of the site facing Highway 5. Staff proposed that if the Goodyear and the Abra signs were combined into one free standing sign, the third parcel located to the south would also be permitted to have signage facing Highway 5. This third sign would be part of the Abra and Goodyear free standing sign. The applicant started working on a design for the free standing sign; however, we believed additional refinement was required. The applicant has submitted more detailed plans. The area of the sign is proposed to be 60 square feet. The ordinance allows 64 square feet in area and a maximum height of 8 feet for monument signs. The sign is designed as a monument and not a pylon due to the height of the sign board above the ground. The applicant requested a height of 12 feet Considering the fact that the applicant could place a pylon sign with an area of 80 square feet and a height of 20 feet, staff was in favor of granting a 4 foot variance for the height of the monument sign. It is a clear benefit to have one coordinated sign instead of two individual pylon signs. The Planning Commission and City Council concurred with staff and granted the applicant a height variance to allow a 12 foot high sign. The sign ordinance also allows one wall business sign per street frontage for each business occupant within a building. The total of all wall mounted sign display area shall not exceed 15% of the total area of the building wall upon which the signs are mounted. No individual business sign shall exceed eighty square feet in sign display area. A wall business sign may be mounted upon any wall of a principal building. Both buildings have two wall mounted illuminated signs along the north and west for Goodyear and north and south for Abra. Staff recommends that all signage facing south be non -illuminated to protect the residential neighborhood located south of Lake Drive East. Goodyear's sign contains approximately 50 square feet of signage. Abra has not identified the square footage of their wall mounted sign, however, the sign description submitted by the applicant (Attachment #1) states that the sign area shall not exceed 80 square feet Planning Commission May 5, 1994 Page 3 On -premises directional signs are also permitted if they are not larger than 4 square feet. The maximum height of the sign shall not exceed five feet from the ground. The placement of directional signs on the property shall be so located such that the sign does not adversely affect adjacent properties or the general appearance of the site from public rights-of-way. The number of signs shall not exceed four unless approved by the city council. Both Abra and Goodyear will utilize directional signs. Goodyear is proposing two directional signs for customers reflecting "Goodyear Entrance" and "Goodyear Office." The sign description reflects an area of 6 square feet per sign. The area must be reduced to 4 square feet to meet the maximum 4 square feet permitted by ordinance. The height of the signs are 4 feet which is in compliance with the ordinance requirements. The Abra directional signs reflecting "ABRA" and ARRA Drive -In Estimates" has an area of 5 square feet, according to the narrative submitted by the applicant, however, the plans reflect a 4 square foot sign. The area must be reduced to meet the maximum 4 square feet permitted by ordinance. The height of the signs are proposed at 4 feet which is in compliance with the sign ordinance requirements. The following shall serve as a guideline for the sign covenants: 1. The monument sign which will face Highway 5 shall be 12 feet high and contain only the names of the occupants of Lots 1, 2 and 3. The material and color of brick used shall be consistent with brick and colors used on the Abra and Goodyear buildings. 2. All businesses built on Lots 1, 2, and 3 shall share one monument sign. 3. Wall signs are permitted on no more that 2 street frontages. The total of all wall mounted sign display areas shall not exceed (80 square feet). 4. All signs require a separate permit. 5. Consistency in signage shall relate to color, size, materials, and heights. 6. No illuminated signs facing south may be viewed from the residential section located south of Lake Drive East. 7. Only back -lit individual letter signs are permitted. 8. The area of all directional signs shall not exceed 4 square feet and the height shall not exceed 5 feet. On January 23, 2017 the Chanhassen City Council met at its regularly scheduled meeting to consider the application of Mathew Duffy on behalf of Steve Youngstedt for a sign variance for the property located at Lake Drive E and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Highway and Business Services District (BH). 2. The property is guided by the Land Use Plan for Commercial. 3. The relatively narrow profiles of the buildings located on 40 and 50 Lake Drive E and their substantial setback from Highway 5, combined 30 Lake Drive E's lack of Highway 5 frontage makes these businesses highly reliant on their shared monument sign to inform and attract customers. By combining their signage, the business located on 30, 40, and 50 Lake Drive E reduce the number of detached signs and amount of display area along the Highway 5 corridor and Lake Drive E. It is in line with the spirit and intent of the City's Sign Ordinance to permit business to consolidate signage in order to avoid a cluttered appearance along commercial corridors. Furthermore, the requested height and display area do not exceed the maximum amount allowed within the Highway and Business Services District. 5. The planning report, Planning Case #17-02 dated January 3, 2017, prepared by MacKenzie Walters, is incorporated herein. DECISION The City Council approves the variance request for a 12 -foot -high monument sign with 80 square feet of sign display area. The code stipulates that variances cannot be grated that "adversely affect the spirit or intent of this article." It is my belief that the code establishes the three tiers of sign size and specifies a decreasing percentage of message center signage for each subsequent tier with the intent of limiting the maximum size of a single message center. The maximum threshold established is 32 sq. ft. If the code was not concerned with establishing a set limit for message center size the initial tier's 50% ratio would have been applied to all sign sizes. I would also be concerned about the precedent of allowing for a larger sized message center without a clearly defined hardship. Many businesses could make a case for combined signage or not taking advantage of their theoretical maximum signage in exchange for a larger message center. Allowing a business to make a case that they should be allowed a sign of proportions and size permitted by the ordinance despite not technically meeting the square footage requirement for that category of sign is in this case justifiable, but allowing businesses to exceed the maximum size limits specified for their zoning district is a very different type of variance... and one I would not support. Please keep in mind that the Planning Commission and City Council have the sole authority to grant a variance. They may or may not go with staffs recommendation. (2) Wall signs shall be either illuminated or non -illuminated and shall meet the following criteria: a. Backlit or exposed lighting shall be architecturally compatible with the building and other signage if in a multi - tenant building. b. If a neon sign is illuminated by exposed neon or LED, the luminous shall not to exceed 5,000 Nits between the hours of civil sunrise and civil sunset and not to exceed 500 Nits between the hours of civil sunset and civil sunrise. c. If a sign is non -illuminated, downcast decorative lighting compatible with the building architecture may be used. (3) Company logos shall not occupy more than 30 percent of the sign display area and are exempt from the individual dimension letter requirement. With this reading it would not be required to have the %_" dimensioned letters. It would have to be less than 30% of the sign's display area, but I don't think that will be an issue. I *think* the direction sign should be fine, but we may request some modifications such as a reduction in the size of the logo and/or the addition of the word "entrance' just to make sure it meets the strict definition of a directional sign. I think that covers everything. I'll begin working on the report itself early next week and will let you know if a closer examination reveals anything that I've missed. On January 3, 2017 the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Mathew Duffy on behalf of Steve Youngstedt for a sign variance for the property located at 50 Lake Drive E and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Highway and Business Services District (BH). 2. The property is guided by the Land Use Plan for Commercial. 3. The code stipulates that variances cannot be grated that "adversely affect the spirit or intent of this article." It is my belief that the code establishes the three tiers of sign size and specifies a decreasing percentage of message center signage for each subsequent tier with the intent of limiting the maximum size of a single message center. The maximum threshold established is 32 sq. ft. If the code was not concerned with establishing a set limit for message center size the initial tier's 50% ratio would have been applied to all sign sizes. I would also be concerned about the precedent of allowing for a larger sized message center without a clearly defined hardship. Many businesses could make a case for combined signage or not taking advantage of their theoretical maximum signage in exchange for a larger message center. Allowing a business to make a case that they should be allowed a sign of proportions and size permitted by the ordinance despite not technically meeting the square footage requirement for that category of sign is in this case justifiable, but allowing businesses to exceed the maximum size limits specified for their zoning district is a very different type of variance... and one I would not support. From: Walters, MacKenzie [mailto•MWalters@ci.chanhassen.mn.usl Sent: Friday, October 21, 2016 1:27 PM To: Matthew Duffy<mattduffvPthinkdieitalsiens.com> Subject: RE: Youngstedt's Chanhassen Sign Project Matt, I was able to sit down with the Community Development Director and the Senior Planner who worked on the original site plan for this area in the early 90s, and here is what we've been able to figure out: 1) The site has an existing variance allowing for a 12' monument sign. 2) A condition of the existing variance was that the businesses would consolidate their signage into a single monument sign. 3) Within the existing ordinance and variance you would be allowed to have 64 sq. ft. of total signage, 28.8 sq. ft. of which could be an electronic message center. 4) If you requested a new variance for a 12' monument sign with 80 sq. ft. of total signage you could have a 32 sq. ft. electronic message center. 5) The variance process would entail $450.00+ in fees, and take around 60 days (public hearing and council action required). 6) If goal is an electronic message center, staff is not sure that 3.2 sq. ft. of extra message center is worth the time and expense on your end; however, that is your and your client's decision. 7) If you decide to pursue a variance, staff would likely recommend approval with the condition that all three parcels consolidate their monument/pylon signage to the single sign (Once you have a formal proposal ready we can meet to go over it and I will be able to give a firm answer on our recommendation, but in principle we support a variance allowing for a larger sign in exchange for consolidating signage). Please keep in mind that the Planning Commission and City Council have the sole authority to grant a variance. They may or may not go with staffs recommendation. Multi -tenant commercial and industrial buildings shall have uniform signage. When buildings or developments are presented for site plan review, proposed signs for the development shall be presented concurrently for staff review. All planned centers and multi -tenant buildings shall submit a comprehensive sign plan for approval by the planning commission and city council. (1) All center, development name or an individual tenant building signage on a monument or pylon sign shall use individual dimension letters, at least one-half inch deep. (2) Registered trademarks, company symbols, display messages (less than six inches tall), pictorial presentations, illustrations, or decorations (anything other than wording) and less than 20 percent of the total sign display area are exempt from the individual dimension letter requirement. (3) In multi -tenant buildings, tenant panels may be used and shall be exempt from the individual dimension letter requirement. No. 544, § 1, 6-25-12) I think that a case could be made for either of the highlighted provisions applying, but as it is their corporate logo and the 4" provision seems the most relevant. With this reading it would not be required to have the Y2" dimensioned letters. It would have to be less than 30% of the sign's display area, but I don't think that will be an issue. I *think* the direction sign should be fine, but we may request some modifications such as a reduction in the size of the logo and/or the addition of the word "entrance" just to make sure it meets the strict definition of a directional sign. I think that covers everything. I'll begin working on the report itself early next week and will let you know if a closer examination reveals anything that I've missed.
