A RESOLUTION APPROVING THE LAND USE AMENDMENT FOR
INDEPENDENT SCHOOL DISTRICT 112 — PLANNING CASE NO.04-08
WHEREAS, the City received an application from Independent School District 112 and
Charles Mattson for a land use amendment including office/institutional and office/industrial; and
WHEREAS, on February 17, 2004, the Chanhassen Planning Commission met at its
regularly scheduled meeting to consider the application for a land use amendment to include
office/institutional and office/industrial; and
WHEREAS, the Planning Commission conducted a public hearing on the proposed
amendment preceded by published and mailed notice.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves the land use amendment to include Office/Institutional, as specified with the conditions
and findings of fact.
Passed and adopted by the Chanhassen City Council this 801 day of March 2004.

1. The impervious surface shall be reduced to less than the current 40 percent
impervious surface. The driveway shall be removed and re -vegetated as shown
on the attached "Impervious Surface Reduction" schematic to achieve a reduction
in the impervious surface.
2. Tree protection fencing must be installed prior to any work commencing around
all trees near the construction limits. Fencing shall remain in place until all
construction is completed.
3. The applicant shall work with staff to provide a vegetative buffer between the
principal structure and Lake Minnewashta.
4. Permits must be obtained before beginning construction, alterations and
demolition.
5. The tower and other elements of the project which are beyond the scope of
Chapter 9 of the Minnesota State Building Code must be designed by a licensed
engineer.
All voted in favor and the motion carried unanimously with a vote of 5 to 0.
REQUEST FOR A COMPREHENSIVE LAND USE AMENDMENT FROM
Kate Aanenson presented the staff report and update from the Planning Commission.
Councilman Peterson asked staff to explain how they are planning to compensate for the
loss of this industrial office property. Bev Stofferahn who lives at 8123 Marsh Drive and
is Superintendent of School District 112 spoke on behalf of the school board asking for
the council's approval. Councilman Lundquist stated he will be working and watching
staff to locate industrial zoning elsewhere in the city and the 2005 MUSA area.
Resolution #2004-11: Councilman Peterson moved, Councilman Labatt seconded
that the City Council approve the Land Use Amendment to Office/Industrial and
Office/Institutional subject to the attached findings of fact and conditioned upon
approval of the Amendment from the Metropolitan Council. All voted in favor and
the motion carried unanimously with a vote of 5 to 0.
APPOINTMENT OF COMMISSION MEMBERS.
Mayor Furlong requested that this item be added to appoint members to the Southwest
Metro Transit Commission and Planning Commission.

REQUEST FOR A COMPREHENSIVE LAND USE AMENDMENT FROM
Kate Aanenson: Thank you Mayor, council members. School District 112 is requesting
a land use amendment to provide the opportunity to build a second school. When the
staff first looked at this we contemplated rezoning the site and doing a single land use. In
looking at it further their decision is a couple years down the road and similar to what
we've done in the southern area of the city, we felt it's probably more appropriate to
provide for two land use options. One in interest to the city, and then in interest of the
applicant that they can close on the property and have an appropriate land use and when
they come back for site plan review, at that time we would actually rezone the property.
When this item was held before the Planning Commission, there was some concern of
neighbors for the proximity to the railroad so we know when the school does come
forward, that we need to look through some design issues, but again we put in the staff
report the uses that were permitted under the industrial office park for the OI. Again
we're adding, this is guided office industrial park, and office institutional would permit a
school. Again when an application does come in, because it's guided for both land uses,
you have the ability to decide which one you want to go with. And in good faith, what
we're telling the school district that we understand that this could be a school. By having
both land uses on there, if for some reason the school chose not to go there, we still have
the ability to maintain the tax base and keep the IOP zoning in place. Again with
findings of fact provide for the appropriate use that the city may have at that time if it
were not to be a secondary school site. So with that, the staff is recommending approval.
This item does have to go to the Metropolitan Council because it is a land use change.
We don't see any issues with that. I have talked to our representative about that and it
seems like that would be pretty much routine on their agenda because the school district
does want to close on this property in the next few months, so with that we do have
findings of fact in the staff report. So we are recommending approval of the subject site
and I'd be happy to answer any questions that you may have.
Mayor Furlong: Thank you. Questions for staff.
Councilman Peterson: Kate, you know I think we've talked about it for years. We don't
normally like to see IOP go off. I mean what are you and your team, what can you do to,
whether it's in the 2005 MUSA area or whatever to bring other IOP back on to
compensate? Are we.
Kate Aanenson: That's a good question and we did put that in the land use, the overall
percentage and what the impacts of that change would be, and we certainly know that
that's on the council's radar to be cognizant of the impacts of that and where we pick
those up. And as we work through the development of the rest of those areas, we know
that we need to see where we can pick up that difference. Again, because the school is

not intending to build until 2007, again we anticipate that there will be a school there, but
you know we'll keep that in kind of our checks and balances to make sure that we're
being consistent with what our goals of having a diversified tax base and we'll be looking
at that so it's being followed through.
Councilman Peterson: I mean as we go from guided areas to zoning, that's really when
our, or we want to do it then versus later.
Kate Aanenson: Correct, and as projects come forward that we're managing that check
and balance and seeing where there's other opportunities. Certainly it's easier to go from
institutional or residential then to put industrial where someone wasn't anticipating it so
we need to kind of get ahead of the curve and we'll be working on that here in the next
few months, specifically in the 2005, but as we work towards the old 212 area too.

Councilman Peterson: Good, thank you.
Mayor Furlong: Just to follow up then. It's your sense that we will be able to pick that
up based upon the other guy, portions, land use guided portions?
Kate Aanenson: I don't want to say we can get it all back, but we certainly, you know we
need to look at the implications of that. Is there other ways that we do it, whether we
anticipated probably some support commercial and some other areas that we hadn't
anticipated. So again kind of measuring back with the holes. We're anticipating things
coming forward but we will be looking at it more carefully. Not only in the 2005, but
again in that old, what will be the old 212 area, and that's mostly industrial in that
southern end too.
Mayor Furlong: Well and I guess I know the staff has taken an opportunistic approach
over the years as well, and we had a couple of those come up before this council. Where
we changed some residential I think. The one I'm thinking of is 5 and Galpin, where we
actually went from residential to commercial so what I'm hearing is those opportunities.
Kate Aanenson: Exactly, so we're kind of keeping that in check and we're anticipating
some of those other ones coming forward so we ]mow that it's an important issue. Again,
meeting the goals and fiscal impacts of the city.
Mayor Furlong: Absolutely. Thank you. Other questions for staff. No? None? Thank
you. I see representatives from the school district here. Is there anything you'd like to
say or address the council on?
Bev Stofferahn: Good evening Mr. Mayor, members of the council. I'm Bev Stofferahn.
I live here in Chan at 8123 Marsh Drive and I'm Superintendent of District 112. We
know that there are more schools in the future of District 112, and specifically there will
be a secondary school and not very far off in our future, given our rapid growth. Finding
this piece of property culminates a long search for land in Chanhassen that would be

appropriate for a school. That was priced in a way that taxpayers were willing to support
and we believe that this will be a very aesthetically pleasant site with some great natural
buffers for a school that is probably not very far off in our future. I also just wanted to
comment on how much we have appreciated from the district's perspective the assistance
of your staff as well as the Planning Commission in this entire process over about the last
2 years. It's been outstanding. I would stand by for any questions you might have.

Mayor Furlong: Discussion. Comments. Council members
Councilman Lundquist: Would just like to go along with what Councilman Peterson said
before. Wasn't that long ago that we had a request for this same piece of property to go
to medium density residential, and one of the reasons that we denied that was due to the
loss of that potential tax revenue from that OI so I think it's important that we keep that
in mind, especially going forward in that 2005 MUSA area. That we look at
opportunities as we're guiding land in there and in our zoning land and that to keep that
in mind and that will be our best, this is a big piece of property and it's going to be
difficult to replace in little chunks here and there throughout the city. And if we're truly
committed that we were committed enough a few months ago to deny another proposal
on this that we've got to keep that in mind and we need to be committed and I guess the
underlying message in my comment Mr. Gerhardt, to you and your staff is, expect to get,
if not from the rest of the council, you can guarantee you'll get from me as we go to zone
that property in 2005, that we need to be prepared to show how we're off -setting this
property in that area, or at least a big portion of it as we go in there, so it doesn't really
apply to the school site now but needed to take that opportunity to put that editorial
comment in there so, thank you.
Mayor Furlong: Thank you. Other comments or discussion?
Councilman Labatt: I would imagine that's a point we're all going to share as leaders
here. We need to replace, and I think the five of us, we'll all look forward to that date
here coming down and we look at 2005 and we try to replace it. I think that we're all
going to have a common goal, the five of us in your concerns Brian so you're not going
to fall on deaf ears with me. I am excited about the school and the opportunity that this
presents for the residents of Chanhassen. I know many of us have been vocal on this
issue and boy it'd be nice to see an ice arena at this place too.
Councilman Peterson: Had to get that in there.
Mayor Furlong: Out of order.
Councilman Labatt: I had to get that in there somehow. And so that's all I've got to say.

Mayor Furlong: And point's well made. I think back in June when this council voted
unanimously to support the school district's acquisition of land within the city, we went
on record saying that we wanted to support the school district, and this is the next step in
that so I commend the school district and their staff for all the hours that I'm not even
aware of that you put in to get this done. That being said, when we set aside land like this
for these uses we have to deal with the effects of that and preserving the tax base or
maximizing that for the long term benefit of all our residents is important so we will do
that. Still I think I wanted to just comment, commend staff for coming up with the dual
land use option here, which I think provides good flexibility. It achieves the school
district's goal and objective so they can close on the property and still maintains
flexibility for the city and I think it's a very reasonable accommodation that we're being
asked to make here. It's exciting. It's good. We're getting closer. Getting closer so,
with that, is there any other discussion or comments? If not, is there a motion then?

Mayor Furlong: Next item here was added at my request at our work session this
evening. We interviewed some candidates. Two candidates for the one position for
Southwest Metro Transit Commission. This is the, help me out here Councilman
Peterson. This is the one of the two representatives. You serve as a representative right
now, and this is one of the two representatives that we have. We had two candidates, or
two applicants. Ms. Vicki Ernst and Bill Thompson and at this point I'd like to bring
before the council consideration of appointment of one of these two individuals to that
position. So with that is there discussion?
Councilman Lundquist: Discussion or a motion?
Councilman Ayotte: Well very brief discussion. Both candidates were very, very
qualified so I don't think we can miss with either. I'll state that at the beginning and end.
Mayor Furlong: No, I concur and that was I think our sense is that we have two very well
qualified applicants here so it's good to have choices between two good ones. Not easy.
But is there a motion to nominate or approve one of the applicants.

REQUEST SUMMARY
The City of Chanhassen submitted a comprehensive plan amendment (CPA) for 95 acres. This amendment is to
change the land use guide plan from Industrial/Office Park to Institutional/Office Park and Office Institutional in
order to accommodate a secondary school.
PROPOSED ACTION
Staff recommends that the Metropolitan Council take the following action:
1 Allow the City to put the comprehensive plan amendment into effect.
ISSUES
Council staff has found no issues with the CPA. However, the City's surface water management plan update was to
be completed by June 2003. The City is in the process of preparing a request for proposal of a surface water
management plan, to be completed in 2005. Once the City has a consultant and identified a preliminary completion
date for the plan, the City should forward that information to the Council.
OVERVIEW

The Metropolitan Council received the City's plan amendment for the Independent School District #112

Council staff finds the proposed plan amendment complete for review. In accordance with state law, the
Council has 60 days to complete its formal review of the plan amendment, with the option to extend the
review an additional 60 days. Staff anticipates that the review will be complete within the first 60-day
period, which ends May 20, 2004.
The amendment is tentatively on the Council's Community Development Committee agenda, as a consent
list item, at its meeting on April 19; 2004. Following that meeting, the amendment will go on the full
Council's consent list for its April 28, 2004 meeting. At this time, staff does not anticipate significant
issues with this amendment.

BACKGROUND
The applicant, Independent School District 112 (ISD 112), is requesting a change in land use and zoning
to permit a secondary school. It is not the intention to build the school at this time. A Land Use
Amendment and Rezoning require a public hearing before the planning commission and approval of the
City Council. In addition the Metropolitan Council must approve the land use amendment. When the
type of school is chosen, a site plan approval and rezoning will be required. Site plan review and
rezoning require a public hearing before the planning commission and approval of the city council. The
tentative plans for the school district include the site plan approval and rezoning in 2007 with an
opening of the school in 2009.
The subject site, as well as the Holasek and Volk properties at the intersection of Galpin Boulevard and
Lyman Boulevard, was guided for office/industrial development as part of the 1991 comprehensive plan
partly because it was adjacent to the industrial expansion coming from the south and west in Chaska. In an
attempt to accommodate a reasonable amount of office -industrial development within the community and
in order to promote a balance of land uses and accompanying mix of tax base, these lands and others
(adding approximately 640 acres) were guided for office/industrial uses. The site is also adjacent to an
arterial roadway, which provides high levels of access, as well as adjacent to an active railroad corridor.
In April 1993, D. R. Horton submitted a proposal for a land use amendment to permit a concept plan of a
mixed townhouse (52 acres), support commercial (5.5 acres) and open space (24.7 acres) development on
this property for review by the city. The Planning Commission and staff recommended denial of the
amendment. The applicant withdrew their requested amendment prior to City Council review.
In June of 2003 Tollefson Development proposed a land use amendment from Office/Industrial to
Residential Medium Density and concept Planned Unit Development approval for a 427 unit townhouse
project on 94.8 acres of land. This request was denied by the City Council.
Originally, staff was considering re -guiding the land use to Office/Institutional only. A concern arose that if
ISD 112 chose not to build on the site they could sell the property to a use that may be less desirable. With
the option of Office/Industrial or Office/Institutional it gives the city the ability to rezone to either land use
zoning designation.
Staff is recommending the approval of the additional land use of Office/Institutional. Based on the trip
generation and the use of the building it is compatible to an office or industrial use. The site is also
adjacent to a collector street.
ANALYSIS
Staff is recommending the Land Use be designated as office/industrial or office/institutional. The
purpose of having the two underlying land use designations is if ISD 112 chooses not to build a school
the city could still require an Industrial Land use/zoning. This would give the city the flexibility of
reviewing those uses that are public or "quasi -public" or private.

The intent of the "OI" District is to provide for public or quasi -public nonprofit uses and professional
business and administrative offices
The following uses are permitted in an "OI" District:
1. Schools.

6. Library.
7. Museum.
8. Health services/hospitals.
9. Nursing homes.
10. Community center.
11. Public recreational facilities.
12. Utility services.
13. Professional, business, and administrative offices.

15. Commercial antennas as regulated by article XXX of this chapter.
The following minimum requirements shall be observed in an "OP' District subject to additional
requirements, exceptions and modifications set forth in this chapter:
1. The minimum lot area is fifteen thousand (15,000) square feet.
2. The minimum lot frontage is seventy-five (75) feet, except that lots fronting on a cul-de-sac shall
have a minimum lot frontage of sixty (60) feet.
3. The minimum lot depth is one hundred fifty (150) feet.
4. The maximum lot coverage is sixty-five (65) percent.
5. Off-street parking shall comply with district setback requirements except:
a. There is no minimum setback when it abuts a railroad right-of-way, except as provided in
sections 20-1191 and 20-1192 pertaining to landscaping requirements.
b. There is no minimum setback when it abuts, without being separated by a street, another
off-street parking area.
c. The minimum setback is fifty (50) feet when it abuts a residential district without being
separated from the residential district by a street or railroad right-of-way.
d. The minimum setback is twenty-five (25) feet for side street side yards.
6. The maximum height is as follows:
a. For the principal structure, two (2) stories.
b. For accessory structures, one (1) story.

6. Printers.
7. Indoor health and recreation clubs.
8. Body shops.
9. Utility services.
10. Recording studios.
11.Off-premises parking lots.
12. Conference/convention centers.
13. Commercial antennas as regulated by article XXX of this chapter.
The following minimum requirements shall be observed in an "IOP" District subject to additional
requirements, exceptions and modifications set forth in this chapter:
1. The minimum lot area is one (1) acre.
2. The minimum lot frontage is one hundred fifty (150) feet, except that lots fronting on a cul-de-
sac shall have a minimum frontage of sixty (60) feet.

4. The maximum lot coverage is seventy (70) percent.
5. Off-street parking shall comply with district setback requirements except:
a. There is no minimum setback when it abuts a railroad right-of-way, except as provided in
sections 20-1191 and 20-1192 pertaining to landscaping requirements.
b. There is no minimum setback when it abuts, without being separated by a street, another
off-street parking area.
c. The minimum setback is fifty (50) feet when it abuts a residential district without being
separated from the residential district by a street or railroad right-of-way.
d. The minimum setback is twenty-five (25) feet for side street side yards.
e. Parking setbacks along public rights -of -way may be reduced to a minimum of ten (10)
feet if the applicant can demonstrate to the satisfaction of the city that one -hundred -
percent screening is provided at least five (5) feet above the adjacent parking lot. The
intent of this section is that the city is willing to trade a reduced setback for additional

landscaping that is both an effective screen and of high quality aesthetically. Acceptable
screening is to be comprised of berming and landscaping. Screening through the use of
fencing is not permitted.
6. The maximum height is as follows:
a. For the principal structure, four (4) stories/fifty (50) feet.
b. For accessory structures, one (1) story.
7. Minimum setback requirements:
a. For front yards, thirty (30) feet.
b. For rear yards, ten (10) feet.
c. For side yards, ten (10) feet.
d. The minimum setback is fifty (50) feet when it abuts a residential district without being
separated from the residential district by a street or railroad right-of-way.
e. Buffer yards: The city comprehensive plan establishes a requirement for buffer yards.
Buffer yards are to be established in areas indicated on the plan where higher intensity
uses interface with low density uses. In these areas, a fifty -foot buffer yard is to be
provided where the interface occurs along a public street, a one -hundred -foot buffer yard
is required where the interface occurs on internal lot lines.
The buffer yard is an additional setback requirement. It is to be cumulatively calculated
with the required setbacks outlined above. The full obligation to provide the buffer yard
shall be placed on the parcel containing the higher intensity use.
The buffer yard is intended to provide additional physical separation and screening for
the higher intensity use. As such, they will be required to be provided with a combination
of berming, landscaping and/or tree preservation to maximize the buffering potential. To
the extent deemed feasible by the city, new plantings shall be designed to require the
minimum of maintenance, however, such maintenance as may be required to maintain
consistency with the approved plan, shall be the obligation of the property owner.
Buffer yards shall be covered by a permanently recorded conservation easement running
in favor of the city.
In instances where existing topography and/or vegetation provide buffering satisfactory
to the city, or where quality site planning is achieved, the city may reduce buffer yard
requirements by up to fifty (50) percent. The applicant shall have the full burden of
demonstrating compliance with the standards herein.

BLUFF CREEK OVERLAY DISTRICT
The site is partially within the Meadowlands Region of the Bluff Creek Overlay District. This region of the
overlay district is characterized by fragmented forest communities, high quality wetlands and diverse
wildlife populations.
The goals set forth in the Bluff Creek Watershed Natural Resources Management Plan (BCWNRMP) for
the Lowlands Region are to:
1. Preserve high -quality wetland systems, riparian areas and remaining forests;
2. Regenerate impaired ecosystems, especially wetlands, to the extent practical under the present land
use constraints;
3. Re-create natural links between major natural features within the Bluff Creek corridor; and
4. Develop environmental educational opportunities within the corridor.
The applicant should keep these goals in mind as a site plan is developed for the property and should work
with staff to achieve these goals for this property.
Staff is recommending the Land Use be designated as office/industrial or offrcelinstitutional. The

Application of Independent School District #112 and Charles Mattson for a land use amendment
including officelinstitutional and officetindustrial. On February 17, 2004, the Chanhassen
Planning Commission met at its regularly scheduled meeting to consider the application of
Independent School District #112 and Charles Mattson for a land use amendment to include
office/institutional and office/industrial. The Planning Commission conducted a public hearing
on the proposed amendment preceded by published and mailed notice. The Planning
Commission heard testimony from all interested persons wishing to speak and now makes the
following:
FINDINGS OF FACT
1. The property is currently zoned Agricultural Estate District, A2.
2. The property is guided in the Land Use Plan for Office/Industrial uses.
3. The legal description of the property is: See attached Exhibit A
4. Findings for Land Use Amendment:
The proposed land use amendment has been considered in relation to the specific policies
and provisions of the comprehensive plan and has been found to be consistent with the
official City Comprehensive Plan. City land use goals and policies require that the city
maintain an appropriate balance of land uses, preserve a tax base mix, and create new
employment opportunities. The city needs to preserve more industrial land for
development since only 8.3 percent of the land is guided for office/industrial uses. With
the amendment of either land use designation if the school were not to be built the city
could still recommend a zoning for industrial uses. The land use amendment provides an
opportunity for a community asset and will provide for the needs of the growth in the
community.
The proposed land use amendment will be compatible with the present and future land
uses of the area. Industrial development exists and is planned to the south and west of
this property. A secondary school use would be similar in traffic impacts as the industrial
or office zoning.
5. The planning report #04-08 Land Use Plan Amendment dated February 17, 2004,
prepared by Kate Aanenson, et al, is incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the Land Use
Amendment.

PROPOSAL: Comprehensive Land Use Amendment APPLICANT: Independent School District No. 112
from Office Industrial to Office; and a
Rezoning from A2 to Office Institutional LOCATION: East of Lyman Blvd., South of the
Railroad and West of Bluff Creek
NOTICE: You are invited to attend a public hearing about a proposal in your area. The applicant, Independent School
District No. 112, is requesting a Comprehensive Land Use Amendment from Office Industrial to Office; and a Rezoning
from A2 to Office Institutional. The intended use is a secondary school.
What Happens at the Meeting: The purpose of this public hearing is to inform you about the applicant's request and to
obtain input from the neighborhood about this project. During the meeting, the Chair will lead the public hearing through
the following steps:
1. Staff will give an overview of the proposed project.
2. The applicant will present plans on the project.
3. Comments are received from the public.
4. Public hearing is closed and the Commission discusses the project.
Questions and Comments: If you want to see the plans before the meeting, please stop by City Hall during office hours,
8:00 a.m. to 4:30 p.m., Monday through Friday. If you wish to talk to someone about this project, please contact Kate
Aanenson at 952-227-1139 or e-mail kaanenson@ci.chanhassen.mn.us. If you choose to submit written comments, it is
helpful to have one copy to the department in advance of the meeting. Staff will provide copies to the Commission.
Notice of this public hearing has been published in the Chanhassen Villager on February 5, 2004.
City Review Procedure
Subdivisions, Planned Unit Developments, Site Plan Reviews, Conditional and Interim Uses, Wetland
Alterations, Rezonings, Comprehensive Plan Amendments, Code Amendments require a public
hearing before the Planning Commission. City ordinances require all property within 500 feet of the
subject site to be notified of the application in writing. Any interested party is invited to attend the
meeting.
Staff prepares a report on the subject application. This report includes all pertinent information and a
recommendation. These reports are available by request. At the Planning Commission meeting,
staff will give a verbal overview of the report and a recommendation. The item will be opened for the
public to speak about the proposal as a part of the hearing process. The Commission will close the
public hearing and discuss the item and make a recommendation to the City Council. The City
Council may reverse, affirm or modify wholly or partly the Planning Commission's recommendation.
Rezonings, land use and code amendments take a simple majority vote of the City Council except
rezonings and land use amendments from residential to commercial/industrial.
Minnesota State Statute 519.99 requires all applications to be processed within 60 days unless the
applicant waives this standard. Some applications due to their complexity may take several months
to complete. Any person wishing to follow an item through the process should check with the
Planning Department regarding its status and scheduling for the City Council meeting.
A neighborhood spokesperson/representative is encouraged to provide a contact for the city. Often
developers are encouraged to meet with the neighborhood regarding their proposal. Staff is also
available to review the project with any interested person(s).
Because the Planning Commission holds the public hearing, the City Council does not. Minutes are
taken and any correspondence regarding the application will be included in the report to the City
Council. If you wish to have something to be included in the report, please contact the Planning Staff
person named on the notification.

NOTICE IS HEREBY GIVEN that the Chanhassen Planning Commission will hold a
public hearing on Tuesday, February 17, 2004, at 7:00 p.m. in the Council Chambers in
Chanhassen City Hall, 7700 Market Boulevard. The purpose of this hearing is to consider the
request for a Comprehensive Land Use Amendment from Office Industrial to Office; and a
Rezoning from A2 to Office Institutional for property located east of Galpin Blvd. and north of
Lyman Blvd., Independent School District #112 — Planning Case No. 04-08.
A plan showing the location of the proposal is available for public review at City Hall
during regular business hours.

All voted in favor, except Slagle and Tjornhom who opposed, and the motion
carried with a vote of 3 to 2.
Since it was not enough of a majority vote, the item automatically goes to City Council
for review. Chairman Sacchet summarized the Planning Commission's concerns as, the
vote of 3 to 2 is that they do agree with the front yard setback. They consider that a
reasonable use. They do not agree with the variance on the side yard setback because
there are ample possibilities to mitigate that, as well as with the deck. Definitely want to
have the coverage reduced, not increased. That's the one area where they can mitigate
the non-conformance, the shoreland setback is the most sensitive in terms of the nature.
There was a concurrence to save the evergreen to the east of the deck. Commissioner
Claybaugh clarified his position on the garage depth of 24 feet. It's less a function of the
garage depth and more a function of making the bedrooms above it work out. As such he
doesn't have reservations about that. Commissioners Slagle and Tjomhom stated they
were in concurrence with the application. It seemed that the neighbor, the applicant and
the builder were willing to work together to reach a reasonable agreement.
Commissioner Lillehaug clarified that with the eaves, it would be a request for a 3 foot 6
inch encroachment into the setback.

Kate Aanenson presented the staff report on this item. Commissioner Slagle asked for
clarification on what's allowed in the proposed zoning district. He also asked if there
were any concerns with a school being located next to a sub -station. Chairman Sacchet
asked if the 95 acres of industrial land was going to be replaced somewhere else in the
city. Bev Stofferahn, Superintendent of District 112, spoke on behalf of the school

district. She explained that the purchase agreement culminates over a 2 year process of
trying to find land specifically within Chanhassen that (a), the taxpayers could afford and
would be willing to support, and (b), could support a secondary school down the road.
Chairman Sacchet opened the public hearing.
Lori Juelich, 2246 Stone Creek Lane East which is across the railroad tracks from the
proposed school site, stated her support for a secondary or middle school being built on
this property and would prefer to have a school on this site rather than industrial. Her
concerns was with secondary schools there tends to be a 2 mile walk zone and with
children crossing the railroad tracks. Karen Kennedy who lives in Stone Creek expressed
her support for the school on this site but asked for clarification on the request for a
change in zoning. Chairman Sacchet closed the public hearing.
Claybaugh moved, Lillehaug seconded that the Planning Commission recommends
approval of the Land Use Amendment to Office/Industrial and Office/Institutional,
subject to the attached Findings of Fact. All voted in favor and the motion carried
unanimously with a vote of 5 to 0.

Slagle: Kate, in offering the two options if you will, would there be a reason the
applicant would be opposed to that, from what you know?
Aanenson: No, we did speak to them about that and I think they're comfortable with that.
Again we don't anticipate that, but for some reason the school district decided or couldn't
build the school in the future, it just protects our options of providing industrial, and also
gives the residents some level of protection of what they think might go in there.
Slagle: Okay. On page 3, where it talks about OI district. Maximum height.
Aanenson: Two stories.

Slagle: Two stories, okay with that. Accessory structures, one story. Okay. On page 4.
It talks about minimum setback when it abuts a railroad right-of-way. We have the
railroad to the north, and it only raised a question in my mind that potentially, obviously
we don't need to address it tonight but you know, could you potentially have a two story
gym wall, 10 feet from that property line so that people on the other side of the, you
know I'm just throwing some thoughts out.
Aanenson: Right, no and I think if they work through the design, I think that was one of
the nice, I mean they have decided it it'd be two story or one, or whether it's a middle or
a high school, but I think as they work through the design, that was one of the nice things
about the size of it. It does have some prominence. Some nice views and if it is a two
story, I think we would look at that. What's the best way to site the building. They've
certainly looked and had some potential drawings on that but those are all good points.
Slagle: Okay, and then let's see here. Oh, on page 5. Just one last question. It talks
about in instances where existing topography and/or vegetation provide buffering
satisfactory to the city, da, da, da, da, da, the city may reduce buffer yard requirements by
up to 50 percent. Obviously it says the city may. You wouldn't at this point see any
reason.
Aanenson: No, I think we want to see when the design comes in, but obviously you have,
which again lends to this site, you have some built in natural topographic. The railroad
tracks. The Bluff Creek corridor which has some expansive wetlands, so there are
already some natural, the sub -station for Chaska so there's already some natural kind of
breaks and they're buffering the neighborhood and then you've got the industrial on this
side so I think there are already some impediments to the visual impact.
Slagle: You know actually one last question, I'm sorry. Speaking of the sub -station.
mean any concerns about having a school next to a sub -station?
Aanenson: We did an extensive study on electromagnetic fields when we had Kindercare
come in and really actually Europe, actually Sweden probably has the most requirements
on that but as far as that concern, we'll certainly look at it. More than likely the school
will probably be more towards the north, so it'd be probably a parking lot on that side.
Slagle: Okay. That's it.
Sacchet: Other questions from staff? Questions for staff. Craig, any questions from
staff?
Claybaugh: Yeah. Just with respect to what we're doing with the land use amendment.
This is the most restrictive vehicle that we can use to accomplish that for the potential for
the school, but still retain as much control for the industrial aspect that we're trying.
Aanenson: That's correct.

Claybaugh: I know we went through.
Aanenson: Right. It provides them a level that they can close on the property. It
provides the city a level of protection that if they were not to go forward, we have some
other zoning in place.
Claybaugh: That's my only question.
Sacchet: Quick question Kate. In terms of we're losing 95 acres of industrial. Most
likely with this move. Is the idea that we try to add some more industrial somewhere else
in the city or what's the idea there?
Aanenson: I think that's something that the council is certainly considering too, and in
looking at this, when we looked at things that are appropriate for the city's overall well
being.
Sacchet: Balance.
Aanenson: Balancing, certainly. School, institutional uses are a part of that, but as we
move towards the 2005 area and 10 and 15, certainly the next project coming up, the
lower half of that, we do see.
Sacchet: You'll be able to mitigate that there. Okay, thank you very much. That's all

Bev Stofferahn: Good evening commissioners, I'm Bev Stofferahn. Superintendent of
District 112. I reside at 8123 Marsh Drive here in Chanhassen. We know that with a
rapidly growing school district we've got more secondary schools in our future. They're
down the road a little bit yet, although probably not very far, and one of the first major
steps in that process always is to think about siting of those schools, and as you know, not
only are land prices in this area soaring, but land is being purchased and increasingly
more difficult to get. The purchase agreement that we have right now culminates over a
2 year process that we have been through in trying to find land specifically within
Chanhassen that (a), the taxpayers could afford and would be willing to support, and (b),
could support us in a secondary school down the road. We very much appreciate the help
of this body in helping identify about 18 months ago some potential sites and actually we
worked hard from that list to narrow down to the short list based on criteria that the
school district used, and ultimately to the site, so we think it's a great site with a
wonderful potential for a secondary school and we'd stand by to answer any questions
that you might have.

Lori Juelich: Sure. I'm Lori Juelich and I live at 2246 Stone Creek Lane East in
Chanhassen, so our development is close, next to the railroad tracks.
Sacchet: Across the railroad, yeah.
Lori Juelich: I support this as a school property. I think it's a wonderful addition to our
community to have a secondary or a middle school in our community. I would prefer to
have a school there versus some other type of industrial option there. I would like just to
put out there, just because I'll probably forget in the future but with our secondary and
middle schools we tend to have a 2 mile walk zone so I would have concerns with the
railroad tracks because everything around this area is industrial other than Stone Creek
and then the houses towards Audubon. So that would be a walk in area which I think is a
great opportunity for kids, middle school or high school, if you don't have a car. For
them to walk or ride so I guess I'd be concerned about the railroad tracks and kids always
take the short way to school, and that will be over the tracks. So if there would be some
way we could put a by-pass underneath. I'm sure the city.
Aanenson: There is a by-pass underneath and I think we certainly.
Sacchet: There is an underpass or by-pass?
Lillehaug: It's a ways away.
Aanenson: Yeah, so I mean if we can work that into the design, there is a trestle...
Lori Juelich: Right, and having 4 kids, I know they will all, you know the kids that are
here will cross the tracks here, so I'm wondering if maybe something here, because
you're got, this will all be walk zone. And they're going to cross that track. And I know
we've got the old one here, and then you've got this development too so if we can just, I
think I just know they will take the shortest route and to cross there will be a big option
for kids, because you've got this development here too. Coming through. I also think
it'd be a great opportunity for our science programs to have Bluff Creek, the actual creek
there. It would be a wonderful experience for our schools. I'll support it, thanks.

Karen Kennedy: My name is Karen Kennedy and I live in Stone Creek, right across the
railroad tracks. I actually butt up, right up to the railroad tracks and I like the plan. I
really do. I think it's a great idea. There's been several different options that have come
across the way along the line, but one of the questions I had is, I didn't really understand,
does the school district want to change the ordinance that allows the school to be there
instead of an industrial building, is that correct?

Sacchet: Do you want to address that please Kate?
Aanenson: Sure. Right now the way the property is guided is for industrial uses only. A
school isn't a permitted use in that district, in that land use designation, so in order for the
school to go there we'd have to change the guiding to allow it to be something else.
Karen Kennedy: But let's say that down the line, four years down the line the school
finds another great site and they end up not building. Can something else be built there
now that it has a different ordinance? Can some other thing, what kind of things could be
built there besides a school?
Aanenson: We're going to leave both of those in place, so this body and the City Council
will have the choice to pick between office institutional or the industrial zoning.
Karen Kennedy: So is it like set in stone that there is going to be a school there or is this
just changing the ordinance so if they possibly?
Sacchet: Well that's a difficult question to answer. I mean considering they're buying
the property I think they're certainly a high likeliness. Is it a guarantee? Well no, it isn't
and so from the city viewpoint, what Kate is explaining is we want to leave the option
open that it can be used for industrial use as it was originally guided within our
comprehensive plan framework and at the same time expand the guidance. It's really not
changing the ordinance. It's what that land is planned to be used for so what's in front of
us here is to make the decision whether we want to expand what it's guided for. Not to
just be industrial but also for a school use, which is a requirement to purchase this. I
mean they don't want to purchase it if they can't build a school, right?
Karen Kennedy: Right, so they haven't, okay.
Sacchet: Alright?

goals of the Bluff Creek Overlay District. It stresses those four points. What we're
trying to aim for with the Bluff Creek Overlay District to preserve the quality of the
natural environment to regenerate impaired environment where it's impaired, which is in
most places. To regenerate natural links between the natural areas. Develop
environmental education opportunities which would go very much hand in hand
obviously with the school. I just want to mention this for the record because that's an

City Council. In addition the Metropolitan Council must approve the land use amendment. When the
type of school is chosen, a site plan approval and rezoning will be required. Site plan review and
rezoning require a public hearing before the planning commission and approval of the city council. The

ut a subject site, as well as the Holasek and Volk properties at the intersection of Galpin Boulevard and
'Lyman Boulevard, was guided for officelindustrial development as part of the 1991 comprehensive plan
4�partly because it was adjacent to the industrial expansion coming from the south and west in Chaska. In an
l ttempt to accommodate a reasonable amount of office -industrial development within the community and
n order to promote a balance of land uses and accompanying mix of tax base, these lands and others
\ (adding approximately 640 acres) were guided for office/industrial uses. The site is also adjacent to an
arterial roadway, which provides high levels of access, as well as adjacent to an active railroad corridor.
In April 1993, D. R. Horton submitted a proposal for a land use amendment to permit a concept plan of a
mixed townhouse (52 acres), support commercial (5.5 acres) and open space (24.7 acres) development on
this property for review by the city. The Planning Commission and staff recommended denial of the
amendment. The applicant withdrew their requested amendment prior to City Council review.
In June of 2003 Tollefson Development proposed a land use amendment from Office/Industrial to
Residential Medium Density and concept Planned Unit Development approval for a 427 unit townhouse
project on 94.8 acres of land. This request was denied by the City Council.
Originally, staff was considering re -guiding the land use to Office/Institutional only. A concern arose that if
LSD 112 chose not to build on the site they could sell the property to a use that may be less desirable. With
the option of Office/Industrial or Office/Institutional it gives the city the ability to rezone to either land use
zoning designation.
Staff is recommending the approval of the additional land use of Office/Institutional. Based on the trip
generation and the use of the building it is compatible to an office or industrial use. The site is also
adjacent to a collector street.

landscaping that is both an effective screen and of high quality aesthetically. Acceptable
screening is to be comprised of berming and landscaping. Screening through the use of
fencing is not permitted.
6. The maximum height is as follows:
a. For the principal structure, four (4) stories/fifty (50) feet.
b. For accessory structures, one (1) story.
Minimum setback requirements:
a. For front yards, thirty (30) feet.
b. For rear yards, ten (10) feet.
c. For side yards, ten (10) feet.
d. The minimum setback is fifty (50) feet when it abuts a residential district without being
separated from the residential district by a street or railroad right-of-way.
e. Buffer yards: The city comprehensive plan establishes a requirement for buffer yards.
Buffer yards are to be established in areas indicated on the plan where higher intensity
uses interface with low density uses. In these areas, a fifty -foot buffer yard is to be
provided where the interface occurs along a public street, a one -hundred -foot buffer yard
is required where the interface occurs on internal lot lines.
The buffer yard is an additional setback requirement. It is to be cumulatively calculated
with the required setbacks outlined above. The full obligation to provide the buffer yard
shall be placed on the parcel containing the higher intensity use.
The buffer yard is intended to provide additional physical separation and screening for
the higher intensity use. As such, they will be required to be provided with a combination
of berming, landscaping and/or tree preservation to maximize the buffering potential. To
the extent deemed feasible by the city, new plantings shall be designed to require the
minimum of maintenance, however, such maintenance as may be required to maintain
consistency with the approved plan, shall be the obligation of the property owner.
Buffer yards shall be covered by a permanently recorded conservation easement running
in favor of the city.
In instances where existing topography and/or vegetation provide buffering satisfactory
to the city, or where quality site planning is achieved, the city may reduce buffer yard
requirements by up to fifty (50) percent. The applicant shall have the full burden of
demonstrating compliance with the standards herein.

BLUFFCREEK OVERLAY DISTRI
The site is partially within a eadowlands Region of the Bluff Creek Overlay District. This region of the
overlay district is characterized by fragmented forest communities, high quality wetlands and diverse
wildlife populations.
The goals set forth in the Bluff Creek Watershed Natural Resources Management Plan (BCWNRMP) for
the Lowlands Region are to:
1. Preserve high -quality wetland systems, riparian areas and remaining forests;
2. Regenerate impaired ecosystems, especially wetlands, to the extent practical under the present land
use constraints;
3. Re-create natural links between major natural features within the Bluff Creek corridor; and
4. Develop environmental educational opportunities within the corridor.
The applicant should keep these goals in mind as a site plan is developed for the property and should work
with staff to achieve these goals for this property.
Staff is recommending the Land Use be designated as officetindustrial or officelinstitutional. The
purpose of having the two underlying land use designations is if ISD 112 chooses not to build a school

the city could still require an Industrial Land use/zoning. This would give the city the flexibility of

Application of Independent School District #112 and Charles Mattson for a land use amendment
including office/institutional and office/industrial. On February 17, 2004, the Chanhassen
Planning Commission met at its regularly scheduled meeting to consider the application of
Independent School District #112 and Charles Mattson for a land use amendment to include
officefinstitutional and office/indusUW. The Planning Commission conducted a public hearing
on the proposed amendment preceded by published and mailed notice. The Planning
Commission heard testimony from all interested persons wishing to speak and now makes the
following:
FINDINGS OF FACT
1. The property is currently zoned Agricultural Estate District, A2.
2. The property is guided in the Land Use Plan for Office/Industrial uses.
3. The legal description of the property is: See attached Exhibit A
4. Findings for Land Use Amendment:
The proposed land use amendment has been considered in relation to the specific policies
and provisions of the comprehensive plan and has been found to be consistent with the
official City Comprehensive Plan. City land use goals and policies require that the city
maintain an appropriate balance of land uses, preserve a tax base mix, and create new
employment opportunities. The city needs to preserve more industrial land for
development since only 8.3 percent of the land is guided for office/industrial uses. With
the amendment of either land use designation if the school were not to be built the city
could still recommend a zoning for industrial uses. The land use amendment provides an
opportunity for a community asset and will provide for the needs of the growth in the
community.
The proposed land use amendment will be compatible with the present and future land
uses of the area. Industrial development exists and is planned to the south and west of
this property. A secondary school use would be similar in traffic impacts as the industrial
or office zoning.
5. The planning report #04-08 Land Use Plan Amendment dated February 17, 2004,
prepared by Kate Aanenson, et al, is incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the Land Use
Amendment.

Chanhassen Elementary wins environmental award
I'm so proud to report that Chanhassen Elementary School has received an Environmental
Excellence Award from the City of Chanhassen! The award recognizes the school's effort to
improve its recycling program. Teacher Justin Rowlandson accepted the award for the school.
To increase recycling rates at Chanhassen Elementary, each classroom received its own
recycling bins with recycling stations set up throughout the school. The effort truly improved
recycling rates and our hats are off to the students and staff at Chanhassen for their
commitment to improving our world through recycling!
Chanhassen Planning Commission to consider rezoning new school site
On Tuesday, the Chanhassen Planning Commission will be holding a public hearing on our
request to rezone the secondary school site we recently purchased in Chanhassen. We'll be
there to answer questions at the Planning Commission's meeting at 7 p.m. at City Hall. I

continue to be excited about this property. Located north of the intersection of Lyman Blvd.
and County Road 17, the site is both practical and beautiful. The zoning is one of several
contingencies that must be resolved before the sale is final.
I Love to Read Month aimed at all of us
Our schools are observing I Love to Read Month in February. It's a great opportunity for all of
us to remember the importance of reading. The research is very clear that reading to children
and allowing our children to see us reading for pleasure are among the most important actions
adults can take to help their children develop a love for reading. Because reading skills are
fundamental for learning in every subject area, nothing we do in school is more important than
teaching reading, and parents become our partners when they make reading a family
commitment as well. Our media specialists can provide suggestions of book titles that are
appropriate for your child and I encourage you to read with your child this month ... and every
month.
Many apply ... few are chosen
You may have heard me talk about the extensive process we use to hire staff in District 112.
At a School Board work session last night, Dr. Jim O'Connell, Director of Administrative
Services, shared some facts I thought you might find interesting. Teaching applications for the
2003-04 school year totaled 700. Feedback on our application tells us it is one of the most
thorough around. Following our initial screening process, 428 applications were forwarded for
consideration. Candidates selected for an interview went through another rigorous process
which included a second screening, reference checks, and a deep background check. From
that pool of candidates, 16 teachers were hired at the elementary level; 37 were hired for
secondary/special areas. We were able to fill our 53 positions with the best of a very large
pool of applicants. Our community tells us repeatedly that our greatest strength is our teaching
staff. I want to assure you that we are doing everything possible to continue the teaching
quality you expect.
And finally... how about those Hawks! We're proud of our basketball team and I encourage
you to attend one of their games. Ranked number one in the state, the team is one of the
most entertaining tickets in town! I encourage you to get involved with any of our tremendous
high school teams. High School sports are fun to watch and it's important for all of our athletes
to know the community is behind them.
