SUMMARY OF REQUEST: The applicant is requesting an amendment to the existing sign criteria for the Medical Arts Buildings Phase I and II to increase the size of the Phase 1 sign band to 3 feet and to remove the provisions for both phases that respectively restrict the size of letters and logos to a maximum of 12 inches and 24 inches. LOCATION: 470 and 480 West 78th Street (Lots 1 & 2, Block 1, Medical Arts Addition) APPLICANT: Mason McClellan 1525 Hemlock Way Chanhassen, MN 55317 Owner: Chanhassen Medical Arts Attn: Mary Johnson 470 78" St. W #260 Chanhassen, MN 55317 PRESENT ZONING: CBD, Central Business District 2030 LAND USE PLAN: Commercial ACREAGE: 0.44 Acres & 0.46 Acres DENSITY: N/A LEVEL OF CITY DISCRETION IN DECISION-MAKING: The city's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with Zoning Ordinance requirements. If it meets these standards, the city must then approve the site plan. This is a quasi-judicial decision. Notice of this public hearing has been mailed to all property owners within 500 feet. Medical Arts Building Planning Case 2017-17 September 5, 2017 Page 2 of 6 PROPOSAU/SUMMARY The applicant is requesting an amendment to the sign criteria for the Medical Arts Buildings Phases I and II. The current sign plan specifies that signs are only allowed within a continuous two -foot two-inch high band near the roofline for both buildings. Signs within the band are limited to letters up to 12 inches in height and logos up to 24 inches in height. The applicant is requesting that the sign plan be modified to specify a three-foot high sign band for the Phase I building and to remove the letter and logo size restrictions for both buildings. They believe that approving this amendment would make the buildings' sign plan consistent with the City's Sign Code, which does not specify maximum letter or logo sizes, and with the city's general practice of regulating sign placement through sign bands and sign size to a certain percentage of the building's facade. The applicant has also noted that several signs currently located in the development exceed the size requirements specified by the building's sign criteria. The proposed changes would encompass the existing signs and create uniform standards for both existing and incoming businesses. APPLICABLE REGULATIONS Chapter 20, Article II, Division 6, Site Plan Review Chapter 20, Article XXVI. — Signs BACKGROUND General: On May 22, 1989, the City Council approved the preliminary plat and site plan application for the Medical Arts Buildings. The site plan review was approved with two buildings to be built in two phases. Phase I building was completed in 1990 and Phase 11 was constructed in 1996. W t el 4- 0 31 Medical Arts Building Planning Case 2017-17 September 5, 2017 Page 3 of 6 Part of the site plan approval included a sign plan. Due to the size of the building, the small street setback, and the potential number of offices within the building, the city wanted to insure a detailed sign plan was in place. The original sign plan limited the number of signs within a designated strip as well as the color, lighting, sign band size, maximum letter size, and maximum logo size. The original restrictions were created based on an understanding that building was to contain medical offices with low advertising needs. Phase I On May 22, 1989, the City Council approved a sign plan. It is not clear exactly what was approved. On May 30, 1990 The City Council amended, the sign plan to clarify that a maximum of 10 signs, five on each fagade would be permitted; the one sign per -tenant restriction was removed. This was done to reconcile the difference in the site plans dated April 14, 1989 and April 18, 1989. The April 18, 1989 plan appears to show a two -foot high sign band. On July 11,1991, the City Council amended the sign plan to clarify that the south middle area of the building, defined as the area between the two projecting porticoes, allowed signs of up to three feet in height, with letters not to exceed 12 inches in height. Up to three signs were permitted in this area. The rest of the building was limited to nine signs, five north and four south, not to exceed two feet 2 inches in height and 24 feet in width with letters not to exceed 12 inches in height. Phase II On October 12, 1992, the City Council approved a sign plan for the Phase II building. This sign plan limited signs to a two -foot two-inch high sign band and limited letters to 12 inches in height and logos to 24 inches in height. The sign plan also limited the development to a total of 14 signs. On April 1, 1996, staff received a letter from Vernelle Clayton requesting that an exception be made to the 24 inch sign and logo space restriction in order to accommodate a tenant moving an existing Phase I sign to the Phase II building. At the time, the Phase I sign plan allowed for three-foot signs in the middle section. On June 26, 1996, a permit was issued allowing the sign to be relocated with its existing dimensions. Phase 1 and II On December 8, 2014, the existing sign plans were amended to remove the provisions limiting the number of signs allowed on each building. The rational for removing this provision was that the city typically restricts the proliferation of signs using sign bands and square footage limits, rather than per -building limits on the number of signs. At this time the Phase II sign criteria where adopted for both buildings, effectively removing the three-foot exception for the middle sign area in the Phase I building and confining all signage to the two -foot two-inch sign band. Medical Arts Building Planning Case 2017-17 September 5, 2017 Page 4 of 6 ANALYSIS The city's general sign ordinance attempts to balance the advertising needs of businesses with the potential visual nuisance that can be created by unrestricted signage. The city does this by limiting the maximum square footage of signage to a sliding percentage of a building's facade, and by requiring buildings to submit a site-specific sign plan as part of their site plan review. Multi -tenant commercial buildings are required to designate a sign band or bands, either conceptually or with specific dimensions, and, in some cases, restrictions are placed on the maximum height of letters and logos. In the case of the Medical Arts Buildings, the sign plan designated a two -foot two-inch area near the roofline as the sign band and illustratively depicted the band. In addition to restricting signage to the sign band, the sign plan limits letters to 12 inches in height and logos to 24 inches in height. Of the 29 sign plans that staff examined, no other sign plan limits signs to a 12 inch maximum letter size. About half of sign plans do not limit letter size. Restricting the letters on the Medical Arts Building to a maximum height of 12 inches is stricter than the limits placed on similar developments in the city. The letter and band requirements have been difficult for numerous tenants to meet. Of 14 sign permits, current and historic, that staff was able to find, eight did not comply with either the letter or band size restrictions. The largest sign approved was three feet in height with 21 inch letters and is still present on the building. Other signs were approved with total heights of three feet, 30 inches, and two -foot nine - inches, despite the sign band's two -foot two-inch height limit. Regarding letter size, several signs with letters between 15 inches and 21 inches have been approved. In some cases, variances or amendments to the sign plan were made to accommodate these signs. The acupuncture sign which the applicant wishes to relocate to the Phase I building has 28 inch high letters. Historically, portions of the Phase I allowed three-foot high signs, though with 12 inches high letters, and, as noted above, exceptions to the sign plan have been made to accommodate larger signs in other locations. TI LA- 0 aIs" Medical Arts Building Phase R (2016 Google Street Vieu) lion ii: Three goals of the City's Sign Code are relevant to the proposal to amend the Medical Arts Buildings' Sign Plan: Goal 1: Establish standards which permit businesses a reasonable and equitable opportunity to advertise their name and service. The Medical Arts Buildings are held to a letter size standard significantly smaller than any other development within the city. The difficulty that various tenants have faced meeting this standard has led to the city granting exceptions on a case-by-case base. This leads to confusion as some businesses feel they are held to a different standards than other tenants within the building. The proposed amendment would create a uniform standard met by all existing signs, and which can be met by future tenants. Goal 2: Preserve and promote civic beauty, and prohibit signs which detract from this objective because of size, shape, height, location, condition, cluttering, or illumination. Medical Arts Building Planning Case 2017-17 September 5, 2017 Page 6 of 6 Signs of up to three feet in height, the limit proposed in the amendment, are currently present on the Phase I building. They appear appropriately scaled and have not generated any complaints from residents. Signs with 18 inch letters are currently present on the on the Phase II building. They appear appropriately scaled and have not generated any complaints from residents. While the amendment would allow for larger letters, it would retain the existing two -foot two-inch sign band size for the Phase lI building. Staff does not believe that allowing larger letters would detract from the civic beauty of the building or downtown. Goal 3: Ensure signs that are in proportion to the scale of, and are architecturally compatible with, the principle structures. The Phase I building is primarily a two level structure whereas the Phase II building is primarily a single level structure. Due to the increased facade area of the Phase I building, the visual impact of a three-foot sign is different than it would be for the shorter Phase II building. For this reason staff believes it is appropriate to establish different sized sign bans for the buildings. The proposed distinction is similar to what existed before the 2014 sign plan amendment applied the Phase II criteria to both buildings. RECOMMENDATION Staff believes that the proposed sign plan amendment is in line with the relevant goals of the City's Sign Code, and staff recommends the Planning Commission adopt the following motion: "The Chanhassen Planning Commission recommends that City Council approve the attached Sign Plan Criteria for Medical Arts Buildings Phase I and II; and adoption of the attached Findings of Fact and Recommendation." Should the Planning Commission recommend denial of the proposed sign plan amendment, it is recommended that the Planning Commission adopt the following motion: "The Chanhassen Planning Commission recommends that City Council deny the attached Sign Plan Criteria for Medical Arts Buildings Phase I and II; and adoption of the attached Findings of Fact and Recommendation." PUBLIC HEARING: 470480 WEST 78TH STREET — MEDICAL ARTS BUILDINGS: SIGN PLAN REVIEW TO AMEND CURRENT BUILDING SIGN PLAN TO CONCUR WITH CITY STANDARDS. Aanenson: Thank you Chairman, members of the Planning Commission. I indicated to you that I did pass out a slight change and I'll go through this amendment but the, this item does require because it's a site plan amendment and we have a lot of different, we have a variance on layer but a site plan amendment does requirement approval because it's actually like a rezoning. We're changing the terms of it so this will have to go to the City Council for final approval but the applicant, Mason McClellan, owner of Chanhassen Medical Arts is requesting a change to the two different buildings located on what we call the Medical Arts Building, Phase I and Phase H. It's zoned Business Highway and there's a percentage of wall fagade that can be used so they are, again they're located just to the east of where we are today on West 781' Street. So the existing sign band on Phase I and II was, when this building was put into place was very narrow in scope and the fact that there's a designated sign band. Then there was a minimum for letters. There's also a maximum for logo and the signs were intended to be on the front and back of the building. Originally there was more office in there and now there'd be kind of some quasi type uses in there. Maybe kind of more retail or medical office and some professional things like MacPhail Center is also in there so they've been looking at the different, the criteria of the sign band again which was put in place a number of years ago so in looking at the two different buildings, trying to keep the band at the same width between the two. Looking at our overall sign ordinance and trying to be consistent with that. We'd like to, as requested here and what we've looked at, you can see in the staff report where we did a summary. MacKenzie had looked at some of the surrounding uses in the area to see how we're being treated and making sure that these are being treated similarly. So on Phase I there was the 3 foot designated and then on this one we changed it. There was a 2.2 in there. We want to both be at the 3 foot and that would be consistent so when you're looking across that band that that width is the same across both buildings and not have a narrower penalized one so the maximum footage, square footage is still restricted to the band on the building so you can see where there's existing bands. The main criteria then is the lettering so with 3 feet you could have two rows of lettering which some of them do. You can also have the logo. There was restrictions originally on the size of the logo but as long as it stays within that band we're going to allow that to move forward. So you can see the 12 inch maximum letter size is smaller than other similar properties allowed in the city and the 14 that we looked at, 8 didn't meet current ordinance. The largest sign in Phase I is 3 3 Chanhassen Planning Commission — September 5, 2017 feet high with the 21 inch letters. Prior to 2014 portions of the Phase I were allowed 3 foot so over time as we've had different people reviewing those there's been a little bit of interpretation. Generous interpretation so to make everybody whole we are agreeing that the sign band, to make it 3 feet across both buildings and we think that's reasonable. Again that's the front and the back. You can see here now where you've got the MacPhail and then some of the dental offices and the like to be consistent so up in this area you can see where it's the much narrower band, the 12 inch letter. I know it's kind of hard to read that on there but so this is being requested by someone that wants to put a larger band on there. So with that we think it makes sense. We are recommending the 3 foot band. So if you look at the attachment that I handed out, that's what you'll be adopting. That will be the new sign criteria for both buildings so again we want to change it to their consistency so that'd be on Phase II as shown in bold. Where it says 2 feet we're changing that to 3 feet, the band so they'd be consistent between the two buildings. So with that this is a public hearing and I'd be happy to take any questions that you have. Aller: Any questions at this time for staff? Commissioner Weick. Weick: Just for clarification. The sign band on both Phase I and Phase H of the buildings would roughly be the same height relative to the ground. Aanenson: That's a great question. Yep they are pretty much the same height, yep. Weick: So it's kind of a consistent eye line. Aanenson: Yeah and that was one of our goals in looking at this is, unfortunately I didn't catch this before it got written the difference between the two but I think it's good to have it consistent on your eye. The visual part of it. Weick: And then, can I have one more question? Aller: Of course. Weick: On page, well on either page I guess. You know on the handout where it says b(1). Is that consistent to have the building on the monument sign not to have tenant identification but only to have, I assume it's just the address of the building. Is that normal? Aanenson: Well that's what we did on this one. Weick: Okay. Aanenson: It's not the normal. On this one I think we tried to, not all those tenants can get on there so it's kind of a, it can be a leasing thing too and then it gets some confusion so really the goal there was to get identification that you know where you are. This is the Medical Arts Building. 4 Chanhassen Planning Commission — September 5, 2017 Weick: Okay. Aanenson: So if you're a person that you're going to says I'm in that Medical Arts Building then you know where to find it. They may just have a sign on the back. Weick: Okay. And are the, and I'm sorry if I'm getting too detailed but is the address for the entire building, like for instance the one story one I think says 480 or something on there. Aanenson: I think there are just suites on the inside. Weick: So is it like 480 and then Suite 200 or whatever? Aanenson: Yeah, somebody... yep. There are suites, yeah. Weick: I just want to make it easy for people to find it. Aanenson: Nope but that's why you would say 480 would be the identifier on there. Weick: Right. Aanenson: And there'd be suites on the inside. Weick: Your GPS would take you there and then it would. Aanenson: Correct, correct. Weick: Okay, thank you. Aller: Great, thank you. Commissioner Madsen. Madsen: And I just want to confirm that so these proposed changes would just make the sign more consistent with the existing city's sign code, is that correct? Aanenson: Correct, yep. Yep. Madsen: Thank you. Aller: Okay. So at this point in time would the applicant like to come forward or is the City the applicant on this? Aanenson: Nope. There's someone here that would probably like to speak to it. 5 Chanhassen Planning Commission — September 5, 2017 Aller: So if the applicant would like to come forward at this time they can choose to make a presentation or not. Mason McClellan: Yep. 1 recently moved in and the MacPhail Center obviously they're up there and it didn't occur to me that there was a difference since I've had my sign in the city for the last 8 years and now moving it's been a little. Aanenson: If you can go to the microphone and talk. Mason McClellan: Sorry, and moving has been a little trickier than I had anticipated but MacKenzie was kind enough to work with me and he just said I should be here and if you guys had any questions for me, here I am. Aller: Alright, this is a request that was before the public so we will have a public hearing and I'll open the public hearing at this point in time so any individual that's present can come forward and speak either for or against the item before us. I think it's nice that it's going to be consistent with both Phase I and Phase II so it will add to that so. Aller: I agree. When we do a lot of these projects, especially in the downtown area and when we like to get, I know I like to get PUD's because we can usually squeeze a little bit more value out for the city as a whole and community and we can tweak things but here when we're talking about signage and the capability to see what's out there. We want people to shop and stop and provide services and receive services here in the city and you can't do that if you don't know that Chanhassen Planning Commission — September 5, 2017 they're there so the consistency in the signage I think is important. Moving onto our second public hearing. PUBLIC HEARING: 20 HILL STREET: VARIANCE FOR A GARAGE ADDITION WITHIN THE FRONT YARD SETBACK. Aller: For the record we received a couple of attachments to the application package that was previously received and those consist of several emails and if you could address those during the presentation that would be great. They are being read and considered and are being made part of the package. Aanenson: Thank you Chairman, members of the Planning Commission. So this item too unless it's appealed would stop here. Otherwise it would go to the City Council also on the 25th so there's a number of days to appeal this decision. So the applicant, Sather Design Build, on behalf of Steven and Beth McAuley are requesting a variance to expand their garage. The house is located on 20 Hill Street. It is zoned residential single family. It's 15,000 square foot minimum lot area, 30 in the front, 10 on the sides, 25 percent hard cover, 75 foot lake setback and the 30 foot bluff setback. So the house is steep towards the back and you can see the change in grade. It does have a 22.7 percent lot coverage. It meets the setback. The house was built in 1961 with a 25.5 front yard setback. (Note: A motion for denial and associated Findings of Fact and Decision is also attached to this report.) City Council approval requires a simple majority vote. EXECUTIVE SUMMARY The Chanhassen Medical Arts buildings (470 and 480 West 781i Street) are requesting an amendment to their sign plan in order to remove provisions respectively limiting the size of letters and logos to a maximum of 12 inches and 24 inches, and to increase the height of the sign band from 26 inches to 36 inches. The letter and logo restrictions outlined in the Medical Arts Buildings' sign plans are significantly more restrictive than those imposed on other developments in the city. Throughout the project's history, the sign plan has been repeatedly amended and exceptions have been made to permit signage with larger letters. The largest sign currently present within the development is 36 inches tall with 21 -inch high letters. The proposed amendment would ensure equity between tenants within the development by limiting the height of all signage to the tallest existing sign. The overall size of signs would still be limited by the city's general provisions limiting the square footage of signage to a percentage of the building's fagade area. Given that a 36 -inch tall sign is already present, staff does not believe this change will negatively impact the aesthetics of the building. PLANNING COMMISSION SUMMARY The Planning Commission held a public hearing on September 5, 2017 to review the proposed sign plan amendment. No members of the public spoke for or against the proposal. Commissioner Weick requested clarification of the proposed height of the bands and questioned the reason behind the restrictions on the monument sign. Community Development Director Aanenson clarified that both bands would have a height of three feet and that the monument provision was pre- existing and the result of the development's orientation towards office uses. The Planning Commission voted unanimously 5-0 to recommend approval of the variance request. The Planning Commission minutes of September 5, 2017 are included in the consent agenda of the September 25, 2017 City Council agenda. Should the City Council choose to deny the proposed sign plan amendment, staff recommends that the City Council adopt the following motion and attached Findings of Fact and Decision: "The Chanhassen City Council denies the attached Sign Plan Criteria for Medical Arts Buildings Phase I and II; and adopts the attached Findings of Fact and Decision." If it meets these standards, the city must then approve the site plan. This is a quasi-judicial decision. Notice of this public hearing has been mailed to all property owners within 500 feet. Medical Arts Building Planning Case 2017-17 September 5, 2017 Page 2 of 7 PROPOSAU/SUMMARY The applicant is requesting an amendment to the sign criteria for the Medical Arts Buildings Phases I and II. The current sign plan specifies that signs are only allowed within a continuous two -foot two-inch high band near the roofline for both buildings. Signs within the band are limited to letters up to 12 inches in height and logos up to 24 inches in height. The applicant is requesting that the sign plan be modified to specify a three-foot high sign band forthe ase4 Wildift and to remove the letter and logo size restrictions for be&the buildings. They believe that approving this amendment would make the buildings' sign plan consistent with the City's Sign Code, which does not specify maximum letter or logo sizes, and with the city's general practice of regulating sign placement through sign bands and sign size to a certain percentage of the building's fagade. The applicant has also noted that several signs currently located in the development exceed the size requirements specified by the building's sign criteria. The proposed changes would encompass the existing signs and create uniform standards for both existing and incoming businesses. APPLICABLE REGULATIONS Chapter 20, Article H, Division 6, Site Plan Review Chapter 20, Article XXVI. — Signs BACKGROUND General: On May 22, 1989, the City Council approved the preliminary plat and site plan application for the Medical Arts Buildings. The site plan review was approved with two buildings to be built in two phases. Phase I building was completed in 1990 and Phase II was constructed in 1996. Due to the size of the building, the small street setback, and the potential number of offices within the building, the city wanted to insure a detailed sign plan was in place. The original sign plan limited the number of signs within a designated strip as well as the color, lighting, sign band size, maximum letter size, and maximum logo size. The original restrictions were created based on an understanding that building was to contain medical offices with low advertising needs. Phase I On May 22, 1989, the City Council approved a sign plan. It is not clear exactly what was approved. On May 30, 1990 The City Council amended, the sign plan to clarify that a maximum of 10 signs, five on each facade would be permitted; the one sign per -tenant restriction was removed. This was done to reconcile the difference in the site plans dated April 14, 1989 and April 18, 1989. The April 18, 1989 plan appears to show a two -foot high sign band. On July 11, 1991, the City Council amended the sign plan to clarify that the south middle area of the building, defined as the area between the two projecting porticoes, allowed signs of up to three feet in height, with letters not to exceed 12 inches in height. Up to three signs were permitted in this area. The rest of the building was limited to nine signs, five north and four south, not to exceed two feet 2 inches in height and 24 feet in width with letters not to exceed 12 inches in height. Phase II On October 12, 1992, the City Council approved a sign plan for the Phase II building. This sign plan limited signs to a two -foot two-inch high sign band and limited letters to 12 inches in height and logos to 24 inches in height. The sign plan also limited the development to a total of 14 signs. On April 1, 1996, staff received a letter from Vernelle Clayton requesting that an exception be made to the 24 inch sign and logo space restriction in order to accommodate a tenant moving an existing Phase I sign to the Phase H building. At the time, the Phase I sign plan allowed for three-foot signs in the middle section. On June 26, 1996, a permit was issued allowing the sign to be relocated with its existing dimensions. Phase 1 and II On December 8, 2014, the existing sign plans were amended to remove the provisions limiting the number of signs allowed on each building. The rational for removing this provision was that the city typically restricts the proliferation of signs using sign bands and square footage limits, rather than per -building limits on the number of signs. At this time the Phase H sign criteria where adopted for both buildings, effectively removing the three-foot exception for the middle sign area in the Phase I building and confining all signage to the two -foot two-inch sign band. Medical Arts Building Planning Case 2017-17 September 5, 2017 Page 4 of 7 ANALYSIS The city's general sign ordinance attempts to balance the advertising needs of businesses with the potential visual nuisance that can be created by unrestricted signage. The city does this by limiting the maximum square footage of signage to a sliding percentage of a building's fagade, and by requiring buildings to submit a site-specific sign plan as part of their site plan review. Multi -tenant commercial buildings are required to designate a sign band or bands, either conceptually or with specific dimensions, and, in some cases, restrictions are placed on the maximum height of letters and logos. In the case of the Medical Arts Buildings, the sign plan designated a two -foot two-inch area near the roofline as the sign band and illustratively depicted the band. In addition to restricting signage to the sign band, the sign plan limits letters to 12 inches in height and logos to 24 inches in height. Of the 29 sign plans that staff examined, no other sign plan limits signs to a 12 inch maximum letter size. About half of sign plans do not limit letter size. Restricting the letters on the Medical Arts Building to a maximum height of 12 inches is stricter than the limits placed on similar developments in the city. aif,• The letter and band requirements have been difficult for numerous tenants to meet. Of 14 sign permits, current and historic, that staff was able to find, eight did not comply with either the letter or band size restrictions. The largest sign approved was three feet in height with 21 inch letters and is still present on the building. Other signs were approved with total heights of three feet, 30 inches, and two -foot nine - inches, despite the sign band's two -foot two-inch height limit. Regarding letter size, several signs with letters between 15 inches and 21 inches have been approved. In some cases, variances or amendments to the sign plan were made to accommodate these signs. The acupuncture sign which the applicant wishes to relocate to the Phase I building has 28 inch high letters. Historically, portions of the Phase I allowed three-foot high signs, though with 12 inches high letters, and, as noted above, exceptions to the sign plan have been made to accommodate larger signs in other locations. Medical Arts Building Planning Case 2017-17 September 5, 2017 Page 5 of 7 Medical Arts Building Phase 11 (2016 Google Street View) PT r Three goals of the City's Sign Code are relevant to the proposal to amend the Medical Arts Buildings' Sign Plan: Goal 1: Establish standards which permit businesses a reasonable and equitable opportunity to advertise their name and service. I. The Medical Arts Buildings are held to a letter size standard significantly smaller than any other development within the city. The difficulty that various tenants have faced meeting this standard has led to the city granting exceptions on a case-by-case base. This leads to confusion as some businesses feel they are held to a different standards than other tenants within the building. The proposed amendment would create a uniform standard met by all existing signs, and which can be met by future tenants. Goal 2: Preserve and promote civic beauty, and prohibit signs which detract from this objective because of size, shape, height, location, condition, cluttering, or illumination. They appear appropriately scaled and have not generated any complaints from residents. Signs with 18 inch letters are currently present on the on the Phase II building. Staff does not believe that allowing larger letters and logos would detract from the civic beauty of the building or downtown. Goal 3: Ensure signs that are in proportion to the scale of, and are architecturally compatible with, the principle structures. The city ensures that signs are of appropriate scale by limiting the percentage of the building's faVade that they can cover. These general provisions are sufficient to ensure that the buildings do not have excessively large signs. Other buildings of similar height in the city have three-foot tall signs and an existing sign on the Phase I building is three feet in height and does not overwhelm the building. RECOMMENDATION Staff believes that the proposed sign plan amendment is in line with the relevant goals of the City's Sign Code, and staff recommends the Planning Commission adopt the following motion: "The Chanhassen Planning Commission recommends that City Council approve the attached Sign Plan Criteria for Medical Arts Buildings Phase I and II; and adoption of the attached Findings of Fact and Recommendation." We want to update the 470/480 building standard to city standards that does not arbitrarily restrict letter size to 12 inches. This will allow signs both currently and proposed for the building to conform to Chanhassen's current standards. Thus allowing the "MacPhail" sign to conform to city norms and allow the "Acupuncture" sign (which has been used in Chanhassen for the last 8years). We still want to maintain the integrity and visual appeal of Chanhassen as building owners. But this will allow us the flexibility to support our businesses and their sign's and logo's and future considerations. PROPOSAU/SUMMARY The applicant is requesting an amendment to the sign criteria for the Medical Arts Buildings Phases I and II. The current sign plan specifies that signs are only allowed within a continuous 2'2" high band near the roofline for both buildings. They believe that approving this amendment would make the buildings' sign plan consistent with the City's Sign Code, which does not specify maximum letter or logo sizes, and with the City's general practice of regulating sign placement through sign bands and sign size to a certain percentage of the building's fagade. The applicant has also noted that several signs currently located in the development exceed the size requirements specified by the building's sign criteria. The proposed changes would encompass the existing signs and create uniform standards for both existing and incoming businesses. APPLICABLE REGULATIONS Chapter 20, Article II, Division 6, Site Plan Review Chapter 20, Article XXVI. — Signs BACKGROUND General: On May 22, 1989, the City Council approved the preliminary plat and site plan application for the Medical Arts Buildings. The site plan review was approved with two buildings to be built in two phases. Phase I building was completed in 1990 and Phase II was constructed in 1996. A a d7 ' Part of the site plan approval included a sign plan. Due to the size of the building, it small street setback, and the potential number of offices within the building, the City wanted to insure a detailed sign plan was in place. The original sign plan limited the number of signs within a designated strip as well as the color, lighting, sign band size, maximum letter size, and maximum logo size. The original restrictions were created based on an understanding that building was to contain medical offices with low advertising needs. Phase I On May 22, 1989, the City Council approved a sign plan. It is not clear exactly what was approved. On May 30, 1990 The City Council amended, the sign plan to clarify that a maximum of 10 signs, five on each facade would be permitted; the one sign per -tenant restriction was removed. This was done to reconcile the difference in the site plans dated April 14, 1989 and April 18, 1989. The April 18, 1989 plan appears to show a 2' high sign band. On July 11, 1991, the City Council amended the sign plan to clarify that the south middle area of the building, defined as the area between the two projecting porticoes, allowed signs of up to 3' in height, with letters not to exceed 12" in height. Up to three signs were permitted in this area. The rest of the building was limited to 9 signs, 5 north and 4 south, not to exceed 2' in height and 24' in width with letters not to exceed 12" in height. Phase II On October 12, 1992, the City Council approved a sign plan for the Phase II building. This sign plan limited signs to 27" high sign band and limited letters to 12" in height and logo's to 24" in height. The sign plan also limited the development to a total of 14 signs. On April 1, 1996, staff received a letter from Vemelle Clayton requesting that an exception be made to the 24" sign and logo space restriction in order to accommodate a tenant moving an existing Phase I sign to the Phase I1 building. At the time, the Phase I sign plan allowed for 3' signs in the middle section. On June 26, 1996, a permit was issued allowing the sign to be relocated with its existing dimensions. Phase I and II On December 8, 2014, the existing sign plans were amended to remove the provisions limiting the number of signs allowed on each building. The rational for removing this provision was that the City typically restricts the proliferation of signs using sign bands and square footage limits, rather than prebuilding limits on the number of signs. At this time the Phase H sign criteria where adopted for both buildings, effectively removing the 3' exception for the middle sign area in the Phase I building and confining all signage to the 27" sign band. ANALYSIS The City's general sign ordinance attempts to balance the advertising needs of businesses with the potential visual nuisance that can be created by unrestricted signage. The City does this by limiting the maximum square footage of signage to a sliding percentage of a building's facade, and by requiring buildings to submit a site-specific sign plan as part of their site plan review. Multi -tenant commercial buildings are required to designate a sign band or bands, either conceptually or with specific dimensions, and, in some cases, restrictions are placed on the maximum height of letters and logos. In the case of the Medical Arts Buildings, the sign plan designated a 2'2" area near the roofline as the sign band and illustratively depicted the band. In addition to restricting signage to the sign band, the sign plan limits letters to 12" in height and logos to 24" in height. Of the 29 sign plans that staff examined, no other sign plan limits signs to a 12" maximum letter size. About half of sign plans do not limit letter size. The 12" letter requirement has been difficult for numerous tenants to meet. Of 8 existing signs on the south examined by staff, 4 comply with 12" letter standard and 4 do not. The largest sign is 3' in height and has a maximum letter size of 21". Two other signs had 18" high letters, and one sign had 14" high letters. The acupuncture sign which the applicant wishes to relocate to the Phase I building has 28" high letters. Historically, portions of the Phase I allowed 3' high signs, though with 12" high letters, and exceptions to the sign plan have been made to accommodate larger signs in other locations. Medical Arts Phase 1(2016 Google Street Vie11) Medical Arts Building Phase U (2016 Google Street View) Three goals of the City's Sign Code are relevant to the proposal to amend the Medical Arts Buildings' Sign Plan: Goal 1: Establish standards which permit businesses a reasonable and equitable opportunity to advertise their name and service. The Medical Arts Building is held to a letter size standard significantly smaller than any other development within the City. The difficulty that various tenants have faced meeting this standard has led to the City granting exceptions on a case-by-case base. This leads to confusion as some businesses feel they are held to a different standards than other tenants within the building. The proposed amendment would create a uniform standard met by all existing signs. Goal 2: Preserve and promote civic beauty, and prohibit signs which detract from this objective because of size, shape, height, location, condition, cluttering, or illumination. Signs of up to 3' in height, the limit proposed in the amendment, are currently present on the Phase I building. They appear appropriately scaled and have not generated any complaints from residents. Signs with 18" letters are currently present on the on the Phase II building. They appear appropriately scaled and have not generated any complaints from residents. While the amendment would allow for larger letters, it would retain the existing 2'2" sign band size for the Phase I1 building. Staff does not believe that allowing larger letters would detract from the civic beauty of the building or downtown. Goal 3: Ensure signs that are in proportion to the scale of, and are architecturally compatible with, the principle structures. The Phase I building is primarily a two level structure whereas the Phase H building is primarily a single level structure. Due to the increased facade area of the Phase I building, the visual impact of a 3' sign is different than it would be for the shorter Phase II building. For this reason staff believes it is appropriate to establish different sized sign bans for the buildings. The proposed distinction is similar to what existed before the 2014 sign plan amendment applied the Phase I1 criteria to both buildings. RECOMMENDATION Staff believes that the proposed sign plan amendment is in line with the relevant goals of the City's Sign Code, and staff recommends the Planning Commission adopt the following motion: "The Chanhassen Planning Commission recommends that City Council approve the attached Sign Plan Criteria for Medical Arts Buildings Phase I and II; and adoption of the attached Findings of Fact and Recommendation." We want to update the 470/480 building standard to city standards that does not arbitrarily restrict letter size to 12 inches. This will allow signs both currently and proposed for the building to conform to Chanhassen's current standards. Thus allowing the "MacPhail" sign to conform to city norms and allow the "Acupuncture" sign (which has been used in Chanhassen for the last 8years). We still want to maintain the integrity and visual appeal of Chanhassen as building owners.
