The acoustical measurements were conducted to determine if the neighboring traffic noise is in compliance with the Minnesota Pollution Control Agency. A summary of the results is listed in the Test Results section, and the complete test data is included as Appendix B of this report. The test area was selected by Intertek-ATI. Test Methods: Testing for this project was conducted in accordance with the following standards. ASTM El 0 14-12, Standard Guide for Measurement of Outdoor A -Weighted Sound Levels ANSI/ASA SIA -2014, Electroacoustics - Sound Level Meters ANSI/ASA S1.11-2014, Electroacoustics - Octave -band and Fractional -octave -band Filters Test Equipment: The equipment, used to conduct these tests, meets the requirements of ANSI SIA for Type 1 sound level meters and ANSI SIA l for octave band and fractional octave band analog and digital filters. The microphone was calibrated before and after testing at the site. Two more recordings were taken inside the building, in the middle of one of the rooms on the north side of the building looking towards the Arboretum Boulevard. Readings were continually monitored over spans of a one hour period to determine the Lio and L5o. Test Areas and Results: Location "A": The first measurement was taken outside the building, 30 feet from the exterior of the building and approximately 80 feet from Arboretum Boulevard. This first measurement ran from 9:10am — 10:10am. Resulted in a Lio of 75.8 dBA and an L50 of 70.2 dBA. Test 1 of Appendix B shows this data. Pictures of this location is included as Figure 1-3 in Appendix C. Location "Bit: The second measurement was taken inside the building, in the middle of one of the rooms on the north side of the building looking towards the Arboretum Boulevard. This second measurement ran from 10:30am — 1 1:30am. Resulted in a Lio of 42.6 dBA and an L5o of 38.3 dBA. Test 2 of Appendix B shows this data. A picture of this location is included as Figure 4-5 in Appendix C. Location "A": The third measurement was taken outside the building, 30 feet from the exterior of the building and approximately 80 feet from Arboretum Boulevard. This third measurement ran from 12:15pm — 1:15pm. Resulted in a Lio of 75.4 dBA and an L5o of 69.3 dBA. Test 3 of Appendix B shows this data. Pictures of this location is included as Figure 1-3 in Appendix C. Location "B": The fourth measurement was taken inside the building, in the middle of one of the rooms on the north side of the building looking towards the Arboretum Boulevard. This fourth measurement ran from 1:30pm — 2:30pm. Resulted in a Lio of 41.9 dBA and an L5o of 37.9 dBA. Test 4 of Appendix B shows this data. A picture of this location is included as Figure 4-5 in Appendix C. Conclusions: In summary, the Lin and L5o measurements taking inside the build in question were below the allowable sound measure for NAC 2 (Lio of 70 and L5o of 65). The first indoor measurement was taken 10:30am — 11:30pm and resulted in a Lio of 42.6 dBA and an L50 of 38.3 dBA. The second indoor measurement was taken 1:30pm — 2:30pm and resulted in a Lio of 41.9 dBA and an L50 of 37.9 dBA. Note: We were told by the client that the city requested measurements inside and outside the building. Due do this constant we could not do one measurement from 9:00am — 3:00pm. Instead four one hour measurements were taken, two inside the building and two outside the building. NOW, THEREFORE, BE IT RESOLVED, the Chanhassen City Council approves Conditional Use Permit 2016-02 to operate an adult daycare facility located at 18976 Lake Drive East; subject to the following conditions: 1. Building permit(s) are required for building code changes and a fire permit for the proposed adult day care. 2. The center shall obtain applicable state, county and city licenses. 3. The center shall submit average annual test results for radon gas and shall comply with all applicable state and federal requirements pertaining to testing and requiring mitigation techniques. 4. The center shall conduct tests of existing noise conditions and submit test results to the city for review. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of this permit. Lapse. If within one year of the issuance of this permit the authorized construction has not been substantially completed or the use commenced, this permit shall lapse, unless an extension is granted in accordance with the Chanhassen Zoning Ordinance. If the conditional use is discontinued for six months, the conditional use permit shall become void. E L Criminal Penalty. The daycare is currently serving 24 clients in Victoria, MN. If Mount Olivet Adult Daycal• January 5, 2016 Page 2 approved, those clients will move to the new Chanhassen site. Additionally, the Chanhassen site will accommodate up to a total of 60 clients, which is the maximum permitted under their Minnesota Department of Human Services license. Licensing of the adult daycare is contingent on their meeting zoning requirements, which in this case means the approval of a conditional use permit. Their current hours of operation are 9 am — 3 pm, but with more clients they will expand to 8 am — 4 pm. They currently offer snacks and lunch, which will continue after the move. Their licensed food service provider is Augustana Care. Currently they have 12 staff, including the program director. They anticipate being able to serve additional clients in the new location and in tum will likely be adding employees. The exact number will vary depending on client needs, but they anticipate 5-7 additional employees. A caterer will be preparing and delivering lunch and snacks that will be served to their clients and staff. Their license requires them to offer a meal and snacks as part of the program. Transportation is also offered to their clients or clients can make their own arrangements. There is an hour window in the morning and again in the afternoon in which drop-offs and pick-ups occur. All clients enrolled in the program attend the whole day. They do not offer a partial day option. Client activity groups go on outings to local parks, the Arboretum, and their campus in Victoria. They own a bus that will most likely be parked on site. The clients are assigned to a smaller activity group that is based on interests and level of need. Activities vary slightly from group -to -group based on those interests and needs. In general, the day includes a balance of active and passive activities. Typical offerings include: exercise group, arts and crafts, board games, active games (bean bag toss, parachute, beach ball volleyball, etc.), music, computer-based activities, reading and sensory activities. Each group has a daily schedule they follow. This is based on a monthly activity plan that features different themes each month. DISCUSSION The Industrial Office Park zoning district permits daycare uses as conditional uses. Conditional uses include those uses which are not usually allowed within the zoning district, but which may be suitable under some circumstances. The applicant shall have the burden of proof that the use is suitable and that the standards set forth in the conditional use regulations have been met. Daycare review standards are geared toward childcare centers. Due to the changing demographics and the future potential increase in such facilities, staff will be investigating creating specific standards for adult daycare centers. As part of this, we will request input from the Senior Commission as well as contact other care providers for input. The proposed use constitutes a change in "occupancy classification." Building Code requires a new certificate of occupancy when a change in occupancy classification occurs. Permits must be obtained for the construction, alteration, or occupancy use changes to any building or portion of a building. Building permit(s) are required for building code changes and a fire permit for the proposed adult daycare. Mount Olivet currently occupies 13,188 square feet of the adjacent unit within the building for their business offices. With the addition of this area for adult daycare, they will occupy 21,450 square feet of the 32,890 square foot building or 65 percent of the building. The balance of the building (11,440 square feet) is occupied by Korterra, a damage prevention company working with pipeline companies, utilities, municipalities, contract locators, and one -call centers to help them operate as efficiently as possible through the use of industry-leading technology and ticket management operations processing. Parking standards for the building are 511,000 square feet for office uses (123 spaces) and one per six clients for day care (10 spaces) for a total of 133 required parking. (2) Outdoor play areas shall be located and designed in a manner which mitigates visual and noise impacts of adjoining residential areas. *The applicant will take clients on outings to local parks, the Arboretum and their campus in Victoria, rather than an onsite playground area. (3) Each center shall obtain applicable state, county and city licenses. This condition still applies. *They are in the process of receiving state licensing, which is contingent on receiving city approval. (4) Daycare facilities in the IOP district shall be subject to a maximum lot coverage of 65 percent. *This standard applies to new development. The IOP standard is 70 percent hardcover. On January 5, 2016, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Mount Olivet Rolling Acres for a conditional use permit for the property located at 18976 Lake Drive East. The Planning Commission conducted a public hearing on the proposed interim use which was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Industrial Office Park District, IOP. 2. The property is guided by the Land Use Plan for office industrial uses. 3. The proposed adult daycare use will not be detrimental to the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. Generous: Thank you Chairman Aller, commissioners. As you stated Planning Case 2016-02 is a public hearing. The applicant is Mount Olivet Rolling Acres. CSM Corporation is the property owner. It's scheduled for the public hearing tonight before the Planning Commission and then to City Council on January 25th. The request is for a conditional use permit to operate an adult daycare center in the industrial office park district. Uses in the industrial office park are either permitted, conditional or interim uses or accessory uses. In this case conditional uses are uses that are permitted in certain zoning districts provided you can meet the criteria designed for that. The property's located at 18976 Lake Drive East. This is a portion of the city that's actually in Hennepin County and so we will he doing a resolution for the recording of the CUP before City Council. This property was developed, approved for development in 1998. It's approximately a 33,000 square foot building that's guided for office industrial use. Mount Olivet is currently occupying the unit directly to the west of the unit that they're proposing for the adult daycare center and then there's another, the Korterra to the east of it has the other half of the building. With the expansion into this area they'll have a, Mount Olivet will have about 65 percent of the total building in their use. This unit itself is 8,662 square feet. It's access is from the south which is the parking lot and you'll see that on the next slide. They will have to do some remodeling to the space and that's part of the, one of the conditions is they'll need to get building permits for that and also there are some fire code requirements that they'll have to meet before they can actually begin the operation of the adult daycare. The operation itself is pretty straight forward. Their licensing will allow them to have up to 60 clients. Their hours will be 8:00 a.m. to 4:00 p.m. They're actually extending this from their move from their current location into Chanhassen and with a larger facility. They currently have 12 employees and they're likely to add more with the additional clientele. Food is provided through a caterer that will be coming in and providing snacks and luncheons for both the clients and the staff members SCANNED Chanhassen Planning Commission — January 5, 2016 • there. And then it's sort of, as part of their operation they do have outings and they will have a bus to take their clients to different facilities including city parks, Minnesota Landscape Arboretum, their facilities in Victoria or any other outings that they may have. And they have, it's my understanding they assign their groups to smaller activity groups within the building and based on their needs and their interest and they can do different things. There's arts and crafts, music, computer works, what have you. That's it. We are recommending approval of the conditional use permit to operate the adult daycare in the industrial office park district and subject to the conditions of the staff report and adoption of the Findings of Fact and Recommendation. With that I'd be happy to answer any questions you may have. Aanenson: Bob could you just briefly go over with the commission... daycare just for your edification and anybody else. We do have standards. Generous: Yeah. Unfortunately our daycare standards are geared towards children's daycare so a lot of these really won't be applicable in this and in the future we will be looking at bringing forth a code, probably a code amendment to address standards specifically for adult daycare. One is a site shall have a loading and drop off points designed to avoid interfering with traffic and pedestrian movement. And you can, their access and drop off will be their doorway would be right in the middle. Let's get the pointer. Of the facility and it's, works out well because there's a no parking space right at that entranceway so that will be there. This is the primary entrance to the unit. The next one is outdoor play area shall be located and designed in such a manner which mitigates visual and noise impacts of adjoining residential areas. Well there's two issues with that. First there's no residential areas adjacent to this one but really they're not designed. That's for child care. They have the play facilities to burn off energy. They're going to be taking their clients out on outings and so they have other facilities that they'll be using. Each center shall obtain applicable state, county and city licensing and they're in the process of receiving their licensers. Part of the hold up is they need to get through our zoning approval processes which is the conditional use permit. Daycare facilities in IOP districts shall be subject to a maximum lot coverage of 65 percent and this standard is really designed for new buildings so that they can have sufficient green space so they can have the outdoor play areas. This property under the IOP district the standard is 70 percent hard cover is permitted and they're pretty close to that 70 percent on this to meet all the parking standards. They do have, they exceed the parking requirements for the uses within the building and if you look at it specifically for a daycare facility they exceed it significantly by over 20 spaces so. Daycare facilities shall submit average annual test results for radon gas. Well we're going to make them do this. It's not going to hurt them and it will provide some health, make sure that health issues won't result from that. And then they have to meet any standards there and prior to issuance of a building permit daycare facilities that can test a test of existing noise conditions. This is to make sure that they, it's not an overly noisy facility, and I just talked with the applicant this evening to explain what that involves. It will be measurements both inside and outside the facility and it will have to meet the MPCA standards for such a facility. And of that there's, it's those two tests will be the conditions of approval. The building permit requirement and the license. 2 Chanhassen Planning Commission — January 5, 2016 • Aller: Great. So for clarification although we're looking at the use of the building we're not controlling or giving primary input into the employment of individuals and what the standards are for employment or for the food preparation if any or for the licensing itself. I've been working at Rolling Acres for 28 years. Our corporate office until 6 years ago was located in Victoria. 6 years ago we were welcomed into the city of Chanhassen on Lake Drive and really like being in the city of Chanhassen. Been very welcomed. Been very helpful. City staff has been as well in developing this and our other project. We also just so you know do operate 2 group homes within the city limits of Chanhassen. This particular facility is a transfer of our current clientele from our corporate, our former corporate office in Victoria and we have reached our licensed maximum of 24 in that building. We have quite a long waiting list and so we looked for in several communities additional space. It happened that CSM had property right next to our corporate office which with some very minor modifications, some of them which were just explained, we can operate within that. The state and Hennepin County will be involved in licenser as well as you spoke. We took a little while to convince Hennepin County that we were in Hennepin County. The individual we spoke to that sets up the licensing looked at her computer and said we're not. We said computers aren't always perfect and 2 days later she decided we were in Hennepin County so we had that licenser lined up and all those are contingent on this and the City Council moving forward. Their current hours of operation are 9 am — 3 pm, but with more clients they will expand to 8 am — 4 pm. They currently offer snacks and lunch, which will continue after the move. Their licensed food service provider is Augustana Care. Currently they have 12 staff, including the program director. They anticipate being able to serve additional clients in the new location and in turn will likely be adding employees. The exact number will vary depending on client needs, but they anticipate 5-7 additional employees. A caterer will be preparing and delivering lunch and snacks that will be served to their clients and staff. Their license requires them to offer a meal and snacks as part of the program. Transportation is also offered to their clients or clients can make their own arrangements. There is an hour window in the morning and again in the afternoon in which drop-offs and pick-ups occur. All clients enrolled in the program attend the whole day. They do not offer a partial day option. Client activity groups go on outings to local parks, the Arboretum, and their campus in Victoria. They own a bus that will most likely be parked on site. The clients are assigned to a smaller activity group that is based on interests and level of need. Activities vary slightly from group -to -group based on those interests and needs. In general, the day includes a balance of active and passive activities. Typical offerings include: exercise group, arts and crafts, board games, active games (bean bag toss, parachute, beach ball volleyball, etc.), music, computer-based activities, reading and sensory activities. Each group has a daily schedule they follow. This is based on a monthly activity plan that features different themes each month. DISCUSSION The Industrial Office Park zoning district permits daycare uses as conditional uses. Conditional uses include those uses which are not usually allowed within the zoning district, but which may be suitable under some circumstances. The applicant shall have the burden of proof that the use is suitable and that the standards set forth in the conditional use regulations have been met. Daycare review standards are geared toward childcare centers. Due to the changing demographics and the future potential increase in such facilities, staff will be investigating creating specific standards for adult daycare centers. As part of this, we will request input from the Senior Commission as well as contact other care providers for input. The proposed use constitutes a change in "occupancy classification." Building Code requires a new certificate of occupancy when a change in occupancy classification occurs. Permits must be obtained for the construction, alteration, or occupancy use changes to any building or portion of a building. Building permit(s) are required for building code changes and a fire permit for the proposed adult daycare. Mount Olivet currently occupies 13,188 square feet of the adjacent unit within the building for their business offices. With the addition of this area for adult daycare, they will occupy 21,450 square feet of the 32,890 square foot building or 65 percent of the building. The balance of the building (11,440 square feet) is occupied by Korten-a, a damage prevention company working with pipeline companies, utilities, municipalities, contract locators, and one -call centers to help them operate as efficiently as possible through the use of industry-leading technology and ticket management operations processing. Parking standards for the building are 511,000 square feet for office uses (123 spaces) and one per six clients for day care (10 spaces) for a total of 133 required parking. (2) Outdoor play areas shall be located and designed in a manner which mitigates visual and noise impacts of adjoining residential areas. *The applicant will take clients on outings to local parks, the Arboretum and their campus in Victoria, rather than an onsite playground area. This condition still applies. *They are in the process of receiving state licensing, which is contingent on receiving city approval. (4) Daycare facilities in the IOP district shall be subject to a maximum lot coverage of 65 percent. *This standard applies to new development. The IOP standard is 70 percent hardcover. (5) Daycare facilities shall submit average annual test results for radon gas. Results shall be submitted annually on the anniversary of the day of the issuance of the original occupancy permit. The Planning Commission conducted a public hearing on the proposed interim use which was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Industrial Office Park District, IOP. 2. The property is guided by the Land Use Plan for office industrial uses. 3. The legal description of the property is Lot 1, Block 1, Chanhassen East Business Park 0 Addition. 4. Section 20-232: a. The proposed adult daycare use will not be detrimental to the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. It will provide a needed and growing service. b. The proposed adult daycare use will be consistent with the objectives of the city's comprehensive plan and zoning code. c. The proposed adult daycare use will be designed, constructed, operated and maintained so as to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. d. The proposed adult daycare use will not be hazardous or disturbing to existing or planned neighboring uses. e. The proposed adult daycare use will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. 0 P f The proposed adult daycare use will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. g. The proposed adult daycare use will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. h. The proposed adult daycare use will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. i. The proposed adult daycare use will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. j.
