Mike Walling: Good evening Mr. Mayor, City Council. I'm Sergeant Walling, the TZD Coordinator for the sheriff s office. Just wanted to let the community know the sheriffs office has been beginning on May 19'", we've been participating in the statewide mobilization with over 400 other law enforcement agencies in the state for the May Click It or Ticket seatbelt mobilization. That enforcement effort runs through June 1 ", upcoming this Sunday. If you weren't aware Minnesota has a primary seatbelt law that requires all occupants of a vehicle to be buckled up. Front seat passengers. Back seat passengers and then law enforcement can issue a citation to anyone who isn't buckled. Some statistics in the last 5 years on Minnesota roads, that being 2009 through 2013 there were 1,423 motor vehicle occupant deaths out of which 587 were not buckled. In Carver County during this 5 year period 8 of those motorists were unbelted. Some pre -enforcement efforts that we do at the sheriffs office. We do pre -enforcement surveys prior to the enforcement wave at one of those locations. At Highway 212 and Powers Boulevard. Survey indicates that roughly 95% of motorists in Chanhassen are wearing their seatbelt. A post enforcement survey after the enforcement wave last year conducted on June 6, 2013 showed that motorists at this same intersection were at 92% use so efforts to increase seatbelt use are having their effect. The Click It or Ticket seatbelt mobilization and education and seatbelt enforcement education is a component of the State's towards zero death program. Primary vision of the TZD program is to create a safe driving culture in Minnesota in which motorists support a goal of zero road fatalities by practicing and promoting safe driving behavior. Again the message to our citizenry when we make stops for seatbelts is buckle up. We value your life. That's what I have. Do you have any questions? Mayor Furlong: Okay, thank you. Councilman Laufenburger: Sergeant, you can help educate me and others that are watching at home. There was a time in maybe a few years ago I thought that getting stopped for not having your seatbelt buckled was not the only offense. If you were stopped for some other reason and they caught you with your buckle unbuckled they could ticket you for that. Is that still true today? Or first of all, was that true at one time Sergeant? Sgt. Mike Walling: It was true prior to, I want to believe 2008 or 2010. That you needed, that the seatbelt law wasn't a primary offense. Councilman Laufenburger: So you called it a primary offense which means that you can be stopped if the only thing you're doing wrong is driving without visibly noticeable buckle, is that correct? Sgt. Mike Walling: Correct. Legislation passed within the last few years made the not wearing your seatbelt a primary violation which you can be stopped for and cited. City Council approval requires a majority vote of the entire City Council. EXECUTIVE SUMMARY Staff is recommending revoking three (3) Conditional Use Permits (2003-08, 1997-05 and 1984-20). All three property owners have been mailed a letter informing them that their conditional use permit has been voided due to their discontinued use. However, procedurally, the city must take the conditional use permits through the public hearing process to have them revoked. Will not be hazardous or disturbing to existing or planned neighboring uses. Finding: There will not be any required work done on these properties for the revocation of their CUPS. Therefore, there will not be any hazardous or disturbing conditions for existing or planned neighboring uses. e. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Finding: There will be no alternation in services required by the revocation of these CUPS. All of these properties are adequately serviced by the city or through services provided by the persons or agencies responsible for the property. f. So the conditional uses, what we do is we inspect conditional uses that have certain standards that need an annual review and so these three conditional uses are no longer active. So because the conditional use runs with the property often times when someone does a title check these will come up and they'll ask us, the City to go through and do a revocation so on the circumstance they are no longer being used so we are recommending that they be revoked and the process then would be a public hearing and that would go to the Planning Commission and City Council so. So the three conditional uses kind I've talked about. They're discontinued for 6 months. That'd be one thing you could do. You could also declare it null and void and so all three property owners have been mailed a letter informing that their conditional use has been voided or that due to their continued use, although procedurally we need to take formal action. So the first one is on Mallory Court and that one is actually, was for a bakery use and that one is no longer being used so, the bakery was located in an industrial building. Upon inspection it hasn't been there for at least 6 months so it's currently occupied by a different user, Direct Source. Again this sometimes comes up when, if that building was to get refinanced or something then the bank would want to know if those sort of things are in there. So the second one is on Stoughton and this is actually a cell tower so, for a ham radio and prior to inspection, again the property owner has informed that there's not been a ham radio on that site for over 6 months and that was verified again on inspection so that's the second one. And then finally the third one is a contractors yard for excavating and this is also located off of Galpin Boulevard at the address 7300 Galpin Boulevard. So again it was for contractor's activities. Again those run with the property and since it hadn't been used we would recommend again that that also be terminated. So with those three we are recommending the termination and we have a motion here but I'd be happy to answer any questions that you may have on any of those. Aller: I have no questions? That was one of the things that you didn't see but they did ask the City Council for a letter of support on that. We do have items for the May 20'h meeting. Then that Park Court Daycare expansion for site plan review and then an interim use permit for a grading permit. And just a note of record, we do not, did not have any items come in for June 31 so we will not have a meeting on June 31 so. But as long as we're talking about meetings, just a reminder that we do have a work session with the City Council next Monday. I know Commissioner Hokkanen cannot make it.
