WHEREAS, pursuant to Minnesota Statutes Seebon 412.851, after two (2) weeks'
published and posted notice of the hearing and after mailing written notice of the hearing at least ten
(10) days before the hearing to each property owner affected by the proposed vacauon, the
Chanhassen City Council has conducted a hearing to consider the vacation of the public drainage
and utility easements legally described on the attached Exhibit "A"; and
WHEREAS, following the hearing and consideration of the proposed vacation, the Council
has determined that it is in the public interest to vacate the public drainage and utility easements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chanhassen:
I . 'Me public drainage and utility easements legally described on the attached Exhibit
A are hereby vacated.
2. ne vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas and sewer ImM

Dear Mr. Henricksen,
Thank you for seeking input from the Department of Natural Resources regarding the proposed vacation
of a portion of the drainage and utility easement on 3690 Lone Cedar Lane. Your letter was forwarded
to me to review and provide comments as required by M.S. 412.851.
M.S. 412.851 indicates that "No vacation shall be mode unless it appears in the interest of the public to
do so." In response, "The commissioner must evaluate:
(1) the proposed vacation and the public benefits to do so,
(2) the present and potential use of the landfor access to public waters; and
(3) how the vacation would impact conservation of natural resources."
The DNR has reviewed the proposed vacation of the utility easement abutting the public waters of Lake
Minnewashta in the city of Chanhassen, and we offer the following comments:
The proposed vacation public benefit: There is nothing in the application/letter that states a clear
benefit to the public.
Present and potential use of the land for access to public waters: Although this proposed vacation is a
platted as a utility easement, the DNR invites water access discussion when vacating any possible public
access.
Impact on the conservation of natural resources: The applicant has indicated that the proposed
development of the property (an accessory building) could limit possible future adverse effects on
natural resources through removing the potential for another single family home. The applicant asserts
that a single family home would impact more of the wetlands through the construction of a dock and
impact to natural vegetation as well as a larger building imprint. Reducing the potential for an increase
in impervious surface in the Lake Minnewashta water shed would be beneficial from a natural resources
conservation standpoint if the applicant is able to develop the property as stated.

Using the above criteria and considering existing utilities in the easement, the DNR does not oppose the
vacation.
It is unclear how the city will access utilities on the property if the vacation is permitted. if the city
grants the vacation the DNR would encourage the city maintain some access to its utilities.

Paul Oehme: Let me bring up the slide show.
Mayor Ryan: Alright.
Paul Oehme: So thank you Madam Mayor and City Council members. This is a proposed
vacation for a drainage and utility easement at 3790 Lone Cedar Avenue. So Lone Cedar
Avenue is just south of Lake Minnewashta, north of Highway 5 and the properties in question
are the last two properties on Lone Cedar Lane. The easement in question that's proposed for the
vacation is located right between Lots I and 2. This property has recently been sold and the
property owner, current property owner owns both lots. So again the drainage and utility
easement was dedicated back in the original plat in 1962 between two lots shown here in a little
bit more detail. It's a 10 foot wide drainage and utility easement on both sides of the parcel line.
The City does not have any utilities, water or sanitary sewer in this easement and there are no
private utilities in this easement as well such as gas or electric and those type of casements so we
did talk to the DNR, or contacted the DNR for this easement if they had any concerns for the
vacation. They actually sent a letter back today, late this afternoon saying they didn't have any
issues with the vacation of this easement so, so staffs in support of dedication.
Kate Aanenson: Can I just give a little background on that too?
Paul Oehme: Yep.
Kate Aanenson: There was two lots of record. Can you just go back a little bit. So this, Lots I
and 2, they were two lots of record and so the applicant on that lot actually got a variance to put a
garage on that second lot so to vacate the easement allows him to use it, which we were excited
about as opposed to having a house that close to Highway 5 and it did have access so it's really a
better use of the property so that's why we did support the variance and this is the last part of the
condition of that variance was to get the vacation of the easement.
Mayor Ryan: So are they done with any construction on the property?
Kate Aanenson: They have to wait, yeah.
Mayor Ryan: It will be a garage.
Kate Aanenson: Yep it will be a garage but they had to get, they had to vacate the easement first
in order to build a garage because they want to move it closer to the house.
Mayor Ryan: Okay, perfect.

The property owner of 3790 Lone Cedar Lane has requested the city vacate the easterly 10 feet and westerly 10 feet
of drainage and utility easements of their parcels located on Cedar Crest, Lots I and 2, respectively. The entire
drainage and utility easement is being vacated to meet conditions of a lot combination and variance. The drainage and
utility easements on Lots I and 2 were originally platted in 1962 in the event public drainage and utilities were
required. Staff has reviewed the vacation and finds no need for the easements. Furthermore, staff agrees that the
vacation, in concert with the variance and lot combination, will benefit the surrounding natural resources. The
Minnesota Department of Natural Resources (DNR) was provided the vacation request for review in accordance with
Minnesota Statute 412.851 on November 15, 2018. This statute gives the DNR a 60 -day period to review
vacations, in which the DNR did not respond as of January 17, 2019 (63 days).
No exisfing public or private utilities, structures, or public appurtenances are within the requested vacation area.
Staff recommends granting the vacation of the I 0 -foot portions of drainage and utility easements of Cedar Crcst�

WHEREAS, pursuant to Minnesota Statutes Section 412.85 1, after two (2) weeks'
published and posted notice of the hearing and after mailing written notice of the hearing at least ten
(10) days before the hearing to each property owner affected by the proposed vacation, the
Chanhassen City Council has conducted a hearing to consider the vacation of the public drainage
and utility easements legally described on the attached Exhibit "N'; and
WHEREAS, following the hearing and consideration of the proposed vacation, the Council
has determined that it is in the public interest to vacate the public drainage and utility easements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chanhassen:
I . The public drainage and utility easements legally described on the attached Exhibit
A are hereby vacated.
2. The vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines,

Dear Mr. Landwehr:
The City of Chanhassen received a vacation request for drainage and utility easements located
between the lot lines of P.I.D. 251700020 and 251700010 (3790 Lone Cedar Lane). This
vacation abuts the south side of Lake Minnewashta, a public water. In accordance with
Minnesota Statute 412.851, Chanhassen is providing this written notification to inform you of
the public hearing on the matter, which will be scheduled 60 days after receipt of this
notification. This hearing is projected to occur on January I e, 2019.
Enclosed in this notification you will find the following documents to assist you in the evaluation
of the proposed drainage and utility easement vacation:
Exhibit 1: A letter from the property owner discussing the intent and subsequent justification.
Chanhassen agrees that the vacation and lot combination will benefit the surrounding natural
resources. The proposed vacation will allow the property owner to place the proposed accessory
building 10 feet finther west on P.I.D. 251700010. This placement will result in a shorter
driveway and reduced impervious coverage, an increased structure setback from the Lake
Minnewashta's OHW, and an increased setback from the wetland located on the northern section
of the property.
Exhibit 2: Existing survey of drainage and utility easement area to be vacated (10' on both sides
of the abutting lot lines).

Dear Mr. Bob Generous & City Planning Commission,
On 9/28/2018, 1 purchased a home at 3750 Arboretum Blvd within the city limits of
Chanhassen. The City and I have since changed the address to 3790 Lone Cedar Lane to
match the neighbors and facilitate emergency response and postal services.
Two lots of record were included in the sale. There is a 1981 single family home on PID
25700020. There is a vacant lot adjacent with PID 25700010. Both are on Lake
Nfirmewashta's south side.
A variance from the 1W wetland setback is requested from the city to allow the building of
a 26x 38.5' garage accessory building on the vacant lot. Yve met with Mr. Bob Generous
and Ms. Vanessa Strong regarding the project. Both the City Building Department and Lake
resources staff support an accessory building as the optunal usage for this lot versus the
alternative of another single-family home. As an official lot of record, a ra could be made
to build a house on this lot as an alternative to the accessory building proposal.
Provided the accessory building is approved, I am willing to consolidate the two lots into
one, and thereby permanently remove the potential for another single-family home. If
another single-family home was built, it would result in more impact to the wedand and
lake with another dock, erosion from usage, and riparian owner weed removal rights of
2500 square feet plus a 15' path to dear water. Another house would also impact a city fire
hydrant, the access road, and a drainage ditch. Lot 1 is zoned for a single-family home and
a hardship of usage exists from the lot shape and lack of buildable space.
Mr. Generous notes that combining lots vacates the existing 10' side lot setback between
these two lots. He also supports waiving the 30' frontage setback to the proposed 17
setback to provide more spacing from the lake OHW mark. Instead of the 75' setback from
the OHW mark, the proposed location is 71.8' for one comer as shown on the Site Plan. 99%
of the building area satisfies the 75' lake setback and City Code Section 20-481. The previous
(and currently website ordinance posted) OHW mark was 944.5', but it was recently
changed to 945.9.
Your consideration and approval of this variance request for an accessory building with the
condition of lot consolidation is appreciated. As noted above, this plan is supported by
Lake Resources and City Building Dept staff.

Dear Mr. Generous & City Planning Commission,
On 9/28/2018, 1 purchased a home at 3750 Arboretum Blvd. within the city limits of Chanhassen. The
City and I have since changed the address to 3790 Lone Cedar Lane to match the neighbors and facilitate
emergency response and postal services.
Two lots of record were in included in the sale. There is a 1981 single family home on PID 25700020.
There is a vacant lot adjacent with PID 25700010. Both are on Lake Minnewashta's south side.
A variance from the 100'wetland setback is requested from the city to allow the building of a 26' x 38.5'
garage accessory building on the vacant lot. I've met with Mr. Bob Generous and Ms. Vanessa Strong
regarding the project. Both the City Building Department and Water Resources staff support an
accessory building as the optimal usage for this lot versus the alternative of another single-family home.
As an official lot of record, a case could be made to build a house on this lot as an alternative to the
accessory building proposal.
To be a good steward of the lake and water resources, I will consolidate the two lots into one
contingent upon approval of the variance, and thereby permanently remove the potential for another
single-family home. I am requesting vacation of the drainage and utility easement. The City Engineer
confirmed the easement is not used. Recording of the vacation will occur concurrently with the
recording of the variance and consolidation of the lots.
If another single-family home was built, it would result in more impact to the wetland and lake with
another dock, erosion from usage, and riparian owner weed removal rights of 2500 square feet plus a
15' path of weed removal to clear water. Another house would also impact a city fire hydrant, the

access road, and a drainage ditch. Lot 1 is zoned for a single-family home and a hardship of usage exists
from the lot shape and lack of buildable space.
Mr. Generous and City staff support waiving the 30' frontage setback to the proposed 17' setback to
provide more spacing from the lake OHW mark. Instead of the 75' setback from the CHW mark, the
proposed location is 71.8' for one corner as shown on the Site Plan. 99% of the building area satisfies
the 75' lake setback and City Code Section 20-481. The previous (and currently website ordinance
posted) OHW mark was 944.5', but it was recently changed to 945.9'.
Your consideration and approval of this variance request for an accessory building with the condition of
lot consolidation is appreciated. As noted above, this plan is supported by Water Resources and City
Building Dept. staff.

COMMITMENT CONDITIONS
1. DEFINITIONS
(a) "Knowledge" or "Known": Actual or imputed knowledge, but not constructive notice imparted by the
Public Records.
(b) "Land" The land described in Schedule A and affixed improvements that by law constitute real property.
The term "Land" does not include any property beyond the lines of the area described in Schedule A, nor
any right, Ube, interest, estate, or easement in abutting streets, roads, avenues, alleys, lanes, ways, or
waterways, but this does not modify or limit the extent that a right of access to and from the Land is to be
insured by the Policy.
(c) "Mortgage": A mortgage, deed of trust or other security instrument including one evidenced by
electronic means authorized by law.
(d) "Policy": Each contract of fitle insurance, in a form adopted by the American Land Titie Association,
issued or to be issued by the Company pursuant to this Commitment
(e) "Proposed Insured": Each person identified in Schedule A as the Proposed Insured of each Policy to be
issued pursuant to this Commitment
(f) "Proposed Policy Annount": Each dollar amount specified in Schedule A as the Proposed Policy Amount
of each Policy to be issued pursuant to this Commitment
(g) "Public Records` Records established under state statutes eit the Commitment Date for the purpose of
imparting constructive notes of matters relating to real property to purchasers for value and without
Knowledge.
(h) "Tifle": The estate or interest described in Schedule A.
2. If all* of the Schedule B, Part t—Requirements have not been met within the finne period specified in the
Commitment to Issue Policy, this Commitment terminates and the Company's liability and obligation end.
3. The Company's liability and obligation is limited by and this Commitment is not valid without

S. LIMITATIONS OF LIABILITY

Commitment and the delivery of the amended Commitment, resulting from the Proposed Insured's good

(b) The Company shall not be liable under Commitment Condition 5(a) if the Proposed Insured requested the
amendment or had Knowledge of the matter and did not notify the Company about it in writing.
(c) The Company will only have liability under Commitment Condition 4 if the Proposed Insured would not
have incurred the expense had the Commitment included the added matter when the Commitment was
first delivered to the Proposed Insured.
(d) The Company's liability shall not exceed the lesser of the Proposed Insured's actual expense incurred in
good faith and described in Commitment Conditions 5(a)(i) through 5(a)(iii) or the Proposed Policy
Amount.

(g) In any event, the Company's liability is limited by the terms and provisions of the Policy.
6. LIABILITY OF THE COMPANY MUST BE BASED ON THIS COMMITMENT
(a) Only a Proposed Insured identified in Schedule A. and no other person, may make a claim under this
Commitment.
(b) Any claim must be based in contract and must be restricted solely to the terms and provisions of this
Commitment.
(c) Until the Policy is issued, this Commitment, as last revised, is the exclusive and entire agreement
between the parties with respect to the subject matter of this Commitment and supersedes all prior
commitment negotiations, representations, and proposals of any kind, whether written or oral, express or
implied, relating to the subject matter of this Commitment.
(d) The deletion or modification of any Schedule B, Part II—Exception does not constitute an agreement or
obligation to provide coverage beyond the terms and provisions of this Commitment or the Policy.
(e) Any amendment or endorsement to this Commitment must be in writing and authenticated by a person
authorized by the Company.
(f) When the Policy is issued, all liability and obligation under this Commitment will end and the Company's
only liability will be under the Policy.
7. IF THIS COMMITMENT HAS BEEN ISSUED BYAN ISSUING AGENT
The issuing agent is the Company's agent only for the limited purpose of issuing title insurance commitments
and policies. The issuing agent is not the Company's agent for the purpose of providing closing or settlement
services.
8. PRO -FORMA POLICY
The Company may provide, at the request of a Proposed Insured, a pro -forma policy illustrating the coverage
that the Company may provide A PrO-fOFma policy neither reflects the status of Title at the time that the
pro -forma policy is delivered to a Proposed Insured. nor is it a commitment to insure.
9. ARBITRATION
The Policy contains an arbitration clause. All arbitrable matters when the Proposed Policy Amount is

Requirements
All of the following Requirements must be met
1 The Proposed Insured must notify the Company in writing of the name of any party not referred to in this
Commitment who will obtain an interest in the Land or who will make a loan on the Land. The Company
may then make additional Requirements or Exceptions.
2. Pay the agreed amount for the estate or interest to be insured.
3. Pay the premiums, fees, and charges for the Policy to the Company.
4. Documents satisfactory to the Company that convey the Tide or create the Mortgage to be insured, or
both, must be properly authorized, executed, delivered, and recorded in the Public Records.
5. A deed from Abraham C. Abbariao and Dorothy P. Abbariao, married to each other to Richard D. Morris
must be signed and recorded.
6. A mortgage from Richard D. Morris, a single person to Wells Fargo Bank, N.A. in the amount of
$460,000.00 must be signed and recorded.
7. Edina Realty Title's "Affidavit by Seller" or an affidavit of similar form must be signed at the closing.
8. Edina Realty Title's "Affidavit by Mortgagor" or an affidavit of similar form must be signed at the closing.
9. A completed Certificate of Real Estate value must accompany each deed or conveyance which is to be
recorded.
10. VERIFY PRIOR TO CLOSING THAT THERE ARE NO UNPAID WATER/UTILITY CHARGES ON
SUBJECT PROPERTY -
11. Pursuant to Internal Revenue Service requirements, Edina Realty Title requires that every seller in a real
estate transaction fully complete and execute a "Certification for No Information Reporting on the Sale or
Exchange of a Principal Residence."
12. A completed Well Disclosure Certificate must accompany each deed or conveyance which is to be

proposal assumes building site is prepared and level, with no underground obstructions, has easy and
obtainable TractoriTrailer access and has no other features that can inhibit efficient construction
performance. Any delays or additional costs resulting from owner(s) or owner(s) agents negligence to or
failure to comply with any part of this contract, or have not completed site preparation prior to start of
construction will be charged extra material and labor according to Change Order Procedures and Schedules.

Application to Combine Real Estate Parcels
Per MIN Statute 272,46 the county auditor, upon written application of any person, shall for property
tax purposes only, combine legal descriptions of contiguous parcels to which the applicant(s) hold
title.
In order to be combined, the following requirements must be met:
• Receipt of completed form by owner or designated representative
• Based upon deeds of record. parcels must be of the same (identical) ownership
• Parcels must be contiguous
• Parcels must be located in same unique taxing districts (TAG)
• Current year and delinquent taxes must be paid on each parcel
• If parcels are in a Tax increment Financing District (TIF), they must be located in the
same TIF district
• If special assessments are not paid on all parcels, the city/township would need to
rpnertify the SiDecial assessments for the new parcel
CAUTION
Parcels that have been combined cannot be Subdivided again without local municipality approval.
if located in a township, carver County Land Management Office must also approve the subdivision.
Combined property tax will be reflected on next year's tax statement
