RESOLUTION VACATING ALLEY AND RETAINING
A DRAINAGE AND UTILITY EASEMENT
WHEREAS, pursuant to Minnesota Statutes Section 412.85 1, after two (2) weeks'
published and posted notice of the hearing and after mailing written notice of the hearing at least
ten (10) days before the hearing to each property owner affected by the proposed vacation, the
Chanhassen City Council has conducted a hearing to consider the vacation of the alley legally
described on the attached Exhibit "A" ("Vacated Alley"); and
WHEREAS, following the hearing and consideration of the proposed vacation, the
Council has determined that it is in the public interest to vacate the alley and retain a drainage and
utility easement over the Vacated Alley.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chanhassen:
I . The Vacated Alley legally described on the attached Exhibit "A" is hereby vacated
retaining a drainage and utility easement over the Vacated Alley.
2. The vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines,
water pipes, mains and hydrants thereon or thereunder, if any, to continue maintaining the same or
to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or
otherwise attend thereto.
3. The City Manager is directed to file a certified copy of this Resolution with the
County Auditor and County Recorder of Carver County.

Are you talking about a title search for ownership and encumbrances for the applicant's property to verify that a
majority of owners of the property abutting the street have signed the petition for vacation? If so, we can check title to
verify.
Or are you talking about getting the list of property owners affected by the vacation for notification purposes?
Notice of the hearing must be published in the city's legal newspaper and
posted at least two weeks prior to the hearing. Newspaper publication must
be once a week for two weeks. In addition, written notice of the hearing
must be mailed to each property owner affected by the proposed vacation at
least 10 days before the hearing. The notice must contain, at minimum, a
copy of the petition or proposed resolution as well as the time, place, and
date of the hearing. Certified mail is not required by the statute.
The Court has established that when platted streets are vacated, due process
requires, at minimum, that notice be sent to all owners or occupants of land
within the platted area. Owners and purchasers of platted land are
presumed to rely upon access to the areas dedicated to public use in a plat
and are deemed to be "affected" owners.

Since the vacation accrues to the property through the operation of law regardless of the owner, we usually do not do
any title search. It is generally a matter of determining legal descriptions of abutting properties and how the easement
came to be (dedication v. easement agreement) to determine which property the vacated land accrues to. In this case,
the easement was a dedicated alley and half will accrue to the abutting lot within the plat that the alley was dedicated
in.

Stephanie, while in my opinion the sample description you provided would be more appropriately described as "the
North half of the vacated alley adjacent to Lot 8, Block 4" and also has the potential to create ambiguity in the future, I
can provide a metes and bounds description of the alley that is similar to your example. While I don't think that is the
best way to described the vacated alley, I will acquiesce to the long form of such a description to keep this moving
forward.
Rick, please schedule a Gopher One locate and make sure to keep a copy of the ticket to submit with the application.
Please let us know when the utilities are marked up. We will return at that time and update the survey.

The alley has not yet been vacated, so I am unsure as to how the legal description "north half of the vacated alley"
would apply. Please clarify. We need a legal description of the area being vacated to include in the vacation resolution
for City Council that would be recorded with the County if the vacation is approved. I have attached a sample legal for a
similar alley vacation in the ST HUBERTUS plat.
There are no known public utilities in the alley. A GSOC is required to determine if private utilities are on site. The GSOC
ticket should be submitted with the application.
We are requiring a drainage and utility easement dedication over the proposed vacated area. I was planning to have our
attorney use the vacation legal description to draft the Grant of Easement document.

Stephanie, the legal description for the vacated alley is simply the North half of the vacated alley adjacent to Lot 12. 1
thought it would be appropriate to provide the proposed legal description for the new parcel, but I can separate out the
proposed legal for just the alley on the survey if needed. Please let me know. Also, if there are any additional
corrections/additions, please send an itemized list to Rick so that we can work on getting what the city needs on the
next submission. If you are requiring utilities to be shown, please send me the public utility plans for this area and I'll
add them to the survey. if private utilities are required, Rick will have to call Gopher One to get the lot marked up. The
only reason I ask if these are required is sometimes a number of requirements are waived or aren't necessary for a
