I have reviewed the materials submitted with the variance request. It is my
understanding that a building permit will be required for the proposed structure and a
site plan will be submitted with the building permit application. I will comment at that
time regarding the need for an erosion control plan consistent with §19-145 of
Chanhassen City Code. Excepting these future comments, I have no additional
comments pertaining to this submittal.

The above described application for approval of a land development proposal was filed with the Chanhassen Planning
Department on April 19, 2013. The 60-day review period ends June 18, 2013.
In order for us to provide a complete analysis of issues for Planning Commission and City Council review, we would
appreciate your comments and recommendations concerning the impact of this proposal on traffic circulation, existing and
proposed future utility services, storm water drainage, and the need for acquiring public lands or easements for park sites,
street extensions or improvements, and utilities. Where specific needs or problems exist, we would like to have a written
report to this effect from the agency concemed so that we can make a recommendation to the Planning Commission and City
Council.
This application is scheduled for consideration by the Chanhassen Planning Commission on May 21, 2013 at 7:00 p.m. in
the Council Chambers at Chanhassen City Hall. We would appreciate receiving your comments by no later than May 10,
2013. You may also appear at the Planning Commission meeting if you so desire. Your cooperation and assistance is
greatly appreciated.

C. WELL NO. 9 PROJECT 03-02: APPROVE CONSTRUCTION
CONTRACTS.
Councilman Lundquist asked that this be approved minus the SCADA line item until that
can be further defined. Paul Oehme recommended that the item be approved as is and a
change order can be done later on if concerns arise. Councilman Lundquist asked the city
attorney for his opinion on putting in a condition of secondary approval on the SCADA.
Roger Knutson suggested a condition which states, don't proceed on the SCADA until
further authorization from the council.
Councilman Lundquist moved, Councilman Ayotte seconded to approve
construction contracts with Mark J. Traut Wells in the amount of $521,330 and
with Kusske Construction in the amount of $288,351.25 for work to be performed
on Project No. 03-02 with the condition that further council approval is required
before proceeding with any purchases or construction related to the SCADA system.
All voted in favor and the motion carried unanimously with a vote of 5 to 0.
VISITOR PRESENTATIONS: None.
Kate Aanenson updated the City Council on changes made to the code since the last work
session. Councilman Ayotte asked staff to explain what mechanism will the residents
have to be able to judge performance on the part of the contractor when it comes to
recycling. Councilman Lundquist stated his reasons for not supporting this ordinance
amendment. Councilman Ayotte and Councilman Labatt agreed with Councilman
Lundquist. Councilman Peterson stated his support for staffs recommendation. Mayor
Furlong commented he was in agreement with going forward with this proposal and then
review it in a year to see how the program is working. Sheldon Swensen with Waste
Management spoke regarding the proposed change to the ordinance. Councilman
Lundquist asked the applicant for clarification on costs and benefits to Waste
Management. Councilman Ayotte stated as the discussion has developed, he was looking
for more information and asked the applicant his feelings of tabling the item.

CONTRACTS.
Councilman Lundquist: The question, concern on this item is around the SCADA piece
of it so, what the City Engineer and I had discussed earlier today was to approve the
contract minus the SCADA line items, if you will, until we get further, some further
definition around that. And then proceed at that time, shortly thereafter with a change
order or an addition or something like that, to that pulling it off of this. Paul, unless you
want to.
Paul Oehme: Thank you Mayor and council members. What the staff would recommend
going ahead with approving of the item before you tonight and we can always have a
change order later on if the recommendation that staff has given you, if you're not
comfortable with that, we can always take that out of the contract but we feel that if we
could leave it in the contract at this time and put it, have a change order later on so we
don't have to revisit it if we still want to move forward with the product that staff has
recommended. I think that would be our recommendation at this time.
Councilman Lundquist: So would we be forced to re -bid if we removed the SCADA
piece now to re -bid just that piece, is that what you're?
Paul Oehme: Right. If we don't award the contract with the SCADA component,
anyway now we would be forced to re -bid or obtain separate quotes and go through the
bidding process again, quoting process. So if we leave it right now, and if we feel, still
feel comfortable with moving forward with the SCADA system, we still can leave in but
for now we can take it out at any point in time prior to construction. We can still award a
contract...
Councilman Lundquist: How far down the line are we talking about before any of those
purchases on hardware, software or any of that installation gets started?
Paul Oehme: Well we'll direct the contractor to not make any purchases or schedule any
installations until we hear back from the council in terms of your feelings on the
components that are in the contract right now. And that's, right now the preliminary time

Nate Bouvet presented the staff report on this item. Commissioner Lillehaug questioned
the notification list, stating he felt the 500 foot notification was based off the wrong lot
but stated he was in favor of the application and he didn't believe it was controversial.
Commissioner Keefe asked the applicant is she was proposing any signage. Kate
Aanenson explained that for a home occupation, permitted signage was very small.

Kate Aanenson presented the staff report on this item. Commissioner Papke asked for
staff clarification on their recommendation for only one restaurant and traffic between
this development and Lake Ann Park. Commissioner Slagle asked for clarification on the
public/private situation with the proposed water park/pool and traffic concerns.
Commissioner Lillehaug had questions regarding zoning, roadways, and regional
ponding requirements. Commissioner Keefe asked for clarification regarding the
proposed hotel. Commissioner Tjomhom stated she was struggling with the idea of a
water park in an industrial area. Chairman Sacchet had questions relating to the proposed
uses, i.e. hotel and bank, the percentage of uses, the water park and height of buildings.
Richard Bjork provided background information on the applicant, Advance Fitness. Jim
Lasher with LSA Design spoke on behalf of the team to outline the proposal.
Commissioner Tjomhom asked the applicant to explain how the water park differs from a
regular swimming pool. Commissioner Papke asked for clarification on the scale of
restaurants being proposed. Commissioner Lillehaug asked for clarification on the
roadway connection with McGlynn Road. Chairman Sacchet opened the public hearing.
Brent Griowski, 2221 Hunter Drive, spoke on behalf of General Mills at 8000 Audubon
Road which is adjacent to the proposed development. He wanted to remind the
commission that General Mills is open 24 hours a day, 7 days a week and asked if a hotel

the wrong lots got identified and the 500 feet is based off the wrong area. Or a

PROPOSAL SUMMARY
The applicant is requesting an interim use permit (IUP) to allow lessons at a riding academy. By ordinance
stables and riding academies are an interim use in the A2 district. The purpose of the riding academy is to
educate students on the proper care of horses and to teach them how to ride.
APPLICABLE REGULATIONS
Sec. 20-383. General Issuance Standards
The planning commission shall recommend an interim use permit and the council shall issue interim
permits only if it finds that such use at the proposed location:
1. Meets the standards of a conditional use permit set forth in section 20-232 of the City Code.
2. Conforms to the zoning regulations.
3. The use is allowed as an interim use in the zoning district.
4. The date of event that will terminate the use can be identified with certainty.
5. The use will not impose additional cost on the public if it is necessary for the public to take
the property in the future; and
6. The user agrees to any conditions that he City Council deems appropriate for permission of
the use.
Sec. 20-384 Termination.
An interim use permit shall terminate on the happening of any of the following events, whichever first
occurs.
1. The date stated in the permit.
2. Upon violation of conditions under which the permit was issued.
3. Upon change in the city's zoning regulations which renders the use nonconforming.

BACKGROUND
The purpose of an interim use permit is to allow a use that is presently acceptable but that with
anticipated development will not be acceptable in the future. An interim use permit has a specific
termination date that expires when urban services are located in the area, to include sewer and water.
The property on which the interim use permit is applied for is currently zoned Agricultural Estate
District (A2). With the growing urban services proposed for the area, the property is guided by the 2020
Land Use Plan as Mixed Low Density Residential. While riding academies are an interim use in the A2
district, it is not a permitted use in the Residential -Low Density District of the 2020 Land Use Plan.

The subject site is 10.31 acres; the applicant is proposing to provide riding lessons and illustrate proper
care to 1 or 2 students at a time. An existing pole barn and riding area are located west and northwest of
the home, including several storage sheds, garage, and horse boarding stalls south of the home.
The site currently has six (6) acres designated for the keeping of horses and a stable permit allowing
nine (9) horses to be stabled on the property.
CONDITIONAL USE PERNM FINDINGS
As part of the Interim Use Permit approval is subject to findings of a Conditional Use Permit. The
following constitutes staffs review of this proposal against conditional use permit standards. Section 20-
232 includes the following 12 items:
1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general
welfare of the neighborhood or the city.
Finding. The site is zoned A2. The proposed use will not create any significant or unexpected
impacts with the incorporation of staffs conditions. Staff determined that a riding stable with
one (1) or two (2) students will not significantly increase traffic from the applicant's intended
use.
2. Will be consistent with the objectives of the city's comprehensive plan and this chapter.
Finding: The site is currently zoned A2. Riding academies are an interim use in the A2 district.
The site has an existing stable permit for the stable boarding of nine (9) horses. The site is guided
Mxed Low Density Residential by the 2020 Land Use Plan, where riding academies are not a
permitted use. Upon urban services entering the area the Interim Use Permit would expire.
3. Will be designed, constructed, operated and maintained so to be compatible in appearance with the
existing or intended character of the general vicinity and will not change the essential character of
that area.
Finding: The site is located in an agricultural estate district. The site is similar to other large lots
and single family homes located on all three sides of the property. The riding academy will not
affect the general character of the vicinity, whereas the riding arena and stables already exist.
Several property owners in the area own horses and have similar properties.
4. Will not be hazardous or disturbing to existing or planned neighboring uses.
Finding. The proposed project will not be hazardous or disturbing to existing or planned
neighboring uses.
5. Will be served adequately by essential public facilities and services, including streets, police and
fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be
served adequately by such facilities and services provided by the persons or agencies responsible for
the establishment of the proposed use.

Finding: Access to the site is provided via West 90s Street. The site will be able to
accommodate the proposed use. The site includes a crushed rock parking area north of the
proposed home for students of the riding academy.
6. Will not create excessive requirements for public facilities and services and will not be detrimental
to the economic welfare of the community.
Finding: The proposed project will not create excessive requirements for public facilities and
services and will not be detrimental to the economic welfare of the community.
7. Will not involve uses, activities, processes, materials, equipment and conditions of operation that
will be detrimental to any persons, property or the general welfare because of excessive production
of traffic, noise, smoke, fumes, glare, odors, rodents, or trash.
Finding: The proposed use may increase the amount of traffic serviced via West 96 h Street. The
increase will be approximately four (4) trips according to the applicant's intended use. This is
equivalent to less than one household's average daily trips. Proposed use will not impact
neighboring properties.
8. Will have vehicular approaches to the property which do not create traffic congestion or interfere
with traffic or surrounding public thoroughfares.
Finding: The site currently has a single access via West 96`" Street; staff does not anticipate a
significant increase in traffic with the use of the riding academy.
9. Will not result in the destruction, loss or damage of solar access, natural, scenic or historic features
of major significance.
Finding. The proposed development will not result in the loss or destruction of any significant
features with the incorporation of staff's recommendations.
10. Will be aesthetically compatible with the area.
Finding: With the incorporation of staff's recommendation and existing conditions of neighboring
properties, the riding academy will maintain the aesthetic compatibility with the surrounding area.
11. Will not depreciate surrounding property values.
Finding: The use will not depreciate surrounding property values.
12. Will meet standards prescribed for certain uses as provided in this article.

The instruction would be for 1, 2 or 3 students at a time. I would guess the
majority of the time it would be 1 or 2 students. The length of the lesson would be 1 hr.
The students would probably car pool because they are usually neighbors or friends at
school wanting to learn how to horseback ride. I have two wonderfid old ponies to
accommodate this. I like to give back to the children a part of my childhood and
expertise. To see them smile and learn the proper care and parts of the animal gives the
children a great confidence booster as well as learning to ride and feeling they have
something special to do rather than sit and watching Television.
My hours would revolve around school brs. Summer — 3 days a week Tuesdays,
Wednesdays, Thursdays, 8:00 am. to 1:00 or 2:00 p.m. depending on the heat. Fall thru
Spring —Saturdays, 8:00 am. to 12:00 p.m. and a few after school hrs. 3:00 p.m. to 5:00
p.m. on Tuesdays, and Thursday. Also, a good day for a lesson would be spring break or
a vacation day. Lastly, I do not have lighting in my riding ring so I would only be
teaching before it becomes dark. And only weather permitting because we only ride
outdoors.
The location of my lessons given only by myself would be in my riding ring
behind my barn. And around my hay field after I feel they can handle the ponies properly.
The duration of this proposed issue would cease when sewer and water is
available in the area. Proposed for year 2020. I also have no reason to increase the size or
change any part of my operation.
I will be in compliance with the twelve general standards. This Inter use permit will not
be detrimental or endanger the welfare of the neighborhood or city. I will be consistent to
the cities compliance plan and hours I have submitted. I also keep an extremely clean
stable. Appearance is the number one thing that I demand. The stables are cleaned daily
and disposed of instantly on the tree farm or hauled out if it is to wet to spread. All
designing is completed so no extras are foreseen. Weekly upkeep is also an importance as
there are always things that manage to need repairs. I think first impressions are
important so appearance is everything. There is very little noise associated with horses
unless they winny here or there, saying hi as you come up to them. This operation will
not be detrimental to the economic welfare of the community. It will be a very quiet
activity for the children to enjoy and not disturb anyone. Also there will be very little
traffic as parents tend to bring a friend and car pool together as they usually are
neighborhood children or classmates in school. People need quality time with a friend
and a pony. This is very therapeutic as animals help all of us relief stress. I have ample
parking approximately one-half an acre with a large area to turn around so there would
never be excessive traffic or problems with cars having no place to park. I have has a
stable since I moved to my place in 1987. There are Five others in the neighborhood with
horses as well. So I feel it is compatible with the area. Property values in the area will
only increase in value due to the park appearance that I keep my place, for example I
have no weeds and keep the pastures groomed. I feel I meet the standards set for this
interuse permit. Please consider my request.

I am writing to strongly recommend you approve the above referenced permit. My family has been
neighbors with the Worms for 11 years now and we have always found them to be responsible and caring
neighbors. They take very good care of their property and horses.
The riding academy is a positive use of local land. It reaffirms the rural qualities that prompted us to move
here in 1993, and sadly are being lost as the southwest suburbs rapidly grow. In addition, the academy will

In regards to the proposed riding academy project that is being coordinated by Sandy
Worm, I would like to make my personal recommendation for the approval of this
project..
I have two reasons for my enthusiasm for this project. First off, I am a close neighbor of
Sandy Worm and have personally seen how open and willing she has been in welcoming
children and adults to her home and stables to learn about horses. Not only is she a kind
and upstanding member of the community, but she is a wonderful role model to all of our
children!
Secondly, and most importantly, I am an elementary school teacher in a local school
district. Many of my past and present students are those that Sandy has welcomed into
her home to provide the wonderful opportunity of riding horses. I have heard and seen
first-hand how valuable the experience has been for these children. Many children at this
age have such an interest and yearning to ride horses. Many children at this age do not
have access to this opportunity. Sandy provides the rural -type environment that many of
our suburban children do not know about. Learning and working with horses is a
fabulously wholesome activity that does not leave the often negative residue that
competitive sports can leave. It is a healthy focus for children living in a world that is
filled with unhealthy options! I can't tell you how valuable this experience is for the
children Sandy works with.
For these reasons, my hope is that you make the motion to approve Sandy Worm's riding
academy program.

remember the top end but it's pretty small for a home occupation so, it's like 2 by 2 or
something like that so she would put that in the driveway, just for an address so people

Kate Aanenson presented the staff report on this item. Commissioner Papke asked for
staff clarification on their recommendation for only one restaurant and traffic between
this development and Lake Ann Park. Commissioner Slagle asked for clarification on the
public/private situation with the proposed water park/pool and traffic concerns.
Commissioner Lillehaug had questions regarding zoning, roadways, and regional
ponding requirements. Commissioner Keefe asked for clarification regarding the
proposed hotel. Commissioner Tjornhom stated she was struggling with the idea of a
water park in an industrial area. Chairman Sacchet had questions relating to the proposed
uses, i.e. hotel and bank, the percentage of uses, the water park and height of buildings.
Richard Bjork provided background information on the applicant, Advance Fitness. Jim
Lasher with LSA Design spoke on behalf of the team to outline the proposal.
Commissioner Tjornhom asked the applicant to explain how the water park differs from a
regular swimming pool. Commissioner Papke asked for clarification on the scale of
restaurants being proposed. Commissioner Lillehaug asked for clarification on the
roadway connection with McGlynn Road. Chairman Sacchet opened the public hearing.
Brent Griowski, 2221 Hunter Drive, spoke on behalf of General Mills at 8000 Audubon
Road which is adjacent to the proposed development. He wanted to remind the
commission that General Mills is open 24 hours a day, 7 days a week and asked if a hotel

LEVEL OF CITY DISCRETION IN DECISION -MAKING: The City has limited discretion in
approving or denying interim use permits, based on whether or not the proposal meets the interim use
permit standards outlined in the Zoning Ordinance. If the City finds that all the applicable interim use
permit standards are met, the permit must be approved. This is a quasi-judicial decision.

PROPOSAL SUMMARY
The applicant is requesting an interim use permit (IUP) to allow lessons at a riding academy. By ordinance
stables and riding academies are an interim use in the A2 district. The purpose of the riding academy is to
educate students on the proper care of horses and to teach them how to ride.
APPLICABLE REGULATIONS
Sec. 20-383. General Issuance Standards
The planning commission shall recommend an interim use permit and the council shall issue interim
permits only if it finds that such use at the proposed location:
1. Meets the standards of a conditional use permit set forth in section 20-232 of the City Code.
2. Conforms to the zoning regulations.
3. The use is allowed as an interim use in the zoning district.
4. The date of event that will terminate the use can be identified with certainty.
5. The use will not impose additional cost on the public if it is necessary for the public to take
the property in the future; and
6. The user agrees to any conditions that he City Council deems appropriate for permission of
the use.
Sec. 20-384 Termination.
An interim use permit shall terminate on the happening of any of the following events, whichever first
occurs.
1. The date stated in the permit.
2. Upon violation of conditions under which the permit was issued.
3. Upon change in the city's zoning regulations which renders the use nonconforming.

BACKGROUND
The purpose of an interim use permit is to allow a use that is presently acceptable but that with
anticipated development will not be acceptable in the future. An interim use permit has a specific
termination date that expires when urban services are located in the area, to include sewer and water.
The property on which the interim use permit is applied for is currently zoned Agricultural Estate
District (A2). With the growing urban services proposed for the area, the property is guided by the 2020
Land Use Plan as Mixed Low Density Residential. While riding academies are an interim use in the A2
district, it is not a permitted use in the Residential -Low Density District of the 2020 Land Use Plan.

The subject site is 10.31 acres; the applicant is proposing to provide riding lessons and illustrate proper
care to 1 or 2 students at a time. An existing pole barn and riding area are located west and northwest of
the home, including several storage sheds, garage, and horse boarding stalls south of the home.
The site currently has six (6) acres designated for the keeping of horses and a stable permit allowing
nine (9) horses to be stabled on the property.
CONDITIONAL USE PERMIT FINDINGS
As part of the Interim Use Permit approval is subject to findings of a Conditional Use Permit. The
following constitutes staffs review of this proposal against conditional use permit standards. Section 20-
232 includes the following 12 items:
1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general
welfare of the neighborhood or the city.
Fending. The site is zoned A2. The proposed use will not create any significant or unexpected
impacts with the incorporation of staffs conditions. Staff determined that a riding stable with
one (1) or two (2) students will not significantly increase traffic from the applicant's intended
use.
2. Will be consistent with the objectives of the city's comprehensive plan and this chapter.
Finding: The site is currently zoned A2. Riding academies are an interim use in the A2 district.
The site has an existing stable permit for the stable boarding of nine (9) horses. The site is guided
Mixed Low Density Residential by the 2020 Land Use Plan, where riding academies are not a
permitted use. Upon urban services entering the area the Interim Use Pemvt would expire.
3. Will be designed, constructed, operated and maintained so to be compatible in appearance with the
existing or intended character of the general vicinity and will not change the essential character of
that area.
Finding: The site is located in an agricultural estate district. The site is similar to other large lots
and single family homes located on all three sides of the property. The riding academy will not
affect the general character of the vicinity, whereas the riding arena and stables already exist.

On April 20, 2004, the Chanhassen Planning Commission met at its regularly scheduled meeting
to consider the application of Sandy Worm for an Interim Use Permit for a riding academy at
760 West 96m Street.
The Planning Commission conducted a public hearing on the proposed development which was
preceded by published and mailed notice. The Planning Commission heard testimony from all
interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
• The site is zoned A2. The proposed use will not create any significant or unexpected impacts
with the incorporation of staffs conditions. Staff determined that a riding stable with one (1)
or two (2) students will not significantly increase traffic from the applicant's intended use.
• The site is currently zoned A2. Riding academies are an interim use in the A2 district. The site
has an existing stable permit for the stable boarding of nine (9) horses. The site is guided Mixed
Low Density Residential by the 2020 Land Use Plan, where riding academies are not a
permitted use. Upon urban services entering the area the Interim Use Permit would expire.
• The site is located in an agricultural estate district. The site is similar to other large lots and
single family homes located on all three sides of the property. The riding academy will not
affect the general character of the vicinity, whereas the riding arena and stables already exist.

The instruction would be for 1, 2 or 3 students at a time. I would guess the
majority of the time it would be 1 or 2 students. The length of the lesson would be 1 hr.
The students would probably car pool because they are usually neighbors or friends at
school wanting to learn how to horseback ride. I have two wonderful old ponies to
accommodate this. I like to give back to the children a part of my childhood and
expertise. To see them smile and learn the proper care and parts of the animal gives the
children a great confidence booster as well as learning to ride and feeling they have
something special to do rather than sit and watching Television.
My hours would revolve around school hrs. Summer — 3 days a week Tuesdays,
Wednesdays, Thursdays, 8:00 am. to 1:00 or 2:00 p.m. depending on the heat. Fall thru
Spring --Saturdays, 8:00 am. to 12:00 p.m. and a few after school hrs. 3:00 p.m. to 5:00
p.m. on Tuesdays, and Thursday. Also, a good day for a lesson would be spring break or
a vacation day. Lastly, I do not have lighting in my riding ring so I would only be
teaching before it becomes dark. And only weather permitting because we only ride
outdoors.
The location of my lessons given only by myself would be in my riding ring
behind my bam. And around my hay field after I feel they can handle the ponies properly.
The duration of this proposed issue would cease when sewer and water is
available in the area. Proposed for year 2020. I also have no reason to increase the size or
change any part of my operation.
I will be in compliance with the twelve general standards. This Inter use permit will not
be detrimental or endanger the welfare of the neighborhood or city. I will be consistent to
the cities compliance plan and hours I have submitted. I also keep an extremely clean
stable. Appearance is the number one thing that I demand. The stables are cleaned daily
and disposed of instantly on the tree faun or hauled out if it is to wet to spread. All
designing is completed so no extras are foreseen. Weekly upkeep is also an importance as
there are always things that manage to need repairs. I think first impressions are
important so appearance is everything. There is very little noise associated with horses
unless they winny here or there, saying In as you come up to them. This operation will
not be detrimental to the economic welfare of the community. It will be a very quiet
activity for the children to enjoy and not disturb anyone. Also there will be very little
traffic as parents tend to bring a friend and car pool together as they usually are
neighborhood children or classmates in school. People need quality time with a friend
and a pony. This is very therapeutic as animals help all of us relief stress. I have ample
parking approximately one-half an acre with a large area to turn around so there would
never be excessive traffic or problems with cars having no place to park. I have has a
stable since I moved to my place in 1987. There are Five others in the neighborhood with
horses as well. So I feel it is compatible with the area. Property values in the area will
only increase in value due to the park appearance that I keep my place, for example I
have no weeds and keep the pastures groomed. I feel I meet the standards set for this
interuse permit. Please consider my request.

• Subdivisions, Planned Unit Developments, Site Plan Reviews, Conditional and Interim Uses,
Wetland Alterations, Rezonings, Comprehensive Plan Amendments and Code Amendments require
a public hearing before the Planning Commission. City ordinances require all property within 500
feet of the subject site to be notified of the application In writing. Any Interested party Is Invited to
attend the meeting.
• Staff prepares a report on the subject application that Includes all pertinent Information and a
recommendation. These reports are available by request. At the Planning Commission meeting,
staff will give a verbal overview of the report and a recommendation. The Item will be opened for
the public to speak about the proposal as a part of the hearing process. The Commission will close
the public hearing and discuss the Item and make a recommendation to the City Council. The City

• Minnesota State statute 519.99 requires all applications to be processed within 50 days unless the
applicant waives this standard. Some applications due to their complexity may take several months
to complete. Any person wishing to follow an Item through the process should check with the
Planning Department regarding Its status and scheduling for the City Council meeting.
• A neighborhood spokesperson/representative is encouraged to provide a contact for the city. Often
developers are encouraged to meet with the neighborhood regarding their proposal. Staff Is also
available to review the project with any Interested person(s).
• Because the Planning Commission holds the public hearing, the City Council does not. Minutes are
taken and any correspondence regarding the application will be included in the report to the City
