As well as the very onerous nature of actually applying for one of these permits where if you were putting in a garage with space underneath for a basement would probably run in the vicinity of $20,000 we believe so it's, the rules are complicated. They are onerous. They are by far the most stringent of any watershed in the metro district we believe in the state but we haven't had time to analyze every watershed in the state but we are asking, as we did in the email, that you all please get in touch with the watershed in an official manner express concern about these rules. I just brought for your review, Terry Jeffery did an excellent job of going through the concerns on this and I'm just going to, I don't know if you can even read this but I just thought instead of using my words I would use his official words here. He said just in his general comments, when looking at the proposed Hiles for buffers, floodplain management, stormwater management and bank stabilization, it is undeniable that these rules will result in significant additional encumbrances on the limited developable land, excuse me. Developable land within Chanhassen and the other communities that lie within the district boundaries. So there's little land to develop and this is going to prevent quite a bit of that. In many cases these rules go well beyond regulatory mechanisms which have been implemented by the other 3 watershed organizations with jurisdiction in Chan and the MPCA. One of Terry's big concerns is that the other watersheds that have rule in Chanhassen, the rules from the Riley-Purg watershed are going significantly beyond what the other watersheds are. Then regarding buffers. The implications of the encumbrances being imposed on privately and publicly held land by the proposed buffer rule is dramatic and not without potential for significant hardship to people and government agencies. The proposed buffer rules by far exceed any buffer requirements implemented by other watershed management organizations in the metropolitan area. Chanhassen cannot support these buffers and strongly requests that the RPBCWD align the buffer requirements for closely with the other cities and WML's in the area. And then he goes on again with the stormwater just to say how many properties, three-quarters of the properties in Chan will be affected by the stormwater rules. They are very, very difficult to achieve. The levels that are requested, that are required by the rules are levels that cities, counties, watersheds theirselves have trouble achieving with their engineering and taxpayer dollars at their hands. As I said the homeowners in private property owners is extremely onerous. One of the things that we have been asking since the beginning of this, of the rules process was for the watershed to provide us with some actual data that why this is important, particularly with the buffers. The property is zoned Agricultural Estate District (A-2), which permits agriculture use. The subject property has an area in excess of 2,800,908 square feet (64.3 acres). It has a parcel frontage of approximately 1,103 feet along Audubon Road and 1,328 feet along Lyman Boulevard. The parcel depth is in excess of 2,500 feet. Section 20-1554 b. state that "All lots of record in existence and parcels of land located within the Bluff Creek Overlay District on which a principal structure has been constructed prior to December 14, 1998, are exempt from requiring a conditional use permit. Further subdivision of the property will require a conditional use permit and shall comply with the Bluff Creek Overlay District." The subject site formerly included 80 acres to the east which is now the Preserve on Bluff Creek. The Preserve was platted in 2006 and is a Planned Unit Development containing single-family detached homes. ANALYSIS The applicant is proposing to place approximately 40,000 cubic yards of fill in the northeast comer of the property. Grading must be kept out of the Bluff Creek primary zone. The primary zone includes the treed area west of Bluff Creek. The applicant will need to revise the grading plans to avoid impacting this area. Erosion control fencing shall be placed at the edge of the primary zone in this area. The fill is being generated from the Lyman Boulevard project improvements adjacent to the property. This area is currently used for agricultural purposes and the grade ranges from 4% to 18%, draining to the northeast. The applicant proposes up to 10 feet of fill in the area, creating a 5% slope to the northeast and a 3:1 slope along the eastern edge. The proposed grading will provide laminar flow characteristics, removing the areas of concentrated flow on the site. The applicant proposes to access the fill site from the City's lift station access to the east of the property. The City and the contractor currently have an agreement in place regarding this access for the Lyman improvement project. EROSION CONTROL Under the current plan, the applicant is proposing that a portion of the Phase 1 and Phase 2 material placement areas encroach into the Bluff Creek Overlay District which is coincidental with the tree line. The plans shall be revised such that no fill is placed beyond the drip line of the wooded area. This area drains to Bluff Creek. Bluff Creek is identified as having an impairment for turbidity. The SWPPP must identify this impairment and the location of Bluff Creek. Silt fence shall be installed using metal t -posts. This project is a separate project from Lyman Boulevard operating under its own NPDES permit. However, given the contractor is exporting materials from the Lyman Boulevard project and has incentives in place with that project to maintain a clean site which does not introduce sediment into surface waters, an erosion control escrow in the amount of $1,500.00 shall be adequate. When approving an interim use permit, approvals follow the requirements of a conditional use permit, the City must determine the capability of a proposed development with existing and proposed uses. The general issuance standards of the conditional use Section 20-232, include the following 12 items: a. The grading operation will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. The site work will maintain water quality. b. The grading operation will be consistent with the objectives of the city's comprehensive plan and the zoning code. The earthwork will be maintaining the site in a form suitable for office industrial use which is compatible with the Comprehensive Plan and this chapter. Additionally, the grading plan will be revised to preserve the Bluff Creek primary zone. 0 c. The grading operation will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of the site. d. The grading operation will not be hazardous or disturbing to existing or planned neighboring uses because the grading and drainage will be contained within the site perimeters. Additionally, hours of operation are limited and specific conditions of approval will be in place and enforced by the city. e. The grading operation will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use since development of the site will be delayed until urban services are extended through the property. The grading is temporary which does not need to be served by public facilities and services except for roads. The grading operation will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community since this site already contains a farm. g. The grading operation will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare due to excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. The conditions of the approval will provide standards by which the activities should be minimized. h. The grading operation will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. Through the use of signage, limits on the hours of operation, and the limited nature of the operation, traffic impacts will be minimized. i. The grading operation will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. The grading operation is limited. The grading plans shall be revised to preserve the Bluff Creek corridor. j. The grading operation will be aesthetically compatible with the area since the grading and re -vegetation of the site will improve the site storm water management. k. APPLICANT: MATHIOWETZ CONSTRUCTION COMPANY. OWNER: GAYLE DEGLER, PLANNING CASE 2014-17. Fauske: Good evening Chairman Aller, members of the Planning Commission. Tonight we have an Interim Use Permit application for the property located at 9111 Audubon Road, Planning Case 2014-17. The applicant is Mathiowetz Construction. The property owner is Mr. Gayle Degler. The property is located on the southeast corner of Lyman Boulevard and Audubon Road. It's currently being used for agricultural purposes. An Interim Use Permit is required whenever grading exceeds 1,000 cubic yards. The Lyman Boulevard project between Audubon and Powers is currently under construction and the applicant in this instance is the contractor for the project and proposes to place 40,000 cubic yards of fill in the northeast corner of the site adjacent to the Lyman Boulevard project. This graphic was also included in the packet and it shows the existing and proposed conditions within the site. The area in yellow indicates the area that they would be placing some fill. This has been adjusted based on staff's comments with regards to limiting the grading within the drip line of the trees so this graphic has been Chanhassen Planning Commission — June 17, 2014 • modified by the applicant. But this just shows an indication of the existing condition shown in the light purple and the pink and the proposed condition shown in blue. There is an area of concentrated flow to the east that's caused some erosion issues in the past so the proposed fill on the site actually helps to alleviate that situation. As I had stated before there's a, the erosion issue currently on the site would be alleviated with the proposed fill on the site. Also stated that there's a drip line along the Bluff Creek primary zone that the grading has to stay out of. As well with the proposal staff recommends that an erosion control escrow be provided. That number is included on page, page 3 of the staff report with the recommendation on page 4 and it's a low dollar amount than what we've seen in the past and the reason is, is because the applicant, as I mentioned is the contractor for the Lyman Boulevard project so there are many securities in place for that project so we simply just had a simple erosion control escrow for this proposal with the bulk of the security being taken through the Lyman Boulevard project. As well we recommend that the IUP to end with the substantial completion of the Lyman Boulevard project. At this point the staff has provided a recommendation for the Planning Commission to recommend to the City Council to approve the Interim Use Permit to allow the site grading for approximately 40,000 cubic yards of fill subject to the conditions of approval and adopt the Findings of Fact in the staff report. And with that I would be happy to answer any questions that the commission might have at this time. Aller: So the new grading will hopefully stop any further erosion? Fauske: Correct. Aller: And in fact it looks to me like it would increase the filtration so we get better filtration of the actual ground waters that comes in. Fauske: It slows the, it slows the ground water down. Or the water down as it goes through there. They've eliminated the area of concentrated flow. They've created a sheet flow so instead of channeling it to one particular location it sheet flows across the entire area that's being filled. Aller: Great. Any other question from commissioners? Would the applicant like to come forward? I-Fei Tsu: Is it still agricultural use of that area? Aller: Sir are you a member of the public or are you the applicant? I-Fei Tsu: I'm a resident. Aller: A resident, okay. We're going to open up the public hearing in a second here and then we'll entertain any questions you have. I-Fei Tsu: Alright. Aller: Great, thank you. Chanhassen Planning Commission — June 17, 2014 • I-Fei Tsu: Chanhassen and I just want to make sure it still remain agricultural use after the grading. Is that correct understanding? Fauske: I can answer. They're not proposing to change the land use associated with the site. The proposal is simply to place some fill within the existing property. I-Fei Tsu: Okay, just putting, okay. Fauske: Yeah. Aller: So if it was to change in the future there would be another hearing on this. Any additional individuals wishing to come forward to speak either for or against or opportunity to ask questions. Tim Paine: Tim Paine, 2345 Fawn Hill Court. I'm actually here for another issue but I was just an idle question is that when the fill is brought in, where is it coming from, what's it's quality and what compaction will it be brought to? To insure that what you were saying that the erosion control was actually better than what you have right now. Fauske: The fill is coming from the Lyman Boulevard construction project. At this point since it's not proposed to he supporting any kind of foundation of that matter, they don't have any compaction per se as far as required bearing loads. Perhaps if the applicant wishes to elaborate on this he's certainly welcomed to do so but it's simply to compact it to insure that it won't erode away to the best of their ability. They'll track the slope in order to try to break up some of the flow conditions while vegetation establishes. Aller: Any additional questions? Okay, seeing no one come forward we'll close the public hearing on the matter and open it up for commissioner comments. We're not substantially changing the property. Looks like we're going to at least make an effort to stop the erosion. There's a NPDES permit for Lyman so we should be covered there. I'll entertain any motions. Undestad: I'll make a motion then. When approving an interim use permit, approvals follow the requirements of a conditional use permit, the City must determine the capability of a proposed development with existing and proposed uses. The general issuance standards of the conditional use Section 20-232, include the following 12 items: a. The grading operation will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. The grading is temporary which does not need to be served by public facilities and services except for roads. f. The grading operation will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community since this site already contains a farm. g. The grading operation will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare due to excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. The conditions of the approval will provide standards by which the activities should be minimized. h. It's currently being used for agricultural purposes. An Interim Use Permit is required whenever grading exceeds 1,000 cubic yards. The Lyman Boulevard project between Audubon and Powers is currently under construction and the applicant in this instance is the contractor for the project and proposes to place 40,000 cubic yards of fill in the northeast comer of the site adjacent to the Lyman Boulevard project. This graphic was also included in the packet and it shows the existing and proposed conditions within the site. The area in yellow indicates the area that they would be placing some fill. This has been adjusted based on staff's comments with regards to limiting the grading within the drip line of the trees so this graphic has been modified by the applicant. But this just shows an indication of the existing condition shown in the fight purple and the pink and the proposed condition shown in blue. There is an area of concentrated flow to se"NEO Chanhassen Planning Compion —June 17, 2014 • the east that's caused some erosion issues in the past so the proposed fill on the site actually helps to alleviate that situation. As I had stated before there's a, the erosion issue currently on the site would be alleviated with the proposed fill on the site. Also stated that there's a drip line along the Bluff Creek primary zone that the grading has to stay out of. As well with the proposal staff recommends that an erosion control escrow be provided. That number is included on page, page 3 of the staff report with the recommendation on page 4 and it's a low dollar amount than what we've seen in the past and the reason is, is because the applicant, as I mentioned is the contractor for the Lyman Boulevard project so there are many securities in place for that project so we simply just had a simple erosion control escrow for this proposal with the bulk of the security being taken through the Lyman Boulevard project. As well we recommend that the IUP to end with the substantial completion of the Lyman Boulevard project. At this point the staff has provided a recommendation for the Planning Commission to recommend to the City Council to approve the Interim Use Permit to allow the site grading for approximately 40,000 cubic yards of fill subject to the conditions of approval and adopt the Findings of Fact in the staff report. And with that I would be happy to answer any questions that the commission might have at this time. Aller: So the new grading will hopefully stop any further erosion? Fauske: Correct. Aller: And in fact it looks to me like it would increase the filtration so we get better filtration of the actual ground waters that comes in. Fauske: It slows the, it slows the ground water down. Or the water down as it goes through there. They've eliminated the area of concentrated flow. They've created a sheet flow so instead of channeling it to one particular location it sheet flows across the entire area that's being filled. Aller: Great. Any other question from commissioners? To insure that what you were saying that the erosion control was actually better than what you have right now. Fauske: The fill is coming from the Lyman Boulevard construction project. At this point since it's not proposed to be supporting any kind of foundation of that matter, they don't have any compaction per se as far as required bearing loads. Perhaps if the applicant wishes to elaborate on this he's certainly welcomed to do so but it's simply to compact it to insure that it won't erode away to the best of their ability. They'll track the slope in order to try to break up some of the flow conditions while vegetation establishes. Aller: Any additional questions? There's a vacant parcel in the northwest comer of the property and then the farmstead site on the south side and then homestead site in the central, north central portion of the property. The request is for a rezoning of the property from Agricultural Estate District to Residential Low and Medium Density. A condition use permit for development within the Bluff Creek corridor and preliminary plat with a variance for use of a private street creating 15 lots and 4 outlots with the dedication of public right-of-way. The Homestead Partners letter, memo that I provided to you is their response to the staff recommendations in the report. Most of this is technical details that will be resolved between preliminary and final plat. They have to provide us with additional information and so he's trying to clarify that. They are working on the private street has an island area within it and they're looking at whether or not they can continue to have that or because the design wasn't clear as part of their submittal and so they're asking if it's a sunken design would the Fire Marshal allow that so we're working that out with him. I did submit that to him for review and he hasn't gotten back to me on that as of yet. The one item that I can clarify is the applicant was requesting some type of hybrid credit for the parks and recreation. I did contact the Parks Director and he said there'll be no credit involved with this because Sugarbush Park is located a quarter mile north of this site and so the City has park facilities available. Also under the residential low and medium density, part of the intent is to preserve large areas of permanent open space. Upland areas of open space and that I'll show as part of the review that they are providing that. In exchange they get smaller lot sizes for some of their development and so that's the exchange we were looking at. So those were the two major issues. The areas currently zoned Agricultural Estate District, it's really a holding category. To the north of it is the Fawn Hill development and that is zoned Single Family Residential. To the west, northwest is the Longacres development which is a Planned Unit Development Residential. Both of those are single family homes and then to the southwest is the Vasserman Ridge development and along that specific edge there are both single family homes and a twin home development. This plan also contains a Storm Water Pollution Prevention Plan (SWPPP) for the site. The paragraphs below give a brief outline of the plan's conditions and operations. The existing conditions of the site consist of farm fields with approximately one foot of topsoil and slopes varying from 8:1 to 3;1. The proposed end user plan will move these 3:1 slopes toward the perimeter of the site, allowing for a field with minimal changes in grade. This will also reduce the channeling of water on the site by removing concentrated drainage areas currently found on the site. Prior to construction, silt fence and inlet protection will be placed on site to prevent sediment from leaving the site. Topsoil Berms will also be place in front of the silt fence, further reducing sediment from leaving the site. During construction, topsoil will be removed from the designated fill areas and stockpile adjacent to said area. At the time of completion of construction in each area, topsoil will be replaced prior to fill being placed in the new area. Seeding and mulch will occur throughout the duration of the construction within the site to reduce sediment transfer. The plan outlines the phasing of these operations into three phases with the construction beginning in the Southwest comer of the construction limits.
