CONDITIONAL USE PERMIT
1. Permit Subject to the terms and conditions set forth herein, the City of Chanhassen
hereby grants a conditional use permit for the following use:
Screened Outdoor Storage
2. Property. The permit is for property situated in the City of Chanhassen, Carver County,
Minnesota, and legally described as Lot 1, Block 2, Chanhassen Lakes Business Park 5th Addition.
3. Conditions. The Conditional Use Permit— Planning Case 2014-22 is issued for the
construction of a screened outdoor storage as shown in plans dated received August 27, 2014, and
adoption of the Findings of Fact and Recommendation, subject to the following conditions:

a. A Conditional Use Permit shall be recorded at Carver County.
b. No unlicensed or inoperable vehicle/equipment shall be stored on the premises.
Water Resources Coordinator
a. All stockpiled materials must have adequate perimeter control.
b. The existing catch basin must be protected at all times from having sediment enter. The
applicant must demonstrate how this will be accomplished to the satisfaction of the City.
c. Access to the catch basin must be provided at all times for the City or their representatives.
d. The applicant must provide a detailed description of the anticipated materials to be stored on-
site. No materials considered hazardous may be stored here.
e. No maintenance or refueling of vehicles may occur in the storage area.
f. Any leaks or spills must be cleaned up immediately and, if these spills exceed state threshold,
must be reported to the State Duty Officer."
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit
5. Lapse. If within one year of the issuance of this permit the authorized construction has
not been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance. SCANNED
6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal
misdemeanor.

CONDITIONAL USE PERMIT
1. Permit. Subject to the terms and conditions set forth herein, the City of Chanhassen
hereby grants a conditional use permit for the following use:

e. No maintenance or refueling of vehicles may occur in the storage area.
f. Any leaks or spills must be cleaned up immediately and, if these spills exceed state threshold,
must be reported to the State Duty Officer."
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit.
5. Lapse. If within one year of the issuance of this permit the authorized construction has
not been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal
misdemeanor.

VISITOR PRESENTATIONS.
Sam Chase: Thank you. The name's Sam Chase, 6621 Arlington Court and I'd like to talk about the road
conditions just real briefly. I've lived here most of my life and last year the roads were just abysmal for a
period of time. I saw people sliding through intersections. I had a personal experience where on
Mulberry I spun 360. Almost wound up in the lake. I had 2 cars that I pulled out of ditches or pushed out
of ditches and I ran into a number of telephone, not me but I saw a number of telephone poles that people
had run into. I talked to the gentleman in charge of the roads and he said it's because they're not using
sand anymore. And the State had stopped using sand. So I called MnDOT. MnDOT said there are three
reasons they've quit using sand. The first was because at 70 miles an hour it didn't work. We don't go
70 miles an hour here. The second was they had a lot of high winds blowing on the roads and we don't
have that. And the third was that he said we clear the roads and the highways within 3 hours right to the
pavement and that's not a reasonable expectation. The city of Chanhassen there will be times when it's
days before the roads are cleared so this year I talked to Charlie Burke and asked him if they were going
to start using sand at all because last year was so horrendously bad and he said no. It was his decision
with one other person and they weren't going to use it. He said they had sand but I couldn't really get an
answer from him as to whether they'd ever use it and it kind of boils down to either it pollutes. It's bad
for the environment. or it's costly and I looked everywhere I could on the internet. I cannot find
anything that says sand is worst than salt and chemicals. Sand doesn't mix with anything. Sand doesn't
corrode anything. Sand doesn't pollute anything. ltjust sits and the gentleman last year said they're
using extra chemicals to try and compensate for this. I've talked to multiple teachers and parents where I
volunteer in the school. We're all eagerly hoping that this will change. I'm not asking that you dump
sand everywhere but I would hope that there would be times when you look at the roads and say this is
just beyond belief. We can't work with salt. It's not evaporating or dissolving the ice. We need to use
some sand. It'sjust entirely too dangerous. Last year I stopped shopping in Chanhassen because Ijust
couldn't move around on these roads safely without being worried that I was going to hit someone or
someone else was going to hit me. I know it costs money but it's a matter of public safety and the
families and the people who work in Chanhassen really need to be able to move around without having to
worry that they're going to slide into a ditch or another car or a light pole or who knows what. That's it.

those watching at home. We're glad that youjoined us this evening. At this time I'd like to go through a
few changes and modifications to the agenda that was published. First of all at the request of the
applicant, item number 5. E(5) on the consent agenda which is, was to consider the Bluff Creek, Preserve
at Bluff Creek Ob Addition will be removed so if you're here for that item, number E(5), we will not be
discussing that this evening. Also the resolution relating to item number E(9) has been modified with a
change in the, Be It Resolved that the City Council hereby requests installation as opposed to approving
the installation. That resolution is in front of the council members. You should have that. We'll
continue to have that on the consent agenda unless someone would like separate discussion on it. And
then also we will add an item 3 under New Business which relates, or we'll consider approval of
renewing an agreement with the BCA for data access for our prosecution. So at this point unless there are

EXECUTIVE SUMMARY
The developer is requesting Conditional Use Permit approval for Screened Outdoor
Storage located at 1380 Park Road. The site is located at the northeast intersection of
Park Road and Park Place.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on August 19,2014. The Planning
Commission had no issues or concerns and voted unanimously to recommend approval
of the project. The August 19, 2014 Planning Commission minutes are included in the
City Council packet. Since the Planning Commission meeting, the applicant submitted
revised landscaping plans showing vegetation that provides year-round screening. The
staff report has been revised to reflect this change.
RECOMMENDATION
Staff recommends approval of the request.

On August 18, 1985, the Chanhassen City Council approved an off -premise parking lot on Lot 1,
Block 2, Chanhassen Lakes Business Park 501 Addition.
PROPOSAUSUMMARY
The applicant is requesting a conditional use permit for a screened outdoor storage yard to
occupy an existing parking lot located at the northeast intersection of Park Road and Park Place.
The site is zoned Industrial Office Park and has an area of 1. 16 acres. The screened outdoor
storage is permitted as a conditional use in the Industrial Office Park District.

The intent is to screen the outdoor storage area with berms and landscaping. The space will be
used to house equipment associated with a utility construction business located southwest of the
subject site. All equipment is proposed to be screened. The applicant also intends to add a chain
link fence and a gate to secure the site.

The applicant is requesting to utilize

located at the northeast intersection

The fence and gate must be located entirely upon the private property. Encroachment into a city
easement shall require an encroachment agreement between the property owner and the city. The
fence and gate shall not be placed within the public right-of-way.

According to the plan, no grading is proposed with the CUP application. The site was graded in
conjunction with Grading Permit 13-05. This permit has expired. If additional grading over 50
cubic yards is required, the applicant shall apply to amend the CUP accordingly, or apply for a
grading permit (if grading is less than 1,000 cubic yards).

applicant must submit a detailed and comprehensive list of materials to be stored on site. These
cannot include hazardous waste. The presence of soils materials on a paved surface will generate
sediment -laden waters. The presence of a catch basin in the northeast comer of the project area
will result in sediment -laden waters leaving the site. It is required under federal, state and local
rules and guidelines that no sediment -laden waters enter into regulated water features. The
applicant must demonstrate how they will prevent any sediment from entering the catch basin in
the northeast comer of the parking lot or otherwise leaving the site.
The catch basin within the parking lot is part of Chanhassen's Municipal Separate Storm Sewer
System (MS4). This catch basin is regulated under the National Pollution Discharge Elimination
System - MS4 Permit program. Chanhassen is responsible for the operation and maintenance of
this catch basin and the pond into which it drains. City crews must have access to this catch
basin for inspection and maintenance purposes. If the catch basin cannot be protected from
sediment -laden waters or other illicit discharges, it must be removed or bulkheaded. If the city
cannot be provided access to the catch basin it must be removed or bulkheaded. If these
conditions cannot be met, I strongly recommend denial of the Conditional Use Permit.
Landscapin
City ordinance requires that outdoor storage areas be screened from all public views. The
applicant is proposing landscaping on top of berms to accomplish this. The proposed landscape
plan provides good coverage of the area-,butfiet. The applicant revised the landscape plans to
insure year-round screening is provided. Staff f-eeeffffneads that the fnajeFity of ShFubs

CONDITIONAL USE PERMIT
Screened Outdoor Storage is permitted in the IOP District as a conditional use. The following
constitutes staffs review of this proposal against conditional use permit standards:
GENERAL ISSUANCE STANDARDS
1. Will not be detrimental to or endanger the public health, safety, comfort, convenience
or general welfare of the neighborhood or city.
FINDING: The site is zoned IOP. The proposed use will not create any significant or
unexpected impacts from this operation.
2. Will be consistent with the objectives of the city's comprehensive plan and this chapter.
FINDING: The proposed use is consistent with the City's Comprehensive Plan. The city
approved a site plan for the site without variances and found that it is in compliance with the
zoning ordinance requirements. The proposed use is specifically permitted in the IOP
District.

3. Will be designed, constructed, operated and maintained so to be compatible in
appearance with the existing or intended character of the general vicinity and will not
change the essential character of that area.
FINDING: The site is located in the industrial district. The applicant has submitted plans
that include berming and landscaping which will provide adequate screening of the site.
4. Will not be hazardous or disturbing to existing or planned neighboring uses.
FENDING: There will be no measurable impacts to the existing or planned neighboring
uses.
5. Will be served adequately by essential public facilities and services, including streets,
police and fire protection, drainage structures, refuse disposal, water and sewer systems
and schools; or will be served adequately by such facilities and services provided by the
persons or agencies responsible for the establishment of the proposed use.
FINDING: Full city services are available to this site. Roads serving the site are fully
capable of handling the access needs of this proposal.
6. Will not create excessive requirements for public facilities and services and will not be
detrimental to the economic welfare of the community.
FENDING: Staff is not aware of any excessive requirements for public facilities. The
landscape business is a good auxiliary use within the industrial park.
7. Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare
because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or
trash.
FINDING: This site will not create adverse impacts to persons, property or the general
welfare of the area. The screened outdoor storage will comply with city ordinances.
8. Will have vehicular approaches to the property which do not create traffic congestion
or interfere with traffic or surrounding public thoroughfares.
FENDING: The site is accessible from a city street designed to commercial standards.
9. Will not result in the destruction, loss or damage of solar access, natural, scenic or
historic features of major significance.
FENDING: The development of this site will not result in the loss of any features of major
significance.

10. Will be aesthetically compatible with the area.
FINDING: The site contains an existing parking lot which the applicant intends to screen
via berms and landscaping. All equipment stored on site will be screened.
11. Will not depreciate surrounding property values.

Application of MG, LLC for a Conditional Use Permit to allow screened outdoor storage in the
Industrial Office Park District.
On August 19, 2014, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of MG, LLC for a Conditional Use Permit to allow
screened outdoor storage in the Industrial Office Park District. The Planning Commission
conducted a public hearing on the proposed rezoning preceded by published and mailed notice.
The Planning Commission heard testimony from all interested persons wishing to speak and now
makes the following:
FINDINGS OF FACT
1. The property is currently zoned Industrial Office Park District, 10P.
2. The property is guided in the Land Use Plan for Office Industrial.
3. The legal description of the property is Lot 1, Block 2, Chanhassen Lakes Business Park 5th
Addition.
4. Conditional Use Permit:
a. Will not be detrimental to or endanger the public health, safety, comfort,
convenience or general welfare of the neighborhood or city.
FINDING: The site is zoned IOP. The proposed use will not create any significant or
unexpected impacts from this operation.
b. Will be consistent with the objectives of the city's comprehensive plan and this
chapter.
FINDING: The proposed use is consistent with the City's Comprehensive Plan. The city
approved a site plan for the site without variances and found that it is in compliance with
the zoning ordinance requirements. The proposed use is specifically permitted in the IOP
District.
c. Will be designed, constructed, operated and maintained so to be compatible in
appearance with the existing or intended character of the general vicinity and will
not change the essential character of that area.

FINDING: The site is located in the industrial district. The applicant has submitted
plans that include berming and landscaping which will provide adequate screening of the
site.
d. Will not be hazardous or disturbing to existing or planned neighboring uses.
FINDING: There will be no measurable impacts to the existing or planned neighboring
uses.
e. Will be served adequately by essential public facilities and services, including
streets, police and fire protection, drainage structures, refuse disposal, water and
sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use.
FINDING: Full city services are available to this site. Roads serving the site are fully
capable of handling the access needs of this proposal.
E Will not create excessive requirements for public facilities and services and will not
be detrimental to the economic welfare of the community.
FINDING: Staff is not aware of any excessive requirements for public facilities. The
landscape business is a good auxiliary use within the industrial park.
g. Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare
because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents,
or trash.
FINDING: This site will not create adverse impacts to persons, property or the general
welfare of the area. The screened outdoor storage will comply with city ordinances.
h. Will have vehicular approaches to the property which do not create traffic
congestion or interfere with traffic or surrounding public thoroughfares.
FINDING: The site is accessible from a city street designed to commercial standards.
i. Will not result in the destruction, loss or damage of solar access, natural, scenic or
historic features of major significance.
FINDING: The development of this site will not result in the loss of any features of
major significance.
j. Will be aesthetically compatible with the area.
FINDING: The site contains an existing parking lot which the applicant intends to
screen via berms and landscaping. All equipment stored on site will be screened.

watershed district rules. The draft rules were released for public review and comment earlier this spring.
TheDistrict is currently reviewing comments and anticipates implementing the permitting programthis
summer. Because the draft rules have not been adopted, the District does not currently have an official
permitting program. We appreciate the opportunity to provide comments on the project relative to the
draft rules and your willingness to work with the District in advance of the permitting program. The
following is a summary of FFBOND review comments for the 1380 Park Poad request for a conditional
use permit. The following comments are based on the draft rules that would likely apply to this project
and highlight the areas where revisions or additional information would be needed to fully meet the draft
rules.

%le Q Erosion and Sediment Control applies if a project disturbs 5,000 square feet or more or disturb
50 cubic yards or more of earth. Based on the submitted landscaping plan, it appears that the project will

erosion and gediment control plan submittal) and meeting the criteria established in Section 3 of

Summary

rules once implemented. Depending on the timing of the project and the off cial implementation date of
the draft rules, the project could be required to obtain an Brodon and Sediment Control permit from

FINDINGS OF FACT
AND RECOMMENDATION
IN RE:
Application of MG, LLC for a Conditional Use Permit to allow screened outdoor storage in the
Industrial Office Park District.
On August 19, 2014, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of MG, LLC for a Conditional Use Permit to allow
screened outdoor storage in the Industrial Office Park District. The Planning Commission
conducted a public hearing on the proposed rezoning preceded by published and mailed notice.
The Planning Commission heard testimony from all interested persons wishing to speak and now
makes the following:
FINDINGS OF FACT
1. The property is currently zoned Industrial Office Park District, IOP.
2. The property is guided in the Land Use Plan for Office Industrial.
3. The legal description of the property is Lot 1, Block 2, Chanhassen Lakes Business Park P
Addition.
4. Conditional Use Permit:
a. Will not be detrimental to or endanger the public health, safety, comfort,
convenience or general welfare of the neighborhood or city.
FINDING: The site is zoned IOP. The proposed use will not create any significant or
unexpected impacts from this operation.
b. Will be consistent with the objectives of the city's comprehensive plan and this
chapter.
FINDING: The proposed use is consistent with the City's Comprehensive Plan. The city
approved a site plan for the site without variances and found that it is in compliance with
the zoning ordinance requirements. The proposed use is specifically permitted in the IOP
District.
c. Will be designed, constructed, operated and maintained so to be compatible in
appearance with the existing or intended character of the general vicinity and will
not change the essential character of that area.

FINDING: The site is located in the industrial district. The applicant has submitted
plans that include berming and landscaping which will provide adequate screening of the
site.
d. Will not be hazardous or disturbing to existing or planned neighboring uses.
FINDING: There will be no measurable impacts to the existing or planned neighboring
uses.
e. Will be served adequately by essential public facilities and services, including
streets, police and fire protection, drainage structures, refuse disposal, water and
sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use.
FINDING: Full city services are available to this site. Roads serving the site are fully
capable of handling the access needs of this proposal.
E Will not create excessive requirements for public facilities and services and will not
be detrimental to the economic welfare of the community.
FINDING: Staff is not aware of any excessive requirements for public facilities. The
landscape business is a good auxiliary use within the industrial park.
g. Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare
because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents,
or trash.
FINDING: This site will not create adverse impacts to persons, property or the general
welfare of the area. The screened outdoor storage will comply with city ordinances.
h. Will have vehicular approaches to the property which do not create traffic
congestion or interfere with traffic or surrounding public thoroughfares.
FINDING: The site is accessible from a city street designed to commercial standards.
i. Will not result in the destruction, loss or damage of solar access, natural, scenic or
historic features of major significance.
FINDING: The development of this site will not result in the loss of any features of
major significance.
j. Will be aesthetically compatible with the area.
FINDING: The site contains an existing parking lot which the applicant intends to
screen via berms and landscaping. All equipment stored on site will be screened.

k. Will not depreciate surrounding property values.
FINDING: The site is being used for a screened outdoor storage operation which is
consistent with its designation. It will not depreciate surrounding property values.
1. Will meet standards prescribed for certain uses as provided in this article.
Sec. 20-308. Screened outdoor storage states:
The following applies to screened outdoor storage:
1. All outdoor storage must be completely screened with 100 percent opaque fence
or landscaped screen.
FINDING: The applicant intends to store supplies and vehicles within a screened
parking lot. Screening will be achieved via berming and landscaping.

incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the Conditional
Use Permit to allow screened outdoor storage in the Industrial Office Park District.

PARK (10P) AND LOCATED AT 1380 PARK ROAD (NORTHEAST CORNER OF
PARK ROAD AND PARK PLACE). APPLICANT/PROPERTY OWNER: MG. LLC.
PLANNING CASE 2014-22.
Generous: Thank you Chairman Aller, commissioners. Planning Case #2014-22 is a
Conditional Use Permit for outdoor storage. The developer is MG, LLC. They are a contractor
in the community and they do, they own the property. Previously they came in and did some
grading to the site. If you've been out there they already have the berming in place and so as
part of this they'd be adding landscaping and some fencing in this. This property is located at
the northeast comer of Park Road and Park Place. It is an existing parking lot area that was built
to provide overflow parking for the property just to the south of it across Park Road. Aerial view
of the site. There is stormwater treatment on the property, or stormwater facilities on the
property and that was part of the discussion as part of our review of this. At one time there was,
where soil was stored on the property. They have removed all of that and the applicant has
advised me that they don't intend to put any more soil on that site so. Let's see, here's a
schematic of the access will be from Park Road. The driveway into the site, they are proposing
to put a security gate in place and then they would have fencing along the eastern property line
so that people can't take trailers off the site without getting through the fencing. Here's a picture
of it as you're going west on Park Road. You can see some of the equipment on the property
currently. Not a whole lot of landscaping. The berming has greened up pretty well with the, the
one condition that we have as part of the landscaping is that they change some of the shrubs from
perennial, annual type leafing to evergreen trees or evergreen and so we'll have them work with
the City Forester to improve that screening so it's more year round basis. There is a dirt pile
that used to be on the property. It's now gone and it's not going to be there and actually one of
the conditions of approval is that they can't have it. If they do then they have to block up the
stormwater system in there so. Here's a picture of the fencing that will be at the main gate. It
will be lockable so that they can secure their equipment and materials on site. Staff is
recommending approval of the Conditional Use Permit for screened outdoor storage at 1380 Park
Road subject to the conditions in the staff report and adoption of Findings of Fact and
Recommendations. With that I'd be happy to answer any questions.
Aller: Bob under the Code, the screening has to be opaque?
Generous: Well it has to be, yes. Screening you can't see through it so.
Aller: Right.
Generous: It could be landscaping.
Aller: So it's notjust slat, like slat every other one or.
Generous: No. It has to be completely that you can't see what's behind there. And the berming
does most of the screening for the site. It'sjust the, at the very top of it, it will help to, forthe
taller equipment.

Alter: And then they're going to work with the City's Forester on the evergreens?
Generous: Right. Coming up with an appropriate plan for that and species.
Alter: Any additional questions?
Weick: For point of clarification. Are we approving the idea of screening the area or the idea of
storing stuff outside? Or both.
Generous: Well it's both. Screened outdoor storage.
Weick: It is?
Generous: So it would allow them to, the use is storage but.
Weick: So we don't care what type of things they put in there?
Generous: Well we do. We want them to provide us with a list of the materials that are going to
be out there and of course one of the conditions is they can't have hazardous materials stored
outside so.
Weick: Right.
Generous: They are putting that list together for us and that will be one of the things that we
review annually as part of our continuing conditional use permit reviews.
Alter: So if they violate the terms of conditions of the use permit then the City will come in and
we'll remove the permit and.
Generous: Yes. We could through the public hearing process Council could revoke that and
fliey can take everything off.
Weick: So does the, and I might have missed it. Does the screening have to completely hide
anything that's stored back there? Or can it be above the screening?
Generous: Well generally yes. It's supposed to screen everything but if they make a good faith
effort to screen it up 10 feet, you know if you see the very top of something it's not going to be
too bad.
Weick: Okay.
Aanenson: I just want to remind you too, I think the equipment's coming and going. It'sused
for the business so it's not.
Weick: They're in and out of there.

Aanenson: Yeah, it's not like, we do have another business that has outdoor storage and that's
down on Stoughton Avenue where things sit out there you know for longer periods of time so in
this circumstance equipment is coming and going so.

Gary Disch: Good evening Chairman, commissioners. My name is Gary Disch with Magney
Construction. Also MG, LLC and we're applying. Bob pretty much said everything. The dirt is
gone. We don't anticipate any, we aren't going to put any dirt back on there. No hazardous
waste. It is you know construction equipment. Excavators. Dump trucks. Trailers. So, and
we're going to be working with staff with our landscape architect to make sure the evergreens,
whatever they need.
Aller: Okay, thank you. So my understanding would be there's not going to be a bunch of oil
drums out there.
Gary Disch: None.
Aller: And being stored for maintenance purposes or.
Gary Disch: No. No, we won't be changing oil over there.
Aller: And the conditions, the conditions that I understand the way the motion will be if it's
approved, if there is dirt put back on you're not precluded necessarily from doing that but there
will be additional requirements.
Gary Disch: Yeah and the only reason why there was dirt on there in the first place is we
repaired our driveway on the other side of the road last fall when it rained and rained and rained.
Well we put it in and it rained and rained. We had to take it back out. We put it over there
because it was too wet to do anything with so we brought new stuff in and that was left over but
now it's gone. We don't ever anticipate, we're not a huge dirt contractor. We don't want to
bring it back to our shop and handle it again.

1. A Conditional Use Permit shall be recorded at Carver County.
2. No unlicensed or inoperable vehicle/equipment shall be stored on the premises.
Water Resources Coordinator
1. All stockpiled materials must have adequate perimeter control.
2. The existing catch basin must be protected at all times from having sediment enter. T13e
applicant must demonstrate how this will be accomplished to the satisfaction of the City.
4. Access to the catch basin must be provided at all times for the City or their representatives.
5. The applicant must provide a detailed description of the anticipated materials to be stored on-
site. No materials considered hazardous may be stored there.
6. No maintenance or refueling of vehicles may occur in the storage area.
7. Any leaks or spills must be cleaned up immediately and, if these spills exceed state threshold,
must be reported to the State Duty Officer.

The applicant shall revise the landscape plan to replace the majority of the deciduous shrubs

Aller: And for the record we've received an additional letter to add to our packets dated August
12, 2014 from Mr. William Humphries and that has been read by all the commissioners and will
become part of the packet.
Ingvalson: Good evening Chairman Aller and Planning Commission. My name is Drew
Ingvalson, since I don't have a name tag I'll introduce myself. My name is Drew Ingvalson. I'm
interning here at the City of Chanhassen. The itern before you, Planning Case 2014-20 is a bluff
setback variance request. The location is at 3880 Lone Cedar Lane. This is north of State
Highway 5, on the southwest side of Lake Minnewashta. The applicant is requesting a 13 foot
bluff setback variance from the required 30 foot bluff setback to locate a water oriented structure
17 feet from the toe or the low side of the bluff. So if you look at the survey up there, there
currently is a shed existing on the property that will be removed with the, with locating a new
water oriented structure on the property. In green you can see a 20 foot sanitary sewer easement.
Permanent structures are not allowed within that easement. Also there is a red line on the left
side of that green 20 foot sanitary sewer easement. That shows the 30 foot bluff setback and
then in yellow is the yellow rectangle is the proposed water oriented structure location. The left
side would be within that bluff setback. The property owner is requesting a variance for this
location so that the water oriented structure can be permanent and is not in danger of being
removed in the future by the City. Within 500 feet of this property there have been three
variance requests. One of those requests was approved for a 10 foot bluff setback variance for a
retaining wall. So while it is reasonable to request a water oriented structure, it is possible for
this property to have one and also meet city code. Staffs recommendation is to locate a
temporary water oriented structure within the buildable area. You can see the location for that
would be the rectangle in blue and then the buildable area is the black diagonal lines within the
sanitary sewer easement. To locate something within that sanitary sewer easement it would
require an encroachment agreement with the City. This would City ordinance but would not
allow for the permanent structure and would possibly need to be removed by the City in the
future. So staff is recommending that the Board of Appeals and Adjustment denies the bluff
setback variance request and adopts the Findings of Fact and Decision. However should the
Planning Commission decide to approve the variance request, staff has provided an alternative
Findings of Fact and Decision. That is the end of the presentation and I'm open to any questions
that the Planning Commission has.

On August 18, 1985, the Chanhassen City Council approved an off -premise parking lot on Lot 1,
Block 2, Chanhassen Lakes Business Park 5d' Addition.
PROPOSAJUSUMMARY
The applicant is requesting a conditional use permit for a screened outdoor storage yard to
occupy an existing parking lot located at the northeast intersection of Park Road and Park Place.
The site is zoned Industrial Office Park and has an area of 1. 16 acres. The screened outdoor
storage is permitted as a conditional use in the Industrial Office Park District.

The proposed conditional use permit meets ordinance requirements and staff is recommending

Analysis
The applicant is requesting to utilize
an existing paved parking lot located
at the northeast intersection of Park
Road and Park Place for storage.
The intent is to screen the storage
through a combination of berming
and landscaping. The site is
surrounded by mature trees and the
applicant will add additional planting
to increase screening.
The applicant is also proposing to incorporate a six-foot fence with a gate for security purposes.
The fence and gate must be located entirely upon the private property. Encroachment into a city
easement shall require an encroachment agreement between the property owner and the city. The
fence and gate shall not be placed within the public right-of-way.
Gradin
According to the plan, no grading is proposed with the CUP application. The site was graded in
conjunction with Grading Permit 13-05. This permit has expired. If additional grading over 50
cubic yards is required, the applicant shall apply to amend the CUP accordingly, or apply for a
grading permit (if grading is less than 1,000 cubic yards).

construction materials. The applicant must submit a detailed and comprehensive list of materials
to be stored on site. These cannot include hazardous waste. The presence of soils materials on a
paved surface will generate sediment -laden waters. The presence of a catch basin in the
northeast comer of the project area will result in sediment -laden waters leaving the site. It is
required under federal, state and local rules and guidelines that no sediment -laden waters enter
into regulated water features. The applicant must demonstrate how they will prevent any
sediment from entering the catch basin in the northeast comer of the parking lot or otherwise
leaving the site.
The catch basin within the parking lot is part of Chanhassen's Municipal Separate Storm Sewer
System (MS4). This catch basin is regulated under the National Pollution Discharge Elimination
System — MS4 Permit program. Chanhassen is responsible for the operation and maintenance of
this catch basin and the pond into which it drains. City crews must have access to this catch
basin for inspection and maintenance purposes, If the catch basin cannot be protected from
sediment -laden waters or other illicit discharges, it must be removed or bulkheaded. If the city
cannot be provided access to the catch basin it must be removed or bulkheaded. If these
conditions cannot be met, I strongly recommend denial of the Conditional Use Permit.
Landscapin
City ordinance requires that outdoor storage areas be screened from all public views. The
applicant is proposing landscaping on top of berms to accomplish this. The proposed landscape
plan provides good coverage of the area, but -not year-round screening. Staff recommends that
the majority of shrubs proposed be evergreen to provide screening throughout the year. 'Me
applicant shall revise the landscape plan to replace the majority of deciduous shrubs with
evergreen varieties.
CONDITIONAL USE PERMIT
Screened Outdoor Storage is permitted in the IOP District as a conditional use. The following
constitutes staff s review of this proposal against conditional use permit standards:

unexpected impacts from this operation.

FINDING: The site is located in the industrial district. The applicant has submitted plans
that include berming and landscaping which will provide adequate screening of the site.
4. Will not be hazardous or disturbing to existing or planned neighboring uses.
FINDING: There will be no measurable impacts to the existing or planned neighboring
uses.
5. Will be served adequately by essential public facilities and services, including streets,
police and fire protection, drainage structures, refuse disposal, water and sewer systems
and schools; or will be served adequately by such facilities and services provided by the
persons or agencies responsible for the establishment of the proposed use.
FINDING: Full city services are available to this site. Roads serving the site are fully
capable of handling the access needs of this proposal.
6. Will not create excessive requirements for public facilities and services and will not be
detrimental to the economic welfare of the community.
FINDING: Staff is not aware of any excessive requirements for public facilities. The
landscape business is a good auxiliary use within the industrial park.
7. Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare
because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or
trash.
FINDING: This site will not create adverse impacts to persons, property or the general
welfare of the area. The screened outdoor storage will comply with city ordinances.
8. Will have vehicular approaches to the property which do not create traffic congestion
or interfere with traffic or surrounding public thoroughfares.
FINDING: The site is accessible from a city street designed to commercial standards.
9. Will not result in the destruction, loss or damage of solar access, natural, scenic or
historic features of major significance.
FINDING: The development of this site will not result in the loss of any features of major
significance.

FINDING: The site contains an existing parking lot which the applicant intends to screen
via berms and landscaping. All equipment stored on site will be screened.

FINDING: The site is being used for a screened outdoor storage operation which is
consistent with its designation. It will not depreciate surrounding property values.
12. Will meet standards prescribed for certain uses as provided in this article.
Sec. 20-308. Screened outdoor storage states:
The following applies to screened outdoor storage:
(1) All outdoor storage must be completely screened with 100 percent opaque fence
or landscaped screen.
FINDING: The applicant intends to store supplies and vehicles within a screened parking
lot. Screening will be achieved via berming and landscaping.
Based upon the foregoing findings, staff is recommending that the conditional use permit be
approved with appropriate conditions.
RECOMMENDATION
"Staff recommends the Planning Commission recommend to City Council approval of
Conditional Use Permit #2014-22 to allow a screened outdoor storage in an IOP District, for MG
LLC., to be located on Lot 1, Block 2, Chanhassen Lakes Business Park 5d' Addition, as shown
on the plans dated received July 18, 2014, subject to the following conditions:

2. No unlicensed or inoperable vehicle/equipment shall be stored on the premises.

I . All stockpiled materials must have adequate perimeter control.

applicant must demonstrate how this will be accomplished to the satisfaction of the City.
3. Access to the catch basin must be provided at all times for the City or their representatives.
4. The applicant must provide a detailed description of the anticipated materials to be stored on-
site. No materials considered hazardous may be stored here.
