At its meeting on January 24, 2007, the Metropolitan Council reviewed the City's CPA, based on
the staff report. The amendment reguides CPA proposes to change the City's land use
designations for 11 parcels that are single-family residences on large lots and presently without
public sewer and water. The total area is 37.22 acres, of which 6.23 acres are in wetlands. The
net buildable upland area is 30.99 acres.
The Council found that the CPA conforms to the regional system plans for transportation,
wastewater, and parks, is consistent with the 2030 Regional Development Framework and
Council policies, and is compatible with the plans of adjacent jurisdictions. Therefore, the City
may place the CPA into effect.
A copy of the staff report to the Council is attached for your records. The Council will append
the amendment, submission form and supplemental information to the City's plan in the

BACKGROUND
Chanhassen is located in eastern Carver County, surrounded by the cities of Eden Prairie and Shorewood
(Hennepin County), Chaska and Victoria (Carver County), and Shakopee and Jackson Township (Scott
County).
Chanhassen's 2020 Comprehensive Plan (Review No. 16500-4) was reviewed by the Council on June 9,
1999. In 2000, the City had 20,321 residents in 6,914 households and 8,501 jobs. By 2030, the City is
expected to have 38,000 residents in 14,800 households, and 15,600 jobs.
The Council's 2030 Regional Development Framework (RDF) identifies Chanhassen as a "developing
community." As a developing community, Chanhassen should plan and stage development that
accommodates the forecasts for local growth through 2030 at net densities of 3-5 units plus per acre.
The City is connected to the Metropolitan Disposal System (MDS) with treatment occurring at the Blue
Lake Wastewater Treatment Plant.
Since 2000, the Council has reviewed 13 comprehensive plan amendments (CPA).
REQUEST SUMMARY
The City of Chanhassen submitted the Ches Mar Farm comprehensive plan amendment (CPA), to correct a
land use mapping error. The existing 37 -acre Ches Mar Farm has 11 parcels with six single-family homes.
(Figures 1 and 2) While the area is within the Metropolitan Urban Service Area (MUSA), none of the
parcels have municipal sewer or water.
The CPA proposes to correct the intended guiding. The City proposes to correct the guide plan to show the
parcels as "low-density" residential reflecting their present single-family use. Ten of the parcels are guided
as "medium -density" residential. One parcel is guided as Public/Semi-Public. Chanhassen proposes to
correct the guide plan to show the 11 parcels as "low-density" residential reflecting the existing single-
family use.
PROPOSED ACTION
Staff recommends that the Metropolitan Council:
Allow the City to put the comprehensive plan amendment into effect with no modifications.

REGIONAL SYSTEMS

The proposed CPA is in conformance with the regional parks system, and will not impact regional parks
and trails. The CPA is adjacent on the south boundary of Lake Minnewashta Regional Park. .
Transportation (Ann Braden, Senior Planner, 651-602-1705)
The proposed CPA is in conformance with the regional transportation system and will not impact the
regional transportation system. The Ches Mar Farm subdivision is immediately west of Hazeltine Blvd,
about 1600 feet north of Hwy 5.
Water Resources Management (Kyle Colvin, P.E., Asst. Manager, Engineering and Planning, MCES,
651-602-1151)
The proposed CPA is in conformance with the regional water resources management system and will not
impact the regional wastewater system. The Council has adequate regional sewer capacity to serve the
Ches Mar Farm properties. Chanhassen is on the Council's list of communities with I/I problems and the
Surcharge List for 2007. The City's System Statement has an identified IR Goal. Chanhassen has
acknowledged the surcharge and submitted a work plan to identify and mitigate excessive M from the
local system.

REGIONA POLICIES
Housing (Linda Milashius, Planner, 651-602-1541)
The proposed CPA is consistent with Council housing policy. Because there are no forecast changes to
population and housing, the City's share of affordable housing remains the same.
Surface Water Management (Jim Larsen, Senior Planner, 651-602-1159)
The CPA is consistent with the Council's surface water management policies. Surface water in the City of
Chanhassen is managed by the Carver County Watershed Management Organization, and the Lower
Minnesota River and Riley -Purgatory Bluff Creek Watershed Districts. The Carver County watershed
plan was approved by the Board of Water and Soil Resources (BWSR) in 2001. The Lower Minnesota
River and Riley -Purgatory Bluff Creek watershed plans were approved by BWSR in 1999 and 1997
respectively. Chanhassen updated its plan in the spring of 2006.
Water Supply (Sara Bertelsen, Planner, 651-602-1035)
The proposed CPA is consistent with Council water supply policy. The Council is in the process of
reviewing Chanhassen's 2006 Water Supply and Emergency & Conservation Plan update.
2030 Regional Development Framework (Jim Uttley, AICP, Planning Analyst, 651-602-1361)
Chanhassen's 2020 Comprehensive Plan Update (CPU) reviewed by the Council on June 9, 1999,
proposed 1,199 net acres of MUSA expansion at an overall density of 3.1 units per net acre. The Ches
Mar Farm CPA land was in the Stage I MUSA staging area (2000-2005).
The City's intent in the CPA is to correct a mapping error from the 2020 CPU. The City's plan shows the
southern -most parcel of 2.3 acres as public/semi-public. (Figure 2) It is used as single-family residential
and its present land use designation makes the property non -conforming. This means that if the house
was destroyed by a fire or other cause, it could not be reconstructed. The City intended for the parcel to
be shown on the land use plan map as low-density residential (future urban/sewered) land use category
having a density range of 1.2-4 units per net acre.
The remainder of the parcels are currently shown as medium -density residential. (Figure 2) The existing
uses are 5 large -lot single family houses. The City intended for the parcels to be shown on the land use
plan map as low-density residential land use category having a density range of 1.2-4 units per net acre.
If the Ches Mar Faun properties had been correctly shown in the City's 2000 CPU, the plan's density
would have been reduced from 3.1 to 3.01 units per net acre. This would still have met the Council's
policy of 3 units per net acre overall for residential development. As a participant in the Council's Plat
Monitoring Program, the City reported platting between 2000 and 2005, a total of 340 net acres adding
1,409 dwelling units for an overall density of 4.1 units per net acre.
Consistency with the Council's 2030 Forecasts (Jim Uttley, Planning Analyst, 651-602-1361)
The City's forecasts are consistent with the Council's forecasts. The CPA will not change the City's
forecasts.

The Metropolitan Council received the Chesmar Farms CPA on July 10, 2006. The CPA
proposes to change the City's land use designations for 11 parcels that are single-family
residences on large lots without public sewer and water.
One of the properties, Dyvig property (7250 Hazeltine Blvd) is 2.54 acres and was shown on the
City's existing land use map as Public/Semi-Public. It is used as a single-family residence and
the City proposes to reguide it as "low-density' residential (1.24 units/acre net).
The remainder of the Chesmar Farms area consists of 10 parcels -of -record having 6 property
owners and residences. These parcels total approximately 33.7 acres and are shown in the
existing plan as "medium -density" residential (4-8 units/acre net). The City is requesting to
reguide the parcels to "low-density' residential (1.24 unitstacre net).
Council staff finds that the proposed plan amendment is incomplete as submitted. It raises
potential wastewater system issues and density policy issues, which require additional
information.
Additional information addressing the following is requested:
• Is the Chesmar Farms property proposed for reguiding inside the City's existing MUSA?
Is municipal sewer in Hazeltine Blvd adjacent to the Chesmar Fames properties? If sewer
is available, what - if anything - is preventing the extension of sewer service to the
properties? Does the City have time requirements for hooking up to sewer when it is
available?
Given the low density of the properties on average 0.19 units/acre, the households would appear
to be non -conforming uses in terms of both the existing and the proposed new plan designations.

There are several areas in the City that appear to be planned as "residential -large lot" (2.5 acres
minimum 1/10 outside of MUSA) but fall within the City's designated 2000 MUSA. It appears
to Council staff that this designation (residential large lot) would be consistent with the existing
use of the properties and result in substantially fewer non -conforming properties.
Council policy establishes an overall minimum density of 3-5 plus units per acre for MUSA
expansions. The Council's MUSA Expansion Guidelines require staff to use the minimum
density of each residential land use to determine the impacts of proposed land use changes on
overall community densities.
In applying this formula to the current CPA proposal, the overall density for the City as a whole
falls substantially below the 3 units/acre standard to an average net density of 2.6 units per acre
(see Table attached). Council staff is concerned about the City's future ability to meet density
standards. Since 2003, the City has approved 19 plats of which only 3 have had net densities in
excess of 3 units/acre. The average net densities for the years 20003, 2004 and 2005 have been
1.93, 2.1 and 2.37 units per acre respectively. Will the City be able to meet the Council's density
policy with respect to the parcels added to the MUSA?
In addition, Council staff brings the following advisory comments to your attention. These are
not completeness issues at this time.
Surface Water Management (Jim Larsen, P.E., Senior Planner, 651-602-1159)
Surface water management in the City of Chanhassen is overseen by the Carver County
Watershed Management Organization (WMO), and the Lower Minnesota River, Riley -Purgatory
Bluff Creek and Minnehaha Creek Watershed Districts. The Carver County WMO plan was
approved by the Board of Water and Soil Resources (BWSR) in 2001. The Lower Minnesota
River, Riley -Purgatory Bluff Creek and Minnehaha Creek watershed plans were approved by
BWSR in 1999, 1997, and 1997 respectively. Chanhassen was required to update its local
surface water management plan by the end of 2004. The City indicated earlier this year that it is
currently working on the update of its local plan and expects to have a completed draft this
summer. The draft plan should be submitted to the Council for its review concurrent with the
review by the four watershed management organizations.
Water Supply (Sara Bertelsen, Environmental Planner, 651-602-1035)
As a reminder, the City will need to submit their Water Supply and Emergency & Conservation
Plan update to the Council and Minnesota Department of Natural Resources (DNR) by October
15, 2006, in accordance with the DNR's April 28, 2005 guidance letter to the City. Timely
submission of the plan element update will insure any future water appropriation permit requests
or Comprehensive Plan Amendment submissions from the City will not experience unnecessary

Staff discovered inconsistencies between the "City of Chanhassen 2020 Land Use
Plan" and the existing and potential uses on the subject property. Staff is
proposing to process a land use plan amendment to re -guide the property from
Public/Semi-Public and Residential -Medium Density (Net Density Range 4-8
units/acre) to Residential -Low Density (Net Density Range 1.2-4 units/acre).
This land use plan amendment will make the existing and/or potential uses
consistent with the land use plan.
BACKGROUND
On July 8, 1991, the City Council approved Comprehensive Plan Amendment
#91-1 changing the Land Use Designation of the property shown in vertical lines
from Residential Medium Density to Residential Low Density (see page 2 of
attached letter dated August 19, 1991). The land is occupied by single-family
homes. The site density is 0.9 units per acre. Staff is unsure why this change was
never reflected on any land use map.
The second area, guided Public/Semi Public, is actually private property occupied
by a single-family home. Staff suspects that when Camp Tanadoona was guided
Public/Semi Public, the land use designation was inadvertently extended to the
east to include the private property occupied by the single-family home.

RECOMMENDATION
Staff is recommending the Planning Commission adopt the following motion:
"The Planning Commission recommends approval of reguiding all the highlighted
property shown in the attached Exhibit A from Residential Medium Density and

acre)."

8. Demolition permits are required for all demolition; demolition
of all the buildings to be razed shall be completed within 6
months of final plat approval.
9. A revised preliminary plat shall be submitted showing all
existing and proposed on-site sewage treatment sites and
proposed house pads and elevations.
10. If a new residence is constructed on Lot 4, Block 1, it must
meet all required setbacks. All other existing buildings on
Lot 4 must be razed.

Use Permit #91-4 and Wetland Alteration Permit #91-1.
12. A tree preservation plan shall be submitted by the applicant
for city approval for Lot 1, Block 1.

1. - The recreational beachlot will be permitted only one dock with
overnight storage of up to 3 watercraft.
2. Launching of boats from the recreational beachlot is
prohibited.
3. The conditional use permit for the recreational beachlot is
only for the proposed dock improvements. Any additional
improvements to the recreational beachlot shall require
another conditional use permit and wetland alteration permit.

Wetland Alteration Permit #91-1 for construction of a permanent
boardwalk through a Class A wetland as shown on plans dated May 28,
1991, with the following conditions:
1. There shall be no filling or dredging/grading permitted with
.in the wetlands.
2. The applicant shall receive a permit from the Department of
Natural Resources for the permanent boardwalk.
3. The proposed trail shall be constructed at least 10 feet away
from the wetland located in the southwest corner on Outlot A.
4. The wetland shall be permitted to return to its natural state
after installation of the boardwalk.
5. No other alteration to the wetlands are permitted without
receiving another wetland alteration permit. Further, all
approved alterations shall be undertaken at a time and in a
manner so as to minimize disruption to the wetland.
6. The applicant shall meet any.and all conditions of the PUD
Amendment #91-1.and Conditional Use Permit #91-4.

The Metropolitan Council received the Ches Mar Farm CPA on July 10, 2006. The CPA proposes to
change the City's land use designations for 11 parcels that are single-family residences on large lots and
presently without municipal sanitary sewer and water. The total area is 37.22 acres, of which 6.23 acres
are in wetlands. There are 30.99 net buildable acres according to the City's analysis.
On July 27, 2006, Council staff found that the proposed plan amendment was incomplete as submitted. It
raised potential wastewater system and density policy issues requiring additional information. On
September 29, Chanhassen staff provided supplemental information to the Council. The supplemental
information has been evaluated and the plan amendment is now considered complete for review.
This CPA will need to go to the Community Development Committee (CDC) and Council for formal
action. The Council has 60 days to complete its review with the option of extending the period for an
additional 60 days. The initial 60 -day review period ends on November 28, 2006. However, because of
the Thanksgiving holidays, it appears that the CPA will go to the CDC for action in November and to the
Council for action in December. For this reason, the Council is exercising its option at this time to extend
the review period an additional 60 days or until January 27, 2007.

Staff discovered inconsistencies between the "City of Chanhassen 2020 Land Use
Plan" and the existing and potential uses on the subject property. Staff is
proposing to process a land use plan amendment to re -guide the property from
Public/Semi-Public and Residential -Medium Density (Net Density Range 4-8
units/acre) to Residential -Low Density (Net Density Range 1.2-4 units/acre).
This land use plan amendment will make the existing and/or potential uses
consistent with the land use plan.
BACKGROUND
On July 8, 1991, the City Council approved Comprehensive Plan Amendment
#91-1 changing the Land Use Designation of the property shown in vertical lines
from Residential Medium Density to Residential Low Density (see page 2 of
attached letter dated August 19, 1991). The land is occupied by single-family
homes. The site density is 0.9 units per acre. Staff is unsure why this change was
never reflected on any land use map.
The second area, guided Public/Semi Public, is actually private property occupied
by a single-family home. Staff suspects that when Camp Tanadoona was guided
Public/Semi Public, the land use designation was inadvertently extended to the
east to include the private property occupied by the single-family home.

Staff discovered inconsistencies between the "City of Chanhassen 2020 Land Use
Plan" and the existing and potential uses on the subject property. Staff is
proposing to process a land use plan amendment to re -guide the property from
Public/Semi-Public and Residential -Medium Density (Net Density Range 4-8
units/acre) to Residential -Low Density (Net Density Range 1.2-4 units/acre).
This land use plan amendment will make the existing and/or potential uses
consistent with the land use plan.
BACKGROUND
On July 8, 1991, the City Council approved Comprehensive Plan Amendment
#91-1 changing the Land Use Designation of the property shown in vertical lines
from Residential Medium Density to Residential Low Density (see page 2 of
attached letter dated August 19, 1991). The land is occupied by single-family
homes. The site density is 0.9 units per acre. Staff is unsure why this change was
never reflected on any land use map.
The second area, guided Public/Semi Public, is actually private property occupied
by a single-family home. Staff suspects that when Camp Tanadoona was guided
Public/Semi Public, the land use designation was inadvertently extended to the
east to include the private property occupied by the single-family home.

This letter is to confirm that on July 8, 1991, the City Council
approved the following:
PUD Amendment #91-1 shown on plans dated May 28, 1991, with a
variance to the lot width requirement for Lot 1, Block 1 and the
following conditions:
1. The PUD agreement will be drafted and recorded against the
property. The PUD agreement will contain all conditions of
approval for the PUD.
2. A revised preliminary plat must be submitted redesignating Lot
2, Block 1 as Outlot B.
3. The residence on Lot 4, Block 1, shall either be a duplex or
single family unit. The 6 apartment units must be vacated
prior to final plat approval.
4.. The applicant shall receive an access permit from MnDOT for
the proposed access servicing `Lots -1 and 3, Block 1 and Outlot
A and B w= __
5. A driveway easement shall be provided across Lot 2 (Outlot B),
Lot 1 and Outlot A and recorded against such properties. The
driveway must be constructed so as to accommodate emergency
vehicles and must be maintained in good passable condition.
6. The applicant shall be required to install a culvert sized by
a professional engineer, and approved by City Engineers prior
to construction, to accommodate anticipated flows through the
existing ditch on Lot 1, Block 1.

7. No more than 4 dwelling units will be permitted as part of the
PUD; one on Lot 1, one on Lot 3 and one on Lot 4 unless the
existing building is converted to a duplex.
8. Demolition permits are required for all demolition; demolition
of all the buildings to be razed shall be completed within 6
months of final plat approval.
9. A revised preliminary plat shall be submitted showing all
existing and proposed on-site sewage treatment sites and
proposed house pads and elevations.
10. If a new residence is constructed on Lot 4, Block 1, it must
meet all required setbacks. All other existing buildings on
Lot 4 must be razed.
11. The applicant shall meet any and all conditions of Conditional
Use Permit #91-4 and Wetland Alteration Permit #91-1.
12. A tree preservation plan shall be submitted by the applicant
for city approval for Lot 1, Block 1.
13. A revised preliminary plat shall be submitted by the applicant
and shall reflect revised southerly lot line of Lot 3, the
trail easement across Lot 1, Block 1, in accordance with Park
and Recreation Commission recommendations, and elimination of
the driveway onto Outlot A. A barrier shall be erected over
the driveway at the lot line between Lot 1 and Outlot A to
keep vehicles from driving or parking on outlot A.
Comprehensive Plan Amendment #91-1 changing the Land Use
Designation from Residential Medium Density to Residential Low
Density subject to the conditions of PUD Amendment, Conditional Use
Permit and Wetland Alteration Permit. —
Conditional Use Permit #91-4 for a recreational beachlot on Outlot
A as shown on plans dated May 28, 1991, with the following
conditions:
1. The recreational beachlot will be permitted only one dock with
overnight storage of up to 3 watercraft.
2. Launching of boats from the recreational beachlot is
prohibited.
3. The conditional use permit for the recreational beachlot is
only for the proposed dock improvements. Any additional
improvements to the recreational beachlot shall require
another conditional use permit and wetland alteration permit.

4. The applicant shall meet any and all conditions of the PUD
amendment #91-1 and Wetland Alteration Permit #91-1.
Wetland Alteration Permit #91-1 for construction of a permanent
boardwalk through a Class A wetland as shown on plans dated May 28,
1991, with the following conditions:
1. There shall be no filling or dredging/grading permitted with
in the wetlands.
2. The applicant shall receive a permit from the Department of
Natural Resources for the permanent boardwalk.
3. The proposed trail shall be constructed at least 10 feet away
from the wetland located in the southwest corner on Outlot A.
4. The wetland shall be permitted to return to its natural state_
after installation of the boardwalk.
5. No other alteration to the wetlands are permitted without
receiving another wetland alteration permit. Further, all
approved alterations shall be undertaken at a time and in a
manner so as to minimize disruption to the wetland.
6. The applicant shall meet any and all conditions of the PUD
Amendment #91-1 and Conditional Use Permit #91-4.
Ten copies of the final plat may now be submitted to our office for

PROJECT.
Councilman Ayotte asked staff to address the number of vendors being used, the bidding
process and establishing a list of performance criteria for a vendor base.
Resolution #2004-35: Councilman Ayotte moved, Councilman Peterson seconded to
approve the plans, budget amendment and authorize advertising for bids, Highway
41 trail connection project. All voted in favor and the motion carried unanimously
with a vote of 5 to 0.
Jackie Kurvers with the Chan-o-laires Chorus Group, along with the Director Marion
Peck, presented a check in the amount of $1,000 to Mayor Furlong to be used in the new
Chanhassen Senior Center.
VISITOR PRESENTATIONS:
Debbie Lloyd, 7302 Laredo Drive addressed the city code amendments regarding private
streets. Janet Paulsen, 7305 Laredo Drive addressed Chapters 18 and 20 of the city code
amendments, specifically Section 20-43 regarding lakeshore owners notification, Section
481 regarding setbacks from private streets, and Chapter 18 regarding the 60 by 60 house
pad requirement. Michael Kohane, 6870 Yuma Drive spoke about their appeal to a
variance request for the property located at 795 Ponderosa Drive and asked what the City
and the Carver Beach community can do to preserve smaller, 9,000 square feet and less
treed lots in that area. He also brought up the issue which was in the local paper
regarding a state law allowing ATV use in wetlands. Mayor Furlong asked Kate
Aanenson and Todd Hoffman to address these issues.

Dear Sharmeen: I received your April 15th letter regarding the proposed change in what I interpret to be
"zoning." Frankly, I was under the impression we were already in a low density area (roughly one unit per acre).
As we have no intentions of subdividing the property, I don't see where there would be a problem.
Coincidentally, we are evaluating our various options with our home, which is very large, and as our eight children
grow up and move out, will be much more real estate than we need or care to maintain for our family's shrinking
needs. Presently, we are listing the property for sale to test its value ( and quite possibly liquidate). Beyond that,
we have contemplated using the property as a group home, as there is significant capacity here, and we are
former foster parents with some experience in the field. Are there any barriers or limits to that type of use under
the city's guidelines?
One more thing ... where does the Planning Commission meet on May 4th?

Graves were to sell the house, how easy would it be for someone to rent the mother-in-
law suite. Chair Slagle asked for further clarification on the time line of events for the
permit. Paul and Laura Graves presented their reasons for the variance request and
clarified the sequence of events. Chair Slagle opened the public hearing. Kent Ludford,
8615 Valley View Court, stated his support for the project. The public hearing was
closed. Commissioner Tjornhom asked for clarification on what plans were submitted to
the city and when. After comments, the following motion was made.
Lillehaug moved, Tjornhom seconded that the Planning Commission approves
variance 04-16 to allow the use of a single family dwelling as two family dwelling
(mother-in-law suite) located at 8634 Valley View Court zoned RSF, with the
following conditions:
1. Permits must be obtained for additional work that has not yet been permitted and
revised as -built plans must be submitted.
2. The dwelling maintains the appearance of a single family dwelling including the
maintenance of one driveway.
3. Separate utility services will not be established.
4. The suite shall not be used for a rental unit.
All voted in favor and the motion carried unanimously with a vote of 4 to 0.

clarification on the 2020 plan. Commissioner Lillehaug had questions regarding what's
driving this request and zoning. Chair Slagle opened the public hearing. Debbie Lloyd,
7302 Laredo Drive asked staff to clarify if open space was dedicated as a part of the
PUD. The public hearing was closed and the following motion made.

approval of re -guiding all the highlighted property shown in the attached Exhibit A
from Residential Medium Density and Public/Semi-Public to Residential Low
Density (Net Density 1.2-4 Units per Acre). All voted in favor and the motion
carried unanimously with a vote of 4 to 0.
The Planning Commission took a short recess at this point in the meeting.
RECOMMEND ADOPTION OF PROPOSED CHANAGES TO CHAPTER 20,
ZONING OF THE CHANHASSEN CITY CODE. THESE CHANGES AFFECT
ARTICLES I THROUGH XXXI OF THE CHAPTER AND ARE INTENDED TO
UPDATE AND CONSOLIDATE THE ENTIRE ZONING ORDINANCE.
Bob Generous updated the Planning Commission on changes made since the last
meeting. Commissioner Tjornhom asked for clarification on the zoning compliance
check and the commission discussed the requirements for retaining walls. It was decided
that retaining walls under 4 feet don't need compliance check. Commissioner Lillehaug
suggested that Chapter 20-908 be amended to only say fences and delete Invisible Fences
and delete underground irrigation systems.
Lillehaug moved, Keefe seconded that the Planning Commission recommend
approval of the ordinance amending Chapter 20 of the Chanhassen City Code with
the following amendments:
1. On page 6, Section 13, Zoning Compliance Review, not require a review for
retaining walls less than 4 feet.
2 Section 20-299, not restricting hours for home improvement trade.
3. On page 87, Section 20-908, deleting Invisible Fences and underground irrigation
systems from requirement of an encroachment agreement in the easement area.
All voted in favor and the motion carried unanimously with a vote of 4 to 0.
APPROVAL OF MINUTES: Lillehaug moved, Keefe seconded to approve the
verbatim and summary Minutes of the Planning Commission meeting dated April
20, 2004, amending on page 3, condition 5 to read, no direct access from any of the
proposed lots to Coulter Boulevard will be allowed. All voted in favor and the
motion carried unanimously with a vote of 4 to 0.
Chair Slagle adjourned the Planning Commission meeting at 9:25 p.m.

for medium.

Keefe: And so if we were to go to low now, I'm confused on how that works in terms of
you, if we got it to low, then we'll just change the 2020 plan, is that what we would do?
Al -Jaffa Correct.
Keefe: And then currently the property, I mean most of those are pretty large lots, aren't
they?
Al -Jaffa That's correct.

Keefe: Would they typically fall today in the medium residential or medium?
Al-Jaff: Right now they are large lot residential. They are served by well and septic.
Keefe: So I'm not clear what the rationale is to go to low versus to go to medium.
Al-Jaff: Well we want to stay consistent with the guide plan. Or with the uses that are
out there today, and what it was guided for. The intent in 1991 when this planned unit
development was processed was to guide this area.
Keefe: To low, right?
Al -Jaffa To low density residential.
Keefe: But was that because of a plan for, a development that was planned to go in
there?
Al -Jaffa It was part of a plan that was proposed and has been built on the site since. I
mentioned earlier, there was an 8 unit apartment that no longer is.
Keefe: It never got built or it got tore down?
Al -Jaffa I believe it got tom down. No? It's still there?
Geri Eikaas: It's a house.
Al -Jaffa It's a house. It was converted?
Keefe: Is that the one that's, okay that's for sale. Okay.
Al -Jaffa It's a single family home today.
Keefe: Okay. That's all I have.
Slagle: Steve.
Lillehaug: A few quick ones. What's driving this at this time? Is it just you guys saw
something and wanted to change it?
Al-Jaff: One of the things that happened was, we received a phone call on this parcel that
is currently guided open space. It is up for sale and I looked at it and realized that it was
guided wrong and staff decided to clean up this area.
Lillehaug: The parcel that goes out to the lake, what is that currently guided right now
because I think the north part of the northeast section I think that is guided I think PUD.

the "City of Chanhassen 2020 Land Use Plan" and the existing and potential uses
