Dear Mr. Henricksen, Thank you for seeking input from the Department of Natural Resources regarding the proposed vacation of a portion of the drainage and utility easement on 3690 Lone Cedar Lane. Your letter was forwarded to me to review and provide comments as required by M.S. 412.851. M.S. 412.851 indicates that "No vacation shall be mode unless it appears in the interest of the public to do so." In response, "The commissioner must evaluate: (1) the proposed vacation and the public benefits to do so, (2) the present and potential use of the landfor access to public waters; and (3) how the vacation would impact conservation of natural resources." The DNR has reviewed the proposed vacation of the utility easement abutting the public waters of Lake Minnewashta in the city of Chanhassen, and we offer the following comments: The proposed vacation public benefit: There is nothing in the application/letter that states a clear benefit to the public. Present and potential use of the land for access to public waters: Although this proposed vacation is a platted as a utility easement, the DNR invites water access discussion when vacating any possible public access. Impact on the conservation of natural resources: The applicant has indicated that the proposed development of the property (an accessory building) could limit possible future adverse effects on natural resources through removing the potential for another single family home. The applicant asserts that a single family home would impact more of the wetlands through the construction of a dock and impact to natural vegetation as well as a larger building imprint. Paul Oehme: Let me bring up the slide show. Mayor Ryan: Alright. Paul Oehme: So thank you Madam Mayor and City Council members. This is a proposed vacation for a drainage and utility easement at 3790 Lone Cedar Avenue. So Lone Cedar Avenue is just south of Lake Minnewashta, north of Highway 5 and the properties in question are the last two properties on Lone Cedar Lane. The easement in question that's proposed for the vacation is located right between Lots I and 2. This property has recently been sold and the property owner, current property owner owns both lots. So again the drainage and utility easement was dedicated back in the original plat in 1962 between two lots shown here in a little bit more detail. It's a 10 foot wide drainage and utility easement on both sides of the parcel line. The City does not have any utilities, water or sanitary sewer in this easement and there are no private utilities in this easement as well such as gas or electric and those type of casements so we did talk to the DNR, or contacted the DNR for this easement if they had any concerns for the vacation. They actually sent a letter back today, late this afternoon saying they didn't have any issues with the vacation of this easement so, so staffs in support of dedication. Kate Aanenson: Can I just give a little background on that too? Paul Oehme: Yep. Kate Aanenson: There was two lots of record. Can you just go back a little bit. So this, Lots I and 2, they were two lots of record and so the applicant on that lot actually got a variance to put a garage on that second lot so to vacate the easement allows him to use it, which we were excited about as opposed to having a house that close to Highway 5 and it did have access so it's really a better use of the property so that's why we did support the variance and this is the last part of the condition of that variance was to get the vacation of the easement. Mayor Ryan: So are they done with any construction on the property? Kate Aanenson: They have to wait, yeah. Mayor Ryan: It will be a garage. Kate Aanenson: Yep it will be a garage but they had to get, they had to vacate the easement first in order to build a garage because they want to move it closer to the house. The City and I have since changed the address to 3790 Lone Cedar Lane to match the neighbors and facilitate emergency response and postal services. Two lots of record were included in the sale. There is a 1981 single family home on PID 25700020. There is a vacant lot adjacent with PID 25700010. Both are on Lake Nfirmewashta's south side. A variance from the 1W wetland setback is requested from the city to allow the building of a 26x 38.5' garage accessory building on the vacant lot. Yve met with Mr. Bob Generous and Ms. Vanessa Strong regarding the project. Both the City Building Department and Lake resources staff support an accessory building as the optunal usage for this lot versus the alternative of another single-family home. As an official lot of record, a ra could be made to build a house on this lot as an alternative to the accessory building proposal. Provided the accessory building is approved, I am willing to consolidate the two lots into one, and thereby permanently remove the potential for another single-family home. If another single-family home was built, it would result in more impact to the wedand and lake with another dock, erosion from usage, and riparian owner weed removal rights of 2500 square feet plus a 15' path to dear water. Another house would also impact a city fire hydrant, the access road, and a drainage ditch. Lot 1 is zoned for a single-family home and a hardship of usage exists from the lot shape and lack of buildable space. Mr. Generous notes that combining lots vacates the existing 10' side lot setback between these two lots. He also supports waiving the 30' frontage setback to the proposed 17 setback to provide more spacing from the lake OHW mark. Instead of the 75' setback from the OHW mark, the proposed location is 71.8' for one comer as shown on the Site Plan. 99% of the building area satisfies the 75' lake setback and City Code Section 20-481. The previous (and currently website ordinance posted) OHW mark was 944.5', but it was recently changed to 945.9. Your consideration and approval of this variance request for an accessory building with the condition of lot consolidation is appreciated.
