Dear Ms Carlson,
This letter is in regards to complaints regarding the condition of your property at
6411 Bretton Way in the City of Chanhassen.
The City of Chanhassen property maintenance ordinances require the exterior of the
structure (Sec. 7-63) be maintained in good repair.
In response to the complaints, we visited the property. We found the building in
need of extensive repair, as required by the City of Chanhassen Property
Maintenance Code. This includes, but is not limited to:
• Repair/replace siding.
• Repair damaged/deteriorated foundation masonry.
• Replace damaged and/or missing shingles.
• Repair/replace damaged windows.
• Repair/replace exterior trim, facia, soffits.
• Repaint.
• Discontinue outdoor storage.
Correction of these issues is required by the City of Chanhassen property
maintenance ordinances (Sec. 7-50). Property maintenance issues must either be
corrected or a schedule of corrections submitted to the City no later than September
20, 2012.

No nonconforming use shall be resumed if normal operation of the use has been
discontinued for a period of twelve months or more.
8. If a nonconforming land use is superseded or replaced by a permitted use, the
nonconforming status of the premises and any rights, which arise under the provisions of
the code, shall terminate.
If you do not agree that such a use is an intensification of the use of the property, then you may
appeal this decision to the Board of Appeals and Adjustments. The Board has the power to hear
and decide appeals where it is alleged that there is an error in any order, requirement, decision or
determination made by a city administrative officer in the enforcement of this chapter.
Should the Board of Appeals and Adjustments agree that the use is not an intensification of the
use of the property or if you appeal their decision, then you must proceed to request that City
Council approve the use of the property. Notwithstanding the prohibitions contained in the
forgoing subsections of the nonconforming use ordinance, if approved by the City Council a
nonconforming land use may be changed to another nonconforming land use of less intensity if it
is in the public interest. In all instances the applicant has the burden of proof regarding the
relative intensities of uses.

October 2010— rental housing (6397 Bretton Way) is discovered to be connected to City
sewer via the commercial building.
August 2009 — Naomi Carlson asks about replacing uses with a pediatric physical therapy
clinic. Was advised that she needs to verify that the non -conforming uses have been
there over the last 12 months. She would need to submit a request to City Council to
approve a replacement of a non -conforming use with another non -conforming use.

Gerald & Karon Story have requested a legal definition of "grandfathered"property located at
6411 Bretton Way, Chanhassen,MN. Parcel ID#25.6940030.
(.Regarding "grandfathered" property: The property can only be used for the industrial zoning
"IOP". The zoning cannot be changed for retail, day care, etc. or used for a personal residence.
The aforementioned property must still be in compliance with all city codes & ordinances. This
is a partial list of some of the codes the building is not in compliance with.
A. Chapter 20 -section 7-63 exterior structures
a. general exterior of a structure shall be maintained in good repair, structurally sound &
sanitary so as not pose a threat to the public health.
b. Doors & windows shall be maintained in locked, secured state with no peeling, chipping
paint. (lead based paint removal).
c. Foundation wall free from open cracks & breaks and structurally sound.
e. Rodent harborage need to be exterminated
g.h.i. Stairways must be maintained with safe steps & handrails.
B. Chapter 20 -Section 20-814 Conditional use
a. Contracting yards- Lawn contracting company rented room#3 filled it with gas mowing
apparatus and and is storing lawn mowing equipment outside including 3 commericial trailers,
4 trucks and (cars of employees when they come to work).They also block the entrance of the
road that runs along the back of the building & leave them on the premises 24-7, which would
obstruct a fire vehicle from coming on the property in an emergency.
11. Screened outdoor storage- City requires buffer yards, fencing and at least 100 feet
between residential and building. (Story property is not fenced off & is only 65 ft. from
structure.
Section 20-282: No outdoor storage or accumulation of garbage- All tenants are currently
throwing garbage, refuse, carpeting, florescence lights and tree branches on to the property
grounds.(see pictures)A few years ago city was notified of 3 toxic barrels stored in back of the
building and Jill Sinclair came out and informed absentee owner Naomi Carlson to properly
dispose of them. Naomi Carlson put them inside of the garages next to the rental property
which also is in total disrepair.
Sec 20-308
a. All outdoor storage shall be screened with 100 %opaque fence of land screened.
Section 20-305 Loading docks must be located from public view & kept in good repair.
2.There is no road leading from the road access down the hill to the Carlson property.
Naomi Carlson would have to drive down a steep grassy embankment to the building or go on
the Storys private property to turn around. The city planning says you cannot have more than a
7 %% grade for a private road, the grade on the grassy hill is currently about 30% and you
cannot go up the embankment from the building even using 4 -wheel drive.
3. Property owner Naomi Carlson has adequate road access in front of her building with the
cul de sac on Bretton way. She also has a road running parallel to building in the back.
4. Abanded well house (see picture) has not been used in the 21 years the Storys have
owned the property. There is deep hole in the middle of the floor, rodents running in and
broken door so property is not secured and children could go inside and be harmed.
This is only a partial list of the violations of Chapter 20- City of Chanhassen Codes.
Chapter 20, sec. 7-53- Duties & powers of the code officer. The code officer shall enforce the
provisions of this code.
Chapter 20, sec. 7-55- b. The code official shall serve a violation or order in accordance with
section 7-56 (c ) Prosecution of violation. Any person failing to comply with a notice of
violation or order served in accordance with section 7-56 shall be deemed guilty of a
misdemeanor. (d ) Violation penalties. Any person who shall violate a provision of this code or
fail to comply therewith orwithany of the requirements shall be prosecuted by state and local
laws. Each day that a violation continues after due notice has been served shall be deemed a
separate offense.

When the court documents are available you are welcome to copies. The old boards have not been replaced, this issue
is a part of our complaint. Lead paint remediation is addressed with a building permit application.

Ms. Aanenson:
Thank you for your prompt response to my request for information regarding Building File: 6411 & 6397
Bretton Way. As part of my request, I would also like a copy of all letters and documents pertaining to the
court proceedings when they become available.
I have attached a few photographs documenting some of the outside storage issues for which our
neighborhood has been requesting action. In addition, it appears the property owner has not complied with
the city order of properly securing the concrete structure embedded in the ground west of the 6397 Bretton
Way building. While walking by the property last night, it appears the old boards that were covering the
structure have not been replaced. Can you confirm the property owner's assertion in her January 31" letter
that this issue was corrected.
Finally, the matter regarding the lead paint on the 6397 Bretton Way building, which I sited in my March 25''x'
e-mail, was not addressed in your letter. Can you please let me know how this will be addressed by the City
