Hesse's Bluff Creek Addition contains 5 lots and was platted in 1972. The subject property was developed in 1968 and is 0.7 acres (30,492 square feet) in size and maintains a 38.37-foot setback from the front property line. The property was originally zoned R-1, Single Family Residence District, in 1972. The R-1 zoning district is consistent with the Village of Chanhassen Zoning Ordinance No. 47, adopted in Good Variance Request Planning Case 10-08 July 6, 2010 Page 3 of 4 1972. The minimum lot size in the R-1 district was 15,000 square feet. The minimum front yard setback was 30 feet. The site complied with these requirements. In 1987, with the Lake Ann Interceptor Agreement, the Metropolitan Council required all lots outside of the MUSA to be developed at a 1 unit per 10 acre density. At this time the subject site was rezoned from Single Family Residence District (R-1) to Agricultural Estate (A2). The minimum lot area within the A2 district is 2 Y2 acres and a minimum 50-front yard setback. The subject site does not meet the A2 requirements and therefore has legal, non -conforming status. In 1991, a zoning ordinance amendment was adopted to rezone specific subdivisions located outside of the MUSA from Agricultural Estate (A2) to Rural Residential (RR). The intent was to identify existing single-family, large -lot subdivisions separate from the surrounding agricultural land. The lot and setback requirements within the A2 and RR districts are the same (minimum 2 YZ acres lot area and 50-foot front yard setback). The subject site continues its legal, non -conforming status. ANALYSIS The applicant is requesting to construct a foyer over an existing patio and an addition above the existing garage. When the home was built in 1968 the garage was constructed 38.37 feet from the front property line abutting Bluff Creek Drive. While the addition will not increase the existing footprint of the structure, it does not comply with the 50-foot front yard setback requirement of the district. The construction of the home predates the zoning ordinance and is therefore a legal, non -conforming structure. Section 20-72 of the Chanhassen City Code states that a non -conforming structure may be continued, through repair, replacement, restoration, maintenance, or improvement, but not including expansion. Good Variance Request Planning Case 10-08 July 6, 2010 Page 4 of 4 The City Code states that a variance may be granted if the literal enforcement causes undue hardship and the property owner does not have reasonable use of the property, which includes comparable properties within 500 feet. Of the five lots within the Hesse's Bluff Creek Addition, two properties comply with the 50-foot setback. Reasonable use within the Hesse's Bluff Creek Addition is described as a single-family home with a two -car garage, which is currently constructed on the property. The maximum height within the residential zoning district is three stories or 35 feet. The proposed addition will bring the height of the structure to 17 feet from grade. This is in compliance with the standards as outlined in the City Code and is otherwise a permitted use in the district. If the property had not been rezoned from R-1 (Single Family Residence District), a variance would not be necessary, only a building permit would be required for the addition. In order for the addition to comply with the 50-foot setback requirement, the owner would be required to step back the proposed addition 11.63 feet to meet the required setback. The applicant would lose nearly 280 square feet of the proposed 576 square -foot addition. Additionally, the proposed addition is aligned over the existing garage; shifting the addition to the middle of the existing house would not be feasible due to the layout and framing of the existing structure. Additionally, if the addition were stepped back 11.63 feet the applicant would be required to provide a load -bearing reinforcement to support the weight of the second story. By constructing the addition over the existing footprint, the second story addition will be supported by the existing load -bearing walls of the garage. On July 6, 2010, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Tim Boyce, on behalf of Jeff and Lynda Good, for a 13.63-foot front yard setback variance from the 50-foot required setback to construct an addition above a non -conforming structure at 1231 Bluff Creek Drive, located in the Rural Residential District (RR) on Lot 5, Block 1, Hesse's Bluff Creek Addition. The Planning Commission conducted a public hearing on the proposed variance that was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The structure on the subject site was built prior to the adoption of the zoning ordinance in 1972. In 1972, the site was zoned Single Family Residence District (R-1) and complied the lot requirements. In 1987, it was rezoned to Agricultural Estate (A2) and did not meet the lot requirements, and the site became legal non -conforming. In 1991, the site was rezoned to Rural Residential (RR) and maintained the legal non -conforming status, as it did not comply with the lot requirements. The proposed addition will not increase the footprint of the structure. c. The purpose of the variation is not based upon a desire to increase the value or income potential of the parcel of land. Finding: The intent of the proposed addition is not based on the desire to increase the value of the home. The property owner's intent is to increase the livable area of the home. If the site had not been rezoned from R-1 to large lot the setback would be in compliance and only a building permit would be required. d. The alleged difficulty or hardship is not a self-created hardship. Finding: A two-story single-family home is a permitted use in the RR district and the proposed addition complies with the height restrictions. The existing structure is located 38 feet back from the front property line and this is where we would adding up only, meaning that we are adding a 2nd floor above garage and will not be building closer to the road in what is considered to be the front yard set -back. b. Generally the set -back requirement is not a problem for most large lot zoned areas. In this case the lot is .7 acres, which is the smallest lot in the area and was built pre set -back requirement. . c. The purpose of this variance application is to create more living space for the Good Family. d. We are not asking to go beyond the buildings original perimeter, but are simply going up within the existing structure. The properties to the north seem to be consistent and also do not meet the current ordinance. The existing structure is located 38 feet back from the front property line and this is where we would adding up only, meaning that we are adding a 2nd floor above garage and will not be building closer to the road in what is considered to be the front yard set -back. b. Generally the set -back requirement is not a problem for most large lot zoned areas. In this case the lot is .7 acres, which is the smallest lot in the area and was built pre set -back requirement. . c. The purpose of this variance application is to create more living space for the Good Family. d. The hardship was created because it pre dates the set -back requirements, this building was built before set backs were required. We are not asking to add on to the building perimeter, we are going up and not past the buildings current foot print. e. The building addition meets all other requirements set forth by the city. f. My opinion is that the proposed addition will have a positive effect on the surrounding properties and will not be injurious in anyway. There are no structures located within a couple hundred feet of the proposed addition. In no way will the addition change the supply of light, air or add to congestion. It does not appear that it would affect public safety or fire safety as we are only going up with the addition. It should enhance rather than diminish property value. The existing structure is located 38 feet back from the front property line and this is where we would adding up only, meaning that we are adding a 2"d floor above garage and will not be building closer to the road in what is considered to be the front yard set -back. b. Generally the set -back requirement is not a problem for most large lot zoned areas. In this case the lot is .7 acres, which is the smallest lot in the area and was built pre set -back requirement. . c. The purpose of this variance application is to create more living space for the Good Family. d. The hardship was created because it pre dates the set -back requirements, this building was built before set backs were required. We are not asking to add on to the building perimeter, we are going up and not past the buildings current foot print. e. The building addition meets all other requirements set forth by the city f.
