NOTICE: You are invited to attend a public hearing about a proposal in your area. The applicant, Brett Winebrenner
of Progress Valley Auto Sales, is requesting a Conditional Use Permit for automobile sales, located at 1900 Stoughton
Avenue.
What Happens at the Meeting: The purpose of this public hearing is to inform you about the applicant's
request and to obtain input from the neighborhood about this project. During the meeting, the Chair will lead
the public hearing through the following steps:

City Review Procedure
Subdivisions, Planned Unit Developments, Site Plan Reviews, Conditional and Interim
Uses, Wetland Alterations, Rezonings, Comprehensive Plan Amendments, Code
Amendments require a public hearing before the Planning Commission. City
ordinances require all property within 500 feet of the subject site to be notified of the
application in writing. Any interested party is invited to attend the meeting.
Staff prepares a report on the subject application. This report includes all pertinent
information and a recommendation. These reports are available by request. At the
Planning Commission meeting, staff will give a verbal overview of the report and a
recommendation. The item will be opened for the public to speak about the proposal
as a part of the hearing process. The Commission will close the public hearing and
discuss the item and make a recommendation to the City Council. The City Council
may reverse, affirm or modify wholly or partly the Planning Commission's
recommendation. Rezonings, land use and code amendments take a simple majority
vote of the City Council except rezonings and land use amendments from residential to
commercial/industrial.
Minnesota State Statute 519.99 requires all applications to be processed within 60 days
unless the applicant waives this standard. Some applications due to their complexity
may take several months to complete. Any person wishing to follow an item through
the process should check with the Planning Department regarding its status and
scheduling for the City Council meeting.
A neighborhood spokesperson/representative is encouraged to provide a contact for
the city. Often developers are encouraged to meet with the neighborhood regarding
their proposal. Staff is also available to review the project with any interested
person(s).
Because the Planning Commission holds the public hearing, the City Council does not.
Minutes are taken and any correspondence regarding the application will be included in
the report to the City Council. If you wish to have something to be included in the
report, please contact the Planning Staff person named on the notification.

The existing IUP 92-1 will be used for the additional outdoor storage of automobiles to
be wholesaled. In talking with the applicant it is staff's understanding is that there will
be no sales on site and the applicant will be storing the automobiles in "phase 3" location,
not on the east side. Should the applicant wish to store the automobiles on the east side
additional landscaping will be required as IUP 92-1 requires 100% opaque screening as
well as an improved gravel surface.

We received an application for an interim use permit for outdoor storage of vehicles at
1900 Stoughton Ave, zoned BF. The vehicles being stored are then taken to local
auctions and licensed dealers. There will not be vehicle sales on the property. I have a
few questions regarding this application:
1. Does this transport from storage to auctions, etc. meet the definition of "storage"?
2. The applicant already has an Interim Use Permit #92-1 for outdoor storage, do we
need to process this permit or can the applicant store the vehicles under NP #92-
1?
3. Our concern is the amount of traffic that will increase due to the vehicles coming
and going to auctions and dealers. Because they are for wholesale purposes is this
more a form of sales rather than outdoor storage?
4. Because this is storage for auto sales and he will need an auto sales license does
he need to apply for a conditional use permit for auto sales in the BF district?
Any insight you have will be very helpful. Bob and I will give you a call this afternoon.

To Whom It May Concern:
1, Brett Winebrenner, am applying for a conditional use permit from the City of Chanhassen for
the sole purpose of the temporary storage of vehicles. The address of the proposed location is at 1900
Stoughton Avenue. The legal description is the southwest comer of zone 34 at Stoughton Avenue. This
proposed area is presently zoned office/industrial, and is also the current location of Progress Valley
Storage.
The main purpose of the conditional use permit will to be to store vehicles for a minimal amount
of time until the are delivered to local auctions, and or licensed dealers. There will not be retail sales of
vehicles conducted at proposed location. The vehicles will not be offered to the general public, therefore,
will not create any increase in traffic to existing location. The storage of vehicles already exists in current
location as to existing business. As to the number of vehicles being stored, this will change on a day to day
basis. Typically anywhere from I-15 vehicles. For the most part, nobody will even know or see a

1, Brett Winebrenner, am applying for a conditional use permit from the City of Chanhassen for
the sole purpose of the temporary storage of vehicles. The address of the proposed location is at 1900
Stoughton Avenue. The legal description is the southwest comer of zone 34 at Stoughton Avenue. This
proposed area is presently zoned office/industrial, and is also the current location of Progress Valley
Storage.
The main purpose of the conditional use permit will to be to store vehicles for a minimal amount
of time until the are delivered to local auctions, and or licensed dealers. There will not be retail sales of
vehicles conducted at proposed location. The vehicles will not be offered to the general public, therefore,
will not create any increase in traffic to existing location. The storage of vehicles already exists in current
location as to existing business. As to the number of vehicles being stored, this will change on a day to day
basis. Typically anywhere from 1-15 vehicles. For the most part, nobody will even know or see a

Thank you for your inquiry regarding dealer license requirements. Following is some general
information that may help you determine whether you are required to have a dealer license and
whether you are interested in applying for a license.
The attached chart reflects basic requirements and the activity limitations of each type of license
offered.
WHO MUST HAVE A DEALER LICENSE?
-- Motor Vehicles
Anyone who wishes to advertise, offer, solicit or engage in the business of leasing, selling new or used
motor vehicles or arranging the sale of motor vehicles. MS168.27
Anyone who has leased or sold more than five motor vehicles, either wholesale or retail, in a twelve
month period is considered to be in the business of buying and selling motor vehicles and is required to
be licensed.

Anyone who is in the business of selling used motor vehicle parts or processing and selling scrap metals
from motor vehicles is required to be licensed. MS168.27

Anyone who conducts consignment sales or arranges sales or leases must be licensed.. MS168.27
MOTOR VEHICLE SALES TAX / TITLE TRANSFER REQUIREMENTS:
Anyone who is licensed as a motor vehicle dealer is exempt from paying motor vehicle sales tax on their
acquisition of any motor vehicle for which they are licensed to lease or sell and is not required to title
the vehicle into the dealership name (due to the Federal Truth In Mileage Act there are some exceptions
to the title requirement). Any vehicle used for lease must be titled into the lessors name.
Anyone who is not licensed to lease or sell motor vehicles must pay applicable taxes and fees, Including
motor vehicle sales tax, on their acquisition of each motor vehicle and transfer each motor vehicle into
their name before they can sell that vehicle. MS2978.035 subd 1 MS168A.10 subd 2 MS168A.11 subd 1
ACCESS TO MOTOR VEHICLE AUCTIONS.
Motor vehicle auction companies (North Star, MAA, etc) ale free to chose whom they wish to do business
With. More often than not, they chose to do business with licensed motor vehicle dealers.
LICENSE TYPES:
This state does not offer a "hobbyist" or "part time" license. See the attached chart.
ZONING:
A dealership of any type is considered to be a commercial operation. Generally, zoning authorities do
not approve commercial activity in areas that are zoned residential. In agricultural and industrial areas,
zoning officials may consider issuing special use permits for a commercial operation. in any case, the
applicant must review their intentions with the local zoning officials and obtain their written consent
for the type of business the applicant wishes to conduct.

As a licensee you are required to have a completed location designed for the exclusive use of the
dealership that meets all of the location requirements and attest to their existance at the time of
application. If it is determined that, upon the State's inspection of your business site, you have not met
the minimum requirements, your license may be denied. The attached chart offers you information on
the basic location requirements.
Exclusive use requirements
In the event that the dealership will be operating in a building where other businesses are located, the
dealership location must be set up in such a way that It is clearly separated.
The dealership must have an address that is separate from the address of any other business in the
building (suite number would qualify).
The dealership must be enclosed with floor to ceiling walls with a door that can be shut and locked to
close off the entire entrance and is designated for the exclusive use of the dealership.
There must be a separate and identifiable entrance to the dealership that leads to the outdoors or to a
public area. Note: shared office space such as a reception area or secretary pool does not qualify as a

The dealership cannot be accessed by entering through any other business or residence that is located

MINNESOTA WORKERS' COMPENSATION LAW
Minnesota Statute, Section 176.182 requires every state and local licensing agency to withhold the
issuance or renewal of a license to permit to operate a business or engage in an activity in
Minnesota until the applicant presents acceptable evidence of compliance with the workers'

176.182 BUSINESS LICENSES OR PERMITS; COVERAGE REQUIRED.
Every state or local licensing agency shall withhold the issuance or renewal of a license or permit
to operate a business in Minnesota until the applicant presents acceptable evidence of compliance with
the workers' compensation insurance coverage requirement of section 176.181, subdivision 2, by
providing the name of the insurance company, the policy number, and dates of coverage or the permit to
self -insure. The commissioner shall assess a penalty to the employer of $2,000 payable to the assigned
risk safety account, if the information is not reported or is falsely reported.
Neither the state nor any governmental subdivision of the state shall enter into any contract for
the doing of any public work before receiving from all other contracting parties acceptable evidence of
compliance with the workers' compensation insurance coverage requirement of section 176.181,
subdivision 2.
This section shall not be construed to create any liability on the part of the state or any
