FIRST AMENDMENT
TO
DEVELOPMENT CONTRACT
LAKESIDE FOURTHADDITION
AGREEMENT dated Felri.Aarj 13 2012, by and between the CITY OF
CHANHASSEN, a Minnesota municipal corporation ("City'), and R.E.C., INC., a Minnesota corporation
(the "Developer'.
1. DEVELOPMENT CONTRACT. The City and the Developer entered into a Development
Contract for LAKESIDE FOURTH ADDITION dated May 24, 2010 (the "Development Contract') which was
recorded with the Carver County Recorder on August 20, 2010 as Document No. A523694. The
Development Contract shall remain in full force and effect except as specifically amended by this First
Amendment to Development Contract ("First Amendment'.
2. AMENDMENT. The Development Contract is amended by adding as a Special
Provision:
Lakeside Fifth Addition. Lots i through 6, Block 2 and Outlot B of Lakeside Fourth Addition
have been replatted as Lakeside Fifth Addition. This Development Contract shall also apply to the
Lakeside Fifth Addition which was approved by the City on February 13, 2012.

PROPOSED MOTION
"The Chanhassen City Council approves the final plat for Lakeside Fifth
Addition and the First Amendment to the Development Contract for Lakeside
Fourth Addition."
City Council approval requires a majority vote of City Council present.
PROPOSAL SUMMARY
The applicant, Ron Clark Construction and Design, is requesting plat approval for
Lakeside Fifth Addition, re -platting Lots 1 — 6, Block 2, and Outlot B, Lakeside
Fourth Addition to adjust the lot lines to accommodate the shift in the housing. The
proposed subdivision complies with the requirements of the Lakeside PUD
regulations. Staff is recommending approval of the final plat for Lakeside Fifth
Addition and approval of the amendment to the Development Contract.
On July 12, 2010, the Chanhassen City Council approved the amended final plat for
Lakeside Fourth Addition.
On May 24, 2010, the Chanhassen City Council approved the final plat for Lakeside
Fourth Addition with a variance to permit a 20-foot wide private street to access
Block 3.
On April 12, 2010, the Chanhassen City Council approved the following:
• The ordinance amending the PUD Design Standards for Lakeside.
• The preliminary plat for Lakeside Fourth Addition.
• Site Plan #10-06 for a 22-unit twin -home project in the Lakeside development.

Lakeside Fifth Addition consists of the re -platting of Block 2 and Outlot B, Lakeside Fourth
Addition.
With the amendment to the development contract, all conditions of the approval for the Fourth
Addition shall be carried forward to the Fifth Addition. All improvements, except for the actual
building construction, have been completed as part of the Fourth Addition.

4) One 11 x17 plan of our plan and description requesting the vacation of the drainage and utility
