from the County Registrar's office as confirmation that the Beddor Registered Land
Survey for the above subdivision was recorded on October 26, 2005 as Document No.
T155369, and is now known as RLS #122. The "Filing of Documents" sheet also
confirms that the warranty deed from Frank and Marilyn Beddor to David Anthony
Beddor for part of Lot 6, Block 1, Christmas Acres was filed with the County on October
26, 2005 as Document No. T155368. I have enclosed the recorded warranty deed. As
with plats, the official RLS Mylars remain at the County following recording.
You provided me with two sets of the RLS Mylars when you sent all of this to me for
recording; however, the County only needed one set for filing. Therefore, I am returning
to you the second set of Mylars.

WHEREAS, the City received a request from Lecy Bros. Homes, the property owner of the
Shively Addition, to vacate a portion of an existing public right-of-way and all drainage and utility
easement within the existing plat of Shively Addition; and
WHEREAS, the existing public right-of-way and drainage and utility easement was
dedicated to the City as a part of the Shively Addition plat in 1990; and
WHEREAS, a condition in the development contract required the vacation of a portion of
the existing right-of-way for Crestview Lane (Drive); and
WHEREAS, the dedicated right-of-way and drainage and utility easement on the plat are
being superceded by the realigned right-of-way and drainage and utility easements within the
Crestview Addition Plat approved on May 9, 2005; and
WHEREAS, the applicant is requesting the City vacate the right-of-way and easement area
which would run through the middle of the proposed new lots.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves vacating a portion of the public right-of-way for Crestview Lane (Drive) and a portion of
the drainage and utility easement at 2150 Crestview Drive as defined in the attached vacation
description.

Councilwoman Tjornhom: I make a motion that the Chanhassen City Council approves
renaming of the Chanhassen Community Gardens to the Olson Community Gardens.
Mayor Furlong: Thank you. Is there a second?
Councilman Labatt: Second.
Mayor Furlong: Made and seconded. Any discussion on that motion?
Councilman Peterson: Just for the only comment that I'll make, because I'm going to vote nay
on this. Not as any relationship to a negative towards Al Olson. I'm going to vote nay because I
think, I think we should review the policy and really determine how we're going to move ahead
long term before we vote on this, so I'm going to vote nay because of that.
Mayor Furlong: Any other discussion? Hearing none we'll proceed with the vote.
Councilwoman Tjornhom moved, Councilman Labatt seconded that the City Council
approves renaming of the Chanhassen Community Gardens to the Olson Community
Gardens. All voted in favor, except Councilman Peterson who opposed, and the motion
carried with a vote of 4 to 1.
Todd Gerhardt: To follow up on that Mayor, City Council members, we'll take a look at that
policy and put it on a future work session.

PUBLIC HEARING ON VACATION OF EASEMENTS AND RIGHT-OF-WAY IN
CRESTVIEW, PROJECT 05-11.
Paul Oehme: Thank you Mayor, City Council members. Staff has received a request from Lecy
Brothers, the property owner of Crestview Addition to vacate the existing public drainage and
utility easement within the lot area of the previous plat and a portion of the existing right-of-way
on Crestview Lane that lies within the approved plat of Crestview Addition. The drawing here is
kind of showing the area in question. Crestview Lane is just north of Lake Lucy Road and just
west of Galpin Boulevard and the area here is highlighted easement and proposed to be vacated
and the area hatched is the area of right-of-way proposed to be vacated as well. The existing
public drainage and utility easements were dedicated to the city as part of the Shivley Addition in
1990. On May 9, 2005 the City Council approved the final plat for Crestview Addition creating
5 lots and associated right-of-way for public streets. A condition of approval was to vacate the

existing right-of-way and drainage and utility easements. Staff has no issues with the proposed
vacations and I stand for questions and I would request that the public hearing be open at this
time.
Mayor Furlong: Thank you. Any questions for staff? This deals just with the schedule you put
up there. Nothing additional along existing Crestview?
Paul Oehme: Correct. It just entails the plat that was approved and again it's just the area that's
highlighted here for vacation of easements within the development area plus the right-of-way as
attached, as shown in this drawing.

Councilman Lundquist: We have the new easements dedicated as part of that final plat on that
one already, correct?
Paul Oehme: That's correct.

come forward and speak on this matter. If there is no one, then we'll close the public hearing

description. All voted in favor and the motion carried unanimously with a vote of 5 to 0.

DISCUSSION
As part of the final plat approval process for the Crestview development, a
condition was placed in the development contract that required the vacation of a
portion of the existing right-of-way for Crestview Lane (Drive) which was outside
of the revised alignment for Crestview Lane (Drive). In reviewing the plat
further, it was determined that the existing lot within the Shively Additions had
drainage and utility easements around the existing lot perimeter, which also needs
to be vacated because of the realigned lot lines.

WHEREAS, the City received a request from Lecy Bros. Homes, the property owner of the
Shively Addition, to vacate a portion of an existing public right-of-way and all drainage and utility
easement within the existing plat of Shively Addition; and
WHEREAS, the existing public right-of-way and drainage and utility easement was
dedicated to the City as a part of the Shively Addition plat in 1990; and
WHEREAS, a condition in the development contract required the vacation of a portion of
the existing right-of-way for Crestview Lane (Drive); and
WHEREAS, the dedicated right-of-way and drainage and utility easement on the plat are
being superceded by the realigned right-of-way and drainage and utility easements within the
Crestview Addition Plat approved on May 9, 2005; and
WHEREAS, the applicant is requesting the City vacate the right-of-way and easement area
which would run through the middle of the proposed new lots.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves vacating a portion of the public right-of-way for Crestview Lane (Drive) and a portion of

description.

VACATION OF EASEMENT
CITY OF CHANHASSEN
NOTICE IS HEREBY GIVEN that the Chanhassen City Council will hold a public
hearing on Monday, June 13, 2005, at 7:00 p.m. in the Council Chambers at Chanhassen City
Hall, 7700 Market Boulevard. The purpose of this hearing is to consider the request of Lecy
Bros. Homes for the vacation of all drainage and utility easements on the underlying parcels of
property within the plat of Crestview.
A legal description and drawing of the proposed vacation area are available for public
review at City Hall during regular business hours.
All interested persons are invited to attend this public hearing and express their opinions
with respect to this proposal.
