Dear Ms. Jackson:
I have been hired by the owners of the Chaska Business Center located at 4300 Peavey Road,
Chaska Minnesota C Chaska Business Center"). As you are aware, the Chaska Business Center
is located across the street from the Canine Club & Spa ("Canine Club'). The Canine Club has
caused and is continuing to cause a nuisance because of the constant barking from the dogs. This
nuisance has become a real problem for the Chaska Business Center. My client understands that
the City of Chanhassen has requested that the Canine Club institute noise mitigation measures
due to complaints from other property owners in the area. It is not clear whether or not efforts
have been made to mitigate the noise.
Regardless, Chaska Business Center demands that the Canine Club immediately take all steps
necessary to control the noise from the dogs. Chaska Business Center has already incurred
significant damages as a direct result of the noise. Failure to take efforts to mitigate the noise
will add to the damages and will cause irreparable harm to Chaska Business Center.
Please confirm that you will be taking further actions to mitigate the noise no later than
November 30, 2013. If you are represented by an attorney, please forward this letter to your
attorney with a request that he or she contact me immediately. I look forward to your timely

7. On September 10, 2012, the Chanhassen City Council approved a 5,281 square -foot
building expansion from the approved 21,020 square feet of building approved for the
development for a total of 26,301 square feet of buildings. Planning Case #2012-06.
8. On June 9, 2008, the Chanhassen City Council approved an amendment to the Planned
Unit Development design standards for Arboretum Business Park to permit pet kennels
and/or veterinary clinics, and the Site Plan for Superdog Country Club, Planning Case
#08-11, for a 21,020 square -foot, one-story kennel and veterinary clinic.
9. The Development Contract/PUD Agreement dated August 25,1997 between the City and
Chaska Gateway Partners Limited Partnership, and amended by several addenda and
amendments, the last amendment being dated June 9, 2008, is in force and effect
regarding the property. There are no current violations of the Development
Contract/PUD Agreement by the owners of the property, and all of the improvements
referenced in the Development Contract/PUD Agreement have been completed and the

2. More than one (1) principal structure may be placed on one (1) platted lot.
3. Building height shall be limited to 3 stories or 40 feet.
4. Lot 5, Block 4, , is intended to accommodate a major corporate headquarters or office, research,
high end manufacturing with limited warehousing type user. While the majority of the
development is based on 30 percent office space, Lot 5 must have a minimum of 40 percent
office use and include multi -story building(s).
e. Building Materials and Design
1. The PUD requires that the development demonstrate a higher quality of architectural
standards and site design. All mechanical equipment shall be screened with material
compatible to the building.
2. All materials shall be of high quality and durable. Masonry material shall be used. Color shall
be introduced through colored block or panels and not painted cinder block.
3. Brick may be used and must be approved to assure uniformity.
4. Block shall have a weathered face or be polished, fluted, or broken face.
5. Concrete may be poured in place, tilt -up or pre -cast, and shall be finished in stone, textured,
coated, or painted.
6. Metal siding will not be approved except as support material to one of the above materials or
curtain wall on office components or, as trim or as HVAC screen.
7. All accessory structures shall be designed to be compatible with the primary structure.
8. All roof mounted equipment shall be screened by walls of compatible appearing material or
camouflaged to blend into the building or background. Wood screen fences are prohibited. All
exterior process machinery, tanks, eic., are to be fully screened by compatible materials.
9. The use of large unadorned, pre -stressed concrete panels and concrete block shall be prohibited.
Acceptable materials will incorporate textured surfaces, exposed aggregate and/or other
patterning. All walls shall be given added architectural interest through building design or
appropriate landscaping. The buildings shall have varied and interesting detailing. The use of
large unadorned, concrete panels and concrete block, or a solid wall unrelieved by
architectural detailing, such as change in materials, change in color, fenestrations, or other
significant visual relief provided in a manner or at intervals in keeping with the size, mass,
and scale of the wall and its views from public ways shall be prohibited. Acceptable
materials will incorporate textured surfaces, exposed aggregate and/or other patterning. All
walls shall be given added architectural interest through building design or appropriate
landscaping.
10. Space for recycling shall be provided in the interior of all principal structures or within an
enclosure for each lot developed in the Business Center.
11. Each buildings shall contain one or more pitched roof elements depending on scale and type of
building, or other architectural treatments such as towers, arches, vaults, entryway projections,
canopies and detailing to add additional interest and articulation to structures.
12. There shall be no underdeveloped sides of buildings visible from public right-of-ways. All
elevations visible from the street shall receive nearly equal treatment and visual qualities.

L Site Landscaping and Screening
1. Landscaping along Highways 41 and 5 shall comply with Buffer yard standard C. Coulter
Boulevard, Century Boulevard, and West 82nd Street shall comply with Buffer yard standard B.
The master landscape plan for the Arboretum Business Park (formerly Gateway) PUD shall be
the design guide for all of the specific site landscape developments. Each lot must present a
landscape plan for approval with the site plan review process.
2. Storage of material outdoors is prohibited unless it has been approved under site plan review.
All approved outdoor storage must be screened with masonry fences and/or landscaping.
3. Undulating or angular berms or elevation changes of 3' in height shall be placed along Coulter
Boulevard, and Century Boulevard. The berms shall be sodded or seeded at the conclusion of
each project Phase grading and utility construction. The required buffer landscaping may be
installed incrementally, but it shall be required where it is deemed necessary to screen any
proposed development. All required boulevard landscaping shall be sodded.
4. Loading areas shall be screened 100 percent year round from public right-of-ways. Wing walls
may be required where deemed appropriate.
g. Signage
All freestanding signs be limited to monument signs. The sign shall not exceed eighty (80)
square feet in sign display area nor be greater than eight (8) feet in height. The sign treatment is
an element of the architecture and thus should reflect the quality of the development. The signs
should be consistent in color, size, and material throughout the development. The applicant
should submit a sign package for staff review.
2. Each property shall be allowed one monument sign per street frontage.
3. The signage will have consistency throughout the development. A common theme will be
introduced at the development's entrance monument and will be used throughout.
4. Consistency in signage shall relate to color, size, materials, and heights.
5. The Arboretum Business Park PUD shall be permitted two Arboretum Business Park
identification signs. One sign per project entrance, at West 82nd and Century Boulevard and at
Highway 41 and the westerly roadway, shall be permitted. Said sign shall not exceed 80 square
feet in sign area nor be greater than eight feet in height.
6. Wall sign shall be permitted per city ordinance for industrial office park site.
7. All signs shall require a separate sign permit.
8. In addition to the two signs identified in g. 5. above, signage for the main entrance on Highway
5 and Century Boulevard shall be reviewed and approved by the Planning Commission and City
Council.
h. Lighting
1. Lighting for the interior of the business center should be consistent throughout the development.
The street lights should be designed consistent with the existing lighting along the existing
Coulter Boulevard
2. A decorative, shoe box fixture (as specified by City Code) with a square ornamental pole shall be
used throughout the development area for area lighting.
3 Lighting equipment similar to what is mounted in the public street right-of-ways shall be used
in the private areas.
3. All light fixtures shall be shielded. Light level for site lighting shall be no more than 1/2 candle
at the property line. This does not apply to street lighting.
i. Alternative Access
Each site shall accommodate transit service within the individual development whenever
possible.
2. Pedestrian access shall be provided from each site to the public sidewalk and trail system.
The developer and site users shall promote and encourage Traffic Demand Management
Strategies.
4. Each site shall provide areas for bicycle parking and storage.

SITE PLAN PERMIT # 2012-06
AGREEMENT dated September 10, 2012, by and between the CITY OF CHANHASSEN, a
Minnesota municipal corporation (the "City"), and SUPER DOG COUNTRY CLUB, LLC (the
"Developer").
1. Request for Site Plan Approval. The Developer has asked the City to approve a site plan
for a 5,281 square -foot expansion to the approved site plan for a total of 26,301 square feet of
building area (referred to in this Permit as the "project"). The land is legally described as Lot 2,
Block 1, Arboretum Business Park 3"r Addition.
2. Conditions of Site Plan Approval. The City hereby approves the site plan on condition
that the Developer enter into this Permit and famish the security required by it.
3. Development Plans. The project shall be developed and maintained in accordance with the
following plans. The plans shall not be attached to this Contract. If the plans vary from the written
terms of this Permit, the written terms shall control. The plans are:
Plan A: Site Plan prepared by James R. Hill, Inc., dated May 4, 2012, revised July 20, 2012.
Plan B: Grading, Drainage and Erosion Control Plan prepared by James R. Hill, Inc., dated May 4,
2012, revised July 20, 2012.
Plan C: Landscaping Plan prepared by James R. Hill, Inc., dated May 4, 2012, revised July 18,
2012.
Plan D: Utility Plans prepared by James R. Hill, Inc., dated May 4, 2012, revised July 20, 2012.
4. Time of Performance. The Developer shall install all required screening and landscaping
by October 1, 2013. The Developer may, however, request an extension of time from the City. If
an extension is granted, it shall be conditioned upon updating the security posted by the Developer
to reflect cost increases and the extended completion date.
5. Security. To guarantee compliance with the terms of this Permit, the Developer shall
furnish the City with a letter of credit from a bank, cash escrow, or equivalent ("security") for
$12,750.00 (erosion control, landscaping and storm sewer). If the Developer requests a Certificate
of Occupancy prior to the installation of site landscaping, then the developer shall provide to the
city a letter of credit or cash escrow in an amount sufficient to insure the installation of said
landscaping.
PROCEDURESFOR
LETTER OF CREDIT REDUCTION
a. Requests for reductions of Letters of Credit must be submitted to the City in writing by
the Developer or his Engineer.
b. Partial lien waivers totaling the amount of the requested reduction shall accompany each
such request.
c. Any reduction shall be subject to City approval.
6. Notices. Required notices to the Developer shall be in writing, and shall be either hand
delivered to the Developer, its employees or agents, or mailed to the Developer by certified mail at

7. Other Special Conditions. City Council approves a site plan for a 5,281 square -foot
expansion to the approved site plan for a total of 26,301 square feet of building area subject to the
following conditions:
Building Official Conditions:
a. The buildings are required to have automatic fire extinguishing systems.
b. Building plans must be prepared and signed by design professionals licensed in the State of
Minnesota.
c. Retaining walls over four feet high must be designed by a professional engineer and a
permit must be obtained prior to construction.
d. The owner and/or their representative shall meet with the Inspections Division as soon as
possible to discuss property line issues as well as plan review and permit procedures.
e. Any work on existing utilities on site will have to be coordinated carefully with the affected
utility to insure there is no interruption of customer service.
Engineering Conditions:
a. Additional information and calculations must be submitted to determine if the regional pond
can accommodate the proposed additional impervious areas. The applicant shall work with
staff on revised calculations.
b. If importing or exporting material for development of the site is necessary, the applicant
will be required to supply the City with detailed haul routes.
c. The developer will need to work with staff to minimize the height of the retaining wall on
the west side of the proposed parking lot. Currently, the finished wall is outside the
drainage and utility easement, but the structural support will likely be located within the
drainage and utility easement. All structural support for the wall must be located outside of
the drainage and utility easement.
d. Building permits are required for all retaining walls four feet tall or higher and must be
designed by a Structural Engineer registered in the State of Minnesota. Due to the height of
the retaining wall, a fence must be placed on the top for safety at any location that the
vertical separation of the ground is greater than four feet.
e. The City of Chaska will be providing sewer and water service to this site. Approvals,
permits, and fees for sewer and water will be with the City of Chaska.
f. The sanitary sewer along the west property line, storm sewer along the east property line,
and storm sewer along the south property line shall be publicly owned and maintained. All
other utilities within the property boundary will be privately owned and maintained.
g. Details must be provided for all proposed storm sewer, sanitary sewer, and watermain
crossings. Actual elevations of existing utilities shall be verified for accuracy. A minimum
vertical separation of 18 inches is required at all storm, sanitary, and watermain crossings.
Contact Gordy Stauff at 952-227-1166 with the City of Chanhassen Engineering
Department 48 hours prior to connecting to the storm.
h. Each new building is subject to sanitary sewer and water hookup charges. Sanitary sewer
and water hookup fees are unknown at this time, but will be need to be paid to the City of
Chaska.
i. All of the utility improvements are required to be constructed in accordance with the City's
latest edition of Standard Specifications and Detail Plates. The applicant is also required to
provide the City with the necessary financial security in the form of a letter of credit or cash
escrow in the amount of $9,000.00 to guarantee the installation of the storm sewer, erosion
control, and seeding. The applicant must also notify the City after installation of the erosion
control and 48 hours prior to the commencement of grading. Permits from the appropriate
regulatory agencies will be required, including the MPCA and the Dept. of Health.
j. Encroachment agreements will be needed for the fence in the drainage and utility
easements.
k. The applicant shall work with staff to make changes to plans according to staff redlines.
Environmental Resource Specialist Conditions:
a. Increase plantings for bufferyard areas in order to meet ordinance requirements.
b. Transplanted trees will not be accepted as quantities to meet minimum landscape
requirements.
c. To control noise the applicant must install, maintain and operate an ultrasonic noise
abatement system. City staff will review the effectiveness of the system 6 months after
the system is operational and then 12 months after it is operational. If city staff concludes
there's an issue with noise they will bring it back to the City Council and the City Council
may require the planting of 15 trees to replace the noise abatement system. The applicant
shall escrow X dollars as determined by city staff to guarantee that the trees are planted.
Fire Marshal Conditions:
a. A three-foot clear space shall be maintained around the circumference of the fire hydrant
per MSFC Section 508.5.5.
b. Nothing shall be placed in a manner that would prevent operation of the fire hydrant by
firefighters. MSFC Section 508.5.4.
Planning Conditions:
a. The applicant shall enter into a site plan agreement with the City and provide the necessary
security to guarantee erosion control, site restoration and landscaping.
b. Mechanical equipment shall be screened through the placement on the roof, the use of
parapet walls and the use of low -profile equipment.
c. The applicant shall extend the sidewalk on the west side of the building to the south to
connect to the sidewalk across the south side of the buildings, and to the north to the
sidewalk along the north side of the building.
d. A separate sign permit is required for each sign.

e. The applicant shall prepare and implement an additional noise abatement/mitigation plan.
Water Resource Coordinator Conditions:
Surface Water Drainage and Treatment
a. While it does not appear that the site will exceed the maximum 70% hardcover as allowed
by §20-505, calculations must be provided. These calculations shall include the artificial
turf areas.
b. The submittal shall indicate if there is an underdram system for the artificial turf areas. If
there is, show how this is connected to the public conveyance system. The applicant must
also describe how this system prevents animal wastes from entering the storm sewer system.
c. The landscape plan calls out non -woven weed mat. This should be changed to reflect that
the fabric must have a minimum permittivity of 0.7 sec' as described in ASTMD -4491 and
an apparent opening size maximum of 0.25 mm. If this is not acceptable for the
landscaping purposes, this area shall be calculated as hardcover for both planning and
stormwater modeling purposes.
Erosion and Sediment Control
a. The applicant shall provide the NPDES Permit number prior to commencement of earth
disturbing activities.
b. The SWPPP shall be amended such that under Project Contacts, the City contact is Terry
Jeffery, Water Resources Coordinator 952-227-1168 and Chip Hentges, Carver County
SWCD, 952-393-1146 shall be added.
c. That portion of the SWPPP with the heading 'Responsibility Requirements" shall be
completed in full and submitted to the City and included in the on -site SWPPP prior to the
commencement of earth disturbing activities.
d. Per Part III. A. 3 of the NPDES permit, a narrative describing the timing and placement of
all erosion prevention and sediment control BWs must be included in the SWPPP.
8. General Conditions. The general conditions of this Permit are attached as Exhibit "A" and
incorporated herein.

EXHIBIT "A"
GENERAL CONDITIONS
1. Right to Proceed. Within the site plan area, the Developer may not grade or otherwise disturb
the earth, remove trees, construct improvements, or any buildings until all the following conditions
have been satisfied: 1) this agreement has been fully executed by both parties and filed with the
City Clerk, 2) the necessary security and fees have been received by the City, and 3) the City has
issued a building permit in reliance on the foregoing conditions having been satisfied.
2. Maintenance of site. The site shall be maintained in accordance with the approved site plan.
Plants and ground cover required as a condition of site plan approval which die shall be promptly
replaced.
3. License. The Developer hereby grants the City, its agents, employees, officers and contractors
a license to enter the plat to perform all work and inspections deemed appropriate by the City in
conjunction with site plan development.
4. Erosion Control. Before the site is rough graded, and before any building permits are issued,
the erosion control plan, Plan B, shall be implemented, inspected, and approved by the City. The
City may impose additional erosion control requirements if they would be beneficial. All areas
disturbed by the excavation and backfilling operations shall be reseeded forthwith after the
completion of the work in that area. Except as otherwise provided in the erosion control plan, seed
shall be certified seed to provide a temporary ground cover as rapidly as possible. All seeded areas
shall be fertilized, mulched, and disc anchored as necessary for seed retention. The parties
recognize that time is of the essence in controlling erosion. If the Developer does not comply with
the erosion control plan and schedule or supplementary instructions received from the City, the City
may take such action as it deems appropriate to control erosion at the Developer's expense. The
City will endeavor to notify the Developer in advance of any proposed action, but failure of the City
to do so will not affect the Developer's and City s rights or obligations hereunder. No development
will be allowed and no building permits will be issued unless there is full compliance with the
erosion control requirements. Erosion control shall be maintained until vegetative cover has been
restored. After the site has been stabilized to where, in the opinion of the City, there is no longer a
need for erosion control, the City will authorize removal of the erosion control measures.
5. Clean up. The Developer shall maintain a neat and orderly work site and shall daily clean, on
and off site, dirt and debris, including blowables, from streets and the surrounding area that has
resulted from construction work by the Developer, its agents or assigns.
6. Warranty. All trees, grass, and sod required in the approved Landscaping Plan, Plan C, shall
be warranted to be alive, of good quality, and disease free at the time of planting. All trees shall be
warranted for twelve (12) months from the time of planting. The Developer or his contractor(s)
shall post a letter of credit or cash escrow to the City to secure the warranties at the time of final
acceptance.

7. Responsibility for Costs.
A. The Developer shall hold the City and its officers and employees harmless from claims
made by itself and third parties for damages sustained or costs incurred resulting from site
plan approval and development. The Developer shall indemnify the City and its officers
and employees for all costs, damages, or expenses which the City may pay or incur in
consequence of such claims, including attorneys' fees.
B. The Developer shall reimburse the City for costs incurred in the enforcement of this Permit,
including engineering and attorneys' fees.
C. The Developer shall pay in full all bills submitted to it by the City for obligations incurred
under this Permit within thirty (30) days after receipt. If the bills are not paid on time, the
City may halt all development work and construction. Bills not paid within thirty (30) days
shall accrue interest at the rate of 8% per year.
8. Developer's Default. In the event of default by the Developer as to any of the work to be
performed by it hereunder, the City may, at its option, perform the work and the Developer shall
promptly reimburse the City for any expense incurred by the City, provided the Developer is first
given notice of the work in default, not less than four (4) days in advance. This Contract is a
license for the City to act, and it shall not be necessary for the City to seek a Court order for
permission to enter the land. When the City does any such work, the City may, in addition to its
other remedies, assess the cost in whole or in part.
9. Miscellaneous.
A. Construction Trailers. Placement of on -site construction trailers and temporary job site
offices shall be approved by the City Engineer. Trailers shall be removed from the subject
property within thirty (30) days following the issuance of a certificate of occupancy unless
otherwise approved by the City Engineer.
B. Postal Service. The Developer shall provide for the maintenance of postal service in
accordance with the local Postmaster's request.
C. Third Parties. Third parties shall have no recourse against the City under this Permit.
D. Breach of Contract. Breach of the terms of this Permit by the Developer shall be grounds
for denial of building permits.
E. Severability. If any portion, section, subsection, sentence, clause, paragraph, or phrase of
this Permit is for any reason held invalid, such decision shall not affect the validity of the
remaining portion of this Contract.
F. Occunancv. Unless approved in writing by the City Engineer, no one may occupy a
building for which a building permit is issued on either a temporary or permanent basis until
the streets needed for access have been paved with a bituminous surface and the utilities
tested and approved by the city.
G. Waivers/Amendments. The action or inaction of the City shall not constitute a waiver or
amendment to the provisions of this Contract. To be binding, amendments or waivers shall
be in writing, signed by the parties and approved by written resolution of the City Council.
The City's failure to promptly take legal action to enforce this Contract shall not be a waiver
or release.
H. Recordine. This Permit shall run with the land and may be recorded against the title to the
property.
I. Remedies. Each right, power or remedy herein conferred upon the City is cumulative and in

addition to every other right, power or remedy, express or implied, now or hereafter arising,
available to City, at law or in equity, or under any other agreement, and each and every
right, power and remedy herein set forth or otherwise so existing may be exercised from
time to time as often and in such order as may be deemed expedient by the City and shall
not be a waiver of the right to exercise at any time thereafter any other right, power or
remedy.
J. Construction Hours. The normal construction hours under this contract shall be from 7:00
a.m. to 9:00 p.m. on weekdays, from 9:00 a.m. to 5:00 p.m. on Saturdays, with no such
activity allowed on Sundays or any recognized legal holidays. Operation of all internal
combustion engines used for construction or dewatering purposes beyond the normal
working hours will require City Council approval-
K. Soil Treatment Systems. If soil treatment systems are required, the Developer shall clearly
identify in the field and protect from alteration, unless suitable alternative sites are fast
provided, the two soil treatment sites identified during the site plan process for each lot.
This shall be done prior to the issuance of a Grading Permit. Any violation/disturbance of
these sites shall render them as unacceptable and replacement sites will need to be located
for each violated site in order to obtain a building permit.
L. Compliance with Laws, Ordinances, and Regulations. In the development of the site plan
the Developer shall comply with all laws, ordinances, and regulations of the following
authorities:
1. City of Chanhassen;
2. State of Minnesota, its agencies, departments and commissions;
3. United States Army Corps of Engineers;
4. Watershed District;
5. Metropolitan Government, its agencies, departments and commissions.
M. Proof of Title. Upon request, the Developer shall Furnish the City with evidence satisfactory
to the City that it has the authority of the fee owners and contract for deed purchasers too
enter into this Development Contract.
N. Soil Conditions. The Developer acknowledges that the City makes no representations or
warranties as to the condition of the soils on the property or its fitness for construction of
the improvements or any other purpose for which the Developer may make use of such
property. The Developer further agrees that it will indemnify, defend, and hold harmless
the City, its governing body members, officers, and employees from any claims or actions
arising out of the presence, if any, of hazardous wastes or pollutants on the property, unless
hazardous wastes or pollutants were caused to be there by the City.
O. Soil Correction. The Developer shall be responsible for soil correction work on the
property. The City makes no representation to the Developer concerning the nature of
suitability of soils nor the cost of correcting any unsuitable soil conditions which may exist.

POLE SHAFT
The pole shaft is one piece construction,
being fabricated from a weldable grade
carbon steel structural tubing which has a
uniform wall thickness of 11 gauge
(0.1196 ). The pole shaft material shall
conform to ASTM A-500 Grade C with a
minimum yield strength of 50,000 psi. The
pole shaft has a full length longitudinal
resistance weld and is uniformly square in
cross-section with flat sides, small comer
radii and excellent torsional properties.
An oval reinforced gasketed handhole,
having a nominal 3" x 5" inside opening.
located P-6" above base, is standard on all
poles. A grounding provision is located
inside the handhole ring.

BASE PLATE
The anchor base is fabricated from
structural quality hot rolled carbon steel
plate that meets or exceeds a minimum
yield strength of 36,000 psi. The anchor
base telescopes the pole shaft and is
circumferentially welded top and bottom.
All welds are performed in accordance
with the American Welding Society
specification AWS DI.I, latest edition.
ANCHOR BOLT
Anchor bolts are fabricated from
commercial quality hot rolled carbon steel
bar that meets or exceeds a minimum
yield strength of 55,000 psi. Four properly
sized anchor bolts, each with two regular
hex nuts and washers, are furnished and
shipped with all poles unless otherwise
specified. Anchor bolts shall have the
threaded end galvanized a minimum of 8
inches in accordance with ASTM A-153.
Fully galvanized anchor bolts are
available upon request.
Standard - All exterior metal surfaces are mechanically cleaned to remove all oxides and
contaminants prior to coming. The standard finish is a polyester thermosetting powder
coating applied to the surface of the substrate to a minimum of 3 mils for all color finishes.

I have reviewed the plans for the above project received by the Planning Department
on May 4, 2012. Following are my comments, which should be included as
conditions of approval.
1. The buildings are required to have automatic fire extinguishing systems.
2. Building plans must be prepared and signed by design professionals licensed
in the State of Minnesota.
3. Retaining walls over four high must be designed by a professional engineer
and a permit must be obtained prior to construction.
4. Structure proximity to property lines (and other buildings) will have an
impact on the code requirements for the proposed buildings, including but
not limited to; allowable size, protected openings and fire -resistive
construction. These requirements will be addressed when complete building
and site plans are submitted.
5. Detailed occupancy related requirements will be addressed when complete
building plans are submitted.
6. The owner and or their representative shall meet with the Inspections
Division as soon as possible to discuss property line issues as well as plan
review and permit procedures.

Hello Kim,
Monti Knazze and I were contacted by Kurt from James R. Hill (612-508-8890) regarding this situation. Kurt asked us to
determine a price for the relocation of CenturyLink's three buried cables that run north and south within an existing utility
easement along the West side of his property. (between the existing kennel and the gas station). Kurt asked for extra
depth for our relocations due to the proposed grade change to the utility easement.
The affected CenturyLink buried facilities provide service to commercial buildings and also the water tower. Numerous
special ckts to the water tower and to the commercial buildings in addition to regular telephone lines are within our
cables. Any work on these special ckts would have to be coordinated carefully to insure there is no interruption of
customer service.
Kurt requested that our pricing would include the moving and lowering of our facilities (as deep as 4 112 ft) due to their
proposed expansion and parking lot changes at 2910 82nd Street East.
We provided Kurt with a price for relocation on 04/30/2012 that included a breakdown of an extensive amount of work
(buried placement, directional boring, placement at extra depth, cable splicing, cutover work, material costs, technician
labor, contractor labor, etc) that they would have to pay prior to our relocation of facilities.
Kurt reviewed the price and determined it was too expensive. He replied to Monti on 05/01 /2012 stating that they would
not pursue the project.
Please keep me informed of this situation and if it will impact CenturyLink buried facilities.

Landscape Notes:
1. Tree saucer mulch to be four inches (4") depth natural single -shred hardwood bark
2. Refer to civil plan sheets for grading & erosion control.
3. All plant material shall comply with the latest edition of the American Standard for Nursery, American Association of Nurserymen. Unless noted otherwise,
deciduous shrubs shall have at least 5 canes at the specified shrub height. Plant material shall be delivered as specified.
4. Plan takes precedence over plant schedule if discrepancies in quantities exist.
5. All proposed plants shall be located and staked as shown unless built conditions vary from plan.

6. Adjustment in location of proposed plant material may be needed in field. Should an adjustment be required, the diets vnll provide field approval. Significant
changes may require city review and approval.
7. The project landscape contractor shall be held responsible for watering and properly handling all plant materials brought on the site both before and after
installation. Schedule plant deliveries to coincide with expected installation time within 36 hours.
8. All plant materials shall be fertilized upon installation as specified.
9. The landscape contractor shall provide the owner with a watering schedule appropriate to the project site conditions and to plant material growth requirements.
10. If the landscape contractor is concerned or perceives any deficiencies in the plant selections, soil conditions, drainage or any other site condition that might
negatively affect plant establishment, survival or guarantee, they must bring these deficiences to the attention of the landscape architect & client prior to bid
submission.
11. Contractor shall establish to his/ her satisfaction that soil and compaction conditions are adequate to allow for proper drainage at and around the building site.
12, Fencing:
a. Atop Retaining Walls: 6' Black Vinyl Chain Link, to match existing on -site from Phase I.
b. Surrouding Dog Yard & Street / Sideyards: fi Cedar Privacy, with lattice top 2', to match existing on -site from Phase I.
13. Contractor is responsible for ongoing maintenance of all newly installed material until time of owner acceptance. Any acts of vandalism or damage which may
occur prior to owner acceptance shall be the responsibility of the contractor. Contractor shall provide the owner with a maintenance program including, but not
limited to, pruning, fertilization and disease/pest control.
14. The contractor shall guarantee newly planted material through one calendar year from the date of written owner acceptance. Plants that exhibit more than 100A
die -back damage shall be replaced at no additional cost to the owner. The contractor shall also provide adequate tree wrap and deer/rodent protection measures
for the plantings during the warranty period.
15. This layout plan constitutes our understanding of the landscape requirements listed in the ordinance. Changes and modifications may be requested by the city
based on applicant information, public input, council decisions, etc. The landscape contractor is responsible for utility location verification.
16. The landscape contractor shall be responsible for obtaining any permits and coordinating inspections as required throughout the work process and
coordinating their work scope with the general contractor.
17. Plant size & species substitutions must be approved in writing prior to acceptance in the field.
18. The landscape contractor shall furnish an Irrigation Layout Plan for head -to -head coverage of all turf and shrub planting areas. Use commercial -grade irrigation
equipment and provide product cu"heets and (4) copies of the proposed layout plan to the landscape architect for review and approval. Coordinate irrigation
connection point, controller, backflow and valving locations with the architect & general contractor. Irrigation is not required within the native seeding areas.
Connect to Phase I irrigation system and ensure no gaps in water coverage.
19. Trees shown for relocation shall be moved by a mechanical tree spade and are to be fertilized and mulched with a 3' saucer of single -shred hardwood mulch
upon relocation. Insure spaded trees receive water for the first 2 weeks of transplant.
