The amendment reguides CPA proposes to change the City's land use designations for 11 parcels that are single-family residences on large lots and presently without public sewer and water. The total area is 37.22 acres, of which 6.23 acres are in wetlands. The net buildable upland area is 30.99 acres. The Council found that the CPA conforms to the regional system plans for transportation, wastewater, and parks, is consistent with the 2030 Regional Development Framework and Council policies, and is compatible with the plans of adjacent jurisdictions. Therefore, the City may place the CPA into effect. A copy of the staff report to the Council is attached for your records. The Council will append the amendment, submission form and supplemental information to the City's plan in the Council's files. Chanhassen's 2020 Comprehensive Plan (Review No. 16500-4) was reviewed by the Council on June 9, 1999. In 2000, the City had 20,321 residents in 6,914 households and 8,501 jobs. By 2030, the City is expected to have 38,000 residents in 14,800 households, and 15,600 jobs. The Council's 2030 Regional Development Framework (RDF) identifies Chanhassen as a "developing community." As a developing community, Chanhassen should plan and stage development that accommodates the forecasts for local growth through 2030 at net densities of 3-5 units plus per acre. The City is connected to the Metropolitan Disposal System (MDS) with treatment occurring at the Blue Lake Wastewater Treatment Plant. Since 2000, the Council has reviewed 13 comprehensive plan amendments (CPA). REQUEST SUMMARY The City of Chanhassen submitted the Ches Mar Farm comprehensive plan amendment (CPA), to correct a land use mapping error. The existing 37 -acre Ches Mar Farm has 11 parcels with six single-family homes. (Figures 1 and 2) While the area is within the Metropolitan Urban Service Area (MUSA), none of the parcels have municipal sewer or water. The CPA proposes to correct the intended guiding. The City proposes to correct the guide plan to show the parcels as "low-density" residential reflecting their present single-family use. Ten of the parcels are guided as "medium -density" residential. One parcel is guided as Public/Semi-Public. Chanhassen proposes to correct the guide plan to show the 11 parcels as "low-density" residential reflecting the existing single- family use. PROPOSED ACTION Staff recommends that the Metropolitan Council: Allow the City to put the comprehensive plan amendment into effect with no modifications. ISSUES 1. Does the proposed CPA change the Council's forecasts? 2. Does the City of Chanhassen need to fulfill any requirements previously identified by the Council? 3. Does the proposed CPA conform to regional systems? Is it consistent with Council policy? Is it compatible with adjacent community plans? OVERVIEW Conformity with The CPA conforms to the Regional System Plans for Parks, Transportation Regional Systems and Water Resources Management with no substantial impact on or departure from these plans.. Consistency with The CPA is consistent with the Council's 2030 Regional Development Council Policy Framework, forecasts and water resources management. This CPA does not change the City's 2010, 2020 or 2030 forecasts. Compatibility with The amendment will have no impact on adjacent communities. Adjacent Community Plans ISSUE ANALYSIS AND FINDINGS REGIONAL SYSTEMS Parks (Jan Youngquist, Senior Planner, 651-602-1029) The proposed CPA is in conformance with the regional parks system, and will not impact regional parks and trails. The CPA is adjacent on the south boundary of Lake Minnewashta Regional Park. . Transportation (Ann Braden, Senior Planner, 651-602-1705) The proposed CPA is in conformance with the regional transportation system and will not impact the regional transportation system. The Ches Mar Farm subdivision is immediately west of Hazeltine Blvd, about 1600 feet north of Hwy 5. Water Resources Management (Kyle Colvin, P.E., Asst. Manager, Engineering and Planning, MCES, 651-602-1151) The proposed CPA is in conformance with the regional water resources management system and will not impact the regional wastewater system. The Council has adequate regional sewer capacity to serve the Ches Mar Farm properties. Chanhassen is on the Council's list of communities with I/I problems and the Surcharge List for 2007. The City's System Statement has an identified IR Goal. Chanhassen has acknowledged the surcharge and submitted a work plan to identify and mitigate excessive M from the local system. 2 REGIONA POLICIES Housing (Linda Milashius, Planner, 651-602-1541) The proposed CPA is consistent with Council housing policy. Because there are no forecast changes to population and housing, the City's share of affordable housing remains the same. Surface Water Management (Jim Larsen, Senior Planner, 651-602-1159) The CPA is consistent with the Council's surface water management policies. Surface water in the City of Chanhassen is managed by the Carver County Watershed Management Organization, and the Lower Minnesota River and Riley -Purgatory Bluff Creek Watershed Districts. The Carver County watershed plan was approved by the Board of Water and Soil Resources (BWSR) in 2001. The Lower Minnesota River and Riley -Purgatory Bluff Creek watershed plans were approved by BWSR in 1999 and 1997 respectively. Chanhassen updated its plan in the spring of 2006. Water Supply (Sara Bertelsen, Planner, 651-602-1035) The proposed CPA is consistent with Council water supply policy. The Council is in the process of reviewing Chanhassen's 2006 Water Supply and Emergency & Conservation Plan update. 2030 Regional Development Framework (Jim Uttley, AICP, Planning Analyst, 651-602-1361) Chanhassen's 2020 Comprehensive Plan Update (CPU) reviewed by the Council on June 9, 1999, proposed 1,199 net acres of MUSA expansion at an overall density of 3.1 units per net acre. The Ches Mar Farm CPA land was in the Stage I MUSA staging area (2000-2005). The City's intent in the CPA is to correct a mapping error from the 2020 CPU. The City's plan shows the southern -most parcel of 2.3 acres as public/semi-public. (Figure 2) It is used as single-family residential and its present land use designation makes the property non -conforming. This means that if the house was destroyed by a fire or other cause, it could not be reconstructed. The City intended for the parcel to be shown on the land use plan map as low-density residential (future urban/sewered) land use category having a density range of 1.2-4 units per net acre. The remainder of the parcels are currently shown as medium -density residential. (Figure 2) The existing uses are 5 large -lot single family houses. The City intended for the parcels to be shown on the land use plan map as low-density residential land use category having a density range of 1.2-4 units per net acre. If the Ches Mar Faun properties had been correctly shown in the City's 2000 CPU, the plan's density would have been reduced from 3.1 to 3.01 units per net acre. This would still have met the Council's policy of 3 units per net acre overall for residential development. As a participant in the Council's Plat Monitoring Program, the City reported platting between 2000 and 2005, a total of 340 net acres adding 1,409 dwelling units for an overall density of 4.1 units per net acre. Consistency with the Council's 2030 Forecasts (Jim Uttley, Planning Analyst, 651-602-1361) The City's forecasts are consistent with the Council's forecasts. The CPA will not change the City's forecasts. The CPA proposes to change the City's land use designations for 11 parcels that are single-family residences on large lots without public sewer and water. One of the properties, Dyvig property (7250 Hazeltine Blvd) is 2.54 acres and was shown on the City's existing land use map as Public/Semi-Public. It is used as a single-family residence and the City proposes to reguide it as "low-density' residential (1.24 units/acre net). The remainder of the Chesmar Farms area consists of 10 parcels -of -record having 6 property owners and residences. These parcels total approximately 33.7 acres and are shown in the existing plan as "medium -density" residential (4-8 units/acre net). The City is requesting to reguide the parcels to "low-density' residential (1.24 unitstacre net). Council staff finds that the proposed plan amendment is incomplete as submitted. It raises potential wastewater system issues and density policy issues, which require additional information. Additional information addressing the following is requested: • Is the Chesmar Farms property proposed for reguiding inside the City's existing MUSA? Is municipal sewer in Hazeltine Blvd adjacent to the Chesmar Fames properties? If sewer is available, what - if anything - is preventing the extension of sewer service to the properties? Does the City have time requirements for hooking up to sewer when it is available? Given the low density of the properties on average 0.19 units/acre, the households would appear to be non -conforming uses in terms of both the existing and the proposed new plan designations. It appears to Council staff that this designation (residential large lot) would be consistent with the existing use of the properties and result in substantially fewer non -conforming properties. Council policy establishes an overall minimum density of 3-5 plus units per acre for MUSA expansions. The Council's MUSA Expansion Guidelines require staff to use the minimum density of each residential land use to determine the impacts of proposed land use changes on overall community densities. In applying this formula to the current CPA proposal, the overall density for the City as a whole falls substantially below the 3 units/acre standard to an average net density of 2.6 units per acre (see Table attached). Council staff is concerned about the City's future ability to meet density standards. Since 2003, the City has approved 19 plats of which only 3 have had net densities in excess of 3 units/acre. The average net densities for the years 20003, 2004 and 2005 have been 1.93, 2.1 and 2.37 units per acre respectively. Will the City be able to meet the Council's density policy with respect to the parcels added to the MUSA? In addition, Council staff brings the following advisory comments to your attention. These are not completeness issues at this time. Surface Water Management (Jim Larsen, P.E., Senior Planner, 651-602-1159) Surface water management in the City of Chanhassen is overseen by the Carver County Watershed Management Organization (WMO), and the Lower Minnesota River, Riley -Purgatory Bluff Creek and Minnehaha Creek Watershed Districts. The Carver County WMO plan was approved by the Board of Water and Soil Resources (BWSR) in 2001. The Lower Minnesota River, Riley -Purgatory Bluff Creek and Minnehaha Creek watershed plans were approved by BWSR in 1999, 1997, and 1997 respectively. Chanhassen was required to update its local surface water management plan by the end of 2004. The City indicated earlier this year that it is currently working on the update of its local plan and expects to have a completed draft this summer. The draft plan should be submitted to the Council for its review concurrent with the review by the four watershed management organizations. Water Supply (Sara Bertelsen, Environmental Planner, 651-602-1035) As a reminder, the City will need to submit their Water Supply and Emergency & Conservation Plan update to the Council and Minnesota Department of Natural Resources (DNR) by October 15, 2006, in accordance with the DNR's April 28, 2005 guidance letter to the City. This land use plan amendment will make the existing and/or potential uses consistent with the land use plan. BACKGROUND On July 8, 1991, the City Council approved Comprehensive Plan Amendment #91-1 changing the Land Use Designation of the property shown in vertical lines from Residential Medium Density to Residential Low Density (see page 2 of attached letter dated August 19, 1991). The land is occupied by single-family homes. The site density is 0.9 units per acre. Staff is unsure why this change was never reflected on any land use map. The second area, guided Public/Semi Public, is actually private property occupied by a single-family home. Staff suspects that when Camp Tanadoona was guided Public/Semi Public, the land use designation was inadvertently extended to the east to include the private property occupied by the single-family home. The total area is 37.22 acres, of which 6.23 acres are in wetlands. There are 30.99 net buildable acres according to the City's analysis. On July 27, 2006, Council staff found that the proposed plan amendment was incomplete as submitted. It raised potential wastewater system and density policy issues requiring additional information. On September 29, Chanhassen staff provided supplemental information to the Council. The supplemental information has been evaluated and the plan amendment is now considered complete for review. This CPA will need to go to the Community Development Committee (CDC) and Council for formal action. The Council has 60 days to complete its review with the option of extending the period for an additional 60 days. The initial 60 -day review period ends on November 28, 2006. However, because of the Thanksgiving holidays, it appears that the CPA will go to the CDC for action in November and to the Council for action in December. For this reason, the Council is exercising its option at this time to extend the review period an additional 60 days or until January 27, 2007. Frankly, I was under the impression we were already in a low density area (roughly one unit per acre). As we have no intentions of subdividing the property, I don't see where there would be a problem. Coincidentally, we are evaluating our various options with our home, which is very large, and as our eight children grow up and move out, will be much more real estate than we need or care to maintain for our family's shrinking needs. Presently, we are listing the property for sale to test its value ( and quite possibly liquidate). Beyond that, we have contemplated using the property as a group home, as there is significant capacity here, and we are former foster parents with some experience in the field. Commissioner Tjornhom asked for clarification on the zoning compliance check and the commission discussed the requirements for retaining walls. It was decided that retaining walls under 4 feet don't need compliance check. Commissioner Lillehaug suggested that Chapter 20-908 be amended to only say fences and delete Invisible Fences and delete underground irrigation systems. It is up for sale and I looked at it and realized that it was guided wrong and staff decided to clean up this area.
