At that time, we discovered that grading operations are continuing on the property as well as firewood processing and storage. You must apply for a grading permit to continue site grading. The permit must include a grading and erosion control plan and such grading shall be limited to 1,000 cubic feet. If you exceed this amount, an Interim Use Permit must be applied for and approved by the City Council. Interim Use Permit #07-16, which approved previous site grading, has expired. The sale of "dirt" is not a permitted use in the Single -Family Residential District. No grading operations are allowed without a permit. You are also operating a commercial firewood operation on the property. The processing Of wood for firewood is considered a light manufacturing operation, which is permitted in the Industrial Office Park District. The sale of firewood is considered a retail commercial operation, which is permitted in commercial districts. The property is zoned Single - Family Residential District, RSF, which does not permit either of these operations. Please remove all signage and stop the processing and sale of firewood on site and move the wood stacks to the rear of the house or off-site. Wood for burning in a fireplace may be kept on the property provided it follows the following regulations: In a neat and secure stack, not exceeding four feet; the wood stack is not infested with rodents; and the wood is not kept in a front yard. We shall visit the site Monday, July 23, 2012, to determine compliance with City Code. The Interim Use Permit was recorded on December 20, 2007 as Carver County Abstract Document No. A476414. 2. EXTENSION OF INTERIM USE PERMIT. The Interim Use Permit shall remain in full force and effect. 3. SPECIAL CONDITIONS. In addition to the terms and conditions outlined in the interim use permit, the following special conditions shall apply to interim use permit 07-16: A. The amendment is to stipulate that the City approves the extension of interim use permit 07-16 until September 24, 2009. Conditions of approval include the previous conditions stated on the initial interim use permit, along with the following: 1. The topsoil stock pile shall be seeded within 14 days of inactivity. The parties have previously entered into an interim use permit for site grading dated September 24, 2007 (the "Interim Use Permit") to permit up to 46,000 cubic yards of fill on the site. The Interim Use Permit was recorded on December 20, 2007 as Carver County Abstract Document No. A476414. 2. EXTENSION OF INTERIM USE PERMIT. The Interim Use Permit shall remain in full force and effect. 3. SPECIAL CONDITIONS. If future construction in this area is anticipated, these soils must be engineered for the intended structural loads and their placement must be properly compacted and tested as required by such soil engineering. A report, verifying placement, compaction and soil suitability, from the testing agency will be required before building permits will be issued. c. Show the trees for the US West Telephone property in the existing conditions and the proposed grading plan. Preserve as many trees as possible in this area to provide screening for the building. d. Install tree protection fencing around all trees to be saved on site. e. Tree protection fencing and erosion control fencing must be installed and inspected by the City prior to beginning site grading. f. Silt fence must be added around the outer limits of the temporary topsoil stockpile. This area must be regraded to the elevations shown on the proposed grading plan. Streets must 2 be kept clean and free of debris at all times. Erosion control blanket shall be installed on all slopes greater than or equal to 3:1. A stormwater pollution prevention plan must be submitted to the City for review by Carver Soil and Water Conservation District. m. Changes are needed to the grading plan. The elevations 906 and 908 that are shown in the black walnut woods in the existing conditions must remain in the grading plan. Change the grading in this area to allow the water to exit the corner of the woods. The swale for the drainage around the US West Telephone property should be moved to the center of the lot line. n. An as -built grading plan is needed at the completion of site grading to ensure compliance with the approved grading plan. 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of this permit. 3 5. Lapse. If within one year of the issuance of this permit the authorized construction has not been substantially completed or the use commenced, this permit shall lapse, unless an extension is granted in accordance with the Chanhassen Zoning Ordinance. 6. This property is surrounded on all sides by roads: New TH 101, Lake Susan Drive and Waters Edge Drive (old Highway 101). A telephone transfer station building is located in the southwest comer of the site. The farmstead is located in the northwest comer of the site. A black walnut woods is located in the north central portion of the site. A partial windbreak is located to the south of the farmstead. The proposed grading will eliminate the trees in the windbreak. The high point on the property is located in the northeastern portion of the site with an elevation of 920. The low point on the property is located in the southeast comer of the site where a 48 -inch culvert outlets water from the site to the east under TH 101. This southeast comer of the property is approximately 20 feet lower than the intersection of TH 101 and Lake Susan Drive. There is an existing house, two accessory structures, and a gravel drive on the site; all of which will remain at the completion of site grading. Approximately 50 percent of the site is farmed or grassland. The site will be left in a condition that will be used for crops in the short term and facilitate development in the future. Staff is recommending approval of the interim use permit subject to the conditions of the staff report. APPLICABLE REGUATIONS Chapter 7, Article III, Excavating, Mining, Filling and Grading Chapter 20, Article IV, Division 2, Conditional Use Permits Chapter 20, Article IV, Division 5, Interim Use Permits BACKGROUND Summer 2007, Minnesota Department of Transportation completes the construction of the adjacent roadways, realigned Trunk Highway 101 and Lake Susan Drive, altering surrounding grades. On April 10, 2006, the Chanhassen City Council approved the final plat for Planning Case #06-05 for Chanhassen Gateway North creating three lots and two outlots. On February 27, 2006, the City Council approved the following: • Preliminary plat for Planning Case 06-05 for Gateway North. • Site plan with a variance for the reduction of nine enclosed parking spaces for Planning Case 06-05 for Chanhassen Gateway Place. On June 27, 2005, the City Council approved rezoning the property located at the northwest intersection of the future alignment of Highways 101 and 212 with an approximate area of 24 Klingelhutz Interim Use Permit Planning Case 07-16 September 18, 2007 Page 3 of 5 acres from Residential Single -Family to Planned Unit Development -Mixed Use incorporating design standards. GRADING. DRAINAGE AND EROSION CONTROL The site currently has two drainage areas. Approximately 90 percent of the site drains through a 48 -inch culvert installed by the Minnesota Department of Transportation during the construction of Trunk Highway 101. The remaining 10 percent of the drainage is directed towards the northeast property line. The proposed grading plan does not change the drainage areas. Drainage calculations were not provided or required with this submittal. The reason for not requiring drainage calculations is because the drainage areas and impervious surface is unchanged. Most of the significant trees on the site will be saved. The black walnut woods will remain after grading completion. Approximately twelve trees will be removed near the middle of the site. The trees that will be removed are primarily box elder and poplar. Some trees near the US West Telephone property were not shown on the plans. These trees will need to be shown on the existing conditions plan and the proposed grading plan to determine which trees will be saved. The trees near the US West Telephone building should be preserved for building screening. Most of the fill is proposed near the center of the property. Up to 10 feet of fill will be placed in some areas. No fill will be placed near the buildings or in the black walnut woods. A temporary stockpile of black dirt is shown near the northeast corner of the site. This area will need to be graded back to existing conditions upon completion. Erosion control must be maintained at all times. The applicant will be required to keep the streets clean and free of debris. If silt fence is used, the bottom flap must be buried and the maximum allowable spacing between posts is 4 -foot on center. All posts must be either 2" x 2" pine, hardwood, or steel fence posts. If hay bales are used, all bales must be staked in place and reinforced on the downstream side with snow fence. The silt fence must be orange in color, which will be more evident and easier to locate for removal at the completion of the project. 2. All areas altered because of construction must be restored with seed and disced mulch, sod, wood fiber blanket, or be hard surfaced within two weeks from the completion of construction or no later than October 1, 2007. 3. Upon completion of construction and restoration of areas disturbed, the permit applicant is responsible for the removal of all erosion control measures installed throughout the site. 4. Street sweeping must be undertaken and completed on an as -needed basis. 5. At the entryway onto the site, a rock filter dike being a minimum of 2 feet in height and having maximum side slopes of 4:1 must be constructed. This rock filter dike will enable construction traffic to enter the site and also provide an erosion control facility. 6. The District must be notified in writing a minimum of 48 hours prior to commencement of construction. Upon receipt of this notification, a field inspection of the project site by the Districts engineer will be undertaken to ensure that all erosion control measures have been properly installed. Construction cannot commence until this field inspection has been completed. 7. Upon completion of the project, the permit applicant is required to complete and submit the middle portion of the attached permit, indicating that the project has been completed. Upon receipt of this application, a field inspection of the site by the Districts engineering advisor will be undertaken to ensure that all areas have been properly restored and that all erosion control measures throughout the project site have been removed. 8. The Riley -Purgatory -Bluff Creek Watershed District (RPBCWD), its officers, employees and agents review, comment upon, and approve plans and specifications prepared by permit applicants and their consultants for the limited administrative purpose of determining whether there is reasonable assurance that the proposed project will comply with the regulations and criteria of the RPBCWD and other state and federal agencies. Keefe: So let's open it up for questions. Let's start down here. You have any questions? Thomas: I don't have any questions, thank you. Larson: No. It's actually pretty thorough. Dillon: So in the, kind of like in the description it says there are literally, you know put them in a hole. So how far down is the hole? I mean what's the low spot in this area that needs to be filled? Fauske: Well the low area will remain as it is right now. They're just raising the remainder of the site. The low area is currently at this location and it will remain there. There is an outlet at this location. But what the applicant is stating is that, with the realignment of 101 and Lake Susan Drive extension, that further exasperated the low area in this location and with material being available, they would like to go ahead and proceed with grading on their site so that when SCANNED Planning Commission Meeting - September 18, 2007 the property does come in for development, it will be ready to go and will minimize the grading needed at that time. Dillon: Okay. And is the long term use still intended to be residential? Generous: That's what the Land Use Plan shows for it, yes. Dillon: So once you bring in all this fill and, you know how long does it take to settle down to you know like our, I mean. Fauske: It depends on the material. It depends how it's compacted. Any structure that would be placed on fill material would have to be so it would have to be tested to make sure that it can withstand the load of the building that's proposed on the site. Dillon: Is there a rule of thumb for something like this? Fauske: Again, it depends on the material being brought in and how much they compact it. You know if they bring them in shallow layers and compact it or if they put in thicker layers to compact it, but perhaps the applicant can speak a little bit better to this but at this point they're not proposing any structures on it at this time. And again with any building permit in the future on this site, they will be required to take up some soil density testing done. Dillon: And you said that the source of the fill hasn't been identified yet? Fauske: Not to my knowledge, unless it was in the last couple of days. The applicant has been able to come up with a source. Dillon: Okay. That's all the questions I had. Keefe: I've got a question. In number 13 you said the elevations 906 and 908 in the black walnut woods must remain on the plan, but then change the grading area to allow the water to exit the corner of the woods. And then the other part of the presentation you say 90% of the site drains you know through a 48 inch culvert. I mean would the changes that are proposed in number 13 affect the drainage pattern on site? Fauske: Not significantly. Keefe: Not significantly. Okay. Alright. And then one other question in regards to you know I think you mentioned in the write up but I didn't necessarily see it in the conditions and that's what I, you know cleaning, we're going to bring in I don't know how many trick loads it is. I presume it's quite a few though, and just dragging all that dirt through the city you know in terms of cleaning streets and so forth. How do we typically handle that? Fauske: Well the applicant, since it is over an acre, what the MPCA and NPDES, non -point discharge elimination system permit will be required and through that they're required to show how they will keep their site maintained with staffs recommendation of collecting a $5,000 Q3t'4EM7t E Planning Commission Meeting - September 18, 2007 escrow. We do have the funds there to say you know, you need to clean up your site or well be withdrawing from your escrow to clean up the site and fortunately we've never come to a situation like that where we've gone to such an extreme enforcement but typically we've found that applicants are very willing to, you know they understand they need to keep things cleaned up and have been responsive. Keefe: And how about the city streets. I mean in terms of you know, those trucks come along. Dirt falls out and then we simply require them to deal with that? Fauske: Yes, exactly. They have, there's several methods. It depends on how much material is on the street. They can get a little bobcat and scoop it up, or they can get a broom and sweep it. It depends on how much rain they've had. How much material's on the street. Keefe: Yeah, do we typically make that a requirement? Fauske: It's a requirement that they need to keep the streets cleaned up. Keefe: Yeah. Fauske: So it will be, you know it will be on the applicant's part, not the city. And then as far as that Planning Commission Meeting - September 18, 2007 90%, I think as she was talking, the site now drains, there's about 10% of it by that black walnut trees that drains towards the, probably northeast and that's still going to drain that way. That's why the whole 90 doesn't fall down on that part, but there's plenty of people keeping an eye on us. We've got MnDot permit. Watershed district. That NPDES permit. Now this. You know it seems to me a little overkill for what we're trying to do. You know it's, I think this interim use permit you could have, you know you could build a whole big structure under this and it's just a matter of getting some dirt in here while it's available so. Neil Klingelhutz: Yeah, we've actually originally had dirt identified for this spring and then the permitting process took so long that that ran away. Either or depending on when we receive the permits that well have the dirt. And then as far as the compaction goes, we're going to do a compaction test now. You know they're going to strip the black dirt. Bring the clay. It's got to be good clay. Compact it up so and then, cover, compact with the black dirt so I mean realistically then were going to have inspections as we're doing this so realistically if you wanted to build on it, the day they were done it should, you know a lot of the compaction results are okayed. It could happen right away. We're not just pushing dirt on there and not compacting it. We're going to compact it up as we go so. Keefe: Do you typically reseed it or... Scraping the black dirt off and re-covering it with the black dirt. So it just seems the right thing to do for the property because I don't know who'd want to live in that hole. Thank you. All erosion control measures shown on the plans must be installed prior to commencement of grading operations and be maintained until all areas altered on the site have been restored. If silt fence is used, the bottom flap must be buried and the maximum allowable spacing between posts is 4 -foot on center. All posts must be either 2" x 2" pine, hardwood, or steel fence posts. If hay bales are used, all bales must be staked in place and reinforced on the downstream side with snow fence. The silt fence must be orange in color, which will be more evident and easier to locate for removal at the completion of the project. 2. All areas altered because of construction must be restored with seed and disced mulch, sod, wood fiber blanket, or be hard surfaced within two weeks from the completion of construction or no later than October 1, 2007. 3. Upon completion of construction and restoration of areas disturbed, the permit applicant is responsible for the removal of all erosion control measures installed throughout the site. 4. Street sweeping must be undertaken and completed on an as -needed basis. 5. At the entryway onto the site, a rock filter dike being a minimum of 2 feet in height and having maximum side slopes of 4:1 must be constructed. This rock filter dike will enable construction traffic to enter the site and also provide an erosion control facility. 6. The District must be notified in writing a minimum of 48 hours prior to commencement of construction. Upon receipt of this notification, a field inspection of the project site by the Districts engineer will be undertaken to ensure that all erosion control measures have been properly installed. Construction cannot commence until this field inspection has been completed. 7. Upon completion of the project, the permit applicant is required to complete and submit the middle portion of the attached permit, indicating that the project has been completed. Upon receipt of this application, a field inspection of the site by the Districts engineering advisor will be undertaken to ensure that all areas have been properly restored and that all erosion control measures throughout the project site have been removed. 8. The Riley -Purgatory -Bluff Creek Watershed District (RPBCWD), its officers, employees and agents review, comment upon, and approve plans and specifications prepared by permit applicants and their consultants for the limited administrative purpose of determining whether there is reasonable assurance that the proposed project will comply with the regulations and criteria of the RPBCWD and other state and federal agencies. This permit is not transferable. I didn't see repair of that connection considered. • There is also a water pipe going under the driveway that was also taken out. • There should be some description of how notification and maintenance of the creek/culvert/erosion will be handled: • Who will monitor the site to see if maintenance is required? (Will that mainly be the property owner's responsibility?) • Who will they notify in the city? • What is the expected level of maintenance? • If the city is going to come on site for maintenance, can we ask for some notification CITY OF CHANHASSEN from the city. (example: if the city is planning some re -work at the same time we RECEIVED are planning a graduation party we probably need to co-ordinate activities. We should probably get this all spelled out — so that future people involved in this aren't left to sort it out.) • I don't have any direct experience, but I have concern that the rip rap around the culvert will quickly fill in with dirt. There has been a lot of upstream soil erosion — which has caused the filling in of our creek and the subsequent overflowing onto our property. This has caused damage to the neighboring property as well. If the soil washing continues, the rip rap will fill in quickly. I know there is a feeling by the city that the erosion was the cause of the upstream construction — and the area has stabilized. If the area upstream is not stabilized, however, the rip rap will fill in with dirt and cease to be of benefit. If this happens too quickly, some further review of flow rate and volume control needs to be done. • Does the trash guard provide any "value added" to the culvert/driveway. If thereis one on both ends of the culvert, I am somewhat concerned about stuff getting trapped in between the trash guards. Or possibly, is there just one on the upstream side of the culvert. Even if there is just one on the upstream end, what does this really accomplish? (this is probably my lack of experience) • There is a lot of added soil that has been dug out and put on our property as well as the adjacent property. I would like to have this distributed to other parts of our property, and/or piled in an area where I can do the same. • Is there any consideration for the black walnut trees that previously lined the creek on both sides. We lost a number of them. • Is there an option to vacate the easement on our property — if the creek, culvert and erosion are found to be stable for a long period of time. (I would think the city would want to leave the option open to vacate the easement if both parties are in agreement. If so, should we at least address this option now — so that future city administration and property owners aren't "stuck" with this forever.) • Has there been any repair planned to the neighbor property (to the West of us)? The damage and fix are intertwined.
