I received a copy of your notification letter and maps pertaining to the West One comprehensive plan land use amendment (CPA). As the handbook indicates, the Council can waive the adjacent review and comment period for minor plan amendments that meet certain criteria listed on the following page (1-11) of the handbook, see http://www.metrocouncil.org/planning/LPH/LPHSectl.pd In my view, this proposed amendment meets the criteria and the adjacent review and comment period for this amendment can be waived. You do not need to wait for 60 days. It is okay to submit the amendment now. What we need is for you to fill out and send a hard copy of the comp plan amendment form (www.metrocounci1.org/planning/assistance/CPASubmittalFormJan07.doc) and electronic copies in PDF format of the form & amendment to Cheryl Olsen, Reviews Coordinator. We will initiate the review once we have the form and electronic copy. In this case, the paper copy that I already have is all I need as hard copy of the amendment itself. If there are no surprises, I would expect us to complete our review within 15 days of our receipt of the material. Once the comp plan update review process is completed later this year, I expect that the Council may decide to move away from paper copies and towards a paperless review process, but that is some months away. Please contact me if you have any questions about this amendment. Also before sending out minor CPA review notices in the future, please contact me so that we can determine in advance whether to waive adjacent review for a proposed amendment. Communities have 60 days to comment on a request. All respondents have waived comments on the amendment. Staff has been notified by the Metropolitan Council that this amendment is minor and, as such, they have waived the requirement for other adjacent local government units and school districts to comment on this request. This amendment will require Metropolitan Council approval following city action. ANALYSIS The parcel has an area of 2.2 acres and is occupied by a light industrial building. The building has an area of 36,289 square feet. COMPLIANCE WITH LAWS AND REGULATIONS. The Developer represents to the City that the proposed development complies with all applicable City, County, Metropolitan, State, and Federal laws and regulations, including but not limited to planned unit development ordinance, subdivision ordinances, zoning ordinances, and environmental regulations. The Developer agrees to comply with such laws and regulations. 9. ENFORCEMENT. City Council approval requires a majority of City Council present. Staff discovered inconsistencies between the "City of Chanhassen 2030 Land Use Plan" and the existing use on the subject property. Staff is proposing to process a land use plan amendment to re -guide the property from Commercial to Office Industrial. This land use plan amendment will make the existing uses consistent with the land use plan. The subject site is zoned Planned Unit Development (PUD) and is located northeast of Highway 5 and southwest of the intersection of Kerber Boulevard and Picha Drive. On September 22, 1993, the Metropolitan Council approved the request (see Attachment 1). This change was never reflected on any land use map. Communities in the metropolitan area must notify adjacent local government units and school districts of proposed comprehensive plan amendments before they take action on the proposals. Communities have 60 days to comment on a request. All respondents have waived comments on the amendment. Staff has been notified by the Metropolitan Council that this amendment is minor and, as such, they have waived the requirement for other adjacent local government units and school districts to comment on this request. This amendment will require Metropolitan Council approval following city action. PLANNING COMMISSION ACTION On July 21, 2009, the Planning Commission reviewed and voted unanimously to recommend approval of the proposed land use amendment. The Planning Commission minutes for July 21, 2009 are item 1 a of the City Council packet. REQUEST FOR APPROVAL. The Developer has asked the City to rezone the land encompassed in the WEST ONE ADDITION ("subject property") to planned unit development ("PUD"). 2. CITY APPROVAL. What is their, why are they involved in this or why would they have been involved in this? Aanenson: Sure. A good question. They have jurisdiction over land use. That's one of their, you know transportation, land use, sewer, water. Because this is a, what they consider a minor amendment that doesn't affect any major systems because it's already in place, they already waived off on any comment and will expedite that. When we do, if we were to do a significantly larger one, they may have comments on it or allow adjoining city, for example if we did a large subdivision with major traffic components, Chaska may want to comment on that and say how that affects their, either their utilities or their transportation system and what the Met Council does is kind of acts as a mediator if there's a dispute between the two cities. Doll: Okay. Aanenson: Fortunately we have a good relationship on these minor amendments. Most cities are pretty expedient of signing off if they don't see any impact to them. Doll: And they agreed with that and it was supposed to be zoned the way we want it now? Aanenson: Correct. Yes. Doll: Or you want it now? Aanenson: Yes. Yep. Doll: That's all I have. Larson: Okay. PROPOSAL Staff discovered inconsistencies between the "City of Chanhassen 2030 Land Use Plan" and the existing use on property located northeast of Highway 5 and southwest of the intersection of Kerber Boulevard and Picha Drive (Lot 1, Block 1, West One Addition). To remedy the situation, staff proposed an amendment to change the land use designation from Commercial to Office Industrial for 2.2 acres of land. The 60-day agency review period ended on August 26, 2009. On July 21, 2009, the Planning Commission held a public hearing to review the request. The Planning Commission recommended approval conditioned on Metropolitan Council approval. On August 10, 2009, the Chanhassen City Council approved the Comprehensive Plan Amendment conditioned on Metropolitan Council approval and the submittal of the Minor Land Use Comprehensive Plan Amendment to the Metropolitan Council for their review. On October 26, 2009, the Metropolitan Council received the City's West One Comprehensive Plan Amendment. On November 10, 2009, the Metropolitan Council found that the request met the Administrative Review Guidelines adopted by the Council on May 11, 2005. Therefore, further action on this review was waived and the City was granted permission to place the amendment into effect. Greg Fletcher: Thank you very much. Mayor Furlong: We have a Certificate of Recognition as well so thank you very much. At this time I'd like to invite members of the St. Hubert's Church and School. I think we have one of the teachers, Layne Bensiek here and some students as well. Project Reduce, Reuse and Recycle programs in the church and school was the winner of this year's award. This year St. Hubert's Church and School decided to do things a little bit differently. Instead of going with the status quo they made some environmental changes throughout their building. Some of the changes were small but some big but they all added up to a significant difference in the church and the school's environmental impact. They discontinued using styrofoam cups and now use donated coffee mugs. In the classrooms paper towels are no longer used but instead rags and natural cleaners are used instead. In hallways and other rooms there's a greater quantity of recycling bins to ensure access for everyone. They switched from, all from lighting to environmentally friendly products and use only green cleaning solutions in their buildings. With the success and accomplishments this year the school plans on forming a student green team, which I think we're seeing the initial membership right here. Excellent. This year and into next year as well as looking at other options such as composting organic waste in their cafeteria_ So to the St. Hubert's Church and School and the green team, thank you and congratulations.
