PROPOSED MOTION: "The Chanhassen Planning Commission, acting as the Board of
Adjustments and Appeals, approves a 13.63-foot front yard setback variance, Planning Case #10-
08, and adoptd the attached Findings of Fact and Action, subject to condition L"
SUMMARY OF REQUEST: The applicant is requesting a 13.63-foot variance from the 50-
foot front yard setback for an addition above an existing legal, non -conforming attached garage.

PRESENT ZONING: Rural Residential (RR)
2030 LAND USE PLAN: Residential Large Lot
ACREAGE: 0.7 acres (30,492 square feet) DENSITY: 1.4 Unit/Acre
ADJACENT ZONING: The adjacent properties are zoned Rural Residential (RR) and contain
single-family homes. The property located south of the Hennepin County Trail Corridor is zoned
Agricultural Estate (A2) and contains open space.
WATER AND SEWER: Water and sewer service is not available to the site. The site utilizes a
well and septic system.
LEVEL OF CITY DISCRETION IN DECISION -MAKING:
The City's discretion in approving or denying a variance is limited to whether or not the
proposed project meets the standards in the Zoning Ordinance for a variance. The City has a
relatively high level of discretion with a variance because the applicant is seeking a deviation
from established standards. This is a quasi-judicial decision.
PROPOSAL SUMMARY
The subject site is located west of Bluff Creek Drive and north of the Hennepin County Trail
Corridor. The house was built in 1968 and predates the 1972 adoption of the zoning ordinance.
The current home is set back 38.37 feet and does not meet the 50-foot front yard setback as required
in the Rural Residential Zoning District. The homeowner is requesting to construct an addition
above the existing garage. While the addition would not increase the footprint of the existing

structure, it is an expansion of a legal, non -conforming structure. The requested variance is
measured from the eaves of the proposed structure. Therefore, the applicant is requesting a 13.63-
foot front yard setback variance (as measured from the eaves). Staff is recommending approval of
the variance request.
APPLICABLE REGULATIONS
• Chapter 20, Division 3, Variances.
• Chapter 20, Division 4, Non -conforming uses or structures.
• Chapter 20, Article XI, Rural Residential Zoning District.
• Section 20-908. Yard regulations.
BACKGROUND
The property is located on Lot 5, Block 1, Hesse's Bluff Creek Addition, which is zoned Rural
Residential (RR). Hesse's Bluff Creek Addition contains 5 lots and was platted in 1972. The
subject property was developed in 1968 and is 0.7 acres (30,492 square feet) in size and
maintains a 38.37-foot setback from the front property line.
The property was originally zoned R-1, Single Family Residence District, in 1972. The R-1
zoning district is consistent with the Village of Chanhassen Zoning Ordinance No. 47, adopted in
Good Variance Request
Planning Case 10-08
July 6, 2010
1972. The minimum lot size in the R-1 district was 15,000 square feet. The minimum front yard
setback was 30 feet. The site complied with these requirements.
In 1987, with the Lake Ann Interceptor Agreement, the Metropolitan Council required all lots
outside of the MUSA to be developed at a 1 unit per 10 acre density. At this time the subject site
was rezoned from Single Family Residence District (R-1) to Agricultural Estate (A2). The
minimum lot area within the A2 district is 2 Y2 acres and a minimum 50-front yard setback. The
subject site does not meet the A2 requirements and therefore has legal, non -conforming status.
In 1991, a zoning ordinance amendment was adopted to rezone specific subdivisions located outside
of the MUSA from Agricultural Estate (A2) to Rural Residential (RR). The intent was to identify
existing single-family, large -lot subdivisions separate from the surrounding agricultural land. The
lot and setback requirements within the A2 and RR districts are the same (minimum 2 YZ acres lot
area and 50-foot front yard setback). The subject site continues its legal, non -conforming status.
ANALYSIS
The applicant is requesting to construct a foyer over an existing patio and an addition above the
existing garage. When the home was built in 1968 the garage was constructed 38.37 feet from
the front property line abutting Bluff Creek Drive.
While the addition will not increase the existing footprint of the structure, it does not comply
with the 50-foot front yard setback requirement of the district. The construction of the home
predates the zoning ordinance and is therefore a legal, non -conforming structure.
Section 20-72 of the
Chanhassen City Code states
that a non -conforming
structure may be continued,
through repair, replacement,
restoration, maintenance, or
improvement, but not
including expansion. The
addition above the garage is
considered to be an expansion
of the non -conforming
setback; therefore, the
applicant is requesting a
variance for its construction.

The City Code allows eaves to encroach into a required setback a maximum of two feet, six
inches. However, when a setback variance is requested, that allowance no longer applies and the
variance request must be measured from the eaves. The footprint of the house is set back 38.37
feet. The proposed addition will have two-inch eaves. Therefore, the applicant is requesting a
13.63-foot front yard setback variance.
Good Variance Request
Planning Case 10-08
July 6, 2010
The City Code states that a variance may be granted if the literal enforcement causes undue
hardship and the property owner does not have reasonable use of the property, which includes
comparable properties within 500 feet. Of the five lots within the Hesse's Bluff Creek Addition,
two properties comply with the 50-foot setback.
Reasonable use within the Hesse's Bluff Creek Addition is described as a single-family home
with a two -car garage, which is currently constructed on the property. The maximum height
within the residential zoning district is three stories or 35 feet. The proposed addition will bring
the height of the structure to 17 feet from grade. This is in compliance with the standards as
outlined in the City Code and is otherwise a permitted use in the district. If the property had not
been rezoned from R-1 (Single Family Residence District), a variance would not be necessary,
only a building permit would be required for the addition.
In order for the addition to comply with the 50-foot setback requirement, the owner would be
required to step back the proposed addition 11.63 feet to meet the required setback. The
applicant would lose nearly 280 square feet of the proposed 576 square -foot addition.
Additionally, the proposed addition is aligned over the existing garage; shifting the addition to
the middle of the existing house would not be feasible due to the layout and framing of the
existing structure. Additionally, if the addition were stepped back 11.63 feet the applicant would
be required to provide a load -bearing reinforcement to support the weight of the second story.
By constructing the addition over the existing footprint, the second story addition will be
supported by the existing load -bearing walls of the garage.
The structure was built prior to the adoption of the zoning ordinance. When the site was rezoned
from R-1 to RR the site became legal, non -conforming. The literal enforcement of the code
causes an undue hardship and is therefore not a self-created hardship.
RECOMMENDATION
Staff recommends that the Planning Commission approve the request for a 13.63-foot front yard
setback variance for an addition above an existing legal non -conforming structure located on Lot
5, Block 1, Hesse's Bluff Creek Addition, based on the staff report and adoption of the attached
Findings of Fact and Action, with the following condition:
1. A building permit is required."

CITY OF CHANHASSEN
CARVER AND HENNEPIN COUNTIES, MINNESOTA
FINDINGS OF FACT
AND ACTION
IN RE: Application of Tim Boyce, on behalf of Jeff and Lynda Good, for a 13.63-foot front yard
setback variance for an addition above a non -conforming structure — Planning Case No. 10-08.
On July 6, 2010, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Tim Boyce, on behalf of Jeff and Lynda Good, for a
13.63-foot front yard setback variance from the 50-foot required setback to construct an addition
above a non -conforming structure at 1231 Bluff Creek Drive, located in the Rural Residential
District (RR) on Lot 5, Block 1, Hesse's Bluff Creek Addition. The Planning Commission
conducted a public hearing on the proposed variance that was preceded by published and mailed
notice. The Planning Commission heard testimony from all interested persons wishing to speak
and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Rural Residential District (RR).
2. The property is guided by the Land Use Plan for Residential -Large Lot (I unit per 10 acres).
3. The legal description of the property is: Lot 5, Block 1, Hesse's Bluff Creek Addition.
4. The Board of Adjustments and Appeals shall not recommend and the City Council shall not
grant a variance unless they find the following facts:
a. That the literal enforcement of this chapter would cause an undue hardship. Undue hardship
means that the property cannot be put to reasonable use because of its size, physical
surroundings, shape or topography. Reasonable use includes a use made by a majority of
comparable property within 500 feet of it. The intent of this provision is not to allow a
proliferation of variances, but to recognize that there are pre-existing standards in this
neighborhood. Variances that blend with these pre-existing standards without departing
downward from them meet this criteria.
Finding: The literal enforcement of this chapter does cause an undue hardship. The
structure was built prior to the adoption of the zoning ordinance. When the site was
rezoned from R-1 to RR the site became legal, non -conforming. A two-story single-
family home is a permitted use in the RR district and complies with the height restrictions.
In order for the addition to comply with the 50-foot setback requirement, the owner
would be required to step back the proposed addition 11.63 feet to meet the required
setback. The applicant would lose nearly 280 square feet of the proposed 576 square -foot
addition. Additionally, the proposed addition is aligned over the existing garage; shifting
the addition to the middle of the existing house would not be feasible due to the layout
and framing of the existing structure. Additionally, if the addition were stepped back
11.63 feet the applicant would be required to provide a load -bearing reinforcement to
support the weight of the second story. By constructing the addition over the existing
footprint, the second story addition will be supported by the existing load bearing wails
of the garage. The literal enforcement of the code causes an undue hardship and is
therefore not a self-created hardship.
b. The conditions upon which a petition for a variance is based are not applicable, generally, to
other property within the same zoning classification.
Finding: The conditions upon which this variance is based are applicable to all properties
within the Hesse's Bluff Creek Addition (RR). The structure on the subject site was built
prior to the adoption of the zoning ordinance in 1972. In 1972, the site was zoned Single
Family Residence District (R-1) and complied the lot requirements. In 1987, it was rezoned
to Agricultural Estate (A2) and did not meet the lot requirements, and the site became legal
non -conforming. In 1991, the site was rezoned to Rural Residential (RR) and maintained
the legal non -conforming status, as it did not comply with the lot requirements. The
proposed addition will not increase the footprint of the structure.
c. The purpose of the variation is not based upon a desire to increase the value or income
potential of the parcel of land.
Finding: The intent of the proposed addition is not based on the desire to increase the value
of the home. The property owner's intent is to increase the livable area of the home. If the
site had not been rezoned from R-1 to large lot the setback would be in compliance and only
a building permit would be required.
d. The alleged difficulty or hardship is not a self-created hardship.
Finding: A two-story single-family home is a permitted use in the RR district and the
proposed addition complies with the height restrictions. In order for the addition to comply
with the 50-foot setback requirement, the owner would be required to step back the
proposed addition 11.63 feet and would lose nearly 280 square feet of the proposed 576
square -foot addition. Literal enforcement of the code causes an undue hardship and is
not a self-created hardship.
e. The granting of the variance will not be detrimental to the public welfare or injurious to
other land or improvements in the neighborhood in which the parcel is located.
Finding: The granting of a variance will not be detrimental to the public welfare or
injurious to other land or improvements in the neighborhood in which the parcel is located.
The recommended proposal will not increase the existing front yard setback. The variance
request is measured from the 24-inch eaves; the existing eaves currently encroach into the
required setback. A two-story home is a permitted use within the RR district and the
proposed height is in compliance with the district regulations.
2
£ The proposed variation will not impair an adequate supply of light and air to adjacent
property or substantially increase the congestion of the public streets or increase the danger
of fire or endanger the public safety or substantially diminish or impair property values
within the neighborhood.
Finding: The proposed home will not impair an adequate supply of light or air to the
adjacent property or substantially increase the congestion of the public streets or increase the
danger of fire or endanger the public safety or diminish property values within the
neighborhood.
5. The planning report #10-08, dated July 6, 2010, prepared by Angie Kairies, et al, is
incorporated herein.
ACTION
"The Chanhassen Planning Commission, as the Board of Adjustments and Appeals,
approves Planning Case #10-08 for a 13.63-foot front yard setback variance for an addition
above an existing non -conforming structure, on Lot 5, Block 1, Hesse's Bluff Creek Addition,
based on these findings of fact."

Written description of variance request:
We are requesting a variance for building above a current garage. This
is the front of the building and does not meet the current set -back
requirements. We are currently at 38 feet plus for the existing
structure. We will not be building closer to the road or the front set-
back requirement. We are building upon the existing garage framing
and going up. In this area we will be creating more living space without
adding to the home's footprint.
We are supplying you with detailed drawing of the project and a survey

RE: 1231 Bluff Creek Drive Variance
Written justification in pursuant to section 20-58:
To whom it may concern
1231 Bluff Creek Drive was built prior to the current ordinance. We are not asking to go beyond the
buildings original perimeter, but are simply going up within the existing structure. The properties to the
north seem to be consistent and also do not meet the current ordinance. The existing structure is
located 38 feet back from the front property line and this is where we would adding up only, meaning
that we are adding a 2nd floor above garage and will not be building closer to the road in what is
considered to be the front yard set -back.
b. Generally the set -back requirement is not a problem for most large lot zoned areas. In this case the
lot is .7 acres, which is the smallest lot in the area and was built pre set -back requirement. .
c. The purpose of this variance application is to create more living space for the Good Family.
d. The hardship was created because it pre dates the set -back requirements, this building was built
before set backs were required. We are not asking to add on to the building perimeter, we are going up
and not past the buildings current foot print.
e. The building addition meets all other requirements set forth by the city.
f. My opinion is that the proposed addition will have a positive effect on the surrounding properties and
will not be injurious in any way.
There are no structures located within a couple hundred feet of the proposed addition. In no way will
the addition change the supply of light, air or add to congestion. It does not appear that it would affect
public safety or fire safety as we are only going up with the addition. It should enhance rather than
diminish property value.

waives this standard. Some applications due to their complexity may take several months to complete. Any
person wishing to follow an item through the process should check with the Planning Department regarding its
status and scheduling for the City Council meeting.
• A neighborhood spokesperson/representative is encouraged to provide a contact for the city. Often developers
are encouraged to meet with the neighborhood regarding their proposal. Staff is also available to review the
project with any interested person(s).
• Because the Planning Commission holds the public hearing, the City Council does not. Minutes are taken and
any correspondence regarding the application will be included in the report to the City Council. If you wish to have
something to be included in the report, lease contact the Plannino Stall person named on the notification.

We are supplying you with detailed drawing of the project and a survey
showing existing conditions and proposed.

We are not asking to add on to the building perimeter, we are going up
and not past the buildings current foot print.
e. The building addition meets all other requirements set forth by the city.
f. My opinion is that the proposed addition will have a positive effect on the surrounding properties and
will not be injurious in anyway.
There are no structures located within a couple hundred feet of the proposed addition. In no way will
the addition change the supply of light, air or add to congestion. It does not appear that it would affect
public safety or fire safety as we are only going up with the addition. It should enhance rather than
diminish property value.

In order for us to provide a complete analysis of issues for Planning Commission and City Council review, we would

proposed future utility services, storm water drainage, and the need for acquiring public lands or easements for park sites,
street extensions or improvements, and utilities. Where specific needs or problems exist, we would like to have a written
report to this effect from the agency concerned so that we can make a recommendation to the Planning Commission and City

We are supplying you with detailed drawing of the project and a survey
showing existing conditions and proposed.
Thank you for your consideration,
Tim Boyce

We are not asking to add on to the building perimeter, we are going up
and not past the buildings current foot print.
e. The building addition meets all other requirements set forth by the city.
f. My opinion is that the proposed addition will have a positive effect on the surrounding properties and
will not be injurious in anyway.
There are no structures located within a couple hundred feet of the proposed addition. In no way will
the addition change the supply of light, air or add to congestion. It does not appear that it would affect
public safety or fire safety as we are only going up with the addition. It should enhance rather than
diminish property value.
