1. Permit Subject to the terms and conditions set forth herein, the City of Chanhassen hereby
grants an amended and restated conditional use permit for the following use which replaces
Conditional Use Permit #2001-2 dated August 13, 2001, and recorded January 21, 2003 as
Torrens Document No. T133213:
DayCo Concrete Company, Inc. to develop within the Bluff Creek Overlay District with a 15-
foot variance from the 40-foot building setback requiremcnt.orthe Bluff Creek Overlay
District and for development within the Bluff Creek Overlay District primary zone and to
operate a contractor's yard.
2. Property. The permit is for the following described property ("subject property") in the City of
Chanhassen, Carver County, Minnesota:
Lot 2, Block 1, Chanhassen Business Center 3rd Addition
3. Conditions. The permit is issued subject to the following conditions:
a. The developer shall enter into a site plan agreement for the property.
b. Outdoor storage is prohibited unless it has been approved under site plan review.
1) No unlicensed or inoperable vehicleJequipment shall be stored on the premises.
2) Outdoor storage is limited to construction equipment outlined in Planning Case
#2015-11.
3) The applicant shall work with city staff to complete full screening of the outdoor
storage space through landscaping.
4) Materials shall be free of concrete.
5) No cleaning or maintenance of equipment can occur in this area.
c. The boundaries of the Bluff Creek Overlay District primary and secondary corridors shall
be shown on the grading plan.
d. The retaining wall must be located outside the Bluff Creek Overlay district primary zone.
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit.
5. Lam. If within one year of the issuance of this permit the authorized construction has not
been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penalty. violation of the tams of this conditional use permit is a criminal
misdemeanor.

2. Property. The permit is for the following described property ("subject property") in the City of
Chanhassen, Carver County, Minnesota:

3. Conditions. The permit is issued subject to the following conditions:
a. The developer shall enter into a site plan agreement for the property.
b. Outdoor storage is prohibited unless it has been approved under site plan review.
1) No unlicensed or inoperable vehicle/equipment shall be stored on the premises.
2) Outdoor storage is limited to construction equipment outlined in Planning Case
#2015-11.
3) The applicant shall work with city staff to complete full screening of the outdoor
storage space through landscaping.
4) Materials shall be free of concrete.
5) No cleaning or maintenance of equipment can occur in this area.
c. The boundaries of the Bluff Creek Overlay District primary and secondary corridors shall
be shown on the grading plan.
d. The retaining wall must be located outside the Bluff Creek Overlay district primary zone.
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit.
5. Lapse. If within one year of the issuance of this permit the authorized construction has not
been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penaltv. Violation of the terms of this conditional use permit is a criminal
misdemeanor.

Per our conversation on your property on June 29, 2015, the City will not require that you
complete landscape screening on your property for your outdoor storage provided that the
storage is limited to areas out of the public view. This will restrict the outdoor storage from
being located in the eastern portion of the approved area. In the future, landscape screening
will be required if outdoor storage is moved to an area that is in view of the public. In
addition, outdoor storage must still comply with Planning conditions 1-3 and Water
Resources Coordinator conditions 1-2 (see below).

PUBLIC ANNOUNCEMENTS:
Mayor Laufenburger: We do have a public announcement this evening. Can you hear me alright
Nann? Okay. I believe at the last council meeting we accepted a large check from KleinBank
for their support of our community summer concert series so I want to extend an invitation to
everyone to the 2015 KleinBank Summer Concert Series presented by the City of Chanhassen.
Join us on Thursdays beginning June 18'h through August 13'b at City Center Park Plaza. All
concerts are free for everyone to enjoy and they feature music from a variety of genres. Most
concerts begin at about 7:00 p.m., weather permitting of course. However there is one children's
show that begins at 11:00 a.m. so pack a picnic. Invite your family and friends out for some
great outdoor music and this event is sponsored by KleinBank of Chanhassen and presented by
the City of Chanhassen so I encourage all residents and people from surrounding communities to
come out and enjoy some music in the out of doors.

PROPOSED MOTION
"The City Council approves amended Site Plan #1991-04 to designate an
outdoor storage area, and approves the amended and restated Conditional Use
Permit #2001-02 to allow screened outdoor storage with conditions on property
located at 1850 Lake Drive West, and adopts the attached Findings of Fact and
Recommendation."
EXECUTIVE SUMMARY
The applicant is requesting an amendment of Site Plan #1991-04 and Conditional Use
Permit #2001-05 to utilize an existing loading dock, located in the rear of the
property, for storage. The outdoor storage is being requested due to an increase in the
volume of product used by the business. The intent is to screen the storage through
existing buildings, landscaping and additional landscaping as necessary.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on May 19, 2015 to review the
proposed amendments. Review of the proposal found that allowing outdoor storage on
the site is consistent with the Chanhassen Business Center Site Plan and outdoor storage
is a continuation of an approved use of the property (contractor's yard). The Planning
Commission did not find any issues with allowing outdoor storage on the site with the
proposed conditions. All voted in favor and the motion carried unanimously with a vote
of 6 to 0. The Planning Commission minutes of May 19, 2015 are included in consent
agenda item for June 8, 2015 City Council agenda.
RECOMMENDATION
Staff and the Planning Commission recommend City Council approve the Conditional
Use Permit and Site Plan amendments to allow screened outdoor storage for LDW
Properties, located on Lot 2, Block 1, Chanhassen Business Center, as shown on the
plans received April 17, 2015, subject to the following conditions:

Conditional Use Permits — The City has limited discretion in approving or denying conditional
use permits, based on whether or not the proposal meets the conditional use permit standards
outlined in the Zoning Ordinance. If the City finds that all the applicable conditional use permit

On February 8, 1993, the City of Chanhassen adopted development standards for the Chanhassen
Business Center (PUD 914). These development standards approved light industrial, warehousing
and office uses within the Chanhassen Business Center PUD (see attachment 5). Section (f.) Site
Landscaping and Screen, subpart (3) of the development standards states, "storage of material
outdoors is prohibited unless it has been approved under site plan review. All approved outdoor
storage must be screened with masonry fences and/or landscaping."
On September 5, 2001, the Chanhassen City Council approved a 15-foot variance from the 40-foot
building setback requirement of the Bluff Creek Overlay district and the operation of a contractor's
yard within the Bluff Creek Overlay district primary zone, with conditions, on Lot 2, Block 1,
Chanhassen Business Center 3' Addition. Condition (b) of the CUP states that, "no outdoor storage
of material or equipment shall be permitted" (see attachment 6).
At the time of the development, May 2002, the applicant did not include outdoor storage as a part of
their Site Plan Review #2001-05 submittal.
PROPOSAL/SUMMARY
The applicant is requesting an amendment to their conditional use permit and the site plan to
allow screened outdoor storage in an existing rear loading dock area. The property is located at
the end of Lake Drive West on the north side of the cul-de-sac. The site is zoned Planned Unit
Development (PUD) and has an area of 6.3 acres. The screened outdoor storage is permitted
within the PUD as long as it has been approved under site plan review.

The applicant is requesting to use an existing loading dock area for the purpose of outdoor
storage of construction materials. None of the proposed materials to be stored in this area are
erodible or hazardous materials (see attachment 3), as long as the equipment stored in this area
are clean. None of the storage materials should be cleaned or maintained in this area to ensure
that drainage and water quality are not negatively affected by the area. The site has been
developed to accommodate stormwater and the storage of the proposed equipment should not
negatively affect drainage.

LANDSCAPING
City ordinance requires that outdoor storage areas be screened from all public views. The
majority of the proposed outdoor storage space is currently screened by either buildings,
elevation changes or landscaping. However, as seen in the image above, there is a viewing area
from Lake Drive West that is only partially screened by landscaping (trees). This area will need
additional landscaping materials (shrubs, trees, etc.) to fully screen the outdoor storage space.
RECOMMENDATION
Staff recommends that the Planning Commission recommend City Council approve the
Conditional Use Permit and Site Plan amendments to allow screened outdoor storage for LDW
Properties, to be located on Lot 2, Block 1, Chanhassen Business Center, as shown on the plans
dated received April 17, 2015, subject to the following conditions:

1. The Conditional Use Permit shall be restated to "outdoor storage is prohibited unless it has
been approved under site plan review."
2. No unlicensed or inoperable vehicle/equipment shall be stored on the premises.
3. Outdoor storage is limited to the construction equipment outlined in this report.
4. The applicant shall work with city staff to complete full screening of the outdoor storage
space through landscaping.

FINDINGS OF FACT
AND RECOMMENDATION
Application of LDW Properties to revise a Conditional Use Permit and to amend a Site Plan
Permit to allow screened outdoor storage in the Planned Unit Development District.
On May 19, 2015, the Chanhassen Planning Commission met at its regularly scheduled meeting
to consider the application of LDW Properties to revise a Conditional Use Permit and to amend
a Site Plan Permit to allow screened outdoor storage in the Planned Unit Development District.
The Planning Commission conducted a public hearing on the proposed revision and amendment
preceded by published and mailed notice. The Planning Commission heard testimony from all
interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Planned Unit Development, PUD.
2. The property is guided in the Land Use Plan for Office Industrial.
3. The legal description of the property is Lot 2, Block 1, Chanhassen Business Center.
4. Conditional Use Permit. General Issuance Standards
a. Permitting screened outdoor storage will not be detrimental to or endanger the public
health, safety, comfort, convenience or general welfare of the neighborhood or city.
The site is zoned PUD, with an underlying zoning of IOP. The proposed use will not
create any significant or unexpected impacts from this operation.
b. Permitting screened outdoor storage is consistent with the objectives of the city s
comprehensive plan and this chapter.
The proposed use is consistent with the City's Comprehensive Plan. The City approved a
site plan Permit with a conditional use permit for the site with a 15-foot variance from the
40-foot building setback requirement of the Bluff Creek Overlay district, and for
development within the Bluff Creek Overlay district primary zone to operate a
contractor's yard. The site has met all of the conditions of approval and now seeks to
utilize a loading dock space for outdoor storage. Outdoor storage is an allowed
conditional use for a contractor's yards in the IOP District, the underlying district and is
allowed within the PUD, if the storage is approved in the site plan.
c. Screened outdoor storage will be designed, constructed, operated and maintained so to be
compatible in appearance with the existing or intended character of the general vicinity
and will not change the essential character of that area.
The site is located a PUD that has an underlying IOP District designation. As a condition
of approval, the applicant will be required to work with staff to complete additional
screening of the site to ensure it keeps with the essential character of the area.
d. Screened outdoor storage will not be hazardous or disturbing to existing or planned
neighboring uses.
Storage equipment will be screened from public view. There will be no measurable
impacts to the existing or planned neighboring uses.
e. Screened outdoor storage will be served adequately by essential public facilities and
services, including streets, police and fire protection, drainage structures, refuse disposal,
water and sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use.
Full city services are available to this site. Roads serving the site are fully capable of
handling the access needs of this proposal.
f. Screened outdoor storage will not create excessive requirements for public facilities and
services and will not be detrimental to the economic welfare of the community.
Staff is not aware of any excessive requirements for public facilities. The contracting
business is a good auxiliary use within the development.
g. Screened outdoor storage will not involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any persons, property or
the general welfare because of excessive production of traffic, noise, smoke, fumes,
glare, odors, rodents, or trash.
This site will not create adverse impacts to persons, property or the general welfare of the
area. The screened outdoor storage will comply with city ordinances.
h. Screened outdoor storage will have vehicular approaches to the property which do not
create traffic congestion or interfere with traffic or surrounding public thoroughfares.
The site is accessible from a city street designed to commercial standards.
i. Screened outdoor storage will not result in the destruction, loss or damage of solar access,
natural, scenic or historic features of major significance.
The development of this site will not result in the loss of any features of major
significance.

j. Screened outdoor storage will be aesthetically compatible with the area.
The site contains an existing loading dock, which is partially screened by buildings,
landscaping and elevation changes. The proposed outdoor storage space will be fully
screened by adding additional landscape screening.
k. Screened outdoor storage will not depreciate surrounding property values.
The site is being used for a screened outdoor storage operation, which is consistent with
its designation. It will not depreciate surrounding property values.
Screened outdoor storage will meet standards prescribed for certain uses as provided in
this article.
Sec. 20-308. Screened outdoor storage states:
The following applies to screened outdoor storage:
(1) All outdoor storage must be completely screened with 100 percent opaque
fence or landscaped screen.
The applicant intends to store construction materials within a screened loading dock area.
Screening will be achieved via buildings, elevation changes, and landscaping.
5. Site Plan Review. In evaluating a site plan and building plan, the city shall consider the
development's compliance with the following:
a. Screened outdoor storage is consistent with the elements and objectives of the city's
development guides, including the comprehensive plan, official road mapping, and other
plans that may be adopted. The proposed use is consistent with the City's Comprehensive
Plan and all other plans. The City approved a site plan permit with a conditional use
permit for the site with a 15-foot variance from the 40-foot building setback requirement
of the Bluff Creek Overlay district and for development within the Bluff Creek Overlay
district primary zone to operate a contractor's yard. The site has met all of the conditions
of approval and now seeks to utilize a loading dock space for outdoor storage. Outdoor
storage is an allowed conditional use for a contractor's yards in the IOP District, the
underlying district and is allowed within the PUD, as the use is approved in the site plan.
b. Screened outdoor storage is consistent with this division 6. The screened outdoor storage
meets the requirements specified under site plan review.
c. Adding screened outdoor storage will preserve the site in its natural state to the extent
practicable by minimizing tree and soil removal and designing grade changes to be in
keeping with the general appearance of the neighboring developed or developing areas.
There will be no tree or soil removal or grade changes with the addition of the screen
outdoor storage area.
d. Screened outdoor storage will keep a harmonious relationship between the building and
open space with natural site features and with existing and future buildings having a
visual relationship to the development. Landscape screening will enhance the natural site
features and will be consistent with the existing relationship between buildings and open
space on the site.
e. The addition of screened outdoor storage will maintain a functional and harmonious
design for structures and site features, with special attention to the following:
1) An internal sense of order for the buildings and use on the site and provision of a
desirable environment for occupants, visitors and general community. The
outdoor storage will be screened from public view and will not be seen by
occupants, visitors or the general community in the area.
2) The amount and location of open space and landscaping. Open space will not be
reduced by the addition of screened outdoor storage. Landscaping will be
increased to screen the outdoor storage.
3) Materials, textures, colors and details of construction as an expression of the
design concept and the compatibility of the same with adjacent and neighboring
structures and uses. The outdoor storage will be completely screened by
landscaping, keeping with the design concept and compatibility with adjacent and
neighboring structures and uses.
4) Vehicular and pedestrian circulation, including walkways, interior drives and
parking in terms of location and number of access points to the public streets,
width of interior drives and access points, general interior circulation, separation
of pedestrian and vehicular traffic and arrangement and amount of parking. The
outdoor storage will be located in the rear loading dock area and will not have any
influence on vehicular or pedestrian circulation.
f. Adding screened outdoor storage will not affect adjacent and neighboring properties
through reasonable provision for surface water drainage, sound and sight buffers,
preservation of views, light and air and those aspects of design not adequately covered by
other regulations which may have substantial effects on neighboring land uses. The
outdoor storage will be completely screened from public view and the construction
equipment permitted as a part of the approval process will not be erodible, thus
mitigating potential negative externalities.
g. Within the HC districts, screened outdoor storage is consistent with the purpose, intent
and standards of the HC districts. The subject property is not within the HC district.
h. Within the BCO district, screened outdoor storage is consistent with the purpose, intent
and standards of the BCO district. Screened outdoor storage will keep with the purpose,
and intent and standards of the BCO district.
Based upon the foregoing findings, staff is recommending that the conditional use permit be
restated and the site plan permit be amended to allow screened outdoor storage with appropriate
conditions.

6. The planning report #2015-11 dated May 19, 2015, prepared by Drew Ingvalson, et al, is
incorporated herein.
The Planning Commission recommends that the City Council revise Conditional Use
Permit #2001-02 and amend Site Plan Permit #2001-05 to allow screened outdoor storage in the
Planned Unit Development District.

a. Intent

The purpose of this zone is to create a PUD light industrial/office park. The use of the PUD zone
is to allow for more flexible design standards while creating a higher quality and more sensitive
proposal. All utilities are required to be placed underground. Each lot proposed for development
shall proceed through site plan review based on the development standards outlined below.
Except as specifically provided herein, the subject property is subject to the requirements of the
IOP, Industrial Office Park District, zoning district, and the City Code supplemental and off
street parking requirements as may be amended. (8/10/09)
b. Permitted Uses
The permitted uses in this zone should be limited to light industrial, warehousing, and office as
defined below. The uses shall be limited to those as defined herein. If there is a question as to the
whether or not a use meets the definition, the City Council shall make that interpretation.
Light Industrial. The manufacturing, compounding, processing, assembling, packaging, or
testing of goods or equipment or research activities entirely within an enclosed structure, with
no outside storage. There shall be negligible impact upon the surrounding environment by
noise, vibration, smoke, dust or pollutants.
2. Warehousing. Means the commercial storage of merchandise and personal property.
3. Office. Professional and business office, non -retail activity.
c. Setbacks
In the PUD standards, there is the requirement for landscape buffering in addition to building and
parking setbacks. The landscape buffer on Audubon Road is 50 feet, south of Lake Drive and
100 feet along the southern property line. The PUD zone requires a building to be setback 50
feet from the required landscape buffer and public right-of-ways. There is no minimum
requirement for setbacks on interior lot lines.

e. Building Materials and Design
1. The PUD requires that the development demonstrate a higher quality of architectural
standards and site design. All mechanical equipment shall be screened with material
compatible to the building.
2. All materials shall be of high quality and durable. Masonry material shall be used. Color shall
be introduced through colored block or panels and not painted block.
3. Brick may be used and must be approved to assure uniformity.
4. Block shall have a weathered face or be polished, fluted, or broken face.
5. Concrete may be poured in place, tilt -up or pre -cast, and shall be finished in stone, textured or
coated.
6. Metal siding will not be approved except as support material to one of the above materials or
curtain wall on office components or, as trim or as HVAC screen.
7. All accessory structures shall be designed to be compatible with the primary structure.
8. All roof mounted equipment shall be screened by walls of compatible appearing material.
Wood screen fences are prohibited. All exterior process machinery, tanks, etc., are to be fully
screened by compatible materials.
9. The use of large unadorned, prestressed concrete panels and concrete block shall be
prohibited. Acceptable materials will incorporate textured surfaces, exposed aggregate
and/or other patterning. All walls shall be given added architectural interest through building
design or appropriate landscaping.
10. Space for recycling shall be provided in the interior of all principal structures for all
developments in the Business Center.

E Site Landscaping and Screening
All buffer landscaping, including boulevard landscaping, included in Phase I area to be
installed when the grading of the phase is completed. This may well result in landscaping
being required ahead of individual site plan approvals but we believe the buffer yard and
plantings, in particular, need to be established immediately. In addition, to adhere to the
higher quality of development as spelled out in the PUD zone, all loading areas shall be
screened. Each lot for development shall submit a separate landscaping plan as a part of the
site plan review process.
2. All open spaces and non -parking lot surfaces shall be landscaped, rockscaped, or covered
with plantings and/or lawn material.
3. Storage of material outdoors is prohibited unless it has been approved under site plan review.
All approved outdoor storage must be screened with masonry fences and/or landscaping.
3. The master landscape plan for the CBC PUD shall be the design guide for all of the specific
site landscape developments. Each lot must present a landscape plan for approval with the
site plan review process.
4. Undulating or angular berms 3' to 4' in height, south of Lake Drive along Audubon Road shall
be sodded or seeded at the conclusion of Phase I grading and utility construction. The required
buffer landscaping may be installed incrementally, but it shall be required where it is deemed
necessary to screen any proposed development. All required boulevard landscaping shall be
sodded.
5. Loading areas shall be screened from public right-of-ways. Wing wall may be required where
deemed appropriate.
g. Signage
All freestanding signs be limited to monument signs. The sign shall not exceed eighty (80)
square feet in sign display area nor be greater than eight (8) feet in height. The sign treatment
is an element of the architecture and thus should reflect with the quality of the development.
The signs should be consistent in color, size, and material throughout the development. The
applicant should submit a sign package for staff review.
2. Each property shall be allowed one monument sign located near the driveway into the private
site. All signs require a separate permit.
3. The signage will have consistency throughout the development. A common theme will be
introduced at the development's entrance monument and will be used throughout.
4. Consistency in signage shall relate to color, size, materials, and heights.
h. Lighting
1. Lighting for the interior of the business center should be consistent throughout the
development. The applicant's proposal is consistent with the lighting standards for the PUD
ordinance. The plans do not provide for street lighting. As with previous industrial
parks/roadways, the City has required the developer to install street lights throughout the
street system. The street lights should be designed consistent with the existing lighting along
Audubon Road.
2. A decorative, shoe box fixture (as specified by City Code)with a square ornamental pole shall
be used throughout the development area for area lighting.
3. Lighting equipment similar to what is mounted in the public street right-of-ways shall be
used in the private areas.
4. All light fixtures shall be shielded. Light level for site lighting shall be no more than 1 /2
candle at the property line. This does not apply to street lighting.

1. Pnrmit- Subject to the terms and conditions set forth herein, the City of
Chanhassen hereby grants a conditional use permit for the following use:
DayCo Concrete Company, Inc. to develop within the Bluff Creek Overlay District with a 15 foot
variance from the 40 foot building setback requirement of the Bluff Creek Overlay district and for
development within the Bluff Creek Overlay district primary zone and to operate a contractor's
yard.
2. Pratperty- The permit is for the following described property ("subject property") in

3. Conditions_ The permit is issued subject to the following conditions:

has not been substantially completed or the use commenced, this permit shall lapse, unless an

SITE PLAN PERMIT 2001-5
SPECIAL PROVISIONS
AGREEMENT dated May 24, 2002, by and between the CITY OF CHANHASSEN, a
Minnesota municipal corporation, (the "City"), and DayCo Concrete Company, Inc. (the
"Developer").
1. Request for Site Plan Approval. The Developer has asked the City to approve a
site plan for a 25,139 sq. ft. office/warehouse building (Phase 1) of a corporate headquarters site
(referred to in this Permit as the "project"). The land is legally described as Lot 2, Block 1,
Chanhassen Business Center P Addition.
2. Conditions of Site Plan Approval. The City hereby approves the site plan on
condition that the Developer enters into this Permit and furnishes the security required by it.
3. Development Plans. The project shall be developed and maintained in accordance
with the following plans. The plans shall not be attached to this Contract. If the plans vary from
the written terms of this Permit, the written terms shall control. The plans are:
Plan A —Site Plan dated April 12, 2002, prepared by Lampert Architects
Plan B—Grading, Drainage, and Utility Plan dated April 29, 2002, by prepared Weststwood

Plan C—Landscaping Plan dated April 29, 2002, prepared by All Seasons Landscape
4. Time of Performance. The Developer shall install all required screening and
landscaping by December 1, 2002. The Developer may, however, request an extension of time
from the City. If an extension is granted, it shall be conditioned upon updating the security posted
by the Developer to reflect cost increases and the extended completion date.
5. Security. To guarantee compliance with the terms of this Permit, the Developer
shall furnish the City with a letter of credit from a bank, or cash escrow, in the amount of
$5,000.00 ($2,500 - boulevard restoration and driveway aprons and $2,500 - erosion control). If
the Developer requests a Certificate of Occupancy prior to the installation of site landscaping, then
the Developer shall provide to the city a letter of credit or cash escrow in an amount sufficient to
ensure the installation of said landscaping.
6. Notices. Required notices to the Developer shall be in writing, and shall be either
hand delivered to the Developer, its employees or agents, or mailed to the Developer by registered

7. Other Special Conditions. Approved Site Plan # 2001-5 as shown on the plans
dated May 2, 2001 and subject to the following conditions:
a. A separate sign permit application is required for the installation of signage. Wall
signage is permitted on only one elevation.
b. The retaining wall shall be located outside the Bluff Creek Overlay District Primary
Zone.
c. A minimum 25 foot building setback shall be maintained from the Bluff Creek
Overlay District Primary Zone.
d. The applicant shall increase understory plantings along the north property line by
4 trees for a total of 20 and increase the number of understory plantings along the
west property line by 1 tree for a total of 13 trees.
e. A revised landscape plan that meets minimum requirements be submitted to the
city prior to building permit approval. The applicant shall work with staff to
increase plantings along the south property line. Transferring from the east and
north is acceptable.
f. If these landscape peninsulas are less than 10 feet in width, then aeration tubing
shall be installed.
g. All new landscaped areas shall have an irrigation system installed.
h. The developer shall work with staff to provide additional articulation to the north
half of the eastern building elevation. Tall arborvitae or evergreen landscaping is
an acceptable solution.
i. The applicant shall provide storm water calculations to demonstrate that the
existing pond has adequate capacity to accommodate storm water from this site.
j. The developer shall revise the storm sewer design to tie into the existing storm
manhole and pond inlet of the existing 48-inch storm sewer that runs along the
eastern property line in order to minimize the number of pipes draining into the
storm water pond.
k. Park fees in the amount of $18,926.00 shall be paid at the time of building permit
approval.
1. The applicant shall report to the City Engineer the location of any drain tiles found
during construction and shall relocate or abandon the drain tile as directed by the
City Engineer.
m. The applicant shall provide detailed storm sewer sizing calculations for a 10-year,
24-hour storm event prior to building permit approval.
n. Silt fence adjacent to the existing pond and wetland on the north and west sides of
the site must be Type 3 heavy-duty.
o. Specify what kind of material is being used at the north and south parts of the
proposed building.
p. On the grading plan, add City Detail Plate Nos. 5215 and 5302. Also, show the
benchmark used for the site survey.
q. Revise the rock construction entrance to be 75 feet in length as per City detail
plate #5301.
r. Add a 6-foot wide sidewalk along the west side of the drive entrance from the cul-
de-sac. Bituminous is acceptable until phase II is completed. The applicant shall
escrow funds to install a 6 foot sidewalk along the west side of the driveway
entrance from the cul-de-sac to be built within two years.
s. Show the most current version of City Detail Plate Nos. 1004 and 5207 on the
utility plan.
t. Remove the northerly 35 feet of the proposed retaining wall from the public
drainage and utility easement.
u. Add straw bale inlet filters around the two existing catch basins in Lake Drive
West.
v. Utilize the existing 8-inch sanitary stub on the south side of the site.
w. Temporary bituminous curb is acceptable for two years. The applicant shall
escrow funds to install curb and gutter around the entire parking and drive area for
the site within two years from the building permit approval.
x. Replace the casting on the westem-most catch basin in Lake Drive West with a
drive -over type grate.
y. Revise the plans to show the following:
a. The existing pond along with the NWL and HWL.
b. Existing street light locations in Lake Drive West.
z. The building is required to have an automatic fire extinguishing system.
aa. The building plans must be prepared and signed by design professionals licensed
in the State of Minnesota.
bb. Three (3) accessible parking spaces are required for the 62 spaces provided.
cc. Detailed occupancy retailed requirements will not be reviewed until complete
plans are submitted.
dd. Utility Plan: The HDPE pipe specified for the storm sewer requires an air test and
must have watertight fittings. The sanitary sewer service into the building must
be schedule 40 pipe.
ee. The owner and or their representative shall meet with the Inspections Division as
soon as possible to discuss plan review and permit procedures.
ff. The 6-inch water service coming into the building will need a post indicator valve.
1999 NFPA 13 Section 5-14.1.1.8.
gg. In accordance with city policy please ensure that there is a 10-foot clear space
around all fire hydrants, Siamese connection, post indicator valves, etc. on site.
8. General Conditions. The general conditions of this Permit are attached as Exhibit
"A" and incorporated herein.

SITE PLAN PERMIT
Right to Proceed. Within the site plan area, the Developer may not grade or otherwise
disturb the earth, remove trees, construct improvements, or any buildings until all the following
conditions have been satisfied: 1) this agreement has been fully executed by both parties and filed
with the City Clerk, 2) the necessary security and fees have been received by the City, and 3) the
City has issued a building permit.
2. Maintenance of site. The site shall be maintained in accordance with the approved site
plan. Plants and ground cover required as a condition of site plan approval which die shall be
promptly replaced.
3. License. The Developer hereby grants the City, its agents, employees, officers and
contractors a license to enter the plat to perform all work and inspections deemed appropriate by the
City in conjunction with site plan development.
4. Erosion Control. Before the site is rough graded, and before any building permits are
issued, the erosion control plan, Plan B, shall be implemented, inspected, and approved by the City.
The City may impose additional erosion control requirements if they would be beneficial. All areas
disturbed by the excavation and backfilling operations shall be reseeded forthwith after the
completion of the work in that area. Except as otherwise provided in the erosion control plan, seed

shall be certified seed to provide a temporary ground cover as rapidly as possible. All seeded areas
shall be fertilized, mulched, and disc anchored as necessary for seed retention. The parties
recognize that time is of the essence in controlling erosion. If the Developer does not comply with
the erosion control plan and schedule or supplementary instructions received from the City, the City
may take such action as it deems appropriate to control erosion at the Developer's expense. The
City will endeavor to notify the Developer in advance of any proposed action, but failure of the City
to do so will not affect the Developer's and City's rights or obligations hereunder. No development
will he allowed and no building permits will be issued unless there is full compliance with the
erosion control requirements. Erosion control shall be maintained until vegetative cover has been
restored. After the site has been stabilized to where, in the opinion of the City, there is no longer a
need for erosion control, the City will authorize removal of the erosion control measures.
5. Clean up. The Developer shall maintain a neat and orderly work site and shall daily clean,
on and off site, dirt and debris, including materials that have blown, from streets and the
surrounding area that has resulted from construction work by the Developer, its agents or assigns.
6. Warranty. All trees, grass, and sod required in the approved Landscaping Plan, Plan C,
shall be warranted to be alive, of good quality, and disease free at the time of planting. All trees
shall be warranted for twelve (12) months from the time of planting. The Developer or his
contractor(s) shall post a letter of credit from a bank or cash escrow with the City to secure the
warranties at the time of final acceptance.
7. Responsibility for Costs.
A. The Developer shall hold the City and its officers and employees harmless from
claims made by itself and third parties for damages sustained or costs incurred
resulting from site plan approval and development. The Developer shall indemnify

the City and its officers and employees for all costs, damages, or expenses which the
City may pay or incur in consequence of such claims, including attorneys' fees.
B. The Developer shall reimburse the City for costs incurred in the enforcement of this
Permit, itt\luding engineering and attomeys' fees.
C. The Develop rshall pay in full all bills submitted to it by the City for obligations
incurred under this Permit within thirty (30) days after receipt. If the bills are not
paid on time, the City may halt all plat development work and construction. Bills
not paid within thirty (30) days shall accrue interest at the rate of 8% per year.
8. Developer's Default. In the event of default by the Developer as to any of the work to be
performed by it hereunder, the City may, at its option, perform the work and the Developer shall
promptly reimburse the City for any expense incurred by the City, provided the Developer is first
given notice of the work in default, not less than four (4) days in advance. This Contract is a license
for the City to act, and it shall not be necessary for the City to seek a Court order for permission to
enter the land. When the City does any such work, the City may, in addition to its other remedies,
assess the cost in whole or in part.
Miscellaneous.
A. t onstmrminn Trailers. Placement of on -site construction trailers and temporary job
site offices shall be approved by the City Engineer. Trailers shall be removed from
the subject property within thirty (30) days following the issuance of a certificate of
occupancy unless otherwise approved by the City Engineer.
B. Postal Service. The Developer shall provide for the maintenance of postal service in
accordance with the local Postmasters request.
C. Third Parries. Third parties shall have no recourse against the City under this Permit.

D. Breach of Contract. Breach of the terms of this Permit by the Developer shall be
grounds for denial of building permits.
E. Sev rahilirv. If any portion, section, subsection, sentence, clause, paragraph, or
phrase of this Permit is for any reason held invalid, such decision shall not affect the
validity of the remaining portion of this Contract.
F. Orrupanny. Unless approved in writing by the City Engineer, no one may occupy a
building for which a building permit is issued on either a temporary or permanent
basis until the streets needed for access have been paved with a bituminous surface
and the utilities tested and approved by the city.
G. Waivers/Amendments. The action or inaction of the City shall not constitute a
waiver or amendment to the provisions of this Contract. To be binding, amendments
or waivers shall be in writing, signed by the parties and approved by written
resolution of the City Council. The City's failure to promptly take legal action to
enforce this Contract shall not be a waiver or release.
H. Recording, This Permit shall run with the land and may be recorded against the title
to the property.
1. Remedies. Each right, power or remedy herein conferred upon the City is
cumulative and in addition to every other right, power or remedy, express or
implied, now or hereafter arising, available to City, at law or in equity, or under any
other agreement, and each and every right, power and remedy herein set forth or
otherwise so existing may be exercised from time to time as often and in such order
as may be deemed expedient by the City and shall not be a waiver of the right to
exercise at any time thereafter any other right, power or remedy.

J. Conctmction i-iours. The normal construction hours and maintenance of equipment
under this contract shall be from 7:00 a.m. to 6:00 p.m. on weekdays, from 9:00
a.m. to 5:00 p.m. on Saturdays, with no such activity allowed on Sundays or any
recognized legal holidays. Operation of all internal combustion engines used for
construction or dewatering purposes beyond the normal working hours will require
City Council approval.
K. Soil Treatment Systems. (Not applicable.) If soil treatment systems are required, the
Developer shall clearly identify in the field and protect from alteration, unless
suitable alternative sites are first provided, the two soil treatment sites identified
during the site plan process for each lot. This shall be done prior to the issuance of a
Grading Permit. Any violation/disturbance of these sites shall render them as
unacceptable and replacement sites will need to be located for each violated site in
order to obtain a building permit.
L. Compliance with Law- Ordinances. and Regulations. In the development of the site
plan the Developer shall comply with all laws, ordinances, and regulations of the
following authorities:
1. City of Chanhassen;
2. State of Minnesota, its agencies, departments and commissions;
3. United States Army Corps of Engineers;
4. Watershed District;
5. Metropolitan Government, its agencies, departments and commissions.
M. Prnnf of Title. Upon request, the Developer shall furnish the City with evidence
satisfactory to the City that it has the authority of the fee owners and contract for

deed purchasers too enter into this Development Contract.
N. Soil Conditions. The Developer acknowledges that the City makes no
representations or warranties as to the condition of the soils on the property or its
fitness for construction of the improvements or any other purpose for which the
Developer may make use of such property. The Developer further agrees that it will
indemnify, defend, and hold harmless the City, its governing body members,
officers, and employees from any claims or actions arising out of the presence, if
any, of hazardous wastes or pollutants on the property, unless hazardous wastes or
pollutants were caused to be there by the City.
O. Soil Cotmction. The Developer shall be responsible for soil correction work on the
property. The City makes no representation to the Developer concerning the nature
of suitability of soils nor the cost of correcting any unsuitable soil conditions which
may exist.

Amended and Restated June 8, 2015 — Planning Case #2015-11
Permit. Subject to the terms and conditions set forth herein, the City of Chanhassen hereby
grants a conditional use permit for the following use:
DayCo Concrete Company, Inc. to develop within the Bluff Creek Overlay District with a 15-
foot variance from the 40-foot building setback requirement of the Bluff Creek Overlay
District and for development within the Bluff Creek Overlay District primary zone and to
operate a contractor's yard.
2. Property. The permit is for the following described property ("subject property") in the City of
Chanhassen, Carver County, Minnesota:
Lot 2, Block 1, Chanhassen Business Center 3rd Addition
3. Conditions. The permit is issued subject to the following conditions:
a. The developer shall enter into a site plan agreement for the property.
b. Outdoor storage is prohibited unless it has been approved under site plan review.
1) No unlicensed or inoperable vehicle/equipment shall be stored on the premises.
2) Outdoor storage is limited to construction equipment outlined in Planning Case
#2015-11.
3) The applicant shall work with city staff to complete full screening of the outdoor
storage space through landscaping.
4) Materials shall be free of concrete.
5) No cleaning or maintenance of equipment can occur in this area.
c. The boundaries of the Bluff Creek Overlay District primary and secondary corridors shall
be shown on the grading plan.
d. The retaining wall must be located outside the Bluff Creek Overlay district primary zone.
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit.
5. Laase. If within one year of the issuance of this permit the authorized construction has not
been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal
misdemeanor.

13. A soils report shall be submitted to staff indicating soil conditions and permeability.
14. The grading plans must be revised to show the first floor elevations of adjacent lots.
15. Spot elevations must also be shown to illustrate the drainage pattern near the existing home's
driveway.
16. The proposed grades on the site shall be no greater than 3:1.
17. The engineer shall coordinate with MnDOT and incorporate their comments.
18. The radius of the driveway curves must be shown on the plan set.
19. The trail width shall be labeled on the plan set.
20. The plan shall be revised to reconstruct the trail further north to create a better connection.
21. The new addition is subject to sanitary sewer and water hookup charges. These charges are
based on the number of SAC units assigned by the Met Council and are due at the time of
building permit issuance.
22. The developer's engineer must incorporate the latest edition of Chanhassen Standard
Specifications and Detail Plates into the plan set.
Environmental Resource Conditions:
1. Install tree protection fencing around all preserved trees shown on grading plans. The
fencing shall be installed prior to any construction activity and remain until site construction
is completed.
Site plantings shall be increased to meet minimum bufferyard requirements. Plantings shall
be located so as to soften direct views in areas where the proposed building is closest to
property lines.
3. Bufferyard plantings shall be located on the west side of the entryway drive rather than on
the east as proposed.
4. A revised landscape plan shall be submitted to the city showing proposed plantings adjacent
to the entire parking area that limit direct views of the pavement and the vehicles.
All voted in favor and the motion carried unanimously with a vote of 6 to 0.

Generous: Thank you Chairman Aller, Planning Commissioners. As you stated this is basically
a re -do. The reason this came about, the City annually does inspections on all our Conditional
Use Permits to determine compliance with the original conditions of approval. When we went
out to DayCo Concrete this year we found that they were storing some of their excess equipment
outside and so we worked with Mr. Brockpahler to come up with a solution. We looked at the
original CUP and there was a condition in that that there be no outdoor storage. However under
the planned unit development there was a clause that you could have outdoor storage if it was
approved as part of the site plan. At the time I don't know why we didn't do this back in 2001
but he thought that all his equipment would fit inside his building. He's been doing very well
and is very busy and so he has all this excess equipment that he needs to store and so we
recommended that he come back through the process and amend both the site plan to show a
storage area and the CUP to eliminate the prohibition against outdoor storage. And so that's
where we are tonight. This property is located at 1850 Lake Drive West. It's at the end of Lake
Drive, west of Audubon. It's the last property on the north side. Just to the north of this is a
railroad. Twin Cities and Western Raihnad Line which is actually 10 feet higher than this
property so it provides a perfect opportunity to screen the back yard of this site from other
properties to the north. And to the west is the Bluff Creek corridor. It's a dense area of wooded
lands and then it drops down into the Bluff Creek which runs through that little valley down
there. LDW Properties or DayCo Concrete are the applicants in this. They're requesting an
amendment to the Conditional Use Permit and Site Plan to allow screened outdoor storage which
is located, and they're proposing to locate this just to the north of the existing building.
Everything behind there will be screened. And this, I thought I changed this number. No, that
was, that was a history one there. The PUD was originally reviewed in 1991 and it was approved
in 1993. This came through for site plan review in 2001 and was approved at that time.
Additionally there's another building pad on the south side of this building that in the future will
come in for site plan review. The conditional use permit was for development within the Bluff
Creek corridor and as part of that there was prohibition against outdoor storage because it wasn't
shown as part of their original site plan so, there we ran into problems so go to the next one. As I
stated they're looking at the north side of the building so from the cul-de-sac you can only see
the very comer of this area and so it's, under our ordinance you have to screen storage with
either buildings or landscaping and one of the next slides will go into that. We asked that he
provide us with a list of the equipment and materials that he was proposing out there. The only
issue we had is to make sure that he didn't provide any storage of any loose materials like dirt or
that. That's something that he says he's not, he doesn't plan on doing and he agreed to all the
conditions of approval that we recommended so. And Terry is acceptable to this because this
does drain right into the Bluff Creek corridor so. We did go out to the site and try to look at the
view corridors into the back part of the site. This shows basically the cone of where you can
potentially see back there and if we go to the next one, there's actually a picture. We tried to
show you know if you were looking what you would see and there's just a small area and so as a
condition of approval we're recommending that they provide additional landscaping in this spot
and work with the City Forester to come up with an adequate plan to make sure we get
permanent screening in that one location. And the next slide basically shows that little area.
There is some existing landscaping in there already so it would just be enhancing that. With that

staff is recommending approval of the amendment to the Site Plan and revise the Conditional
Use Permit to allow screened outdoor storage and adoption of the Findings of Fact and
Recommendation. With that I'd be happy to answer any questions.
Tietz: Yeah Bob, is there any security fencing proposed to screen, you know to, well security
fencing I guess basically. It's a pretty wide open site back there.
Generous: Yes.
Tietz: And if I had equipment and scaffold things tend to get legs sometimes.
Generous: He hasn't proposed that and that was actually one of the questions our Fire Marshal
had. If they do put up a security fence they would need to have access to it but currently he's not
proposing any fencing. I think he believes that the equipment's too heavy for people to move
and plus he's at the end of this long cul-de-sac that you go through so.
Tietz: Okay, thanks.
Aller: I was going to ask, just as clarification. What we're doing here tonight is in reality living
up to the spirit of the original CUP. This isn't something that is a surprise to the City.
Something where he was operating outside of what normally would have been done or was
thought to have been done originally.
Generous: No, we're not operating outside of it. We knew he would have equipment there. It's
just, it's gotten too big for him to be able to continue to store it all inside so. Now we're just
procedurally we have to.
Aller: So the use hasn't changed. The volume has changed
Generous: Right.
Aanenson: And I just want to add too, because it was the Bluff Creek corridor. This is one of
the first industrial parks that I think I worked on when I came here and one of the concerns was,
you know because there's a corridor the wildlife movement and the quality of water that we, you
know he said that at some time in the future as Bob had mentioned they may expand so that was
kind of our sensitivity in looking at what of materials being stored outside and how that's being
used. Just to make sure that the integrity of the creek is being maintained so we do allow
outdoor storage with screening. We have that in industrial parks pretty common place. And
there's different types of screening so we look at it situationally. Not everybody has to secure
their's with a fence depending on what they have. Sometimes it's most appropriate but in this
circumstance because of the view shed it seemed to make a lot of sense and if he's comfortable
with the security he has there, there's no requirement that it has to be fenced. That's kind of
how, we leave that up to the owner to make that decision but that's a good question.

Tietz: And just one more. Kate, you brought up when you mentioned the runoff or the future
expansion. I noticed that that back area is all curb and guttered. Does that drain to that little
wetland to the, what would it be? The northeast.
Aanenson: Yes.
Tietz: Not to the west so I didn't look at the out flow from that curbed area but at least it's
retained now. It's not just sheet drainage.
Aanenson: Right. Exactly, and I think that's similar to what we looked at at Powers Pointe. The
new building that just opened up on Powers Boulevard. I mean they also abut the creek and so
their drainage, they actually have an underground system that's draining the opposite way to
maintain it underneath the parking lot.
Tietz: Okay, thanks.
Aller: Commissioner Madsen.
Madsen: Does the storage area allow for large pieces of tractor equipment and wooden pallets to
be stored outside? I didn't see them on the list.
Generous: Well it would be because it's part of the other materials that they have there.
Madsen: Okay.
Generous: He doesn't intend to store the, actually store the block material outside because he
likes that inside or it's just in time he gets it and he wants it at the job site rather than at his
facilities.
Madsen: Thank you.
Aller: And in looking at the packet he's agreed to all the conditions?
Generous: Yes. As you can see he didn't, he liked it so well and he was happy that we came to
the solution that he's not here tonight.
Aller: Any additional questions?
Weick: Is there any concern over lost parking spaces? Whether it be just for their own
employees or requirements?
Generous: No because they're over parked on this site and the future expansion is that whole
area. He had proof of parking on here because he doesn't have as many men as our ordinance
requires that he provides parking for.
Weick: Oh, okay.

Aanenson: So if you look at there's a future pad on this spot here and that's kind of what we're
talking about. So if he was to come in and put a building on there, then we'd have to reassess, do
both buildings. Are they whole? Right now Bob indicated they're over parked so they should be
fine. Good question.
Aller: And if he wants to put up another structure it will come before us.
Aanenson: Absolutely.
Generous: Right and at that time we will address any stormwater issues for the southern part of
the site.
Aller: And that will be under the new guidelines?
Generous: Yes.
Aller: Any additional questions? Okay we'll open up the public hearing portion of this item.

Aller: I think the, it's a good solution because it's living up to what we wanted to. The use in
reality hasn't changed. He's comfortable with the security issues and I'm sure would bring that
up if there had been problems and there obviously have been no reports of violations of the
understanding of what the privacy was so I would be in favor of a motion at this time.

Aller: I guess I would just like to remind everybody that I believe we have one more upcoming
Mayor Is In on the 28' so feel free to come down and see Mayor Laufenburger and give him a
piece of your mind on how things are going here in Chanhassen.
ADMINISTRATIVE PRESENTATIONS.
Aanenson: Thank you. On Monday, May 11 s, the City Council did hear the Children's Learning
center. They did table action to clarify the site plan conditions and the PUD so that is on for
consent next Tuesday. That's all I had that was on for that meeting. If I may Chair I'll go onto
our future items.

Aanenson: We do have a meeting on June 2°d. Two weeks from tonight and that will include an
interim use permit for grading on, this is on the Holasek Greenhouse property so there's someone
looking forward, pursuing potential development there. Again that's guided office industrial so
you'll see potentially something on like that. And then we do have a variance request for Lund's
Food Holdings. As you know Byerly's and Lund's have combined so their sign, their new sign

Application of LDW Properties to revise a Conditional Use Permit and to amend a Site Plan
Permit to allow screened outdoor storage in the Planned Unit Development District.
On May 19, 2015, the Chanhassen Planning Commission met at its regularly scheduled meeting
to consider the application of LDW Properties to revise a Conditional Use Permit and to amend
a Site Plan Permit to allow screened outdoor storage in the Planned Unit Development District.
The Planning Commission conducted a public hearing on the proposed revision and amendment
preceded by published and mailed notice. The Planning Commission heard testimony from all
interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Planned Unit Development, PUD.
2. The property is guided in the Land Use Plan for Office Industrial.
3. The legal description of the property is Lot 2, Block 1, Chanhassen Business Center.
4. Conditional Use Permit. General Issuance Standards
a. Permitting screened outdoor storage will not be detrimental to or endanger the public
health, safety, comfort, convenience or general welfare of the neighborhood or city.
The site is zoned PUD, with an underlying zoning of IOP. The proposed use will not
create any significant or unexpected impacts from this operation.
b. Permitting screened outdoor storage is consistent with the objectives of the city's
comprehensive plan and this chapter.
The proposed use is consistent with the City's Comprehensive Plan. The City approved a
site plan Permit with a conditional use permit for the site with a 15-foot variance from the
40-foot building setback requirement of the Bluff Creek Overlay district, and for
development within the Bluff Creek Overlay district primary zone to operate a
contractor's yard. The site has met all of the conditions of approval and now seeks to
utilize a loading dock space for outdoor storage. Outdoor storage is an allowed
conditional use for a contractor's yards in the IOP District, the underlying district and is
allowed within the PUD, if the storage is approved in the site plan.
SCANNED
c. Screened outdoor storage will be designed, constructed, operated and maintained so to be
compatible in appearance with the existing or intended character of the general vicinity
and will not change the essential character of that area.
The site is located a PUD that has an underlying IOP District designation. As a condition
of approval, the applicant will be required to work with staff to complete additional
screening of the site to ensure it keeps with the essential character of the area.
d. Screened outdoor storage will not be hazardous or disturbing to existing or planned
neighboring uses.
Storage equipment will be screened from public view. There will be no measurable
impacts to the existing or planned neighboring uses.
e. Screened outdoor storage will be served adequately by essential public facilities and
services, including streets, police and fire protection, drainage structures, refuse disposal,
water and sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use.
Full city services are available to this site. Roads serving the site are fully capable of
handling the access needs of this proposal.
f. Screened outdoor storage will not create excessive requirements for public facilities and
services and will not be detrimental to the economic welfare of the community.
Staff is not aware of any excessive requirements for public facilities. The contracting
business is a good auxiliary use within the development.
g. Screened outdoor storage will not involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any persons, property or
the general welfare because of excessive production of traffic, noise, smoke, fumes,
glare, odors, rodents, or trash.
This site will not create adverse impacts to persons, property or the general welfare of the
area. The screened outdoor storage will comply with city ordinances.
h. Screened outdoor storage will have vehicular approaches to the property which do not
create traffic congestion or interfere with traffic or surrounding public thoroughfares.
The site is accessible from a city street designed to commercial standards.
i. Screened outdoor storage will not result in the destruction, loss or damage of solar access,
natural, scenic or historic features of major significance.
The development of this site will not result in the loss of any features of major
significance.

j. Screened outdoor storage will be aesthetically compatible with the area.
The site contains an existing loading dock, which is partially screened by buildings,
landscaping and elevation changes. The proposed outdoor storage space will be fully
screened by adding additional landscape screening.
k. Screened outdoor storage will not depreciate surrounding property values.
The site is being used for a screened outdoor storage operation, which is consistent with
its designation. It will not depreciate surrounding property values.
1. Screened outdoor storage will meet standards prescribed for certain uses as provided in
this article.
Sec. 20-308. Screened outdoor storage states:
The following applies to screened outdoor storage:
(1) All outdoor storage must be completely screened with 100 percent opaque
fence or landscaped screen.
The applicant intends to store construction materials within a screened loading dock area.
Screening will be achieved via buildings, elevation changes, and landscaping.
5. Site Plan Review. In evaluating a site plan and building plan, the city shall consider the
development's compliance with the following:
a. Screened outdoor storage is consistent with the elements and objectives of the city's
development guides, including the comprehensive plan, official road mapping, and other
plans that may be adopted. The proposed use is consistent with the City's Comprehensive
Plan and all other plans. The City approved a site plan permit with a conditional use
permit for the site with a 15-foot variance from the 40-foot building setback requirement
of the Bluff Creek Overlay district and for development within the Bluff Creek Overlay
district primary zone to operate a contractor's yard. The site has met all of the conditions
of approval and now seeks to utilize a loading dock space for outdoor storage. Outdoor
storage is an allowed conditional use for a contractor's yards in the IOP District, the
underlying district and is allowed within the PUD, as the use is approved in the site plan.
b. Screened outdoor storage is consistent with this division 6. The screened outdoor storage
meets the requirements specified under site plan review.
c. Adding screened outdoor storage will preserve the site in its natural state to the extent
practicable by minimizing tree and soil removal and designing grade changes to be in
keeping with the general appearance of the neighboring developed or developing areas.
There will be no tree or soil removal or grade changes with the addition of the screen
outdoor storage area.
d. Screened outdoor storage will keep a harmonious relationship between the building and
open space with natural site features and with existing and future buildings having a
visual relationship to the development. Landscape screening will enhance the natural site
features and will be consistent with the existing relationship between buildings and open
space on the site.
e. The addition of screened outdoor storage will maintain a functional and harmonious
design for structures and site features, with special attention to the following:
1) An internal sense of order for the buildings and use on the site and provision of a
desirable environment for occupants, visitors and general community. The
outdoor storage will be screened from public view and will not be seen by
occupants, visitors or the general community in the area.
2) The amount and location of open space and landscaping. Open space will not be
reduced by the addition of screened outdoor storage. Landscaping will be
increased to screen the outdoor storage.
3) Materials, textures, colors and details of construction as an expression of the
design concept and the compatibility of the same with adjacent and neighboring
structures and uses. The outdoor storage will be completely screened by
landscaping, keeping with the design concept and compatibility with adjacent and
neighboring structures and uses.
4) Vehicular and pedestrian circulation, including walkways, interior drives and
parking in terms of location and number of access points to the public streets,
width of interior drives and access points, general interior circulation, separation
of pedestrian and vehicular traffic and arrangement and amount of parking. The
outdoor storage will be located in the rear loading dock area and will not have any
influence on vehicular or pedestrian circulation.
f. Adding screened outdoor storage will not affect adjacent and neighboring properties
through reasonable provision for surface water drainage, sound and sight buffers,
preservation of views, light and air and those aspects of design not adequately covered by
other regulations which may have substantial effects on neighboring land uses. The
outdoor storage will be completely screened from public view and the construction
equipment permitted as a part of the approval process will not be erodible, thus
mitigating potential negative externalities.
g. Within the HC districts, screened outdoor storage is consistent with the purpose, intent
and standards of the HC districts. The subject property is not within the HC district.
h. Within the BCO district, screened outdoor storage is consistent with the purpose, intent
and standards of the BCO district. Screened outdoor storage will keep with the purpose,
and intent and standards of the BCO district.
Based upon the foregoing findings, staff is recommending that the conditional use permit be
restated and the site plan permit be amended to allow screened outdoor storage with appropriate
conditions.

6. The planning report #2015-11 dated May 19, 2015, prepared by Drew Ingvalson, et al, is
incorporated herein.
The Planning Commission recommends that the City Council revise Conditional Use
Permit #2001-02 and amend Site Plan Permit #2001-05 to allow screened outdoor storage in the
Planned Unit Development District.

SITE PLAN PERMIT 2001-5
SPECIAL PROVISIONS
AGREEMENT dated May 24, 2002, by and between the CITY OF CHANHASSEN, a
Minnesota municipal corporation, (the "City"), and DayCo Concrete Company, Inc. (the
"Developer").
1. Request for Site Plan Approval. The Developer has asked the City to approve a
site plan for a 25,139 sq. ft. office/warehouse building (Phase I) of a corporate headquarters site
(referred to in this Permit as the "project"). The land is legally described as Lot 2. Block 1,
Chanhassen Business Center P Addition.
2. Conditions of Site Plan Approval. The City hereby approves the site plan on
condition that the Developer enters into this Permit and furnishes the security required by it.
3. Development Plans. The project shall be developed and maintained in accordance
with the following plans. The plans shall not be attached to this Contract. If the plans vary from
the written terms of this Permit, the written terms shall control. The plans are:
Plan A —Site Plan dated April 12, 2002, prepared by Lampert Architects
Plan B--Grading, Drainage, and Utility Plan dated April 29, 2002, by prepared Weststwood

4. Time of Performance. The Developer shall install all required screening and
landscaping by December 1, 2002. The Developer may, however, request an extension of time
from the City. If an extension is granted, it shall be conditioned upon updating the security posted
by the Developer to reflect cost increases and the extended completion date.
5. Security. To guarantee compliance with the terms of this Permit, the Developer
shall furnish the City with a letter of credit from a bank, or cash escrow, in the amount of
$5,000.00 ($2,500 - boulevard restoration and driveway aprons and $2,500 - erosion control). If
the Developer requests a Certificate of Occupancy prior to the installation of site landscaping, then
the Developer shall provide to the city a letter of credit or cash escrow in an amount sufficient to
ensure the installation of said landscaping.
6. Notices. Required notices to the Developer shall be in writing, and shall be either
hand delivered to the Developer, its employees or agents, or mailed to the Developer by registered

7. Other Special Conditions. Approved Site Plan # 2001-5 as shown on the plans
dated May 2, 2001 and subject to the following conditions:
a. A separate sign permit application is required for the installation of signage. Wall
signage is permitted on only one elevation.
b. The retaining wall shall be located outside the Bluff Creek Overlay District Primary
Zone.
c. A minimum 25 foot building setback shall be maintained from the Bluff Creek
Overlay District Primary Zone.
d. The applicant shall increase understory plantings along the north property line by
4 trees for a total of 20 and increase the number of understory plantings along the
west property line by 1 tree for a total of 13 trees.
e. A revised landscape plan that meets minimum requirements be submitted to the
city prior to building permit approval. The applicant shall work with staff to
increase plantings along the south property line. Transferring from the east and
north is acceptable.
f. If these landscape peninsulas are less than 10 feet in width, then aeration tubing
shall be installed.
g. All new landscaped areas shall have an irrigation system installed.
h. The developer shall work with staff to provide additional articulation to the north
half of the eastern building elevation. Tall arborvitae or evergreen landscaping is
an acceptable solution.
i. The applicant shall provide storm water calculations to demonstrate that the
existing pond has adequate capacity to accommodate storm water from this site.
j. The developer shall revise the storm sewer design to tie into the existing storm
manhole and pond inlet of the existing 48-inch storm sewer that runs along the
eastern property line in order to minimize the number of pipes draining into the
storm water pond.
k. Park fees in the amount of $18,926.00 shall be paid at the time of building permit
approval.
1. The applicant shall report to the City Engineer the location of any drain tiles found
during construction and shall relocate or abandon the drain tile as directed by the
City Engineer.
m. The applicant shall provide detailed storm sewer sizing calculations for a 10-year,
24-hour storm event prior to building permit approval.
n. Silt fence adjacent to the existing pond and wetland on the north and west sides of
the site must be Type 3 heavy-duty.
o. Specify what kind of material is being used at the north and south parts of the
proposed building.
p. On the grading plan, add City Detail Plate Nos. 5215 and 5302. Also, show the
benchmark used for the site survey.
q. Revise the rock construction entrance to be 75 feet in length as per City detail
plate #5301.
r. Add a 6-foot wide sidewalk along the west side of the drive entrance from the cul-
de-sac. Bituminous is acceptable until phase II is completed. The applicant shall
escrow funds to install a 6 foot sidewalk along the west side of the driveway
entrance from the cul-de-sac to be built within two years.
s. Show the most current version of City Detail Plate Nos. 1004 and 5207 on the
utility plan.
t. Remove the northerly 35 feet of the proposed retaining wall from the public
drainage and utility easement.
u. Add straw bale inlet filters around the two existing catch basins in Lake Drive
West.
v. Utilize the existing 8-inch sanitary stub on the south side of the site.
w. Temporary bituminous curb is acceptable for two years. The applicant shall
escrow funds to install curb and gutter around the entire parking and drive area for
the site within two years from the building permit approval.
x. Replace the casting on the westem-most catch basin in Lake Drive West with a
drive -over type grate.
y. Revise the plans to show the following:
a. The existing pond along with the NWL and HWL.
b. Existing street light locations in Lake Drive West.
z. The building is required to have an automatic fire extinguishing system.
aa. The building plans must be prepared and signed by design professionals licensed

in the State of Minnesota.
bb. Three (3) accessible parking spaces are required for the 62 spaces provided.
cc. Detailed occupancy retailed requirements will not be reviewed until complete
plans are submitted-
dd. Utility Plan: The HDPE pipe specified for the storm sewer requires an air test and
must have watertight fittings. The sanitary sewer service into the building must
be schedule 40 pipe.
ee. The owner and or their representative shall meet with the Inspections Division as
soon as possible to discuss plan review and permit procedures.
ff. The 6-inch water service coming into the building will need a post indicator valve.

EXHIBIT "A"
1. Right to Proceed. Within the site plan area, the Developer may not grade or otherwise
disturb the earth, remove trees, construct improvements, or any buildings until all the following
conditions have been satisfied: 1) this agreement has been fully executed by both parties and filed
with the City Clerk, 2) the necessary security and fees have been received by the City, and 3) the
City has issued a building permit.
2. Maintenance of site. The site shall be maintained in accordance with the approved site
plan. Plants and ground cover required as a condition of site plan approval which die shall be
promptly replaced.
3. License. The Developer hereby grants the City, its agents, employees, officers and
contractors a license to enter the plat to perform all work and inspections deemed appropriate by the
City in conjunction with site plan development.
4. Erosion Control. Before the site is rough graded, and before any building permits are
issued, the erosion control plan, Plan B, shall be implemented, inspected, and approved by the City.
The City may impose additional erosion control requirements if they would be beneficial. All areas
disturbed by the excavation and backfrlling operations shall be reseeded forthwith after the
completion of the work in that area. Except as otherwise provided in the erosion control plan, seed

shall be certified seed to provide a temporary ground cover as rapidly as possible. All seeded areas
shall be fertilized, mulched, and disc anchored as necessary for seed retention. The parties
recognize that time is of the essence in controlling erosion. If the Developer does not comply with
the erosion control plan and schedule or supplementary instructions received from the City, the City
may take such action as it deems appropriate to control erosion at the Developer's expense. The
City will endeavor to notify the Developer in advance of any proposed action, but failure of the City
to do so will not affect the Developer's and City's rights or obligations hereunder. No development
will be allowed and no building permits will be issued unless there is full compliance with the
erosion control requirements. Erosion control shall be maintained until vegetative cover has been
restored. After the site has been stabilized to where, in the opinion of the City, there is no longer a
need for erosion control, the City will authorize removal of the erosion control measures.
5. Clean up. The Developer shall maintain a neat and orderly work site and shall daily clean,
on and off site, dirt and debris, including materials that have blown, from streets and the
surrounding area that has resulted from construction work by the Developer, its agents or assigns.
6. Warranty. All trees, grass, and sod required in the approved Landscaping Plan, Plan C,
shall be warranted to be alive, of good quality, and disease free at the time of planting. All trees
shall be warranted for twelve (12) months from the time of planting. The Developer or his
contractor(s) shall post a letter of credit from a bank or cash escrow with the City to secure the
warranties at the time of final acceptance.
7. Responsibility for Costs.
A. The Developer shall hold the City and its officers and employees harmless from
claims made by itself and third parties for damages sustained or costs incurred
resulting from site plan approval and development. The Developer shall indemnify
we
the City and its officers and employees for all costs, damages, or expenses which the
City may pay or incur in consequence of such claims, including attomeys' fees.
B. The Developer shall reimburse the City for costs incurred in the enforcement of this
Permit, including engineering and attomeys' fees.
C. The Developer shall pay in full all bills submitted to it by the City for obligations
incurred under this Permit within thirty (30) days after receipt. If the bills are not
paid on time, the City may halt all plat development work and construction. Bills
not paid within thirty (30) days shall accrue interest at the rate of 8% per year.
8. Developer's Default In the event of default by the Developer as to any of the work to be
performed by it hereunder, the City may, at its option, perform the work and the Developer shall
promptly reimburse the City for any expense incurred by the City, provided the Developer is first
given notice of the work in default, not less than four (4) days in advance. This Contract is a license
for the City to act, and it shall not be necessary for the City to seek a Court order for permission to
enter the land. When the City does any such work, the City may, in addition to its other remedies,
assess the cost in whole or in part.
9. Miscellaneous.
A. Conctmrtinn Trailers. Placement of on -site construction trailers and temporary job
site offices shall be approved by the City Engineer. Trailers shall be removed from
the subject property within thirty (30) days following the issuance of a certificate of
occupancy unless otherwise approved by the City Engineer.
B. Postal Servire, The Developer shall provide for the maintenance of postal service in
accordance with the local Postmasters request.
C. Third Parties. Third parties shall have no recourse against the City under this Permit.

D. Breach of Contract. Breach of the terms of this Permit by the Developer shall be
grounds for denial of building permits.
E. Sever, If any portion, section, subsection, sentence, clause, paragraph, or
phrase of this Permit is for any reason held invalid, such decision shall not affect the
validity of the remaining portion of this Contract.
F. Occupancy. Unless approved in writing by the City Engineer, no one may occupy a
building for which a building permit is issued on either a temporary or permanent
basis until the streets needed for access have been paved with a bituminous surface
and the utilities tested and approved by the city.
G. WaivereJAmendmPnts. The action or inaction of the City shall not constitute a
waiver or amendment to the provisions of this Contract. To be binding, amendments
or waivers shall be in writing, signed by the parties and approved by written
resolution of the City Council. The City's failure to promptly take legal action to
enforce this Contract shall not be a waiver or release.
H. Recording. This Permit shall run with the land and may be recorded against the title
to the property.
I. Remedies, Each right, power or remedy herein conferred upon the City is
cumulative and in addition to every other right, power or remedy, express or
implied, now or hereafter arising, available to City, at law or in equity, or under any
other agreement, and each and every right, power and remedy herein set forth or
otherwise so existing may be exercised from time to time as often and in such order
as may be deemed expedient by the City and shall not be a waiver of the right to
exercise at any time thereafter any other right, power or remedy.

J. Constrnctinn i-lours. The normal construction hours and maintenance of equipment
under this contract shall be from 7:00 a.m. to 6:00 p.m. on weekdays, from 9:00
a.m. to 5:00 p.m. on Saturdays, with no such activity allowed on Sundays or any
recognized legal holidays. Operation of all internal combustion engines used for
construction or dewatering purposes beyond the normal working hours will require
City Council approval.
K. Snil Treatment Sytams. (Not applicable.) If soil treatment systems are required, the
Developer shall clearly identify in the field and protect from alteration, unless
suitable alternative sites are first provided, the two soil treatment sites identified
during the site plan process for each lot. This shall be done prior to the issuance of a
Grading Permit. Any violation/disturbance of these sites shall render them as
unacceptable and replacement sites will need to be located for each violated site in
order to obtain a building permit.
L. Compliance with I aw., Ordinances, and Regulation.. In the development of the site
plan the Developer shall comply with all laws, ordinances, and regulations of the
following authorities:
1. City of Chanhassen;
2. State of Minnesota, its agencies, departments and commissions;
3. United States Army Corps of Engineers;
4. Watershed District;
5. Metropolitan Government, its agencies, departments and commissions.
M. Proof of Title. Upon request, the Developer shall furnish the City with evidence
satisfactory to the City that it has the authority of the fee owners and contract for

deed purchasers too enter into this Development Contract.
N. Soil Conditions. The Developer acknowledges that the City makes no
representations or warranties as to the condition of the soils on the property or its
fitness for construction of the improvements or any other purpose for which the
Developer may make use of such property. The Developer further agrees that it will
indemnify, defend, and hold harmless the City, its governing body members,
officers, and employees from any claims or actions arising out of the presence, if
any, of hazardous wastes or pollutants on the property, unless hazardous wastes or
pollutants were caused to be there by the City.
O. Soil Correction. The Developer shall be responsible for soil correction work on the
property. The City makes no representation to the Developer concerning the nature
of suitability of soils nor the cost of correcting any unsuitable soil conditions which
may exist.
